Proposed Local Laws<br />

Mount Alexander Shire Council (‘the Council’) has reviewed its local laws and is proposing to<br />

make new local laws, to be known as Local Law No. 2 of 2010 Roads and Council Land, Local Law<br />

No. 3 of 2010 Environment, Local Law No. 4 of 2010 Animals, Local Law No. 5 of 2010 Trading<br />

and Local Law No. 6 of 2010 Fundraising and Events.<br />

As part of the process of review, the Council has consulted with the community to find out their<br />

ideas and views in respect to the proposed new local laws. The following information about the<br />

proposed local laws is provided in accordance with section 119(2) of the Local <strong>Government</strong> Act<br />

1989 –<br />

Purpose of proposed Local Law No. 2 of 2010 Roads and Council Land<br />

The purpose of this local law is to provide for the peace, order and good governance of the<br />

Mount Alexander Shire by:–<br />

(1) managing the uses and activities on roads and Council land so that the Council is aware of<br />

uses or activities which may:<br />

(a) interfere with the safety and convenience of people travelling on or using roads or<br />

land;<br />

(b) impede free and safe access for people in particular those with sight and movement<br />

disabilities;<br />

(c) cause damage to Council and community assets;<br />

(d) create a danger or expose others to a risk; or<br />

(e) be detrimental to the amenity of the area or the enjoyment of facilities on roads or<br />

land;<br />

(2) identifying activities and uses on roads and Council land where a permit is not required<br />

but conditions are applicable to the use so that the purposes identified in sub-clause (1) are<br />

achieved;<br />

(3) identifying activities and uses that are not permitted on roads and Council land;<br />

(4) regulating and controlling activities on roads an Council land in a way that is consistent with<br />

the community expectations and demands about their desired lifestyle and the availability of<br />

goods and services provided to them; and<br />

(5) providing for the administration of the Council’s powers and functions.<br />

General purport of proposed Local Law No. 2 of 2010 Roads and Council Land<br />

The proposed local law, if made, will:–<br />

l make it an offence if the following works or activities are carried out without a permit:–<br />

– install construct or alter a temporary vehicle crossing<br />

– undertake any works or activity on a road or Council land such as making a hole<br />

or excavation, connecting to or altering a Council drain, fencing off part of a road,<br />

erecting a hoarding or scaffolding, using a mobile crane or locating a bulk rubbish<br />

container<br />

– planting a tree or placing a structure in or on a nature strip<br />

– carry out landscaping of a nature strip<br />

– repair a vehicle on a road<br />

– remove a tree, vegetation or timber from a road or Council land or erect a sign or<br />

hoarding on a road or Council land<br />

– park a vehicle in a restricted parking bay for the purpose of undertaking works.
