l make it an offence for a person not to observe certain requirements concerning:–<br />
– temporary dwellings<br />
– disposing of waste and recyclable materials<br />
– disposing of commercial and industrial trade waste<br />
– use of scareguns to protect crops.<br />
l make it an offence to allow or permit land to be kept in a dangerous or unsightly condition<br />
or to be detrimental to the general amenity of the neighbourhood.<br />
l make it an offence not to keep a nature strip in good condition.<br />
The proposed local law, if made, will also:–<br />
– regulate applications for, and the granting of, permits under the proposed local law;<br />
– regulate the correction, revocation and registration of permits;<br />
– create an offence for a person who fails to comply with a Notice to Comply;<br />
– empower an Authorised Officer to impound certain objects;<br />
– empower an Authorised Officer to issue an infringement notice for contravention of the<br />
proposed local law;<br />
– make it an offence for a person to make a false representation or declaration or to intentionally<br />
omit relevant information in an application for a permit or exemption;<br />
– make it an offence for a person to fail to comply with a permit or any condition in a permit;<br />
and<br />
– make it an offence for a person not to comply with a reasonable direction or instruction of<br />
an Authorised Officer.<br />
Purpose of proposed Local Law No. 4 of 2010 Animals<br />
The purpose of this local law is to provide for the peace, order and good governance of the<br />
Mount Alexander Shire by:–<br />
1. managing activities and uses which may be dangerous, cause a nuisance or be detrimental to<br />
the amenity of the area and the environment;<br />
2. regulating and controlling the activities to maintain a healthy and safe environment in the<br />
municipal district for residents and visitors;<br />
3. regulating the manner in which the animals are kept and housed and the number of certain<br />
animals that may be kept on the property; and<br />
4. providing for the administration of the Council’s powers and functions.<br />
General purport of proposed Local Law No. 4 of 2010 Animals<br />
The proposed local law, if made, will:–<br />
l make it an offence if the following activities are carried out without a permit:–<br />
– graze livestock on a road<br />
– engage in driving livestock on a road<br />
– keeping or allowing to be kept more than the number of animals specified in the local<br />
law.<br />
l make it an offence for a person not to observe certain requirements concerning:–<br />
– roadside grazing<br />
– droving livestock on a road<br />
– transferring livestock by foot on a local road<br />
– horse riding on a road or Council land<br />
– the keeping animals including the provision for adequate housing and enclosures<br />
– the keeping of horses, cattle, sheep, goats or like animals in any yard or enclosed<br />
area<br />
– the keeping of birds.
