PROCLAMATION OF COMMENCEMENT<br />

I, Christopher Maxwell, Administrator of the<br />

State of <strong>Victoria</strong>, as the Governor’s Deputy, with<br />

the advice of the Executive Council and under<br />

section 2(1) of the Liquor Control Reform<br />

Amendment Act 2010 –<br />

(a) fix 1 November 2010 as the day on which<br />

sections 1, 2, 3, 4(3), 7, 8, 12, 13, 14, 15,<br />

16, 20, 21(1), 22, 23, 24, 25, 26, 27 and 29<br />

of that Act come into operation; and<br />

(b) fix 1 January 2011 as the day on which the<br />

Discontinuance of Road<br />

Fitzroy Square, Mernda<br />

Pursuant of section 206 and clause 3 of schedule 10 to the Local <strong>Government</strong> Act 1989,<br />

Whittlesea City Council, at its Ordinary Meeting on 28 September 2010, has resolved to formally<br />

discontinue that section of road known as Fitzroy Square, Mernda.<br />

Those parts of the road shown on the attached plan below are not reasonably required for public<br />

road purposes and once discontinued will be retained by Council for open space purposes.<br />

No submissions were received by the public or relevant statutory authorities in response to the<br />

article published in the Whittlesea Leader dated Tuesday 3 August 2010.<br />

Domestic Animals Act 1994<br />

Melbourne City Council<br />

Municipal Order<br />

The Melbourne City Council resolved at its meetings held on 25 May 2010 and 24 June 2010 to<br />

make an Order pursuant to section 26(2) of the Domestic Animals Act 1994. This Order will take<br />

effect on 7 October 2010 and replaces the Municipal Order published by the Council in <strong>Victoria</strong><br />

<strong>Government</strong> <strong>Gazette</strong> G49, page 2810 on 4 December 2008 and the Municipal Order published by<br />

the Council in the <strong>Victoria</strong> <strong>Government</strong> <strong>Gazette</strong> G9, page 447 on 26 February 2009.<br />

1. Dogs on Leash<br />

Subject to paragraph 2 below, the Owner of any dog must keep the dog under effective control<br />

by means of a chain, cord or leash not exceeding 3 metres held by the Owner and attached to<br />

the dog while the dog is in a Reserve or any Public Place in the municipality, except where<br />

otherwise designated by signs as being a Designated Reserve.<br />

A dog may be exercised off a chain, cord or leash in a Designated Reserve provided the<br />

Owner:<br />

l Carries a chain, cord or leash not exceeding 3 metres in length, sufficient to bring the<br />

dog under effective control if the dog behaves in a manner which threatens any person<br />

or animal;<br />

l Remains in effective voice or hand control of the dog and within constant sight of the<br />

dog so as to be able to promptly place the dog on a chain, cord or leash not exceeding<br />

3 metres in length if that becomes necessary; and<br />

l Does not allow the dog to worry or threaten any person or animal, and does not allow<br />

the dog to attack any person or animal.<br />

If a dog is off a chain, cord or leash, it must be brought under effective control by means of a<br />

chain, cord or leash not exceeding 3 metres in length if the dog is within 20 metres of:<br />

l a children’s play equipment area<br />

l a permanent barbecue or picnic area.<br />

2. Dogs Prohibited<br />

Dogs are prohibited from entering or remaining in a Prohibited Area at any time of the day.<br />

3. Definitions<br />

‘Designated Reserve’ means those parts of the following Reserves as are designated by<br />

signs and shown on the attached maps as off leash areas:<br />

l Clayton Reserve<br />

l Fawkner Park<br />

l Gosch’s Paddock<br />

l J. J. Holland Park<br />

l North Melbourne Recreation Reserve<br />

l Princes Park<br />

l Royal Park<br />

l Yarra Park.<br />

‘Owner’ has the same meaning as in the Domestic Animals Act 1994.<br />

‘Prohibited Area’ means the sections of Fawkner Park, Royal Park and J. J. Holland Park as<br />

‘Public Place’ has the same meaning as in the Summary Offences Act 1966.

Proposed Local Laws<br />

Mount Alexander Shire Council (‘the Council’) has reviewed its local laws and is proposing to<br />

make new local laws, to be known as Local Law No. 2 of 2010 Roads and Council Land, Local Law<br />

No. 3 of 2010 Environment, Local Law No. 4 of 2010 Animals, Local Law No. 5 of 2010 Trading<br />

and Local Law No. 6 of 2010 Fundraising and Events.<br />

As part of the process of review, the Council has consulted with the community to find out their<br />

ideas and views in respect to the proposed new local laws. The following information about the<br />

proposed local laws is provided in accordance with section 119(2) of the Local <strong>Government</strong> Act<br />

1989 –<br />

Purpose of proposed Local Law No. 2 of 2010 Roads and Council Land<br />

The purpose of this local law is to provide for the peace, order and good governance of the<br />

Mount Alexander Shire by:–<br />

(1) managing the uses and activities on roads and Council land so that the Council is aware of<br />

uses or activities which may:<br />

(a) interfere with the safety and convenience of people travelling on or using roads or<br />

land;<br />

(b) impede free and safe access for people in particular those with sight and movement<br />

disabilities;<br />

(c) cause damage to Council and community assets;<br />

(d) create a danger or expose others to a risk; or<br />

(e) be detrimental to the amenity of the area or the enjoyment of facilities on roads or<br />

land;<br />

(2) identifying activities and uses on roads and Council land where a permit is not required<br />

but conditions are applicable to the use so that the purposes identified in sub-clause (1) are<br />

achieved;<br />

(3) identifying activities and uses that are not permitted on roads and Council land;<br />

(4) regulating and controlling activities on roads an Council land in a way that is consistent with<br />

the community expectations and demands about their desired lifestyle and the availability of<br />

goods and services provided to them; and<br />

(5) providing for the administration of the Council’s powers and functions.<br />

General purport of proposed Local Law No. 2 of 2010 Roads and Council Land<br />

The proposed local law, if made, will:–<br />

l make it an offence if the following works or activities are carried out without a permit:–<br />

– install construct or alter a temporary vehicle crossing<br />

– undertake any works or activity on a road or Council land such as making a hole<br />

or excavation, connecting to or altering a Council drain, fencing off part of a road,<br />

erecting a hoarding or scaffolding, using a mobile crane or locating a bulk rubbish<br />

container<br />

– planting a tree or placing a structure in or on a nature strip<br />

– carry out landscaping of a nature strip<br />

– repair a vehicle on a road<br />

– remove a tree, vegetation or timber from a road or Council land or erect a sign or<br />

hoarding on a road or Council land<br />

– park a vehicle in a restricted parking bay for the purpose of undertaking works.

l make it an offence for a person not to observe the requirements relating to:–<br />

– temporary vehicle crossings<br />

– properly constructed vehicle crossings<br />

– removal of vehicle crossings<br />

– location of trees, plants or signs<br />

– display of property numbers<br />

– use of recreational conveyances e.g. skateboards and roller-skates<br />

– damaging roads or Council land<br />

– consumption of alcohol on a road or designated area<br />

– busking<br />

– parking a vehicle to carry out works.<br />

The proposed local law, if made, will also:–<br />

– regulate applications for, and the granting of, permits under the proposed local law;<br />

– regulate the correction, revocation and registration of permits;<br />

– create an offence for a person who fails to comply with a Notice to Comply;<br />

– empower an Authorised Officer to impound certain objects;<br />

– empower an Authorised Officer to issue an infringement notice for contravention of the<br />

proposed local law;<br />

– make it an offence for a person to make a false representation or declaration or to intentionally<br />

omit relevant information in an application for a permit or exemption;<br />

– make it an offence for a person to fail to comply with a permit or any condition in a permit;<br />

and<br />

– make it an offence for a person not to comply with a reasonable direction or instruction of<br />

an Authorised Officer.<br />

Purpose of proposed Local Law No. 3 of 2010 Environment<br />

The purpose of this local law is to provide for the peace, order and good governance of the<br />

Mount Alexander Shire by:–<br />

1. managing activities and uses which may be dangerous, cause damage or a nuisance or be<br />

detrimental to the amenity of the area and the environment;<br />

2. regulating and controlling activities to maintain a healthy and safe environment in the<br />

municipal district for residents and visitors;<br />

3. identifying requirements or conditions that must be observed to ensure that a safe, healthy<br />

and enjoyable environment for residents and visitors is maintained; and<br />

4. providing for the administration of the Council’s powers and functions.<br />

General purport of proposed Local Law No. 3 of 2010 Environment<br />

The proposed local law, if made, will:–<br />

l make it an offence if the following works or activities are carried out without a permit:–<br />

– camping on Council land, public land and private land unless the land or place is<br />

designated as a camping area<br />

– place, establish, erect or occupy any temporary dwelling<br />

– light an incinerator or fire in the open<br />

– place a commercial or industrial waste or recycling receptacle on a road or Council<br />

land.

l make it an offence for a person not to observe certain requirements concerning:–<br />

– temporary dwellings<br />

– disposing of waste and recyclable materials<br />

– disposing of commercial and industrial trade waste<br />

– use of scareguns to protect crops.<br />

l make it an offence to allow or permit land to be kept in a dangerous or unsightly condition<br />

or to be detrimental to the general amenity of the neighbourhood.<br />

l make it an offence not to keep a nature strip in good condition.<br />

The proposed local law, if made, will also:–<br />

– regulate applications for, and the granting of, permits under the proposed local law;<br />

– regulate the correction, revocation and registration of permits;<br />

– create an offence for a person who fails to comply with a Notice to Comply;<br />

– empower an Authorised Officer to impound certain objects;<br />

– empower an Authorised Officer to issue an infringement notice for contravention of the<br />

proposed local law;<br />

– make it an offence for a person to make a false representation or declaration or to intentionally<br />

omit relevant information in an application for a permit or exemption;<br />

– make it an offence for a person to fail to comply with a permit or any condition in a permit;<br />

and<br />

– make it an offence for a person not to comply with a reasonable direction or instruction of<br />

an Authorised Officer.<br />

Purpose of proposed Local Law No. 4 of 2010 Animals<br />

The purpose of this local law is to provide for the peace, order and good governance of the<br />

Mount Alexander Shire by:–<br />

1. managing activities and uses which may be dangerous, cause a nuisance or be detrimental to<br />

the amenity of the area and the environment;<br />

2. regulating and controlling the activities to maintain a healthy and safe environment in the<br />

municipal district for residents and visitors;<br />

3. regulating the manner in which the animals are kept and housed and the number of certain<br />

animals that may be kept on the property; and<br />

4. providing for the administration of the Council’s powers and functions.<br />

General purport of proposed Local Law No. 4 of 2010 Animals<br />

The proposed local law, if made, will:–<br />

l make it an offence if the following activities are carried out without a permit:–<br />

– graze livestock on a road<br />

– engage in driving livestock on a road<br />

– keeping or allowing to be kept more than the number of animals specified in the local<br />

law.<br />

l make it an offence for a person not to observe certain requirements concerning:–<br />

– roadside grazing<br />

– droving livestock on a road<br />

– transferring livestock by foot on a local road<br />

– horse riding on a road or Council land<br />

– the keeping animals including the provision for adequate housing and enclosures<br />

– the keeping of horses, cattle, sheep, goats or like animals in any yard or enclosed<br />

area<br />

– the keeping of birds.

l make it an offence for a person not to immediately collect and remove all of the excrement<br />

left by an animal of which they are in charge on a road or Council land or in a public<br />

place.<br />

l make it an offence for an owner or occupier of a property not to take all necessary steps to<br />

prevent any objectionable animal or bird noise from the property.<br />

The proposed local law, if made, will also:–<br />

– regulate applications for, and the granting of, permits under the proposed local law;<br />

– regulate the correction, revocation and registration of permits;<br />

– create an offence for a person who fails to comply with a Notice to Comply;<br />

– empower an Authorised Officer to impound certain objects;<br />

– empower an Authorised Officer to issue an infringement notice for contravention of the<br />

proposed local law;<br />

– make it an offence for a person to make a false representation or declaration or to intentionally<br />

omit relevant information in an application for a permit or exemption;<br />

– make it an offence for a person to fail to comply with a permit or any condition in a permit;<br />

and<br />

– make it an offence for a person not to comply with a reasonable direction or instruction of<br />

an Authorised Officer.<br />

Purpose of proposed Local Law No. 5 of 2010 Trading<br />

The purpose of this local law is to provide for the peace, order and good governance of the<br />

Mount Alexander Shire by:–<br />

1. managing the uses and activities on roads and Council land so that the Council is aware of<br />

uses or activities which may:<br />

a. interfere with the safety and convenience of people travelling on or using roads or<br />

land;<br />

b. impede the free and safe access for people, in particular those with sight and movement<br />

impairment or disabilities;<br />

c. create a danger or expose others to risk; or<br />

d. be detrimental to the amenity of the area or the enjoyment of facilities on roads or<br />

land;<br />

2. identifying activities and uses on roads and Council land where a permit is not required<br />

but conditions are applicable to the use so that the purposes identified in subclause (1) are<br />

achieved;<br />

3. identifying activities and uses that are not permitted on roads and Council land;<br />

4. regulating and controlling activities on roads and Council land in a way that is consistent<br />

with community expectations and demands about their desired lifestyle and the availability<br />

of goods and services provided to them; and<br />

5. providing for the administration of the Council’s powers and functions.<br />

General purport of proposed Local Law No. 5 of 2010 Trading<br />

The proposed local law, if made, will:–<br />

l make it an offence if the following activities are carried out without a permit:–<br />

– place an A-frame advertising sign on a road or in any area designated by the Council<br />

– display goods on a road<br />

– place tables, chairs or other equipment used for or in connection with outdoor eating<br />

on a road<br />

– engage in itinerant trading except for the home delivery of newspapers or magazines<br />

and goods purchased at another location, home delivery where requested by the owner<br />

of the house or the sale of products for fund raising purposes only.

l make it an offence not to observe the requirements relating to:–<br />

– placing A-frame advertising signs on a road or any area designated by Council<br />

– displaying goods on a road<br />

– placing tables, chairs or other equipment used for or in connection with outdoor eating<br />

on a road.<br />

l make it an offence for a person to leave a vehicle on a road or Council land for the purposes<br />

of offering such a vehicle for sale or with a ‘For Sale’ sign displayed on such a vehicle.<br />

l make it an offence for a person to trade goods or services within the designated trading site<br />

of another person trading similar goods or services.<br />

Purpose of proposed Local Law No. 6 of 2010 Fundraising and Events<br />

The purpose of this local law is to provide for the peace, order and good governance of the<br />

Mount Alexander Shire by:–<br />

(1) managing the uses and activities on roads and Council land so that the Council is aware of<br />

uses or activities which may:<br />

(a) interfere with the safety and convenience of people travelling on or using roads or<br />

land;<br />

(b) impede the free and safe access for people, in particular those with sight and movement<br />

impairment or disabilities;<br />

(c) be detrimental to the amenity of the area or the enjoyment of facilities on roads or<br />

land;<br />

(2) identifying activities and uses on roads and Council land where a permit is not required<br />

but conditions are applicable to the use so that the purposes identified in subclause (1) are<br />

achieved;<br />

(3) identifying activities and uses that are not permitted on roads and Council land;<br />

(4) regulating and controlling activities on roads and Council land in a way that is consistent<br />

with community expectations and demands about their desired lifestyle and the availability<br />

of goods and services provided to them; and<br />

(5) providing for the administration of the Council’s powers and functions.<br />

General purport of proposed Local Law No. 6 of 2010 Fundraising and Events<br />

The proposed local law, if made, will:–<br />

l make it an offence if the following activities are carried out without a permit:-<br />

– place an advertising sign on a road, in any area designated by the Council, on a vehicle<br />

left standing or parked on a road, or in any other location likely to interfere with the<br />

vision of a pedestrian or driver of a vehicle<br />

– conduct an event which involves the closure or partial closure of a road<br />

– engage in the collection of money, gifts or subscriptions on a road or Council land or<br />

from premise to premises<br />

– engage in a fundraising activity such as a raffle, sausage sizzle or food stall on a road<br />

or Council land.<br />

l make it an offence not to observe the requirements relating to:–<br />

– placing advertising signs on a road, in any area designated by the Council, on a vehicle<br />

left standing or parked on a road, or in any other location likely to interfere with the<br />

vision of a pedestrian or driver of a vehicle<br />

– conducting an event which involves the closure or partial closure of a road<br />

and<br />

– make it an offence for a person not to comply with a reasonable direction or instruction of<br />

an Authorised Officer.<br />

It is also proposed to adopt a new Procedures Manual. This will provide for the specific<br />

requirements with respect to the proposed local laws.<br />

the Shire Service Centres located at the Castlemaine Town Hall in 25 Lyttleton Street and the<br />

Castlemaine Enterprise Centre, 9 Halford Street, Castlemaine, during the office hours, or from<br />

Council’s website, www.mountalexander.vic.gov.au<br />

Any person affected by the proposed local laws and procedures manual may make a submission<br />

relating to the proposed local laws and procedures manual to the Council. All submissions received<br />

by Council by 4.45 pm on 4 November 2010 will be considered in accordance with section 223 of<br />

the Local <strong>Government</strong> Act 1989.<br />

The purpose and general purport of the<br />

Local Law is to:<br />

a) ensure a safe and healthy environment<br />

for the municipal residents by regulating<br />

and controlling activities which may be<br />

dangerous or unsafe or be a nuisance;<br />

b) prohibit, regulate and control activities and<br />

circumstances associated with audible bird<br />

scaring devices, fire hazards, dangerous and<br />

unsightly land, emissions from chimneys,<br />

fires in the open air, burning of offensive<br />

materials, recreation vehicles, advertising,<br />

bill posting and junk mail, noise in a public<br />

place, audible intruder alarms, camping,<br />

circuses and carnivals, keeping of animals,<br />

waste, non-compliance with public signs,<br />

consumption and possession of alcohol,<br />

behaviour, municipal buildings, municipal<br />

swimming pools and reserves; and<br />

c) provide for peace, order and good government<br />

of the municipal district.<br />

As part of the review of Local Law No. 2<br />

Environmental, the use of incinerators within<br />

township areas will be prohibited from 1<br />

January 2011. There have also been changes to<br />

the Permit to Burn, which now incur a charge<br />

of $48.10 per application. This is to encourage<br />

residents, wherever possible, to make use of the<br />

access to green waste bins and also the ‘free<br />

green waste’ weekends held annually.<br />

Notice is hereby given that the Colac Otway<br />

Shire Council on 22 September 2010 resolved<br />

(in part):–<br />

‘Having consulted with the community of<br />

Beeac regarding the spelling of Coulstone<br />

Street, resolve the spelling of this street be<br />

amended to be ‘Coulston Street’.’<br />

The amendment to the spelling of the street<br />

name was requested by the Beeac Progress<br />

Association to correct a mistake that appears to<br />

have originated in the early 1900s.<br />

A public consultation process was conducted<br />

Gambling Regulation Amendment<br />

(Bookmaking Related Registration Fees)<br />

Regulations 2010<br />

Notice is given that, in accordance with<br />

section 11 of the Subordinate Legislation Act<br />

1994, a Regulatory Impact Statement (RIS)<br />

has been prepared in relation to the proposed<br />

Gambling Regulation Amendment (Bookmaking<br />

Related Registration Fees) Regulations 2010.<br />

The proposed Regulations are made under<br />

section 11 of the Gambling Regulation Act<br />

2003, which will commence operation on<br />

1 January 2011.<br />

The objective of the proposed Regulations<br />

is to prescribe certain fees to accompany<br />

applications for registration as a bookmaker, or<br />

as a bookmaker’s key employee for the purposes<br />

of the Gambling Regulation Act 2003.<br />

The RIS assesses the costs and benefits of<br />

the proposed Regulations, possible alternative<br />

means of achieving the stated objectives and<br />

explains why the proposed Regulations are the<br />

preferred option. The RIS concludes that the<br />

benefits of the proposed Regulations outweigh<br />

the expected costs.<br />

This exemption applies to outside school hours care services in relation to which:<br />

l it has been necessary to relocate the service from a registered school site to temporary<br />

premises (‘Temporary Premises’) due to building works being undertaken as part of the<br />

‘Building the Education Revolution’ program or similar government initiative; and<br />

l the Secretary of the Department of Education and Early Childhood Development is satisfied<br />

that the design and the location of the temporary premises are satisfactory for the operation<br />

of a children’s service; and<br />

l it is intended that the service return to the registered school site by 31 December 2011; and<br />

l there is an obligation to obtain, under Part 3, Division 2 of the Act, a full licence to operate<br />

an outside school hours care service, upon the expiration of the provisional licence.<br />

This exemption applies only in relation to the Temporary Premises referred to above.<br />

Schedule B – Conditions:<br />

1. An application for a licence to operate a children’s service made under Part 3 Division 2 of<br />

the Act must include the following documentation in relation to the Temporary Premises, to<br />

the satisfaction of the Secretary:<br />

l a site plan;<br />

l a diagram or floor plan of children’s rooms and outdoor space at the premises;<br />

l area measurements of the children’s rooms and outdoor spaces at the premises<br />

conducted in accordance with the Act and Regulations; and<br />

l a brief description or diagram of the location of outdoor space used by the service that<br />

is not part of the premises (if applicable) including written confirmation that this space<br />

complies with the OSHC outdoor space requirements of the Regulations.<br />

The documentation noted above does not have to be completed by a registered building<br />

practitioner.<br />

2. The children’s service must advise the regional office of the Department of Education and<br />

Early Childhood Development within 48 hours of any changes that will prevent the service<br />

from complying with this exemption and its conditions. This includes any change to the<br />

intention to return to the registered school site upon the completion of the building works<br />

being undertaken as part of the ‘Building the Education Revolution’ program.<br />

When this exemption has operation<br />

This exemption has effect in each case from the date on which the Secretary approves the above<br />

documentation.<br />

This exemption remains in force until 31 December 2011 unless revoked earlier.<br />

Purpose<br />

To exempt those Employers listed in the table below, from the requirement that they must not<br />

use unlicensed employees to do high risk work, specifically, to hold a Basic Rigging licence to<br />

perform high risk work.<br />

Definition<br />

In this exemption (‘the Employer’) means those listed in the table below.<br />

Background<br />

In undertaking their duties, the employer uses employees to perform a number of tasks which<br />

require them to hold a Basic Rigging licence under the Occupational Health and Safety Regulations<br />

2007.<br />

Regulations<br />

Regulations 3.6.2 of the Occupational Health and Safety Regulations 2007 states:<br />

‘An employer must not allow an employee to do any such work unless –<br />

a) the employee holds an appropriate high risk work licence in relation to that work’.<br />

Exemption<br />

Under regulation 7.2.2 of the Occupational Health and Safety Regulations 2007, I exempt the<br />

employer from Regulation 3.6.2 only in respect of the requirement for its employees to hold a Basic<br />

Rigging licence, for the type of work described below, and subject to the prescribed conditions of<br />

this exemption.<br />

I am satisfied that the work as described can be performed as safely by a person who does not<br />

hold a licence as it can be performed by a person who holds such a licence, provided that there is<br />

adherence to the prescribed conditions of this exemption.<br />

Type of Work<br />

Undertaking Basic Rigging activities associated with Erecting Distribution Pole Type<br />

Substations, Pole erection into Live HV Conductors and Straining of Overhead Powerlines.<br />

Conditions<br />

This exemption is subject to the conditions listed below:<br />

1. This exemption is granted to the Employer, and shall only apply to employees undertaking<br />

Basic Rigging activities associated with Erecting Distribution Pole Type Substations, Pole<br />

erection into Live HV Conductors and Straining of Overhead Powerlines.<br />

2. This exemption shall apply from the period commencing 1 October 2010, or unless revoked<br />

or amended by the <strong>Victoria</strong>n Workcover Authority (VWA) in writing.<br />

3. In order for employees undertaking Basic Rigging activities associated with Erecting<br />

Distribution Pole Type Substations, Pole erection into Live HV Conductors and Straining of<br />

Overhead Powerlines under this exemption, the following conditions shall be met:<br />

a. All employees shall hold a dogging high risk work licence issued under the<br />

Occupational Health and Safety Regulations 2007, or high risk work licence that is<br />

equivalent to a high risk work licence issued under Occupational Health and Safety<br />

Regulations 2007, 3.6.4 Recognition of interstate licences.<br />

b. A training assessment package to be used is that developed by Gippsland TAFE –<br />

Energy Training Centre, Drummond Road, Chadstone.<br />

c. Each Basic Rigger is required to be trained and assessed against the training assessment<br />

package.

d. That the training undertaken by employees the subject of this exemption will be<br />

completed within 12 months from the granting of this exemption.<br />

e. The Employer will provide training to all new employees who will be required to<br />

undertaking Basic Rigging activities associated with Erecting Distribution Pole<br />

Type Substations, Pole erection into Live HV Conductors and Straining of Overhead<br />

Powerlines.<br />

f. The Employer will provide on going training, against the training assessment package,<br />

to all those employees who will be required to undertake Basic Rigging and that<br />

this training is in accordance with the obligations placed on the Employer under the<br />

Occupational Health and Safety Act 2004, section 21(2)(e), and record that training<br />

and assessment verification on their personnel file.<br />

g. The Employer shall provide each employee working under this exemption with a copy<br />

of the ‘VESI Fieldworkers Handbook June 2006’.<br />

h. The training and assessment records will be retained by the Employer for reference<br />

and the VWA will audit these records from time to time at its discretion to ensure that<br />

‘lettuce leaf blight host material’ means any lettuce leaf blight host plant or soil from a<br />

property where lettuce leaf blight has been detected;<br />

‘Manager Plant Standards’ means the person for the time being occupying or acting in the<br />

position of Manager Plant Standards in the Department of Primary Industries;<br />

‘used package’ means any package which contains or is known to have contained or may<br />

reasonably be suspected of containing or having contained any lettuce leaf blight host<br />

material.<br />

4. Controls applying to lettuce leaf blight<br />

(1) The entry or importation into <strong>Victoria</strong> of any:<br />

(a) lettuce leaf blight host material; or<br />

(b) agricultural equipment; or<br />

(c) used package;<br />

Standards; or<br />

(d) is accompanied by a plant health certificate issued by an officer of the department<br />

responsible for agriculture in the affected State or Territory certifying that it<br />

has been treated in a manner approved by the Manager Plant Standards.<br />

5. Verification of consignments<br />

Where requested by an authorised inspector, lettuce leaf blight host material, agricultural<br />

equipment or used package imported into <strong>Victoria</strong> which is required by clause 4(2) to be<br />

accompanied by a certificate or declaration, must be:<br />

(a) presented to an authorised inspector for inspection; or<br />

(b) verified by a person accredited to do so by the Department of Primary Industries.<br />

Note: Section 25 of the Plant Health and Plant Products Act 1995 provides that a person is<br />

guilty of an offence and a penalty not exceeding 50 penalty units in the case of a natural person, and<br />

1. Objective<br />

The objective of this Order is to prevent the importation or entry of the exotic disease<br />

asparagus stem blight into <strong>Victoria</strong>.<br />

2. Authorising provision<br />

This Order is made under section 24 of the Plant Health and Plant Products Act 1995 (‘the<br />

Act’).<br />

3. Definitions<br />

In this Order –<br />

‘accreditation program’ means any program under which a person is permitted to issue an<br />

assurance certificate, including any procedures available under the Interstate Certification<br />

Assurance (ICA) Scheme;<br />

‘agricultural equipment’ means any equipment used for the culture, harvesting, packing or<br />

processing of any asparagus stem blight host material and includes any vehicle;<br />

‘authorised inspector’ means a person authorised as an inspector under the Act;<br />

‘asparagus stem blight’ means the disease caused by the exotic fungus Phomopsis asparagi<br />

(Sacc.) Bubák;<br />

‘asparagus stem blight host material’ means any plant, plant part or plant product of the<br />

genus Asparagus; or soil in which any asparagus stem blight host material has been grown;<br />

‘Manager Plant Standards’ means the person for the time being occupying or acting in the<br />

position of Manager Plant Standards in the Department of Primary Industries;

I, Tim Holding, Minister for Water, under the provisions of the Water Act 1989, make the<br />

following Order –<br />

1. Title<br />

This Order is called the Bulk Entitlement (Bairnsdale) Conversion Amendment Order 2010.<br />

2. Preliminary<br />

The Bulk Entitlement (Bairnsdale) Conversion Order 2000 (the Bulk Entitlement Order) was<br />

made by the Minister on 4 July 2000 and published in the <strong>Government</strong> <strong>Gazette</strong> on 27 July<br />

2000. The Bulk Entitlement Order converted the East Gippsland Region Water Authority’s<br />

(now the East Gippsland Region Water Corporation) entitlement to water from the Mitchell<br />

River, for the supply of water to the Bairnsdale Water Supply System, to a bulk entitlement.<br />

3. Purpose<br />

The purpose of this Order is to amend the Bulk Entitlement Order to allow the East<br />

Gippsland Region Water Corporation to access up to an additional 3 306 ML of water from<br />

the Glenaladale pump station diversion point on the Mitchell River.<br />

This is equivalent to the volume of the bulk entitlements concurrently revoked by order on<br />

the Nicholson and Tambo Rivers by the Bulk Entitlement (Bruthen) Revocation Order 2010<br />

and the Bulk Entitlement (Lakes Entrance) Revocation Order 2010 respectively. This Bulk<br />

Entitlement Order is for the supply of water to the Bairnsdale Water Supply System, Lakes<br />

Entrance Water Supply System and the Bruthen Water Supply System.<br />

4. Authorising provisions<br />

This Order is made in accordance with section 44 of the Water Act 1989. The Minister<br />

makes this Order on the application of the East Gippsland Region Water Corporation.<br />

5. Commencement<br />

This Order comes into effect on the day it is published in the <strong>Victoria</strong>n <strong>Government</strong><br />

<strong>Gazette</strong>.<br />

6. Changes to definitions<br />

6.1 For the definition of ‘Authority’ in the Bulk Entitlement Order, substitute –<br />

‘ ‘Authority’ means the East Gippsland Region Water Corporation.’<br />

7. Substitution of clause 6<br />

For clause 6 of the Bulk Entitlement Order, substitute –<br />

‘6. BULK ENTITLEMENT<br />

Subject to clause 7 and clause 8, the Authority may take the share of flow in the<br />

waterway specified in clause 7, up to a total of 9 208 ML in any year.’<br />

8. Substitution of clause 7<br />

For clause 7 of the Bulk Entitlement Order, substitute –<br />

‘7. SHARE OF FLOW<br />

7.1 In order to satisfy its annual entitlement, the Authority may take a share of the<br />

flow in the waterway passing the specified point:<br />

(a) up to a maximum rate of 60 ML/day during the period between 1 July<br />

and 31 October inclusive, up to the maximum volume of 3 306 ML;<br />

and<br />

(b) up to a maximum rate of 35 ML/day during any time of the year, up to<br />

the maximum volume of 5 902 ML<br />

subject to the passing flow clause 8.

7.2 The Authority is not entitled to any flow past the specified point, as part of this<br />

entitlement, which is being transferred by the holder of –<br />

(a) any other bulk entitlement; or<br />

(b) any licence –<br />

to a transferee pursuant to the Act.’<br />

9. Substitution of clause 8<br />

For clause 8 of the Bulk Entitlement Order, substitute –<br />

‘8. PASSING FLOWS<br />

The Authority must provide passing flows as follows:<br />

(a) when taking the share of flow specified in sub-clause 7.1(a), the minimum<br />

passing flow is 600 ML/day<br />

(b) when taking the share of flow specified in sub-clause 7.1(b) –<br />

For river flows less than 30 ML/d, no diversion is permitted. For river flows between<br />

30 and 46 ML/d, a passing flow of 30 ML/d must be allowed. For river flows between<br />

46 and 246 ML/d, diversion of up to 16 ML/d is permitted. For river flows between<br />

246 and 265 ML/d, a passing flow of 230 ML/d must be allowed. For river flows<br />

greater than 265 ML/d, diversion of up to 35 ML/d is permitted.’<br />

10. New clause 9A<br />

After clause 9 in the Bulk Entitlement Order, insert –<br />

‘9A. OPERATING RULES<br />

9A.1 The Authority must endeavour to work cooperatively with Gippsland and<br />

Southern Rural Water Corporation and East Gippsland Catchment Management<br />

Authority to develop operating rules for taking water from the waterway under<br />

this Order.<br />

9A.2 The objectives for the operating rules in sub-clause 9A.1 are to:<br />

(a) maintain reliability of supply to the Authority’s customers; and<br />

(b) minimise any adverse impact of the Authority’s taking water under this<br />

Order on the environment and licensed diverters, in particular during<br />

the period from November to June (inclusive) each year; and<br />

(c) take advantage of opportunities to improve environmental flows in the<br />

waterway.<br />

[Noting that Gippsland and Southern Rural Water Corporation’s local management<br />

rules for licensed diverters play a role in determining passing flows in the waterway.]<br />

9A.3 The operating rules in sub-clause 9A.1 may be updated from time to time<br />

with the agreement of the Authority, Gippsland and Southern Rural Water<br />

Corporation and the East Gippsland Catchment Management Authority to take<br />

account of changes to:<br />

(a) the Authority’s use of water; or<br />

(b) the environmental flow requirements for the waterway; or<br />

(c) licensed diverters’ use of water; or<br />

(d) local management rules for licensed diverters.’<br />
