to allow an aircraft engaged in an emergency, mercy flight or military flight of necessity to comply<br />

with safety, legal, or regulatory obligations or requirements prior to commencing that emergency or<br />

mercy operation.<br />

4.1.7 The Port District [<strong>Airport</strong> Authority] has adopted and will enforce administrative<br />

penalties to deter noise abatement regulation [<strong>Airport</strong> Use Regulations] violations.<br />

FAA Action: Disapproved. Penalties associated with violation of Measures 1 and 4 disapproved<br />

because those measures were disapproved. Penalties associated with Measure 3 disapproved as the<br />

escalating penalties become too severe with a possible limitation on, or suspension of, operating<br />

privileges, which raises questions of reasonableness and possible violation of the <strong>Airport</strong> and Airway<br />

Act of 1982, as amended.<br />

Implementation Status: Although disapproved under <strong>Part</strong> <strong>150</strong>, this measure was adopted as written<br />

and the <strong>Airport</strong> Authority continues the implementation as part of the <strong>Airport</strong> Use Regulations.<br />

Currently the administrative penalties include:<br />

■ 1st offense per calendar 6-month compliance period: $2,000<br />

■ 2nd offense per calendar 6-month compliance period: $6,000<br />

■ 3rd offense per calendar 6-month compliance period: $10,000<br />

A multiplier is added to reflect the number of violations during the previous compliance period. In<br />

addition, airport operating privileges may be suspended or terminated.<br />

In the event of any violation of Section 3.0 [Section 4.1.1] of this regulation (Operation of aircraft<br />

with Advisory Circular Takeoff <strong>Noise</strong> Levels which exceed 104 EPNdB) the person(s) committing<br />

such violation shall be assessed a penalty of $10,000 and all airport operating privileges will be<br />

terminated.<br />

4.1.8 Establish a pilot evaluation program to perform sound attenuation construction at one<br />

public school, selected by the <strong>San</strong> <strong>Diego</strong> Unified School District, located within the<br />

1988 65 CNEL noise contour. Evaluate the results of the “soundproofing” program to<br />

determine if the program should be expanded to other educational facilities.<br />

FAA Action: Approved.<br />

Implementation Status: The <strong>San</strong> <strong>Diego</strong> Unified School District selected the Loma Portal Elementary<br />

School for the pilot program. Sound attenuation has been completed at the school and, based upon<br />

evaluations by its staff and independent acoustical consultants, it was concluded that sound<br />

attenuation construction can produce educational benefits by significantly reducing aircraft noise<br />

levels in the classrooms if School District staff takes full advantage of the improvements by keeping<br />

the classroom doors and windows closed. Therefore, the program was expanded to four public<br />

schools and one private school – see Section 4.2.1.<br />

4.1.9 Continue to urge the City of <strong>San</strong> <strong>Diego</strong> to prohibit incompatible land uses in terms of<br />

the operation of Lindbergh Field under the California <strong>Noise</strong> Standards.<br />

FAA Action: Approved.<br />

Implementation Status: The <strong>Airport</strong> Authority continues to work with the City of <strong>San</strong> <strong>Diego</strong>, as the<br />

principal land use regulator of all non-federal lands in the general vicinity of SAN, to use its land use<br />

SAN DIEGO COUNTY REGIONAL AIRPORT AUTHORITY
