Owner. Upon receipt of the written request containing all required<br />

inform<strong>at</strong>ion, the Board will determine whether the proposed<br />

leasing of a Residential Unit is in compliance with the Declar<strong>at</strong>ion<br />

and either grant or disapprove such request. The proposed tenant<br />

may not take occupancy until written approval of the lease is<br />

granted by the Board; and<br />

(ii)<br />

A copy of the lease or rental agreement signed by the Owner and<br />

tenant must be delivered to the Manager for further delivery to the<br />

Board.<br />

8.2.5 Exceptions for Visiting Children. A person under 18 years of age may<br />

reside in a Residential Unit as the Guest of the Owner(s) or Resident(s) of such Residential Unit<br />

for a period of not more than 90 days in any 12 month period as set forth in the Declar<strong>at</strong>ion.<br />

8.3 Age Verific<strong>at</strong>ion. At least once every 2 years, an age verific<strong>at</strong>ion survey in the<br />

form <strong>at</strong>tached hereto as Exhibit 3 (the “Age Verific<strong>at</strong>ion Survey”) shall be completed to verify<br />

occupancy of each Residential Unit in the Project. Pursuant to the Age Certific<strong>at</strong>ion Survey, one<br />

adult Resident of each Residential Unit shall certify to the Associ<strong>at</strong>ion whether such Residential<br />

Unit is occupied by <strong>at</strong> least one person 55 years of age or older. Such certific<strong>at</strong>ion shall be<br />

supported by reliable official document<strong>at</strong>ion of the age of the Resident(s) of such Residential<br />

Unit. The following documents are acceptable as proof of age:<br />

(i)<br />

(ii)<br />

(iii)<br />

(iv)<br />

(v)<br />

(vi)<br />

Valid driver’s license;<br />

Birth certific<strong>at</strong>e;<br />

Passport;<br />

Immigr<strong>at</strong>ion card;<br />

Military identific<strong>at</strong>ion; or<br />

St<strong>at</strong>e, local, n<strong>at</strong>ional or intern<strong>at</strong>ional official documents containing<br />

a birth d<strong>at</strong>e of comparable reliability.<br />

In the event there is a change in the occupancy of a Residential Unit, the Resident<br />

immedi<strong>at</strong>ely shall notify the Board in writing of such change.<br />

8.4 Incorpor<strong>at</strong>ion of Provisions in Declar<strong>at</strong>ion. The provisions of Section 3.33 of<br />

the Declar<strong>at</strong>ion, as they may be amended from time to time, are incorpor<strong>at</strong>ed herein. Each<br />

Owner and Resident of a Residential Unit should read and understand the restrictions in the<br />

Declar<strong>at</strong>ion and these Rules with respect to the st<strong>at</strong>us of the Project as “housing for older<br />

persons.”<br />
