If payment is not received within<br />
two months after its due d<strong>at</strong>e, a<br />
letter will be sent to the Owner<br />
demanding full payment of the<br />
assessment and the l<strong>at</strong>e charges.<br />
In addition, a rebilling and<br />
processing fee plus a lien fee will<br />
be added to the Owner’s<br />
delinquent account and a lien<br />
will be recorded on the Owner’s<br />
property. At this point, payment<br />
must include all l<strong>at</strong>e charges and<br />
fees and be paid by cashiers<br />
check, certified check or money<br />
order. The lien will remain on<br />
the property until the account is<br />
current.<br />
The m<strong>at</strong>ter is referred to an<br />
<strong>at</strong>torney or collection agency for<br />
collection. Remedies may<br />
include filing a lawsuit against<br />
the delinquent Owner. Any fees<br />
incurred in the collection of this<br />
m<strong>at</strong>ter will be charged to the<br />
delinquent Owner. All Owner<br />
privileges, including the right to<br />
vote and the right to use the<br />
Common Area (except th<strong>at</strong> no<br />
Owner will be denied access to<br />
his Lot) will be revoked until full<br />
payment is received.<br />
There will be a charge for checks<br />
not paid by an Owner’s bank.<br />
All fees and charges for delinquencies will be <strong>at</strong> the cost charged to the Associ<strong>at</strong>ion by<br />
the provider of the services.<br />
The fiscal year for the Associ<strong>at</strong>ion is the calendar year. The amount of the Annual<br />
Assessment will be determined each year by the Board and all Owners will be notified of the<br />
