Sir,
I present my report on the work of the
Operations Review Committee (ORC) for the year
2000.
TERMS OF REFERENCE AND MEMBERSHIP
The terms of reference and membership of
the ORC are at Annexes A and B respectively.
There was no change in membership during the
year.
WORK OF THE COMMITTEE
The ORC met on eight occasions during
2000 to review reports prepared by the
Operations Department. At each meeting, the
Committee received progress reports on current
major investigations, cases that had been
investigated by the ICAC for over 12 months,
reports on persons who had been on ICAC bail for
over 6 months and searches authorised by the
Commissioner under Section 17 of the Prevention
of Bribery Ordinance. During the year, the
Committee also received 245 reports on cases
which had been prosecuted at court and
considered 67 major investigations which had not
resulted in prosecution. The Committee handled
a total of 3,970 cases during the year.
The Head of Operations attended all
meetings of the Committee to brief members on
the work of the Operations Department,
corruption statistics and trends, operational liaison
matters and other issues of interest to the ORC.
A Sub-Committee comprising three nonofficial
members sitting in rotation was convened
on eight separate occasions to consider and advise
on 2,672 minor investigations and 1,231 nonpursuable
reports of corruption. In addition, the
Sub-Committee reviewed investigation reports on
cases which, on the advice of the Committee, had
been forwarded to other government departments
for consideration of disciplinary or administrative
