MANAGING RISK<br />

In <strong>the</strong> Table below a general overview <strong>of</strong> <strong>the</strong> requirements is given <strong>for</strong> high tier and low tier<br />

facilities respectively:<br />

*: SWA-VR: With this type <strong>of</strong> safety report, <strong>the</strong> facility operator must be able to <strong>in</strong>dicate that<br />

he knows & manages <strong>the</strong> hazards and risks l<strong>in</strong>ked to <strong>the</strong> presence <strong>of</strong> hazardous substances.<br />

The SWA-VR also needs to conta<strong>in</strong> adequate <strong>in</strong><strong>for</strong>mation to allow <strong>for</strong> emergency response<br />

plann<strong>in</strong>g by <strong>the</strong> responsible authorities. The SWA-VR is a dynamic document that must be <strong>in</strong><br />

accordance with <strong>the</strong> company’s current situation. This is why it must be reviewed<br />

periodically, at le<strong>as</strong>t every five years.<br />

Exam<strong>in</strong><strong>in</strong>g <strong>the</strong> articles <strong>of</strong> <strong>the</strong> SWA 2006 <strong>in</strong> more detail leads to <strong>the</strong> follow<strong>in</strong>g:<br />

Art. 3 §1 states that: "This agreement is applicable to establishments where<br />

dangerous substances are present <strong>in</strong> quantities equal to or greater than those listed <strong>in</strong> Annex I,<br />

Parts 1 and 2, column 3 amount. [...] " (“Dit samenwerk<strong>in</strong>gsakkoord is van toep<strong>as</strong>s<strong>in</strong>g op<br />

<strong>in</strong>richt<strong>in</strong>gen waar gevaarlijke st<strong>of</strong>fen aanwezig zijn <strong>in</strong> hoeveelheden die gelijk zijn aan <strong>of</strong><br />

groter zijn dan de <strong>in</strong> bijlage I, delen 1 en 2, kolom 3, vermelde hoeveelheid. […]) Thus<br />

determ<strong>in</strong><strong>in</strong>g <strong>the</strong> scope <strong>of</strong> applicability <strong>of</strong> this legislation to all establishments where<br />

dangerous substances are present <strong>in</strong> quantities exceed<strong>in</strong>g <strong>the</strong> thresholds <strong>in</strong> <strong>the</strong> directive (<strong>for</strong><br />

<strong>LNG</strong> 50 resp. 200 tons).<br />

However, <strong>in</strong> Art. 6 <strong>the</strong> exceptions to <strong>the</strong> general applicability <strong>of</strong> this legislation are stated:<br />

"This agreement does not apply to: [...] 3 ° <strong>the</strong> transport <strong>of</strong> dangerous substances and<br />
