INTERNATIONAL PRELIMINARY EXAMINING AUTHORITIES<br />

<strong>PCT</strong> applicants can optionally request an International Preliminary Examination (IPE), by filing what is known<br />

as a Chapter II Demand with a competent IPEA. The selection of a competent IPEA is based on negotiated<br />

agreements between ROs and IPEAs. Once the preliminary examination has been carried out, an IPRP is sent<br />

to the applicant, who is then better placed to make an informed decision on whether to enter the <strong>PCT</strong><br />

national phase. The report is also transmitted to all national offices in their capacity as “elected” office. 23<br />

National offices, in examining the <strong>PCT</strong> application during the national phase, can take into account the IPRP<br />

when considering the patentability of the underlying invention.<br />

B.14 Distribution by IPEA<br />

Table B.14 shows the distribution of IPRPs issued by all IPEAs from 2006 to 2010. Since 2009, 17 national<br />

patent offices or regional organizations have been acting as IPEAs. 24<br />
