The final days<br />

of the 111th<br />

Congress began<br />

with Senate passage<br />

of the “Food Safety Modernization Act”<br />

(S 510) by a vote of 73 to 25. While the<br />

bill’s prospects are still uncertain, many<br />

on Capitol Hill now believe the House<br />

will approve the Senate bill despite having<br />

passed its own version in July 2009.<br />

The Senate bill, which would be the first<br />

major overhaul of food safety legislation<br />

in decades, has pitted consumer groups,<br />

retailers and large food companies who<br />

want more FDA regulation against a<br />

grassroots coalition of small farmers<br />

worried about being pushed out of business<br />

and taxpayers angry about excessive<br />

government spending. Here is a summary<br />

of some major FDA regulations that will be<br />

issued if the bill passes Congress:<br />

• Facility Registration<br />

FDA could suspend a registration of<br />

a foreign or domestic food facility<br />

if there is a reasonable probability<br />

that food from the facility will cause<br />

serious adverse health consequences or<br />

death; sales by suspended facilities are<br />

prohibited; biennial registration renewals<br />

are required.<br />

• Records<br />

FDA has access to records if there<br />

is a reasonable probability that food<br />

will cause serious adverse health<br />

consequences or death.<br />

• Recalls<br />

FDA can order a mandatory recall if a<br />

facility or importer refuses a voluntarily<br />
