B. Article 3 of the Geneva Convention Does Not Apply To<br />

Petitioner’s Military Commission<br />

Finally, petitioner argues (Br. 48-50) that the procedures<br />

governing his military commission do not comport with the<br />

requirements of Article 3 of the Geneva Convention. 23 As a<br />

preliminary matter, that contention fails because the Geneva<br />

Convention is not judicially enforceable. In any event, Article<br />

3 by its plain terms does not apply to the ongoing conflict with<br />

al Qaeda. Article 3 applies only “[i]n the case of armed conflict<br />

not of an international character occurring in the territory<br />

of one of the High Contracting Parties” (emphasis<br />

added). As the President determined, because the conflict<br />

between the United States and al Qaeda has taken place and<br />

is ongoing in several countries, the conflict is “of an international<br />

character,” and Article 3 is thus inapplicable. J.A. 35.<br />

Once again, the President’s determination is dispositive or, at<br />

a minimum, entitled to great weight. See Pet. App. 12a-13a.<br />

The International Committee of the Red Cross (ICRC)<br />

commentary for the Geneva Convention confirms the President’s<br />

determination. The commentary explains that the article<br />

“applies to non-international conflicts only.” ICRC, Commentary<br />

to the Geneva Convention Relative to the Treatment<br />

of Prisoners of War 34 (1960). “Speaking generally, it must<br />

be recognized that the conflicts referred to in Article 3 are<br />
