(2) Subjecttotheprovisionsofsection twenty-one, twoormorepiecesoflandmaybetransferredbyone
deedbyonepersonorbytwoormorepersonsholdingsuchpiecesoflandinundividedshares,toonepersonor
twoormorepersonsacquiringsuchpiecesoflandinundividedshares,ifeachpieceoflandisdescribedina
separateparagraph.
25 Transferofundividedsharesinlandbyonedeed
(1) Landheldbyonepersonmaybetransferredbyonedeedfromthatpersontotwoormorepersonsinundividedshares.
(2) Landheldbytwoormorepersonsinundividedsharesmaybetransferredbyonedeedfromthosepersons
toanyoneofthemortotwoormoreoftheminundividedsharesortoanyotherperson,ortotwoormoreother
personsinundividedshares.
(3) Whereapieceoflandistransferredbyseparatedeedsoftransferinundividedsharestheregistrarshall
requiretobeaffixedtooneofsuchseparatedeedsstampsofthevaluewhichwouldinlawbenecessaryifthe
landhadbeentransferredbyoneandthesamedeed.
(4) Nofurtherorotherstampsorfees,exceptaregistrationfee,shallbepayable,buttheregistrarshallendorseuponeachoftheotherseparatedeedsanotethatthesaiddeedsoendorsedshallberegardedasfullyand
completelystampedaccordingtolaw.
26 Specialprovisionsrelatingtotransferofundividedshares
(1) Notransferofanundividedshareinlandwhichisintendedorcalculatedtorepresentorpurportstorepresentadefinedportionoflandshallbecapableofbeingregistered.
(2) Ifapieceoflandisownedbytwoormorepersonsinundividedsharesandoneormoreofsuchpersons
acquirestheshareorsharesoftheremainingownerorownersinadefinedportionofthatpieceofland,allthe
owners jointly, including the owner or owners acquiring the share or shares, maytransfersuchportiontothe
personorpersonsacquiringit.
27 Specialprovisionsrelatingtoundividedshareswithexclusiverightofoccupation
(1) Subjecttotheprovisionsofthissection,if—
(a) theownerofapieceoflandinanurbanareawishestotransfertooneormorepersonsanundivided
shareinthelandcoupledwithanexclusiverightofoccupation;or
(b) twoormorepersonswhoownbyseparatetitledeedundividedsharesinapieceoflandinanurbanarea
wishtoassigntotheownerorownersofeachsuchshare,inconjunctionwiththeundividedshare,an
exclusiverightofoccupation;
the owner orowners,asthecasemaybe,shallregisteragainstthetitletothelandconcernedanotarialdeed
which—
(i) specifiesthenumberofundividedsharescreatedortobecreatedwhichwillbecoupledwithan
exclusiverightofoccupation;and
(ii) clearlyindicateswhichbuildingsorportionsofanybuildingerectedortobeerectedontheland
concerned,eitherwithorwithoutanyareaofground,shallbesubjecttoanexclusiverightof
occupation;and
(iii) clearlyindicatesbymeansofdistinctivenumberswhichsharesreferredtoinsubparagraph(i)
arecoupledwithwhichbuildingsorportionsofabuildingreferredtoinsubparagraph(ii);and
(iv) definesthereciprocalrightsandobligationsapplicabletotheownersoftheundividedshares;
and
(v) provides for the administrationandmaintenanceofthelandconcernedandbuildingsthereon
andtheliabilityforrates,expensesandchargesrelatingthereto;and
(vi) subjecttosubsection(3),providesforthemannerinwhichthenotarialdeedmaybeamended.
(2) Theprovisionsofanotarialdeedregisteredintermsofsubsection (1),asamendedfromtimetotime,
shallbebindingonallownersofundividedsharesinthelandconcernedandontheirsuccessorsintitle.
(3) Anotarialdeedregisteredintermsofsubsection(1)maybeamendedfromtimetotimebyfurthernotarialdeedinaccordancewiththeprovisionsthereofreferredtoinsubparagraph(vi)ofsubsection(1):
Providedthat—
(i) subparagraph(vi)shallnotbeconstruedasauthorizinganyamendmenttheeffectofwhichwouldbeto
alterthenumberofundividedsharesinthelandconcernedwhicharecoupledwithanexclusiverightof
occupation,unless
(a) theownerofeachsuchsharehasconsentedtothealterationinthenumberofsuchshares;and
(b) theDirectorofPhysicalPlanninghasapprovedthealterationinthenumberofsuchshares.;

(ii) nosuchamendmentshallbeofforceoreffectuntilithasbeenregistered.
(4) Whereanundividedshareinlandsuchasisreferredtoinsubsection (1)iscoupledwithanexclusive
rightofoccupation—
