(2) Subjecttotheprovisionsofsection twenty-one, twoormorepiecesoflandmaybetransferredbyone<br />

deedbyonepersonorbytwoormorepersonsholdingsuchpiecesoflandinundividedshares,toonepersonor<br />

twoormorepersonsacquiringsuchpiecesoflandinundividedshares,ifeachpieceoflandisdescribedina<br />

separateparagraph.<br />

25 Transferofundividedsharesinlandbyonedeed<br />

(1) Landheldbyonepersonmaybetransferredbyonedeedfromthatpersontotwoormorepersonsinundividedshares.<br />

(2) Landheldbytwoormorepersonsinundividedsharesmaybetransferredbyonedeedfromthosepersons<br />

toanyoneofthemortotwoormoreoftheminundividedsharesortoanyotherperson,ortotwoormoreother<br />

personsinundividedshares.<br />

(3) Whereapieceoflandistransferredbyseparatedeedsoftransferinundividedsharestheregistrarshall<br />

requiretobeaffixedtooneofsuchseparatedeedsstampsofthevaluewhichwouldinlawbenecessaryifthe<br />

landhadbeentransferredbyoneandthesamedeed.<br />

(4) Nofurtherorotherstampsorfees,exceptaregistrationfee,shallbepayable,buttheregistrarshallendorseuponeachoftheotherseparatedeedsanotethatthesaiddeedsoendorsedshallberegardedasfullyand<br />

completelystampedaccordingtolaw.<br />

26 Specialprovisionsrelatingtotransferofundividedshares<br />

(1) Notransferofanundividedshareinlandwhichisintendedorcalculatedtorepresentorpurportstorepresentadefinedportionoflandshallbecapableofbeingregistered.<br />

(2) Ifapieceoflandisownedbytwoormorepersonsinundividedsharesandoneormoreofsuchpersons<br />

acquirestheshareorsharesoftheremainingownerorownersinadefinedportionofthatpieceofland,allthe<br />

owners jointly, including the owner or owners acquiring the share or shares, maytransfersuchportiontothe<br />

personorpersonsacquiringit.<br />

27 Specialprovisionsrelatingtoundividedshareswithexclusiverightofoccupation<br />

(1) Subjecttotheprovisionsofthissection,if—<br />

(a) theownerofapieceoflandinanurbanareawishestotransfertooneormorepersonsanundivided<br />

shareinthelandcoupledwithanexclusiverightofoccupation;or<br />

(b) twoormorepersonswhoownbyseparatetitledeedundividedsharesinapieceoflandinanurbanarea<br />

wishtoassigntotheownerorownersofeachsuchshare,inconjunctionwiththeundividedshare,an<br />

exclusiverightofoccupation;<br />

the owner orowners,asthecasemaybe,shallregisteragainstthetitletothelandconcernedanotarialdeed<br />

which—<br />

(i) specifiesthenumberofundividedsharescreatedortobecreatedwhichwillbecoupledwithan<br />

exclusiverightofoccupation;and<br />

(ii) clearlyindicateswhichbuildingsorportionsofanybuildingerectedortobeerectedontheland<br />

concerned,eitherwithorwithoutanyareaofground,shallbesubjecttoanexclusiverightof<br />

occupation;and<br />

(iii) clearlyindicatesbymeansofdistinctivenumberswhichsharesreferredtoinsubparagraph(i)<br />

arecoupledwithwhichbuildingsorportionsofabuildingreferredtoinsubparagraph(ii);and<br />

(iv) definesthereciprocalrightsandobligationsapplicabletotheownersoftheundividedshares;<br />

and<br />

(v) provides for the administrationandmaintenanceofthelandconcernedandbuildingsthereon<br />

andtheliabilityforrates,expensesandchargesrelatingthereto;and<br />

(vi) subjecttosubsection(3),providesforthemannerinwhichthenotarialdeedmaybeamended.<br />

(2) Theprovisionsofanotarialdeedregisteredintermsofsubsection (1),asamendedfromtimetotime,<br />

shallbebindingonallownersofundividedsharesinthelandconcernedandontheirsuccessorsintitle.<br />

(3) Anotarialdeedregisteredintermsofsubsection(1)maybeamendedfromtimetotimebyfurthernotarialdeedinaccordancewiththeprovisionsthereofreferredtoinsubparagraph(vi)ofsubsection(1):<br />

Providedthat—<br />

(i) subparagraph(vi)shallnotbeconstruedasauthorizinganyamendmenttheeffectofwhichwouldbeto<br />

alterthenumberofundividedsharesinthelandconcernedwhicharecoupledwithanexclusiverightof<br />

occupation,unless<br />

(a) theownerofeachsuchsharehasconsentedtothealterationinthenumberofsuchshares;and<br />

(b) theDirectorofPhysicalPlanninghasapprovedthealterationinthenumberofsuchshares.;<br />

(ii) nosuchamendmentshallbeofforceoreffectuntilithasbeenregistered.<br />

(4) Whereanundividedshareinlandsuchasisreferredtoinsubsection (1)iscoupledwithanexclusive<br />

rightofoccupation—
