(w) keepregistersandmakesuchentriesthereinasarenecessaryforthepurposeofcarryingouttheprovisionsofthisActoranyotherenactmentandofmaintaininganefficientsystemofregistrationcalculated toaffordsecurityoftitleandreadyreferencetoanyregistereddeed; and,generally,theregistrarshalldischargeallsuchdutiesasbylawmayoraretobedischargedbyaregistrarof deedsorasarenecessarytogiveeffecttotheprovisionsofthisAct. 6 Powersofregistrars Aregistrarshallhavepower— (a) torequiretheproductionofproofuponaffidavitorotherwiseofanyfactnecessarytobeestablishedin connectionwithanymatterorthingsoughttobeperformedoreffectedinhisregistry; (b) wheneveritis,inhisopinion,necessaryordesirabletorectifyinanydeedorotherdocumentregistered orfiledinhisregistry,anerrorinthenameordescriptionofanypersonorpropertymentionedthereinor intheconditionsaffectinganysuchpropertyorintheconditionsofanybond,torectifysucherror,subjecttothefollowingconditionsandexceptions— (i) everypersonappearingfromthedeedorotherdocumenttobeinterestedintherectificationshall haveconsentedtheretoinwriting; (ii) ifanysuchpersonrefusestoconsenttheretoorhisconsenttheretocannotbeobtainedtherectificationmaybemadeontheauthorityofanorderofcourt; (iii) iftheerroriscommontotwoormoredeedsorotherdocuments,includinganyregisterinhis registry,theerrorshallberectifiedinallthosedeedsorotherdocuments; (iv) nosuchrectificationshallbemadeifitwouldhavetheeffectoftransferringanyright; (v) iftheerrorrectifiedoccurredinanotarialdeed,heshallrequirenoticetobegivenoftherectificationtothenotarypublicconcernedor,ifsuchlegalpractitionerisdeceasedorhasceasedto practise,tothepersonhavinglawfulcustodyofhisprotocol; (c) toissue,underconditionsprescribedbyregulation,certifiedcopiesofdeedsorotherdocumentsregisteredorfiledinhisregistry; (d) if,inhisopinion,anydeedorotherdocumentsubmittedtohimhasbecomeillegibleorunserviceableor hasbeenalteredortamperedwithbyanyunauthorizedperson,torequirethatacertifiedcopythereofbe obtainedtotakeitsplace. 7 TransactionsaffectinglandinbothareasdefinedinSchedule Ifitissoughttoregistersimultaneoustransactionsaffectingseparatepiecesoflandsituatewithinbothareas definedintheSchedule,theregistrarsmay,subjecttotheprovisionsofanyregulations,bymutualarrangement, effectsuchregistrationinsuchmannerasmaybefoundexpedient. 8 Registereddeedsnottobecancelledexceptuponorderofcourt (1) SaveasisotherwiseprovidedinthisActorinanyotherenactment,noregistereddeedofgrant,deedof transfer,certificateoftitleorotherdeedconferringorconveyingtitletoland,oranyrealrightinlandotherthana mortgage bond, and no cession of anyregistered bond not made as security, shall be cancelled byaregistrar exceptuponanorderofcourt. (2) Uponthecancellationofanydeedpursuanttoanorderofcourt— (a) thedeedunderwhichthelandoranyrealrightinlandwasheldimmediatelypriortotheregistrationof thedeedwhichiscancelledshallberevivedtotheextentofsuchcancellationunlessacourtordersotherwise;and (b) theregistrarshallmaketheappropriateendorsementsontherelevantdeedsandentriesintheregisters. 9 Inspectionofrecordsandsupplyofinformation A registrarshall,onconditionsprescribedanduponpaymentoftheprescribedfeesunderthisActorany otherenactment,permitanymemberofthepublictoinspectthepublicregistersandotherpublicrecordsinhis registry,andtomakecopiesofthoserecordsorextractsfromthoseregistersandtoobtainsuchotherinformation concerningdeedsorotherdocumentsregisteredorfiledintheregistryaspriortothe2ndJanuary,1960,couldbe madeorobtained. PARTIII REGISTRATION GeneralProvisions 10 Whenregistrationtakesplace (1) Deedsexecutedorattestedbyaregistrarshallbedeemedtoberegisteredupontheaffixingoftheregistrar’ssignaturethereto: Provided that no such deed which isoneofabatchofinterdependentdeeds,intendedforregistrationtogether,shallbedeemedtoberegistereduntilallthedeedsofthebatchhavebeensignedbytheregistrar.
(2) Ifbyinadvertencetheregistrar’ssignaturehasnotbeenaffixedtoadeedatthetimeatwhichthesignatureshouldhavebeenaffixedintheordinarycourse,theregistrarmayaffixhissignaturetheretowhentheomission is discovered, and the deed shall thereupon be deemed to have been registered at the time at which the signatureshouldhavebeenaffixed. (3) Allendorsementsorentriesmadeontitledeedsorinregistersinconnexionwiththeregistrationofany deedexecutedorattestedbyaregistrarshallbedeemedtohavebeeneffectedsimultaneouslywiththeregistration ofsuchdeed,althoughinfacttheymayhavebeenmadesubsequentthereto. 11 Deedstofollowsequenceoftheirrelativecauses (1) SaveasotherwiseprovidedinthisActorasdirectedbythecourt— (a) transfersoflandandcessionsofrealrightsthereinshallfollowthesequenceofthesuccessivetransactionsinpursuanceofwhichtheyaremade,andifmadeinpursuanceoftestamentarydispositionorintestatesuccessiontheyshallfollowthesequenceinwhichtherighttoownershiporotherrealrightin thelandaccruedtothepersonssuccessivelybecomingvestedwithsuchright; (b) itshallnotbelawfultodepartfromanysuchsequenceinrecordinginanydeedsregistryanychangein theownershipinsuchlandorofsuchrealrightunlesstheregistrarissatisfiedthatthecircumstancesare exceptionalandhasconsentedtosuchdeparture: Providedthat— (i) ifthepropertyhaspassed,intermsofawillorthroughintestatesuccession,fromadeceased persontohisdescendants,andoneorotherofthosedescendantshasdiedaminorandintestate andnoexecutorhasbeenappointedinhisestate,transferorcessionofthepropertywhichhas vestedinthatdescendantmaybepassedbytheexecutorintheestateofthedeceasedpersondirecttotheheirsabintestatoofthedescendant; (ii) iftheregistrarissatisfiedthatthevalueoftheimmovablepropertywhichhasvestedinanyheir orlegateeintermsofawillorthroughintestatesuccessionwouldbeequalledorexceededby thecostsinvolvedintransferringorcedingittotheheirorlegatee,andtheheirorlegateehas soldtheproperty,transferorcessionthereofmay,withtheconsentinwritingoftheheirorlegatee,bepassedbytheexecutorintheestateofthedeceasedpersondirecttothepurchaser; (iii) ifintheadministrationanddistributionoftheestateofadeceasedperson— (a) aredistributionofanyoftheassetsinsuchestatetakesplace;or (b) aredistributionofanyoftheassetsinsuchestateandmovablepropertynotformingpart ofsuchestatewhichisintroducedforthepurposeofequalizingthedivisiontakesplace; the executor of such estate maytransfer the land or cede the real rights therein direct to the personentitledtheretointermsofsuchredistribution; (iv) ifafiduciaryinterestinanylandorrealrightthereinterminatesbeforetransferofthelandor cession of the real right has been registered in favour of the fiduciary, the land or real right thereinmaybetransferredorceded,asthecasemaybe,directtothefideicommissary; (v) iftherightofanypersontoclaimtransferofanylandorcessionofarealrightthereinfromany otherpersonhasbeenvestedinanythirdpersonintermsofajudgmentororderofanycourtor intermsofasaleinexecutionheldpursuanttoanysuchjudgmentororder,transferoftheland or cession of the real right therein may be passed direct to such third person by the person againstwhomtherighttoclaimtransferorcessionwasexercisable. (2) Priortotheregistrationofanytransferorcessionintermsofparagraph(b)ofandtheprovisostosubsection(1),thereshallbepaidthestampduty,estatedutyandanyothersuchdutywhichwouldhavebeenpayable hadthelandbeentransferredortherealrightsbeencededtoeachpersonsuccessivelybecomingentitledthereto. 12 Registrationoflandorrealrightinfavouroftrustee Whenanylandorrealrightthereinoranotarialbondisorhasbeenregisteredorrecordedinfavourofatrusteeinhiscapacityassuch,suchregistrationorrecordingshallbesufficienttovestsuccessorsinofficeofthat trusteewiththeownershipofsuchlandorrealrightortherightsundersuchnotarialbond. 13 Preparationofdeeds (1) Nodeedoftransfer,certificateoftitle,mortgagebond,otherthanamortgagebondintendedtoberegisteredassecurityforaloanoradvancereferredtoinparagraph(c)ofsubsection(1)ofsectionforty-fourcessionof amortgagebond,agreementreferredtoinparagraph(o)ofsectionfiveorconsentmentionedinsubsection(1)of section fifty-oneshallbeattested,executedorregisteredbyaregistrarunlessithasbeenpreparedbyanotary public. (2) Subsection(1)shallnotapplytoatitledeedissuedintermsofparagraph(d)ofsubsection(2)ofsection 41orsubsection(2)or(3)ofsection56oftheRegional,TownandCountryPlanningAct[Chapter29:12]which shallbepreparedbyaregistrar. 14 Howrealrightsshallbetransferred SubjecttothisActoranyotherlaw—
