(w) keepregistersandmakesuchentriesthereinasarenecessaryforthepurposeofcarryingouttheprovisionsofthis<strong>Act</strong>oranyotherenactmentandofmaintaininganefficientsystemofregistrationcalculated<br />
toaffordsecurityoftitleandreadyreferencetoanyregistereddeed;<br />
and,generally,theregistrarshalldischargeallsuchdutiesasbylawmayoraretobedischargedbyaregistrarof<br />
deedsorasarenecessarytogiveeffecttotheprovisionsofthis<strong>Act</strong>.<br />
6 Powersofregistrars<br />
Aregistrarshallhavepower—<br />
(a) torequiretheproductionofproofuponaffidavitorotherwiseofanyfactnecessarytobeestablishedin<br />
connectionwithanymatterorthingsoughttobeperformedoreffectedinhisregistry;<br />
(b) wheneveritis,inhisopinion,necessaryordesirabletorectifyinanydeedorotherdocumentregistered<br />
orfiledinhisregistry,anerrorinthenameordescriptionofanypersonorpropertymentionedthereinor<br />
intheconditionsaffectinganysuchpropertyorintheconditionsofanybond,torectifysucherror,subjecttothefollowingconditionsandexceptions—<br />
(i) everypersonappearingfromthedeedorotherdocumenttobeinterestedintherectificationshall<br />
haveconsentedtheretoinwriting;<br />
(ii) ifanysuchpersonrefusestoconsenttheretoorhisconsenttheretocannotbeobtainedtherectificationmaybemadeontheauthorityofanorderofcourt;<br />
(iii) iftheerroriscommontotwoormoredeedsorotherdocuments,includinganyregisterinhis<br />
registry,theerrorshallberectifiedinallthosedeedsorotherdocuments;<br />
(iv) nosuchrectificationshallbemadeifitwouldhavetheeffectoftransferringanyright;<br />
(v) iftheerrorrectifiedoccurredinanotarialdeed,heshallrequirenoticetobegivenoftherectificationtothenotarypublicconcernedor,ifsuchlegalpractitionerisdeceasedorhasceasedto<br />
practise,tothepersonhavinglawfulcustodyofhisprotocol;<br />
(c) toissue,underconditionsprescribedbyregulation,certifiedcopiesofdeedsorotherdocumentsregisteredorfiledinhisregistry;<br />
(d) if,inhisopinion,anydeedorotherdocumentsubmittedtohimhasbecomeillegibleorunserviceableor<br />
hasbeenalteredortamperedwithbyanyunauthorizedperson,torequirethatacertifiedcopythereofbe<br />
obtainedtotakeitsplace.<br />
7 TransactionsaffectinglandinbothareasdefinedinSchedule<br />
Ifitissoughttoregistersimultaneoustransactionsaffectingseparatepiecesoflandsituatewithinbothareas<br />
definedintheSchedule,theregistrarsmay,subjecttotheprovisionsofanyregulations,bymutualarrangement,<br />
effectsuchregistrationinsuchmannerasmaybefoundexpedient.<br />
8 Registereddeedsnottobecancelledexceptuponorderofcourt<br />
(1) Saveasisotherwiseprovidedinthis<strong>Act</strong>orinanyotherenactment,noregistereddeedofgrant,deedof<br />
transfer,certificateoftitleorotherdeedconferringorconveyingtitletoland,oranyrealrightinlandotherthana<br />
mortgage bond, and no cession of anyregistered bond not made as security, shall be cancelled byaregistrar<br />
exceptuponanorderofcourt.<br />
(2) Uponthecancellationofanydeedpursuanttoanorderofcourt—<br />
(a) thedeedunderwhichthelandoranyrealrightinlandwasheldimmediatelypriortotheregistrationof<br />
thedeedwhichiscancelledshallberevivedtotheextentofsuchcancellationunlessacourtordersotherwise;and<br />
(b) theregistrarshallmaketheappropriateendorsementsontherelevantdeedsandentriesintheregisters.<br />
9 Inspectionofrecordsandsupplyofinformation<br />
A registrarshall,onconditionsprescribedanduponpaymentoftheprescribedfeesunderthis<strong>Act</strong>orany<br />
otherenactment,permitanymemberofthepublictoinspectthepublicregistersandotherpublicrecordsinhis<br />
registry,andtomakecopiesofthoserecordsorextractsfromthoseregistersandtoobtainsuchotherinformation<br />
concerningdeedsorotherdocumentsregisteredorfiledintheregistryaspriortothe2ndJanuary,1960,couldbe<br />
madeorobtained.<br />

GeneralProvisions<br />
10 Whenregistrationtakesplace<br />
(1) <strong>Deeds</strong>executedorattestedbyaregistrarshallbedeemedtoberegisteredupontheaffixingoftheregistrar’ssignaturethereto:<br />
Provided that no such deed which isoneofabatchofinterdependentdeeds,intendedforregistrationtogether,shallbedeemedtoberegistereduntilallthedeedsofthebatchhavebeensignedbytheregistrar.
