(i) ifsuchactoromissionismalafideorifsuchregistrarorofficerhasnotexercisedreasonablecareand
diligenceincarryingouthisdutiesinconnexionwithsuchactoromission,theStateshallbeliablefor
thedamageaforesaid;
(ii) theregistrarorofficerguiltyofsuchactoromissionshallbeliabletomakegoodanylossordamage
resultingtherefromtotheStateifsuchactoromissionwasmalafide.
85 Feesofofficenotchargeableincertaincases
NofeeofofficeshallbechargedinrespectofthepreparationorissueintermsoftheRegional,Townand
CountryPlanningAct[Chapter29:12]ofatitledeedtoanylandwhichisacquiredbyalocalauthorityintermsof
thatActforpublicpurposesorwhichvestsinalocalauthorityintermsofthatAct.
86 Formaldefects
No act in connexion with any registration in a deeds registry shall be invalidated by any formal defect,
whethersuchdefectoccursinanydeedpassedorregistered,orinanydocumentupontheauthorityofwhichany
suchdeedhasbeenpassedorregisteredorwhichisrequiredtobeproducedinconnexionwiththepassingor
registrationofsuchdeed,unlessasubstantialinjusticehasbysuchactbeendonewhichintheopinionofthecourt
cannotberemediedbyanyorderofthecourt.
87 Regulations
(1) TheMinistermaymakeregulationsprescribing—
(a) thefeesofofficetobechargedinrespectofanyact,matterorthingrequiredorpermittedtobedonein
orinrelationtoadeedsregistry,includinganyreportmadetothecourtbytheregistrarinconnexion
withanyapplicationoractiontowhichheisnotaparty;
(b) thestepstobetakenfortheprotectionandpreservationoftherecordsofanydeedsregistry(including
thephotographingofsuchrecordsandtheprotectionandpreservationofthephotographiccopies)and
thedestructionordisposalofanyrecordsotherthancurrentdeeds,diagramsandotherdocuments;
(c) themannerandforminwhichanydeedorotherdocumentrequiredorpermittedtobelodged,registered
orfiledinadeedsregistryshallbeprepared,lodged,executed,registered,filedordelivered;
(d) themannerandforminwhichendorsementsorentriesrequiredbythisActoranyotherenactmenttobe
madeonregistereddeedsorotherdocumentsorintheregistersshallbemadethereonortherein;
(e) theparticulardocumentswhich,whenproducedinadeedsregistry,shallbeattestedorwitnessed,the
mannerinwhichanysuchdocumentshallbeattestedorwitnessedandthenumberofcopiesofadocumentwhichshallbelodgedinadeedsregistrywhensuchdocumentisregistered;
(f) thedivisions,districtsorotherareaswithintheareaservedbyadeedsregistry,whichshallbeadoptedin
numbering,forthepurposesofregistration,thefarmsorotherpiecesoflandsituatetherein;
(g) themethodaccordingtowhichfarmsorotherpiecesoflandinanysuchdivision,districtorotherarea
shallbenumbered;
(h) themannerandforminwhichstandsorlotsorportionsoflandorlotsintownshipsorsimilarareasmay
beregistered;
(i) themannerandforminwhichinformationwhichisrequiredbylawtobefurnishedtoaregistrarshall
berecordedinhisdeedsregistry,themannerandforminwhichinformationpermittedbylawtobefurnishedbyaregistrartothepublicshallbefurnishedandthemannerandforminwhichtheidentityof
personsshallbeestablished;
(j) theconditionsuponwhichconveyancers,legalpractitioners,surveyorsandotherpersonsmayconduct
anysearchinadeedsregistryandtheprecautionswhichshallbetakentoensurepreservationoftherecordsfromdamagebyimproperhandlingorotherwise;
(k) theconditionsunderwhichcopiesofdeedsandotherdocumentsregisteredinadeedsregistrymaybe
issuedforjudicialpurposesorpurposesofinformationorinsubstitutionfordeedsorotherdocuments
whichhavebeenlost,destroyed,defacedordamaged,andtheconditionsunderwhichextractsfromregistersorfromanydocumentsregisteredorfiledinadeedsregistrymaybefurnished;
(l) the manner and form in which consent shall be signified to anycancellation, cession, part payment,
releaseoramendmentoforotherregistrabletransactionaffectinganybondorotherdocumentregistered
inadeedsregistry;
(m) theconditionsunderwhichacopyofapowerofattorneymaybeacceptedbyaregistrarinlieuofthe
original;
(n) theformsofdeedswhichshallbeusedincircumstancesnotprovidedforinthisAct;
(o) anymatterwhichunderthisActisrequiredorpermittedtobeprescribed.
(2) Anyregulationsmadeunderparagraph(f)or(g)ofsubsection(1)shallcomeintooperationwithinthe
areaservedbyadeedsregistryuponsuchdatesastheMinistermay,bystatutoryinstrument,fix.
88 Specialjurisdictionofmagistratescourts
NotwithstandinganythingtothecontrarycontainedintheMagistratesCourtAct[Chapter7:10],anapplicationintermsofsubsection(7)ofsectionsixty-threeforanorderfortheejectmentofanypersonwhooccupiesany
