theeventoftheinsolvency,assignmentorliquidationoftheestateofthesellerorthevestingoftheseller’sestate
inatrusteeorassigneeintermsofthelawrelatingtoinsolvency,bythetrustee,assigneeorliquidatorconcerned.
(5) Aconsentreferredtoinsubsection(1)shallbepreparedbyanotarypublicandshall—
(a) identifytheregisteredownerandthepurchaserasisrequiredintermsofthisActinrespectofdocumentslodgedforregistration;and
(b) describethelandconcernedandspecifythenumberanddateofthetitledeedoftheregisteredowner;
and
(c) statethepurchasepriceandtheamountofthedeposit,ifany,andofeachinstalmentpayableintermsof
thecontractinrespectofcapitalandinterest,ifany;and
(d) statewhatamount,ifany,ofeachinstalmentshall,intheeventofthesaleofthelandpursuanttothe
insolvency,assignmentorliquidationoftheseller’sestateorthevestingoftheseller’sestateinatrustee
orassigneeintermsofthelawrelatingtoinsolvencyorthesaleinexecutionoftheproperty,bedeemed
toberentinrespectoftheoccupationofthepropertybythepurchaser;and
(e) haveannexedtheretothecontractoracopythereofcertifiedbyanotarypublic;and
(f) beaccompaniedbythetitledeedoftheregisteredowner.
(6) Therightsconferreduponapurchaserintermsofthissectionshallrankfromthedateoftheendorsement
referredtoinsubsection(1).
(7) Theregistrarshallcancelanendorsementreferredtoinsubsection(1)uponthelodgingwithhimofthe
writtenconsenttheretooftheregisteredownerandthepurchaserconcerned.
(8) Thissectionshallapplytoacontractreferredtoinsubsection(1)whetheritwasenteredintobefore,on
orafterthel9thJanuary,1973.
Leases
65 Registrationofleasesandsub-leases
(1) Savewhereprovisiontothecontraryismadeinanyenactment,anyleaseorsub-leaseoflandandany
cessionofsuchaleaseorsub-leaseintendedorrequiredtoberegisteredinadeedsregistryshallbeexecutedby
notarialdeedbythelessorandthelesseeorbythelesseeandthesub-lesseeorbythecedentandthecessionary,
asthecasemaybe.
(2) Ifthelandleasedorsub-leasedismortgagedorsubjecttotherightsofanyotherperson,itshallbenecessaryforthepurposesofregistrationoftheleaseorsub-leaseoranycessionthereoftoproducetheconsentofthe
legalholderthereof.
66 Terminationofregisteredlease
Whenaregisteredleaseorsub-leasehasterminated,theregistrarshall,onawrittenapplicationbytheowner
ofthelandaffectedtherebyandtheregisteredholderofthelease,accompaniedbyalldeedsaffectedbysuch
termination,noteonallsuchdeedsthatsuchleaseorsub-lease,asthecasemaybe,hasterminated.
67 Whereleasetoberegistered
Anyleaseofimmovablepropertywhichisregisteredinthenameofthelessorinadeedsregistryshallberegisteredinthatregistry,andanysub-leaseofanyleasesoregisteredshallberegisteredinthatregistry.
68 Cessionsofleasesandsub-leases
Nocessionofaleaseorsub-leaseshallberegisteredinanydeedsregistryunlesstheleaseorsub-leasehas
beenregisteredtherein.
69 Nohypothecationofleasesandsub-leases
Nohypothecationofaleaseorsub-leaseshallberegisteredinadeedsregistryunlesssuchhypothecationis
effectedbymeansof—
(a) amortgagebond,iftheleaseorsub-leaseisimmovableproperty;or
(b) anotarialbond,iftheleaseorsub-leaseisnotimmovableproperty.
70 Bondshypothecatingleasesorsub-leases
(1) Fortheregistrationofabondspeciallyhypothecatingaregisteredleaseorsub-leasethedeedofthelease
shallbeproducedtotheregistrar.
(2) In registering such bond the registrar shall endorse on the deed that the lease or sub-lease has been
hypothecatedbythebond.
(3) Sectionfiftyshallapply,mutatismutandis,inrespectofanyleaseorsub-leasesohypothecated.

71 Cancellationofregistrationonlapseofcertainregisteredrights
