“legal practitioner” means a person registered as such in terms of the Legal Practitioners Act [Chapter27:07]; “Master”meanstheMasteroftheHighCourtortheAssistantMasteroftheHighCourtatBulawayo; “Minister”meanstheMinisterofJusticeLegalandParliamentaryAffairsoranyotherMinistertowhomthe Presidentmay,fromtimetotime,assigntheadministrationofthisAct; “mortgagebond”meansabondattestedbytheregistrarspeciallyhypothecatingimmovableproperty; “notarialbond”meansabondattestedbyanotarypublichypothecatingmovablepropertygenerallyorspecially; “notarialdeed”meansadeedattestedbyanotarypublic,butdoesnotinclude— (a) adocumentwithasignaturewhichismerelyauthenticatedbyanotarypublic;or (b) acopyofadocumentwhichhasbeencertifiedascorrectbyanotarypublic; “notarypublic”meansapersonregisteredassuchintermsoftheLegalPractitionersAct [Chapter27:07] and,inrelationtoanydocumentexecutedoutsideZimbabwe,meansapersonlawfullypractisingassuch intheplacewherethedocumentwasexecuted; “owner”,inrelationtoimmovableproperty,meansthepersonregisteredastheownerorholderthereofand includesthetrusteeinaninsolventestate,theliquidatorofacompanywhichisanownerandtherepresentativerecognizedbylawofanyownerwhohasdiedorwhoisaminororofunsoundmindorisotherwise under disabilityso long as such trustee, liquidator or legal representative is acting within the authorityconferredonhimbylaw; “realright”meansanyrightwhichbecomesarealrightuponregistration; “registered”meansregisteredinadeedsregistry; “registrar”meansaregistrarofdeedsappointedunderthisActand,whenusedinrelationtoanydeedsregistry,meanstheregistrarinchargeofthatdeedsregistry;and,whenusedinrelationtoadocument,means aregistrarinchargeofthedeedsregistrywhereinthatdocumentisregisteredorregistrableorintended tobeusedorfiled; “registryduplicate”meansthecounterpartorcopyofadeedconsistingofmorethanonecopywhichisfiled orintendedtobefiledofrecordinadeedsregistry; “share”,inrelationtoland,meansundividedshare; “standorlot”meansanypieceoflandregisteredasastand,lotorplotinadeedsregistry; “township”includes— (a) anareaoflandregisteredinadeedsregistryasoneormorepiecesofland,eithercontiguousor incloseproximitytoeachother,whichisbeingusedorisintendedtobeusedorwhichisbeing orisintendedtobelaidoutordividedintositesforresidential,business,industrial,building,occupationalorsimilarpurposes,orisintendedordestinedorlikelytobeusedforanysuchpurpose;and (b) any township established, approved, proclaimed or otherwise recognized as such under any enactment; “unalienatedStateland”meansStatelandinrespectofwhichnotitledeed,otherthanacertificateofStatetitle,exists. PARTII ADMINISTRATION 3 Deedsregistries (1) ThereshallbedeedsregistriesatHarareandBulawayo,eachtoserveitsrespectiveareaasdefinedinthe Schedule. (2) IneachofthedeedsregistriesinZimbabweexistingatthe2ndJanuary,1960,thereshallbecarriedoutto completion,asifthisActhadnotbeenpassed,allmatterswhich,immediatelybeforesuchdate,werependingin thatregistry,andeachregistrymentionedinsubsection (1)shallbeacontinuationoftheregistryexistingatthe 2ndJanuary,1960,intheareaservedthereby. 4 Appointmentofofficers (1) SubjecttothelawrelatingtothePublicService,theMinister— (a) shallappointanofficertobestyledtheChiefRegistrarofDeeds,whoshallexercisegeneralsupervision anddirectionofthedeedsregistriesinZimbabwe;and (b) mayappointsuchregistrarsofdeedsandotherofficersastheMinisterdeemsnecessaryforthebetter carryingoutoftheprovisionsofthisAct. (2) Anypersonappointedintermsofsubsection(1)shall,iftheMinistersodirects,havethepowertodoany actorthingwhichmaybelawfullydonebyaregistrarofdeedsunderthisActoranyotherenactment. (3) Eachregistrarshallhaveasealofoffice.
5 Dutiesofregistrars Theregistrarshall,subjecttothisAct— (a) takechargeofallrecordswhichwere,priortothe2ndJanuary,1960,ormaybecomeaftersuchdate, recordsofanydeedsregistryinrespectofwhichhehasbeenappointedandpreserveordealwithsuch recordsinsuchmannerasmaybeprescribed; (b) examinealldeedsorotherdocumentssubmittedtohimforexecutionorregistration,andafterexaminationrejectanysuchdeedorotherdocumenttheexecutionorregistrationofwhichisnotpermittedby thisActorbyanyotherlaw,ortotheexecutionorregistrationofwhichanyothervalidobjectionexists; (c) register grants or leases of land lawfullyissued bythe State and register amendments. renewals and cancellationsofsuchleasesandreleasesofanypartofthepropertyleased; (d) attestorexecuteandregisterdeedsoftransferoflandandexecuteandregistercertificatesoftitleto land; (e) attestorexecuteandregistermortgagebonds; (f) register cessions, including cessions made as security, of registered mortgage bonds and register cancellationsofsuchcessionsifmadeassecurity; (g) registercancellationsofregisteredmortgagebonds,partpaymentsofthecapitalamountdueinrespect ofanysuchbondotherthanabondintendedtosecurefuturedebts,releasesofanypartoftheproperty hypothecatedthereby,orofallsuchpropertyifthedebtisfurthersecuredbyacollateralbond,releases ofanyjointdebtororofanysuretyinrespectofanysuchbond,thesubstitutionofanotherpersonfora debtorinrespectofanysuchbondandreductionsofcoverinrespectofanybondintendedtosecurefuturedebts; (h) registerwaiversofpreferenceinrespectofregisteredmortgagebondsinfavourofotherbonds,whether registeredorabouttoberegistered; (i) registerwaiversofpreferenceinrespectofregisteredrealrightsinland,infavourofmortgagebonds, whetherregisteredorabouttoberegistered; (j) registernotarialbondsandcessionsthereof,includingcessionsmadeassecurity; (k) registercancellationsofnotarialbondsandcessionsthereofifmadeassecurity,partpaymentsofthe capitalamountdueinrespectofanysuchbondotherthanabondintendedtosecurefuturedebts,releasesofanypartofthepropertyhypothecatedthereby,orofallsuchpropertyifthedebtisfurthersecuredbyacollateralbond,releasesofanyjointdebtororofanysuretyinrespectofanysuchbond,the substitutionofanotherpersonforadebtorinrespectofanysuchbondandreductionsofcoverinrespect ofanybondintendedtosecurefuturedebts; (l) registerwaiversofpreferenceinrespectofregisterednotarialbondsinfavourofotherbonds,whether registeredorabouttoberegistered; (m) registerantenuptialcontracts,suchnotarialdeedsofdonation,includingadonationtobeheldintrust, andsuchotherdeedshavingreferencetopersonsandpropertywithintheareaservedbythedeedsregistryinquestionasarerequiredorpermittedbylawtoberegistered; (n) registeranyservitude,whetherpersonalorpraedial,andrecordthemodificationorextinctionofany registeredservitude; (o) registernotarialdeedsoflease,sub-leaseandcessionsofleaseorsub-leaseoflandandnotarialdeedsof renewal and also register cancellations of such leases and sub-leases and releases of anypart of the propertyleased; (p) registeranyrealright,notspecificallyreferredtointhissection,andanycession,modificationorextinctionofanysuchregisteredright; (q) register against anyregistered bond anyagreement entered into bythe mortgagor and the registered holderofthatbondwherebyanytermsofthatbondhavebeenvaried; (r) registergeneralplansofstandsorlotsorofsubdivisionsofland,openregistersofthestands,lotsor subdivisionsoflandshownonsuchgeneralplansandrecordinsuchregisterstheconditionsuponwhich thestands,lotsorsubdivisionshavebeenlaidoutorestablished; (s) record powers of attorney whereby the agents named therein are authorized to act generallyfor the principalsgrantingsuchpowers,ortocarryoutaseriesofactsortransactionsregistrableinadeedsregistry,andfilecopiesofsuchpowersrecordedintheotherdeedsregistrywhichhavebeencertifiedby theregistrarthereof; (t) make, in connexion with the registration of anydeed or other document, or in compliance with the requirementsofanyenactment,suchendorsementsonanyregistereddeedorotherdocumentasmaybe necessarytogiveeffecttosuchregistrationortotheobjectsofsuchenactment; (u) recordallnotices,returns,statementsorordersofcourtlodgedwithhimintermsofanylaw; (v) removefromhisrecords,withtheapprovaloftheMasterandafterthelapseoffiveyearsfromthedate ofentryinsuchrecords,anyentrymadetherein,whetherbeforeorafterthe2ndJanuary,1960,inpursuanceofthetransmissiontohimofanoticeofliquidationoranorderofliquidationorsequestration;
