1 Shorttitle<br />

This<strong>Act</strong>maybecitedasthe<strong>Deeds</strong><strong>Registries</strong><strong>Act</strong>[<strong>Chapter</strong><strong>20</strong>:<strong>05</strong>].<br />

2 Interpretation<br />

Inthis<strong>Act</strong>—<br />

“conveyancer”meansapersonregisteredassuchintermsoftheLegalPractitioners<strong>Act</strong>[<strong>Chapter</strong>27:07];<br />

“court”meanstheHighCourt;<br />

“deedsregistry”means—<br />

(a) whenusedinrelationtoimmovableproperty,thedeedsregistrywhichservestheareainwhich<br />

thatpropertyissituate;<br />

(b) whenusedinrelationtoanydeedorotherdocument,thedeedsregistryin<strong>Zimbabwe</strong>wherein<br />

thatdeedorotherdocumentisregisteredorregistrable;<br />

(c) whenusedinrelationtoaregistrar,thedeedsregistryofwhichheisincharge;<br />

“diagram”meansadiagramwhichhasbeensignedbyapersonrecognizedbylawasalandsurveyorand<br />

whichhasbeenapprovedorcertifiedbytheSurveyor-General,andincludesadiagramoracopythereof<br />

preparedintheSurveyor-General’sofficeandapprovedorcertifiedasaforesaid,oradiagramwhichhas<br />

atanytimebeforethe2ndJanuary,1960,beenacceptedforregistrationinadeedsregistryortheSurveyor-General’soffice;<br />

“dispensationcertificate”meansacertificateissuedbytheSurveyor-Generalintermsofsection49ofthe<br />

LandSurvey<strong>Act</strong>[<strong>Chapter</strong><strong>20</strong>:12];<br />

“generalplan”meansaplanwhichrepresentstherelevantpositionsanddimensionsoftwoormorepiecesof<br />

landandhasbeensignedbyapersonrecognizedbylawasalandsurveyor,andwhichhasbeenapproved<br />

or certified as a general plan by the Surveyor-General, and includes a general plan or copy<br />

thereofpreparedintheSurveyor-General’sofficeandapprovedorcertifiedasaforesaid,orageneral<br />

planwhichhasatanytimepriortothe2ndJanuary,1960,beenacceptedforregistrationinadeedsregistryortheSurveyor-General’soffice;<br />

“immovableproperty”includesanyregisteredleaseoflandwhich,whenenteredinto,wasforaperiodofnot<br />

lessthantenyearsorforthenaturallifeofthelesseeoranyotherpersonmentionedinthelease,or<br />

whichisrenewablefromtimetotimeatthewillofthelesseeindefinitelyorforperiodswhichtogether<br />

withthefirstperiodamountinalltonotlessthantenyears;<br />

“land”includesanundividedshareinland;


“legal practitioner” means a person registered as such in terms of the Legal Practitioners <strong>Act</strong> [<strong>Chapter</strong>27:07];<br />

“Master”meanstheMasteroftheHighCourtortheAssistantMasteroftheHighCourtatBulawayo;<br />

“Minister”meanstheMinisterof<strong>Justice</strong>LegalandParliamentaryAffairsoranyotherMinistertowhomthe<br />

Presidentmay,fromtimetotime,assigntheadministrationofthis<strong>Act</strong>;<br />

“mortgagebond”meansabondattestedbytheregistrarspeciallyhypothecatingimmovableproperty;<br />

“notarialbond”meansabondattestedbyanotarypublichypothecatingmovablepropertygenerallyorspecially;<br />

“notarialdeed”meansadeedattestedbyanotarypublic,butdoesnotinclude—<br />

(a) adocumentwithasignaturewhichismerelyauthenticatedbyanotarypublic;or<br />

(b) acopyofadocumentwhichhasbeencertifiedascorrectbyanotarypublic;<br />

“notarypublic”meansapersonregisteredassuchintermsoftheLegalPractitioners<strong>Act</strong> [<strong>Chapter</strong>27:07]<br />

and,inrelationtoanydocumentexecutedoutside<strong>Zimbabwe</strong>,meansapersonlawfullypractisingassuch<br />

intheplacewherethedocumentwasexecuted;<br />

“owner”,inrelationtoimmovableproperty,meansthepersonregisteredastheownerorholderthereofand<br />

includesthetrusteeinaninsolventestate,theliquidatorofacompanywhichisanownerandtherepresentativerecognizedbylawofanyownerwhohasdiedorwhoisaminororofunsoundmindorisotherwise<br />

under disabilityso long as such trustee, liquidator or legal representative is acting within the<br />

authorityconferredonhimbylaw;<br />

“realright”meansanyrightwhichbecomesarealrightuponregistration;<br />

“registered”meansregisteredinadeedsregistry;<br />

“registrar”meansaregistrarofdeedsappointedunderthis<strong>Act</strong>and,whenusedinrelationtoanydeedsregistry,meanstheregistrarinchargeofthatdeedsregistry;and,whenusedinrelationtoadocument,means<br />

aregistrarinchargeofthedeedsregistrywhereinthatdocumentisregisteredorregistrableorintended<br />

tobeusedorfiled;<br />

“registryduplicate”meansthecounterpartorcopyofadeedconsistingofmorethanonecopywhichisfiled<br />

orintendedtobefiledofrecordinadeedsregistry;<br />

“share”,inrelationtoland,meansundividedshare;<br />

“standorlot”meansanypieceoflandregisteredasastand,lotorplotinadeedsregistry;<br />

“township”includes—<br />

(a) anareaoflandregisteredinadeedsregistryasoneormorepiecesofland,eithercontiguousor<br />

incloseproximitytoeachother,whichisbeingusedorisintendedtobeusedorwhichisbeing<br />

orisintendedtobelaidoutordividedintositesforresidential,business,industrial,building,occupationalorsimilarpurposes,orisintendedordestinedorlikelytobeusedforanysuchpurpose;and<br />

(b) any township established, approved, proclaimed or otherwise recognized as such under any<br />

enactment;<br />

“unalienatedStateland”meansStatelandinrespectofwhichnotitledeed,otherthanacertificateofStatetitle,exists.<br />

PARTII<br />

ADMINISTRATION<br />

3 <strong>Deeds</strong>registries<br />

(1) ThereshallbedeedsregistriesatHarareandBulawayo,eachtoserveitsrespectiveareaasdefinedinthe<br />

Schedule.<br />

(2) Ineachofthedeedsregistriesin<strong>Zimbabwe</strong>existingatthe2ndJanuary,1960,thereshallbecarriedoutto<br />

completion,asifthis<strong>Act</strong>hadnotbeenpassed,allmatterswhich,immediatelybeforesuchdate,werependingin<br />

thatregistry,andeachregistrymentionedinsubsection (1)shallbeacontinuationoftheregistryexistingatthe<br />

2ndJanuary,1960,intheareaservedthereby.<br />

4 Appointmentofofficers<br />

(1) SubjecttothelawrelatingtothePublicService,theMinister—<br />

(a) shallappointanofficertobestyledtheChiefRegistrarof<strong>Deeds</strong>,whoshallexercisegeneralsupervision<br />

anddirectionofthedeedsregistriesin<strong>Zimbabwe</strong>;and<br />

(b) mayappointsuchregistrarsofdeedsandotherofficersastheMinisterdeemsnecessaryforthebetter<br />

carryingoutoftheprovisionsofthis<strong>Act</strong>.<br />

(2) Anypersonappointedintermsofsubsection(1)shall,iftheMinistersodirects,havethepowertodoany<br />

actorthingwhichmaybelawfullydonebyaregistrarofdeedsunderthis<strong>Act</strong>oranyotherenactment.<br />

(3) Eachregistrarshallhaveasealofoffice.


5 Dutiesofregistrars<br />

Theregistrarshall,subjecttothis<strong>Act</strong>—<br />

(a) takechargeofallrecordswhichwere,priortothe2ndJanuary,1960,ormaybecomeaftersuchdate,<br />

recordsofanydeedsregistryinrespectofwhichhehasbeenappointedandpreserveordealwithsuch<br />

recordsinsuchmannerasmaybeprescribed;<br />

(b) examinealldeedsorotherdocumentssubmittedtohimforexecutionorregistration,andafterexaminationrejectanysuchdeedorotherdocumenttheexecutionorregistrationofwhichisnotpermittedby<br />

this<strong>Act</strong>orbyanyotherlaw,ortotheexecutionorregistrationofwhichanyothervalidobjectionexists;<br />

(c) register grants or leases of land lawfullyissued bythe State and register amendments. renewals and<br />

cancellationsofsuchleasesandreleasesofanypartofthepropertyleased;<br />

(d) attestorexecuteandregisterdeedsoftransferoflandandexecuteandregistercertificatesoftitleto<br />

land;<br />

(e) attestorexecuteandregistermortgagebonds;<br />

(f) register cessions, including cessions made as security, of registered mortgage bonds and register<br />

cancellationsofsuchcessionsifmadeassecurity;<br />

(g) registercancellationsofregisteredmortgagebonds,partpaymentsofthecapitalamountdueinrespect<br />

ofanysuchbondotherthanabondintendedtosecurefuturedebts,releasesofanypartoftheproperty<br />

hypothecatedthereby,orofallsuchpropertyifthedebtisfurthersecuredbyacollateralbond,releases<br />

ofanyjointdebtororofanysuretyinrespectofanysuchbond,thesubstitutionofanotherpersonfora<br />

debtorinrespectofanysuchbondandreductionsofcoverinrespectofanybondintendedtosecurefuturedebts;<br />

(h) registerwaiversofpreferenceinrespectofregisteredmortgagebondsinfavourofotherbonds,whether<br />

registeredorabouttoberegistered;<br />

(i) registerwaiversofpreferenceinrespectofregisteredrealrightsinland,infavourofmortgagebonds,<br />

whetherregisteredorabouttoberegistered;<br />

(j) registernotarialbondsandcessionsthereof,includingcessionsmadeassecurity;<br />

(k) registercancellationsofnotarialbondsandcessionsthereofifmadeassecurity,partpaymentsofthe<br />

capitalamountdueinrespectofanysuchbondotherthanabondintendedtosecurefuturedebts,releasesofanypartofthepropertyhypothecatedthereby,orofallsuchpropertyifthedebtisfurthersecuredbyacollateralbond,releasesofanyjointdebtororofanysuretyinrespectofanysuchbond,the<br />

substitutionofanotherpersonforadebtorinrespectofanysuchbondandreductionsofcoverinrespect<br />

ofanybondintendedtosecurefuturedebts;<br />

(l) registerwaiversofpreferenceinrespectofregisterednotarialbondsinfavourofotherbonds,whether<br />

registeredorabouttoberegistered;<br />

(m) registerantenuptialcontracts,suchnotarialdeedsofdonation,includingadonationtobeheldintrust,<br />

andsuchotherdeedshavingreferencetopersonsandpropertywithintheareaservedbythedeedsregistryinquestionasarerequiredorpermittedbylawtoberegistered;<br />

(n) registeranyservitude,whetherpersonalorpraedial,andrecordthemodificationorextinctionofany<br />

registeredservitude;<br />

(o) registernotarialdeedsoflease,sub-leaseandcessionsofleaseorsub-leaseoflandandnotarialdeedsof<br />

renewal and also register cancellations of such leases and sub-leases and releases of anypart of the<br />

propertyleased;<br />

(p) registeranyrealright,notspecificallyreferredtointhissection,andanycession,modificationorextinctionofanysuchregisteredright;<br />

(q) register against anyregistered bond anyagreement entered into bythe mortgagor and the registered<br />

holderofthatbondwherebyanytermsofthatbondhavebeenvaried;<br />

(r) registergeneralplansofstandsorlotsorofsubdivisionsofland,openregistersofthestands,lotsor<br />

subdivisionsoflandshownonsuchgeneralplansandrecordinsuchregisterstheconditionsuponwhich<br />

thestands,lotsorsubdivisionshavebeenlaidoutorestablished;<br />

(s) record powers of attorney whereby the agents named therein are authorized to act generallyfor the<br />

principalsgrantingsuchpowers,ortocarryoutaseriesofactsortransactionsregistrableinadeedsregistry,andfilecopiesofsuchpowersrecordedintheotherdeedsregistrywhichhavebeencertifiedby<br />

theregistrarthereof;<br />

(t) make, in connexion with the registration of anydeed or other document, or in compliance with the<br />

requirementsofanyenactment,suchendorsementsonanyregistereddeedorotherdocumentasmaybe<br />

necessarytogiveeffecttosuchregistrationortotheobjectsofsuchenactment;<br />

(u) recordallnotices,returns,statementsorordersofcourtlodgedwithhimintermsofanylaw;<br />

(v) removefromhisrecords,withtheapprovaloftheMasterandafterthelapseoffiveyearsfromthedate<br />

ofentryinsuchrecords,anyentrymadetherein,whetherbeforeorafterthe2ndJanuary,1960,inpursuanceofthetransmissiontohimofanoticeofliquidationoranorderofliquidationorsequestration;


(w) keepregistersandmakesuchentriesthereinasarenecessaryforthepurposeofcarryingouttheprovisionsofthis<strong>Act</strong>oranyotherenactmentandofmaintaininganefficientsystemofregistrationcalculated<br />

toaffordsecurityoftitleandreadyreferencetoanyregistereddeed;<br />

and,generally,theregistrarshalldischargeallsuchdutiesasbylawmayoraretobedischargedbyaregistrarof<br />

deedsorasarenecessarytogiveeffecttotheprovisionsofthis<strong>Act</strong>.<br />

6 Powersofregistrars<br />

Aregistrarshallhavepower—<br />

(a) torequiretheproductionofproofuponaffidavitorotherwiseofanyfactnecessarytobeestablishedin<br />

connectionwithanymatterorthingsoughttobeperformedoreffectedinhisregistry;<br />

(b) wheneveritis,inhisopinion,necessaryordesirabletorectifyinanydeedorotherdocumentregistered<br />

orfiledinhisregistry,anerrorinthenameordescriptionofanypersonorpropertymentionedthereinor<br />

intheconditionsaffectinganysuchpropertyorintheconditionsofanybond,torectifysucherror,subjecttothefollowingconditionsandexceptions—<br />

(i) everypersonappearingfromthedeedorotherdocumenttobeinterestedintherectificationshall<br />

haveconsentedtheretoinwriting;<br />

(ii) ifanysuchpersonrefusestoconsenttheretoorhisconsenttheretocannotbeobtainedtherectificationmaybemadeontheauthorityofanorderofcourt;<br />

(iii) iftheerroriscommontotwoormoredeedsorotherdocuments,includinganyregisterinhis<br />

registry,theerrorshallberectifiedinallthosedeedsorotherdocuments;<br />

(iv) nosuchrectificationshallbemadeifitwouldhavetheeffectoftransferringanyright;<br />

(v) iftheerrorrectifiedoccurredinanotarialdeed,heshallrequirenoticetobegivenoftherectificationtothenotarypublicconcernedor,ifsuchlegalpractitionerisdeceasedorhasceasedto<br />

practise,tothepersonhavinglawfulcustodyofhisprotocol;<br />

(c) toissue,underconditionsprescribedbyregulation,certifiedcopiesofdeedsorotherdocumentsregisteredorfiledinhisregistry;<br />

(d) if,inhisopinion,anydeedorotherdocumentsubmittedtohimhasbecomeillegibleorunserviceableor<br />

hasbeenalteredortamperedwithbyanyunauthorizedperson,torequirethatacertifiedcopythereofbe<br />

obtainedtotakeitsplace.<br />

7 TransactionsaffectinglandinbothareasdefinedinSchedule<br />

Ifitissoughttoregistersimultaneoustransactionsaffectingseparatepiecesoflandsituatewithinbothareas<br />

definedintheSchedule,theregistrarsmay,subjecttotheprovisionsofanyregulations,bymutualarrangement,<br />

effectsuchregistrationinsuchmannerasmaybefoundexpedient.<br />

8 Registereddeedsnottobecancelledexceptuponorderofcourt<br />

(1) Saveasisotherwiseprovidedinthis<strong>Act</strong>orinanyotherenactment,noregistereddeedofgrant,deedof<br />

transfer,certificateoftitleorotherdeedconferringorconveyingtitletoland,oranyrealrightinlandotherthana<br />

mortgage bond, and no cession of anyregistered bond not made as security, shall be cancelled byaregistrar<br />

exceptuponanorderofcourt.<br />

(2) Uponthecancellationofanydeedpursuanttoanorderofcourt—<br />

(a) thedeedunderwhichthelandoranyrealrightinlandwasheldimmediatelypriortotheregistrationof<br />

thedeedwhichiscancelledshallberevivedtotheextentofsuchcancellationunlessacourtordersotherwise;and<br />

(b) theregistrarshallmaketheappropriateendorsementsontherelevantdeedsandentriesintheregisters.<br />

9 Inspectionofrecordsandsupplyofinformation<br />

A registrarshall,onconditionsprescribedanduponpaymentoftheprescribedfeesunderthis<strong>Act</strong>orany<br />

otherenactment,permitanymemberofthepublictoinspectthepublicregistersandotherpublicrecordsinhis<br />

registry,andtomakecopiesofthoserecordsorextractsfromthoseregistersandtoobtainsuchotherinformation<br />

madeorobtained.<br />

PARTIII<br />

REGISTRATION<br />

GeneralProvisions<br />

10 Whenregistrationtakesplace<br />

(1) <strong>Deeds</strong>executedorattestedbyaregistrarshallbedeemedtoberegisteredupontheaffixingoftheregistrar’ssignaturethereto:<br />

Provided that no such deed which isoneofabatchofinterdependentdeeds,intendedforregistrationtogether,shallbedeemedtoberegistereduntilallthedeedsofthebatchhavebeensignedbytheregistrar.


(2) Ifbyinadvertencetheregistrar’ssignaturehasnotbeenaffixedtoadeedatthetimeatwhichthesignatureshouldhavebeenaffixedintheordinarycourse,theregistrarmayaffixhissignaturetheretowhentheomission<br />

is discovered, and the deed shall thereupon be deemed to have been registered at the time at which the<br />

signatureshouldhavebeenaffixed.<br />

(3) Allendorsementsorentriesmadeontitledeedsorinregistersinconnexionwiththeregistrationofany<br />

deedexecutedorattestedbyaregistrarshallbedeemedtohavebeeneffectedsimultaneouslywiththeregistration<br />

ofsuchdeed,althoughinfacttheymayhavebeenmadesubsequentthereto.<br />

11 <strong>Deeds</strong>tofollowsequenceoftheirrelativecauses<br />

(1) Saveasotherwiseprovidedinthis<strong>Act</strong>orasdirectedbythecourt—<br />

(a) transfersoflandandcessionsofrealrightsthereinshallfollowthesequenceofthesuccessivetransactionsinpursuanceofwhichtheyaremade,andifmadeinpursuanceoftestamentarydispositionorintestatesuccessiontheyshallfollowthesequenceinwhichtherighttoownershiporotherrealrightin<br />

thelandaccruedtothepersonssuccessivelybecomingvestedwithsuchright;<br />

(b) itshallnotbelawfultodepartfromanysuchsequenceinrecordinginanydeedsregistryanychangein<br />

theownershipinsuchlandorofsuchrealrightunlesstheregistrarissatisfiedthatthecircumstancesare<br />

exceptionalandhasconsentedtosuchdeparture:<br />

Providedthat—<br />

(i) ifthepropertyhaspassed,intermsofawillorthroughintestatesuccession,fromadeceased<br />

persontohisdescendants,andoneorotherofthosedescendantshasdiedaminorandintestate<br />

andnoexecutorhasbeenappointedinhisestate,transferorcessionofthepropertywhichhas<br />

vestedinthatdescendantmaybepassedbytheexecutorintheestateofthedeceasedpersondirecttotheheirsabintestatoofthedescendant;<br />

(ii) iftheregistrarissatisfiedthatthevalueoftheimmovablepropertywhichhasvestedinanyheir<br />

orlegateeintermsofawillorthroughintestatesuccessionwouldbeequalledorexceededby<br />

thecostsinvolvedintransferringorcedingittotheheirorlegatee,andtheheirorlegateehas<br />

soldtheproperty,transferorcessionthereofmay,withtheconsentinwritingoftheheirorlegatee,bepassedbytheexecutorintheestateofthedeceasedpersondirecttothepurchaser;<br />

(iii) ifintheadministrationanddistributionoftheestateofadeceasedperson—<br />

(a) aredistributionofanyoftheassetsinsuchestatetakesplace;or<br />

(b) aredistributionofanyoftheassetsinsuchestateandmovablepropertynotformingpart<br />

ofsuchestatewhichisintroducedforthepurposeofequalizingthedivisiontakesplace;<br />

the executor of such estate maytransfer the land or cede the real rights therein direct to the<br />

personentitledtheretointermsofsuchredistribution;<br />

(iv) ifafiduciaryinterestinanylandorrealrightthereinterminatesbeforetransferofthelandor<br />

cession of the real right has been registered in favour of the fiduciary, the land or real right<br />

thereinmaybetransferredorceded,asthecasemaybe,directtothefideicommissary;<br />

(v) iftherightofanypersontoclaimtransferofanylandorcessionofarealrightthereinfromany<br />

otherpersonhasbeenvestedinanythirdpersonintermsofajudgmentororderofanycourtor<br />

intermsofasaleinexecutionheldpursuanttoanysuchjudgmentororder,transferoftheland<br />

or cession of the real right therein may be passed direct to such third person by the person<br />

againstwhomtherighttoclaimtransferorcessionwasexercisable.<br />

(2) Priortotheregistrationofanytransferorcessionintermsofparagraph(b)ofandtheprovisostosubsection(1),thereshallbepaidthestampduty,estatedutyandanyothersuchdutywhichwouldhavebeenpayable<br />

hadthelandbeentransferredortherealrightsbeencededtoeachpersonsuccessivelybecomingentitledthereto.<br />

12 Registrationoflandorrealrightinfavouroftrustee<br />

Whenanylandorrealrightthereinoranotarialbondisorhasbeenregisteredorrecordedinfavourofatrusteeinhiscapacityassuch,suchregistrationorrecordingshallbesufficienttovestsuccessorsinofficeofthat<br />

trusteewiththeownershipofsuchlandorrealrightortherightsundersuchnotarialbond.<br />

13 Preparationofdeeds<br />

(1) Nodeedoftransfer,certificateoftitle,mortgagebond,otherthanamortgagebondintendedtoberegisteredassecurityforaloanoradvancereferredtoinparagraph(c)ofsubsection(1)ofsectionforty-fourcessionof<br />

amortgagebond,agreementreferredtoinparagraph(o)ofsectionfiveorconsentmentionedinsubsection(1)of<br />

section fifty-oneshallbeattested,executedorregisteredbyaregistrarunlessithasbeenpreparedbyanotary<br />

public.<br />

(2) Subsection(1)shallnotapplytoatitledeedissuedintermsofparagraph(d)ofsubsection(2)ofsection<br />

41orsubsection(2)or(3)ofsection56oftheRegional,TownandCountryPlanning<strong>Act</strong>[<strong>Chapter</strong>29:12]which<br />

shallbepreparedbyaregistrar.<br />

14 Howrealrightsshallbetransferred<br />

Subjecttothis<strong>Act</strong>oranyotherlaw—


(a) theownershipoflandmaybeconveyedfromonepersontoanotheronlybymeansofadeedoftransfer<br />

executedorattestedbyaregistrar;<br />

(b) otherrealrightsinlandmaybeconveyedfromonepersontoanotheronlybymeansofadeedofcession<br />

attestedbyanotarypublicandregisteredbyaregistrar:<br />

Providedthatattestationbyanotarypublicshallnotbenecessaryinrespectoftheconveyanceofrealrights<br />

acquiredunderamortgagebond.<br />

15 Specialprovisionsrelatingtowomen<br />

(1) Amarriedwomanshallbeassistedbyherhusbandinexecutinganydeedordocumentrequiredorpermittedtobe—<br />

(a) registeredinanydeedsregistry;or<br />

(b) producedinconnectionwithanydeedordocumentreferredtoinparagraph(a);<br />

if,byvirtueofhermarriage,shehasnolegalcapacitytoexecutesuchdeedordocumentwithouttheassistanceof<br />

herhusband.<br />

(2) Aregistrarshallrecordthechangeofmaritalstatusandanyconsequentchangeofnameofawomanina<br />

deedordocumentfiledinthedeedsregistryonwrittenapplicationbysuchwomanaccompaniedbytherelevant<br />

deedordocumentandprooftohissatisfactionofsuchchangeofmaritalstatus.<br />

PARTIV<br />

REGISTRATIONOFLAND<br />

TransferofLand<br />

16 TransferofStateland<br />

(1) Theownershipof—<br />

(a) unalienatedStatelandheldunderacertificateofStatetitlereferredtoinsubsection(2)ofsectionseventeenshallbetransferredonlybydeedoftransferexecutedunderproperauthority;<br />

(b) anyotherunalienatedStatelandshall,subjecttotheprovisionsofsubsection(2),betransferredonlyby<br />

adeedofgrantissuedunderproperauthorityandhavingadiagramofthelandannexedthereto.<br />

(2) Itshallnotbenecessarytoannextoadeedreferredtoinparagraph(b)ofsubsection(1)adiagramofany<br />

landifadispensationcertificatehasbeenissuedinrespectofthatlandandthedeedcontainsareferencetothe<br />

generalplanonwhichthatlandisrepresented.<br />

17 RegistrationofrealrightsinStateland<br />

(1) NodeedpurportingtocreateordealwithordisposeofanyrealrightinanyunalienatedStateland,other<br />

thanadeedofgrant,shallbecapableofregistrationuntilacertificateofStatetitlehasbeenissuedinrespectof<br />

thatlandintermsofsubsection(2).<br />

(2) IfanyunalienatedStatelandhasbeensurveyedandisrepresentedonadiagram,aregistrarshall,upon<br />

writtenapplicationbytheMinisteraccompaniedbythediagramofthelandinduplicate,entertheparticularsof<br />

thelandin theappropriateregistersandexecuteintheprescribedformandinaccordancewiththediagrama<br />

certificateofStatetitlethereofpreparedbyaconveyancer.<br />

(3) If,inrelationtoanyStateland,adispensationcertificatehasbeenissued,aregistrarshall,uponwritten<br />

applicationbytheMinister,entertheparticularsofthelandintheappropriateregistersandexecuteintheprescribedformacertificateofStatetitlethereofpreparedbyanotarypublicandcontainingareferencetothegeneralplanonwhichthelandisrepresented.<br />

18 CancellationoftitledeedsondirectionofMinister<br />

(1) Subjecttotheprovisionsofthissection,theappropriateMinistermaydirectaregistrartocancelthetitle<br />

deedofanyland—<br />

(a) ownedbytheStateundertitledeed;or<br />

(b) inrespectofwhichtheStatehastherighttoclaimtransfer;andtheregistrarshallcomplywithsuch<br />

direction.<br />

(2) Beforeadirectionintermsofsubsection(1)isgiven—<br />

(a) theappropriateMinistershall—<br />

(i) givenoticeintermsofsubsection(3)ofhisintentiontogivesuchdirection;and<br />

(ii) considereveryobjectionlodgedinaccordancewiththenoticegivenintermsofsubsection(3);<br />

and<br />

(b) thenecessarystepsshallbetakentoextinguisheveryservitudeorotherencumbranceregisteredoverthe<br />

landconcerned.<br />

(3) Anoticereferredtoinparagraph(a)ofsubsection(2)shall—<br />

(a) bepublishedonceintheGazetteandonceaweekforthreeconsecutiveweeksinanewspapercirculatinginthedistrictwherethelandconcernedissituated;and


(b) statethattheappropriateMinisterproposestodirectaregistrarofdeedstocancelthetitledeedconcerned;and<br />

(c) describethelandconcerned,thedistrictinwhichthelandissituatedandthenumberofthetitledeedof<br />

theland;and<br />

(d) calluponanypersonwhohasanyobjectiontotheproposedcancellationtolodgehisobjectioninwritingwiththeappropriateMinisterwithinthirtydaysofthedateofthelastpublicationofthenoticein<br />

termsofparagraph(a).<br />

(4) Uponthecancellationofatitledeedofanylandintermsofsubsection(1)thelandshallbecomeunalienatedStatelandandthenecessaryentriesandendorsementsintherecordsofthedeedsregistryconcernedshallbe<br />

made.<br />

(5) Inthissection—<br />

“appropriateMinister”means—<br />

(a) theMinisterempoweredtodealwiththelandinquestion;or<br />

(b) aVice-President,wherethatVice-Presidentisempoweredtodealwiththelandinquestion;<br />

asthecasemaybe.<br />

19 Formandmannerofexecutionofdeedsoftransfer<br />

<strong>Deeds</strong>oftransfershallbepreparedintheformprescribedbylaworbyregulationorinsuchotherformasthe<br />

registrarmayineachcaseapprove,and,saveasinthis<strong>Act</strong>oranyotherenactmentprovidedorasorderedbythe<br />

courtinrespectofdeedsoftransferexecutedbytheregistrar,shallbeexecutedinthepresenceoftheregistrarby<br />

theownerofthelanddescribedorbyanotarypublicauthorizedbypowerofattorneybytheowner,andshallbe<br />

attestedbytheregistrar.<br />

<strong>20</strong> Particularsrequiredineverydeed<br />

Everydeedconferringtitletolandshallcontainthefollowingparticularsinadditiontothedescriptionand<br />

areaofthelandconcerned—<br />

(a) thedateandnumberofthegrant,transferorothertitletowhich—<br />

(i) ifsuchbethecase,thediagramofthelandisannexedorrelates;<br />

(ii) ifsuchbethecase,thediagramofthelandwould,butfortheissueofadispensationcertificate,<br />

beannexedorrelated;<br />

(b) ifadispensationcertificatehasbeenissuedinrespectoftheland,areferencetothegeneralplanconcerned;<br />

(c) thenameofthepersoninwhosefavourthegrant,transferandothertitledeedreferredtoinparagraph<br />

(a)wasmade;<br />

(d) thedateandnumberofthegrant,transferorothertitlebywhichthelandisheld;<br />

(e) thespecialconditions,ifany,containedinthetitledeedfromwhichthelandisbeingtransferred.<br />

21 Diagramdeeds<br />

(1) Noportionofanypieceoflandshallbetransferredexceptuponadiagramthereofandreferenceshallbe<br />

madetothatdiagraminthedeed.<br />

Providedthatnodiagramshallberequiredifadispensationcertificatehasbeenissuedinrespectoftheland<br />

concernedbutinsucheventthedeedshallcontainareferencetothegeneralplaninwhichthelandisrepresented.<br />

(2) Nodeedofgrantortransferorothertitleshallhavemorethanonediagramannexedthereto.<br />

(3) Onlythepieceoflanddescribedinthediagramannexedtoadeedofgrantortransferorothertitleshall<br />

beincludedinsuchdeed.<br />

22 Necessityfordiagramsdespiteissueofdispensationcertificate<br />

Whereadispensationcertificatehasbeenissuedinrespectofanyland,nosubdivisionofthatlandandno<br />

registrationoverthatlandofarealrightwhichisdefinedonadiagramshallberegisteredunlessadiagramofthat<br />

landisannexedtothetitledeedofthatland,anduponsuchregistrationtheregistrarshallendorseuponthattitle<br />

deedareferencetosuchdiagram.<br />

23 Transferfromjointestate<br />

Inanytransferlodgedinadeedsregistryrelatingtolandwhichisanassetinajointestate,thesurviving<br />

spouseshallbejoinedinhispersonalcapacitywiththeexecutoroftheestateofthedeceasedspouseexcept—<br />

(a) wheretheexecutorisonlydealingwiththeshareofthedeceasedspouse;or<br />

(b) wherethelandhasbeensoldtopaythedebtsofthejointestate;or<br />

(c) wheretherehasbeenamassingofthejointestateandthesurvivingspousehasadiated.<br />

24 Transferoftwoormorepiecesoflandbyonedeed<br />

(1) Wheretwoormorepersonseachownadifferentpieceofland,transferofsuchpiecesoflandtooneor<br />

morepersonsbythesamedeedoftransfershallnotbeeffectedunlesssuchtransferisauthorizedbyanorderof<br />

court.


(2) Subjecttotheprovisionsofsection twenty-one, twoormorepiecesoflandmaybetransferredbyone<br />

deedbyonepersonorbytwoormorepersonsholdingsuchpiecesoflandinundividedshares,toonepersonor<br />

twoormorepersonsacquiringsuchpiecesoflandinundividedshares,ifeachpieceoflandisdescribedina<br />

separateparagraph.<br />

25 Transferofundividedsharesinlandbyonedeed<br />

(1) Landheldbyonepersonmaybetransferredbyonedeedfromthatpersontotwoormorepersonsinundividedshares.<br />

(2) Landheldbytwoormorepersonsinundividedsharesmaybetransferredbyonedeedfromthosepersons<br />

toanyoneofthemortotwoormoreoftheminundividedsharesortoanyotherperson,ortotwoormoreother<br />

personsinundividedshares.<br />

(3) Whereapieceoflandistransferredbyseparatedeedsoftransferinundividedsharestheregistrarshall<br />

requiretobeaffixedtooneofsuchseparatedeedsstampsofthevaluewhichwouldinlawbenecessaryifthe<br />

landhadbeentransferredbyoneandthesamedeed.<br />

(4) Nofurtherorotherstampsorfees,exceptaregistrationfee,shallbepayable,buttheregistrarshallendorseuponeachoftheotherseparatedeedsanotethatthesaiddeedsoendorsedshallberegardedasfullyand<br />

completelystampedaccordingtolaw.<br />

26 Specialprovisionsrelatingtotransferofundividedshares<br />

(1) Notransferofanundividedshareinlandwhichisintendedorcalculatedtorepresentorpurportstorepresentadefinedportionoflandshallbecapableofbeingregistered.<br />

(2) Ifapieceoflandisownedbytwoormorepersonsinundividedsharesandoneormoreofsuchpersons<br />

acquirestheshareorsharesoftheremainingownerorownersinadefinedportionofthatpieceofland,allthe<br />

owners jointly, including the owner or owners acquiring the share or shares, maytransfersuchportiontothe<br />

personorpersonsacquiringit.<br />

27 Specialprovisionsrelatingtoundividedshareswithexclusiverightofoccupation<br />

(1) Subjecttotheprovisionsofthissection,if—<br />

(a) theownerofapieceoflandinanurbanareawishestotransfertooneormorepersonsanundivided<br />

shareinthelandcoupledwithanexclusiverightofoccupation;or<br />

(b) twoormorepersonswhoownbyseparatetitledeedundividedsharesinapieceoflandinanurbanarea<br />

wishtoassigntotheownerorownersofeachsuchshare,inconjunctionwiththeundividedshare,an<br />

exclusiverightofoccupation;<br />

the owner orowners,asthecasemaybe,shallregisteragainstthetitletothelandconcernedanotarialdeed<br />

which—<br />

(i) specifiesthenumberofundividedsharescreatedortobecreatedwhichwillbecoupledwithan<br />

exclusiverightofoccupation;and<br />

(ii) clearlyindicateswhichbuildingsorportionsofanybuildingerectedortobeerectedontheland<br />

concerned,eitherwithorwithoutanyareaofground,shallbesubjecttoanexclusiverightof<br />

occupation;and<br />

(iii) clearlyindicatesbymeansofdistinctivenumberswhichsharesreferredtoinsubparagraph(i)<br />

arecoupledwithwhichbuildingsorportionsofabuildingreferredtoinsubparagraph(ii);and<br />

(iv) definesthereciprocalrightsandobligationsapplicabletotheownersoftheundividedshares;<br />

and<br />

(v) provides for the administrationandmaintenanceofthelandconcernedandbuildingsthereon<br />

andtheliabilityforrates,expensesandchargesrelatingthereto;and<br />

(vi) subjecttosubsection(3),providesforthemannerinwhichthenotarialdeedmaybeamended.<br />

(2) Theprovisionsofanotarialdeedregisteredintermsofsubsection (1),asamendedfromtimetotime,<br />

shallbebindingonallownersofundividedsharesinthelandconcernedandontheirsuccessorsintitle.<br />

(3) Anotarialdeedregisteredintermsofsubsection(1)maybeamendedfromtimetotimebyfurthernotarialdeedinaccordancewiththeprovisionsthereofreferredtoinsubparagraph(vi)ofsubsection(1):<br />

Providedthat—<br />

(i) subparagraph(vi)shallnotbeconstruedasauthorizinganyamendmenttheeffectofwhichwouldbeto<br />

alterthenumberofundividedsharesinthelandconcernedwhicharecoupledwithanexclusiverightof<br />

occupation,unless<br />

(a) theownerofeachsuchsharehasconsentedtothealterationinthenumberofsuchshares;and<br />

(b) theDirectorofPhysicalPlanninghasapprovedthealterationinthenumberofsuchshares.;<br />

[Paragraphsubstitutedbysection2of<strong>Act</strong>5of1998]<br />

(ii) nosuchamendmentshallbeofforceoreffectuntilithasbeenregistered.<br />

(4) Whereanundividedshareinlandsuchasisreferredtoinsubsection (1)iscoupledwithanexclusive<br />

rightofoccupation—


(a) theyshallbedealtwithasoneentityandtheundividedshareandtheexclusiverightofoccupationshall<br />

notbecapableofbeingregisteredseparately;and<br />

(b) theymaynotatanytimebeheldbyvirtueofmorethanonetitledeed;and<br />

(c) theexclusiverightofoccupationshallconstitutearealrightintheland.<br />

(5) Wheretheshareofaco-ownerofanundividedshareinlandsuchasisreferredtoinsubsection(1)which<br />

iscoupledwithanexclusiverightofoccupationistransferred—<br />

(a) thedeedrelatingtothetransferofsuchshareshallberegisteredinthenamesofthenewco-ownerand<br />

oftheremainingco-owners;and<br />

(b) itshallnotbenecessaryfortheremainingco-ownerstojoininthepassingoftransfer.<br />

(5a) No transfer of an undivided share in land such as isreferredtoinsubsection (1) shallberegistered<br />

unlessthereisproducedtotheRegistraracertificatewhich<br />

(a) is signed byor on behalf the person responsible for the administration and maintenance of the land<br />

concernedandanybuildingsthereon;and<br />

(b) certifiesthat,inrespectoftheshareconcerned,therearenoleviesdueandpayabletothepersonreferred<br />

toinparagraph(a)orarrangementsforthepaymentofanysuchlevieshavebeenmadetotheperson's<br />

satisfaction:<br />

Providedthat,wheretheconveyancerdeposesinanaffidavitsubmittedtotheRegistrarthathehas,inwriting,<br />

requested the person responsible for the administration and maintenance of the land concerned and any<br />

buildingsthereontostateinwriting,withinthirtydaysoftherequest,whetherornotallsuchlevieshavebeen<br />

paidorwhetherornotsatisfactoryarrangementsfortheirpaymenthavebeenmade,andthathehashadnoresponseforthirtydaysthereafter,theRegistrarmaypasstransferwithouttheproductionofthecertificatereferred<br />

tointhissubsection.<br />

[Subsectioninsertedbysection2of<strong>Act</strong>5of1998]<br />

(6) Undividedsharesinlandsuchasarereferredtoinsubsection(1)whicharecoupledwithanexclusive<br />

rightofoccupationshallnotberegardedassubdivisionsofthelandconcernedforthepurposesoftheRegional,<br />

TownandCountryPlanning<strong>Act</strong>[<strong>Chapter</strong>29:12]oranyotherenactment.<br />

(7) Anotarialdeed—<br />

(a) suchasisreferredtoinsubsection(1),maynotberegisteredinrespectofanylandwhichishypothecatedunderaregisteredmortgagebondunlesstheconsentinwriting,signedbytheholderofsuchbond,<br />

totheregistrationofthenotarialdeedisproducedtotheregistrar;or<br />

(b) whichamendsanotarialdeedthatisregisteredintermsofsubsection(1)inrespectofanylandwhichis<br />

hypothecatedoranundividedshareinwhichishypothecatedunderaregisteredmortgagebond,maynot<br />

beregisteredunlesstheconsentinwriting,signedbytheholderofsuchbond,totheregistrationofthe<br />

notarialdeedisproducedtotheregistrar.<br />

(8) Inthissection—<br />

“exclusiverightofoccupation”,inrelationtoanundividedshareinapieceoflandinanurbanarea,means<br />

therightoftheownerofthatundividedsharetooccupy,totheexclusionofeveryotherownerofanundividedshareinthelandconcerned,aspecificbuildingorpartofanybuildingonthelandconcerned,eitherwithorwithoutanyareaofground;<br />

“urbanarea”means—<br />

(a) anytownship;and<br />

(b) anyareawhichisdeclaredbytheMinister,bystatutoryinstrument,tobeanurbanareaforthe<br />

purposesofthissection.<br />

28 Transfertounascertainedchildren<br />

(1) Iflandisdonatedorbequeathedtothechildrenbornortobebornofanypersonorofanymarriage,<br />

transferofthelandonbehalfofsuchchildrenmaybepassed,inthecaseofchildrenbornortobebornofa<br />

person,tothatpersonand,inthecaseofchildrenbornortobebornofamarriage,tothepersonwhowouldbethe<br />

naturalguardianofthosechildrenduringtheirminority.<br />

(2) Iflandisdonatedtothechildrenbornortobebornofanypersonorofanymarriage,thepersontowhom<br />

transfermaybepassedintermsofsubsection(1)may,forthepurposesofsuchtransfer,acceptthedonation.<br />

(3) Whentheidentityofallsuchchildrenhasbeenestablishedtheregistrarshallmakeanendorsementonthe<br />

transferdeedsettingouttheirnames,whereuponthetransferdeedshallbedeemedtobetoandinfavourofsuch<br />

29 <strong>Deeds</strong>ofpartitiontransfer<br />

(1) Iftwoormorepersonswhoowninundividedsharesthewholeofanypieceorpiecesoflandhaveagreed<br />

topartitionthatland,theregistrarshall,onproductiontohimofapowerofattorneybysuchpersonsauthorizing<br />

thepassingofdeedsofpartitiontransferofsuchlandinaccordancewiththeagreementofpartition,whichagreementshallbeembodiedinthepowerofattorneyorannexedthereto,andoncompliancewiththefurtherprovi-


sionsofthissection,attestdeedsofpartitiontransferwhichshallbeasnearlyaspracticableintheprescribed<br />

form,conveyingtotherespectiveownersthelandorsharesthereinawardedtothemunderthesaidagreement.<br />

(2) Inthepowerofattorneyoragreementofpartitionreferredtoinsubsection(1)thereshallbedescribed—<br />

(a) thelandtobepartitioned;and<br />

(b) theshareorsharesregisteredinthenameofeachjointowner;and<br />

(c) thelandorsharethereinawardedtoeachoftheownersand<br />

(d) theconditions,ifany,affectinganylandorsharethereinsoawarded;and<br />

(e) theconsideration,ifany,givenforthepurposeofequalizingthepartition.<br />

(3) Thereshallalsobeproducedtotheregistrarthetitledeedsofthelandtobepartitionedandthenecessary<br />

diagrams,butnonewdiagramneedbeproducedinrespectofthewholeorremainingextentofanyofthepieces<br />

oflandtobepartitioned.<br />

(4) Subjecttothissection,sections nineteen,twenty,twenty-one, twenty-three, twenty-fourandtwenty-five<br />

shallapply,mutatismutandis,inrespectofdeedsofpartitiontransfer.<br />

(5) Anydeedofpartitiontransferattestedundersubsection(1)shall,inrespectofthelandthereindescribed,<br />

taketheplaceofthedeedordeedsbywhichitwaspreviouslyheld,butthepartitiontransfershallnotvaryor<br />

affecttheconditionsoftenureofthesaidlandoranyconditionsimposedunderanylaworanyotherconditions<br />

affectingthesaidlandgenerally,saveinsofarassuchlast-mentionedconditionsmaybevaried,definedorlimitedbytheagreementofpartitionortheconsentsoftheinterestedparties.<br />

(6) Thissectionshallapply,mutatismutandis,toapartitionoflandorderedbythecourtordeterminedbyan<br />

awardofarbitrators.<br />

30 Requisiteswhereshareinlandpartitionedismortgaged<br />

(1) Iftheshareorsharesownedbyanyofthepartiestoapartitionaremortgaged.thepartitiontransfersshall<br />

notbeattestedunlessthebondisproducedtotheregistrar,togetherwiththewrittenconsentofthelegalholderof<br />

thebondtothepartitionandtothesubstitutionofthelandawardedonpartitiontothemortgagorfortheshareor<br />

sharesmortgaged.<br />

(2) Inregisteringthetransfer,theregistrarshall—<br />

(a) endorseonthebondthatthelandawardedtothemortgagorhasbeensubstitutedfortheshareorshares<br />

mortgaged;and<br />

(b) makeanentryofthesubstitutionintheregisters;and<br />

(c) endorseonthetransferthatthelanddescribedthereinis,inaccordancewiththissection,mortgagedby<br />

thebond.<br />

(3) Ifonlyafractionoftheshareorsharesownedbyanyofthepartiestoapartitionismortgaged,thesubstitutionreferredtointhissectionshallonlytakeplaceinrespectofthefractionsomortgaged,iffromtheagreement<br />

ofpartitionorfromotherevidenceitappearsthatadefinedportionorsharethereinhasbeenseparatelyawarded<br />

inrespectofsuchmortgagedfraction.<br />

(4) Wheremorethanonepropertyispartitionedbythesamepartitionandthewholeofanyoneormoreof<br />

thepropertiesaffectedisawardedtoanowner,suchpropertyorpropertiesmaybesubstitutedunderthatowner’s<br />

bond,ifthebondisoverhisshareinallthepropertiespartitioned.<br />

31 Requisiteswhereshareinlandpartitionedissubjecttootherrights<br />

(1) Iftheshareorsharesownedbyanyofthepartiestoapartitionappearfromthetitledeedsofthelandpartitionedtobesubjecttoalease,personalservitudeorrealright,thewrittenconsentoftheholderthereof,together<br />

withthedeed,ifany,bywhichthelease,servitudeorrealrightisheld,shallbeproducedtotheregistrar.<br />

(2) Thelanddescribedinthedeedsofpartitiontransfershallbemadesubjecttothelease,servitudeorreal<br />

right,tothesameextentastheshareorsharesforwhichitissubstituted,andthedeed,ifany,bywhichthelease,<br />

servitudeorrealrightisheld,shallbeendorsedbytheregistrarinthesamemannerasthebondmentionedin<br />

sectionthirty.<br />

(3) Ifthereexistsanybondbywhichthelease,servitudeorrealrightisitselfmortgaged,thatbondshallalso<br />

beproducedtotheregistrar,togetherwiththewrittenconsentofthelegalholderthereof,andtheregistrarshall<br />

maketheendorsementsandentriesmentionedinsection thirtyonthebondandthedeedsconcernedandinthe<br />

registers.<br />

32 Effectofcompliancewithsections30and31<br />

Uponcompletionoftheendorsementsandentriesmentionedinsections thirty andthirty-onethelanddescribedinthedeedsofpartitiontransfer,andthelease,personalservitudeorrealright,ifany,shallbedeemedas<br />

fullyandeffectuallymortgagedasiftheyhadbeenhypothecatedbythebondatthetimeofitsexecution,andthe<br />

saidlandshallbedeemedtobeasfullyandeffectuallyencumberedbythesaidlease,personalservitudeorreal<br />

rightasifithadbeenencumberedtherebyatthetimeoftheregistrationthereof.


33 Partitionoflandsubjecttofideicommissum<br />

(1) Anypieceofland,thewholeoranyshareofwhichissubjecttoafideicommissum,may,wherepartition<br />

hasnotbeenprohibited,bepartitionedonproduction—<br />

(a) wherethefideicommissaryheirsareascertained—<br />

(i) ofthewrittenconsentofthosewhoaremajorsandotherwisecompetent;<br />

(ii) ofthewrittenconsentofthetrustees,curatorsorotherlegalrepresentativesofthosewhorespectivelyhavebeendeclaredinsolventorareundercuratorshiporotherwiseunderdisability;<br />

(b) wherethefideicommissaryheirsorsuccessorsarenotascertainedorwheretheycannotbefound,of<br />

prooftothesatisfactionoftheregistrarthatthelandawardedintheagreementofpartitiontotheowner<br />

ofanysharesubjecttothefideicommissumisanequivalentofthatshare.<br />

(2) Thelandsoawardedshall,inthedeedofpartitiontransfer,bemadesubjecttothefideicommissuminthe<br />

samemannerasthecorrespondingsharewasinitstitledeedmadesubjecttheretobeforepartition.<br />

SubstitutedTitle<strong>Deeds</strong><br />

34 Certificateofregisteredtitleofundividedshare<br />

(1) Anypersonwhoisthejointownerofapieceofland,thewholeoforsharesinwhichisorareheldby<br />

suchpersonandothersunderonetitledeed,may,subjecttotheprovisionsofsectionthirty-five,obtainacertificateofregisteredtitleofhisundividedshareinsuchland,andnotransferofafractiononlyofhisundividedshare<br />

orhypothecationorleaseofthewholeoranyfractionofhisundividedshareinthelandshallberegisteredina<br />

deedsregistryunlessacertificateofregisteredtitleofsuchundividedshareisproducedtotheregistrar:<br />

Providedthatallthejointownerssoholdingunderonetitledeedmaytogethertransferanundividedsharein<br />

thelandorafractionoftheshareheldundersuchdeedorhypothecateoreffecttheregistrationofaleaseofthe<br />

wholeofsuchlandorsharewithouttheproductionofsuchacertificate.<br />

(2) Ifthetitledeedunderwhichlandis,orsharesthereinare,heldinjointownershipislostordestroyed,any<br />

joint owner may, upon compliance with the prescribed requirements, obtain a certificate of registered title in<br />

respectofhisshareinthelandwithoutobtainingacertifiedcopyofthedeedwhichhasbeenlostordestroyed.<br />

(3) Theprovisionsofsubsections (1)and(2)shallapplyalsowheretwoormorepiecesoflandorshares<br />

thereinareheldinjointownershipbythesametitledeed,butallthepiecesoflandorthesharesthereinshallbe<br />

includedinthecertificateofregisteredtitleandshallbedescribedinseparateparagraphs.<br />

(4) Theprovisionsofthissectionshallnotapplyinrelationtoanundividedshareinlandsuchasisreferred<br />

toinsubsection(1)ofsectiontwenty-sevenwhichiscoupledwithanexclusiverightofoccupationasdefinedin<br />

subsection(8)ofthatsection.<br />

35 Certificateofregisteredtitleofaggregateshare<br />

(1) Anypersonwhois,byvirtueofmorethanonetitledeed,theownerofundividedsharesinoneormore<br />

thanonepieceoflandmay,subjecttotheprovisionsofsectionthirty-seven,obtainacertificateofregisteredtitle<br />

inrespectofhisaggregatesharesintheland,andiftherearetwoormorepiecesoflandtheseveralpiecesofland<br />

orsharesthereinshallbedescribedinseparateparagraphs.<br />

(2) Theprovisionsofsubsection(1)shallnotapplyinrelationtoanundividedsharesuchasisreferredtoin<br />

subsection(1)ofsectiontwenty-sevenwhichiscoupledwithanexclusiverightofoccupationasdefinedinsubsection(8)ofthatsection.<br />

36 Certificateofregisteredtitleofoneormorepropertiesheldunderonedeed<br />

(1) Anypersonwhoholdstwo ormorepiecesofland,orundividedsharestherein,byonetitledeedmay,<br />

subjecttotheprovisionsofsectionthirty-seven,obtainacertificateofregisteredtitleinrespectofoneormoreof<br />

suchpiecesoflandoroftheundividedshareorsharesheldbyhimthereinifatleastoneofthepiecesoflandor<br />

thesharethereinheldbysuchdeedremainsheldthereby.<br />

(2) Subsection(1)shallnotapplyinrelationtoanundividedsharesuchasisreferredtoinsubsection(1)of<br />

section twenty-sevenwhichiscoupledwithanexclusiverightofoccupationasdefinedinsubsection(8)ofthat<br />

section.<br />

37 Conditionsgoverningissueofcertificatesofregisteredtitle<br />

(1) Acertificateofregisteredtitlementionedinsectionthirty-four,thirty-fiveorthirty-sixmaybeobtained<br />

uponwrittenapplicationbytheownertotheregistraraccompanied,saveasprovidedinsubsection(2)ofsection<br />

thirty-four,bythetitledeedoftheland,andshallbeasnearlyaspracticableintheprescribedform.<br />

(2) Ifthepropertyconcernedissubjecttoaregisteredmortgagebondortoanyregistereddeedofleaseor<br />

otherregistereddeedwherebyanyrealrightsinthelandareheldbyotherpersons,thatbondorotherdeedshall<br />

beproducedtotheregistrarbytheholderthereofupontherequestandattheexpenseoftheapplicantforthe<br />

certificateofregisteredtitle.<br />

(3) Beforeissuinganysuchcertificatetheregistrarshallcausetobemadeuponthetitledeedordeedsin<br />

questionandtheregistryduplicatesthereofor,inthecasereferredtoinsubsection(2)ofsectionthirty-four,upon<br />

theregistryduplicateonly,anduponthemortgagebondorotherdeed,ifany,anendorsementthatacertificateof


egisteredtitlehas,inaccordancewiththeappropriatesectionof this<strong>Act</strong>,beensubstitutedforthesaidtitledeed<br />

ordeedsinrespectofthepropertyinquestion.Theregistrarshallfurthermakeentriesintheregistersoftheissue<br />

ofthecertificateandshall,ifthepropertyismortgaged,endorsethatfactuponthecertificate.<br />

(4) Anysuchcertificatewhenissuedshall,inrespectofthepropertydescribedtherein,taketheplaceofthe<br />

titledeedordeedsbywhichsuchpropertywaspreviouslyheld,andtheissueofthecertificateshallnotinany<br />

manneraffectanyrightorobligationinconnexionwithsuchproperty.<br />

38 Certificateofregisteredtitletakingplaceoflostordestroyeddeed<br />

(1) Ifthetitledeedofanylandhasbeenlostordestroyedandtheregistryduplicateofsuchtitledeedhasalso<br />

beenlostlostordestroyed,theregistrarshall,onwrittenapplicationbytheowneroftheland,accompaniedbya<br />

diagramoftheland,ifnodiagramthereofisfiledintheregistryorintheofficeoftheSurveyor-General,execute<br />

acertificateofregisteredtitleinrespectofsuchlandinaccordancewiththediagramoftheland.<br />

Providedthat,whereadispensationcertificatehasbeenissuedinrespectofthelandconcerned,adiagramof<br />

thatlandshallnotberequired.<br />

(2) Beforeissuingthecertificatetheregistrarshall,attheexpenseoftheapplicant,publishintheprescribed<br />

formnoticeofintentiontoissuethecertificateintwoconsecutiveordinaryissuesoftheGazetteandintwoconsecutiveissuesofanewspapercirculatinginthedistrictinwhichthelandissituate.<br />

(3) Adraftoftheproposedcertificateandacopyofthediagram,ifany,accompanyingtheapplication,shall<br />

beopenforinspectionintheregistryfreeofchargebyanyinterestedpersonforaperiodofsixweeksafterthe<br />

dateofthefirstpublicationofthenoticeintheGazette,duringwhichperiodanypersoninterestedmayobjectto<br />

theissueofthecertificate.<br />

(4) Anypersonwhohaslodgedwiththeregistraranobjectiontotheissueofthecertificatemay,indefaultof<br />

anyarrangementbetweenhimandtheapplicant,applytothecourtwithinonemonthafterthelastdayuponwhich<br />

anobjectionmaybelodged,foranorderprohibitingtheregistrarfromissuingthecertificate,andthecourtmay<br />

makesuchorderontheapplicationasitmaydeemfit.<br />

(5) Acertificateofregisteredtitleissuedunderthissectionshallbeasnearlyaspracticableintheprescribed<br />

formandshalltaketheplaceofthelostordestroyedtitledeedandshallembodyorrefertoeverycondition,<br />

servitude, bond,leaseorotherencumbrancewhich,accordingtotherecordsoftheregistry,wasembodiedor<br />

referredtointhelostordestroyedtitledeedorinanyendorsementthereon.<br />

39 Certificateofregisteredtitletocorrecterrorinregistration<br />

(1) Ifbyreasonofanerrorthesamelandhasbeenregisteredinthenamesofdifferentpersons,theregistrar<br />

may,upontransferofthelandbeingmadetooneofthembytheotherorothers,issuetothepersontowhom<br />

transferissogivenacertificateofregisteredtitleofthelandheldbyhimunderthevarioustitledeeds.<br />

(2) Sectionthirty-fiveshallapply,mutatismutandis,inrespectoftheissueofsuchcertificate.<br />

40 Certificateofconsolidatedtitleoftwoormorepiecesofland<br />

(1) IfadiagramhasbeenframedandapprovedundertheprovisionsoftheLandSurvey<strong>Act</strong>[<strong>Chapter</strong><strong>20</strong>:12],<br />

andsuchdiagramrepresentstwoormorepiecesoflandwhichare—<br />

(a) contiguoustoeachother;and<br />

(b) ownedbythesamepersonorbytwoormorepersonsinthesameundividedsharesineachsuchpieceof<br />

land;and<br />

(c) situatewhollywithinoneoftheareasdefinedintheSchedule;<br />

thetitledeedordeedsofthesaidpiecesoflandmay,oncompliancewiththerequirementsofthissectionand<br />

subjecttotheprovisionsofPartVIoftheRegional,TownandCountryPlanning<strong>Act</strong>[<strong>Chapter</strong>29:12]besupersededbyacertificateofconsolidatedtitleissuedbytheregistrarintheprescribedform.<br />

(2) Everysuchcertificateshallbeinaccordancewiththenewdiagramandshallbeissuedonwrittenapplicationbytheownerorownersofthepiecesoflandconcerned.Everysuchapplicationshallbeaccompaniedbythe<br />

titledeedordeedsunderwhichheortheyholdtheland,togetherwiththediagramdeedsthereof,unlessadispensationcertificatehasbeenissuedwhichrelatestothelandconcerned,(orintheeventofthelossordestructionof<br />

suchdiagramdeedsheortheyshallsatisfytheregistrarofthefact),anybondthereonandanyregistereddeedof<br />

leaseorotherregistereddeedwherebyanyrealrightinthelandisheldbyanyotherperson,togetherwiththe<br />

writtenconsentoftheholderofanysuchbond,leaseorright.<br />

(3) Inregisteringthecertificatetheregistrarshallendorseonthetitledeedordeedsthattheyhave,inrespect<br />

of the land described in the certificate, been superseded bythe certificate,andonthecertificatethattheland<br />

thereindescribedorthesharethereofreferredtoinsuchendorsementismortgagedbysuchbondorsubjectto<br />

suchleaseorright,unlessthisappearsfromthecertificateitself,andshallmakesuchendorsementsonthebondor<br />

otherdeedandsuchentriesintheregistersasshallclearlyindicatethatthelandisnowownedbyvirtueofthe<br />

certificateandthatthelandorsuchsharethereofissubjecttosuchbond,leaseorright.<br />

(4) Ifportiononlyofthelandrepresentedonthenewdiagramismortgagedorifdifferentportionsofsuch<br />

landaremortgagedunderdifferentbonds,thecertificatemaynotbeissuedunlessthebondsarecancelled:<br />

Providedthatonthewrittenapplicationoftheownerandwiththewrittenconsentof—


(a) themortgagee;or<br />

(b) wheredifferentportionsoflandaremortgagedunderdifferentbonds,themortgageesandtheirwritten<br />

agreementastotheorderofpreferenceoftheirmortgagebondsafterconsolidationoftheland;<br />

thecertificatemaybeissuedsubjecttothebondorbondsandallthelandincludedinthenewdiagrammaybe<br />

substitutedforthelandoriginallymortgagedunderthebondorbonds.<br />

(5) Ifportiononlyofthesaidlandissubjecttoanyregistereddeedofleaseorotherregistereddeedother<br />

thanabond,wherebyanyrealrightinthelandisheldbyanyotherperson,thecertificateshallnotbeissued<br />

unlessadiagramof suchportionisalreadyannexedtothesaidregistereddeed,orifnosuchdiagramissoannexed,unlessadiagraminduplicate(ortriplicateifrequiredbytheregistrar)ofsuchportionisproduced:<br />

Providedthatitshallnotbenecessarytoproduceadiagramofsuchportionifthediagramoftheconsolidated<br />

landshowsthatportionbydottedlinesorinsuchotherwayastoidentifyit.<br />

(6) Thediagrammentionedinsubsection(5)shallbeannexedtotheregistereddeedreferredtointhatsubsectionandtheregisteredduplicatethereof,andshallbementionedinanyendorsementmadeonorreference<br />

madeinthecertificateconcerningsuchregistereddeed.<br />

41 Certificateofregisteredtitleofportionofpieceofland<br />

(1) Ifadefinedportionofapieceoflandhasbeensurveyed,theregistrarmay,ontheapplicationinwriting<br />

bytheownerofthelandandsubjecttoPartVIoftheRegional,TownandCountryPlanning<strong>Act</strong>[<strong>Chapter</strong>29:12]<br />

issueacertificateofregisteredtitleinrespectofsuchportionoflandasnearlyaspracticableintheprescribed<br />

form.<br />

(2) Anapplicationintermsofsubsection(1)shallbeaccompaniedby—<br />

(a) thetitledeedofthelandconcerned;and<br />

(b) adiagramwhichhasbeenframedandapprovedundertheLandSurvey<strong>Act</strong>[<strong>Chapter</strong><strong>20</strong>:12]representingtheportionoflandconcerned:<br />

Providedthatnodiagramshallberequiredifadispensationcertificatehasbeenissuedinrespectof<br />

thelandandthecertificateofregisteredtitlecontainsareferencetothegeneralplanonwhichthedefinedportionofthepieceoflandisrepresented;and<br />

(c) anyregisteredbond,registereddeedofleaseorotherregistereddeedwherebyanyrealrightintheland<br />

concernedisheldbyanypersontogetherwiththewrittenconsentoftheholderofanysuchbond,lease<br />

orright.<br />

(3) Inregisteringthecertificatetheregistrarshallendorseonthetitledeedthatithasbeensupersededbythe<br />

certificateinrespectofthelanddescribedinthecertificate,andonthecertificatethatthelanddescribedthereinis<br />

mortgagedbythebondorthatitissubjecttosuchleaseorright,unlessthisappearsfromthecertificateitself,and<br />

shallmakesuchendorsementsonthebondandotherdeedandsuchentriesintheregistersasshallclearlyindicate<br />

thatthelandisnowownedbyvirtueofthecertificateandissubjecttosuchbond,leaseorright.<br />

(4) Nodefinedportionofapieceoflandshallbemortgageduntiltheownerthereofhasobtainedacertificate<br />

ofregisteredtitleinrespectofsuchportioninaccordancewiththeprovisionsfthissection.<br />

RectificationofTitlebyEndorsement<br />

42 Rectificationoftitlebyendorsement<br />

(1) Ifrectificationoftitleisrequiredinrespectofanypieceoflandinconsequenceofanysurveyorresurveyor<br />

the correction of anyerror in the diagram thereof under the Land Survey<strong>Act</strong> [<strong>Chapter</strong><strong>20</strong>:12], the<br />

registrarmay,onwrittenapplicationbytheownerofthelandaccompaniedby—<br />

(a) thetitledeed;and<br />

(b) theneworthecorrecteddiagramthereof;and<br />

(c) anybondthereon;and<br />

(d) anyregistereddeedofleaseorotherregistereddeedwherebyanyrealrightthereinisheldbyanyother<br />

person;and<br />

(e) thewrittenconsentoftheholderofsuchbond,leaseorright;<br />

endorseonthetitledeedadescriptionofthelandaccordingtotheneworcorrecteddiagram,whichdescription<br />

shallsupersedethedescriptionalreadyappearinginthetitledeed.<br />

(2) Ifanewdiagramisproduced,theregistrarshall,inmakingthesaidendorsement,substitutethenewdiagramfortheoldone.<br />

43 Transferorcessionbymeansofendorsement<br />

(1) If immovable propertyor a bond is registered in a deeds registryin the name of the survivor of two<br />

spouseswhoweremarriedincommunityofpropertyorinthenameofthejointestateofsuchspousesandsuch<br />

survivorhaslawfullyacquiredtheshareofthedeceasedspouseinthepropertyorbond,theregistrarshall,on<br />

writtenapplicationbysuchsurvivorandbytheexecutorintheestateofthedeceasedspouse,accompaniedby<br />

suchotherdocumentsasmaybeprescribed,endorseonthetitledeedsofthepropertyoronthebondthatthe<br />

survivor is entitled to deal with such property or bond, and thereupon such survivor shall be entitled to deal


therewithasifhehadtakenformaltransferorcessionintohisownnameoftheshareofthedeceasedspousein<br />

thepropertyorbond.<br />

(2) Iftheimmovablepropertymentionedinsubsection(1)ishypothecatedunderaregisteredmortgagebond,<br />

theendorsementprovidedforinthatsubsectionshallnotbemadeunless—<br />

(a) suchbondiscancelled;or<br />

(b) theestateofthedeceasedspouseisreleasedfromliabilityunderthebond;or<br />

(c) thesaidbondhasbeenpassedbythesurvivoraloneandawrittenconsent(whichshallbeinduplicate,<br />

intheprescribedformandsignedbythesurvivorandthelegalholderofthebond)tothereleaseofthe<br />

estateofthedeceasedspousefromliabilityunderthebondandtothesubstitutionofthesurvivorassole<br />

debtorinrespectthereof,isproducedtotheregistrartogetherwiththebond.<br />

(3) Theregistrarshall,inanycaseofreleaseandsubstitutionintermsofparagraph (c) ofsubsection(2),<br />

whenheendorsesonthetitledeedsofthepropertythatthesurvivorisentitledtodealtherewith—<br />

(a) makeintheappropriateregisteranentrysettingforththattheestateofthedeceasedspouseisreleased<br />

fromliabilityinrespectoftheobligationsecuredbythebondandthatthesurvivorhasbecomesole<br />

debtorinrespectofthebond;and<br />

(b) annexoneduplicateofthewrittenconsentreferredtointhesaidparagraphtothebondandfiletheother<br />

withtheregistryduplicateofthebond;and<br />

(c) endorseonthebondthattheestateofthedeceasedspouseisreleasedfromliabilityinrespectofthe<br />

obligationsecuredtherebyandthatthesurvivorhasbecomesoledebtorinrespectofthebond.<br />

(4) Asfromthedateoftheendorsementonthetitledeedsofthepropertyintermsofsubsection(1),theestate<br />

of the deceased spouse shall be absolved fromanyobligationsecuredbythebondandthesurvivorshall<br />

becomesoledebtorinrespectthereofinthesamemannerasifhehadpassedthebondatthatdate.<br />

GeneralProvisions<br />

44 Executionofbonds<br />

(1) Amortgagebondshallbeexecutedinthepresenceoftheregistrar—<br />

(a) bytheowneroftheimmovablepropertythereindescribed;or<br />

(b) byanotarypublicdulyauthorizedbysuchownerbypowerofattorney;or<br />

(c) inthecaseofamortgagebondintendedtosecurealoanoradvancemade—<br />

(i) intermsofsubparagraph(i)ofparagraph(a)ofsubsection(1)ofsection<strong>20</strong>oftheAgricultural<br />

Finance<strong>Act</strong>[<strong>Chapter</strong>18:02];or<br />

(ii) fromafundadministeredundersection23ofthesaid<strong>Act</strong>;or<br />

(iii) intermsoftheAgriculturalAssistanceSchemesetoutintheThirdScheduletothesaid<strong>Act</strong>or<br />

anySchemeestablishedintermsofPartVIIofthesaid<strong>Act</strong>;<br />

byanypersonappointedforthepurposebytheCorporation,asdefinedintermsofsection2ofthesaid<strong>Act</strong>,who<br />

isdulyauthorizedbytheowneroftheimmovablepropertybypowerofattorney;<br />

andshallbeattestedbytheregistrar.<br />

(2) Abondmayberegisteredtosecureanexistingdebtorafuturedebtorbothexistingandfuturedebts.<br />

(3) Bonds intended to secure loans for building purposes shall be deemed to bebondstosecureexisting<br />

debts.<br />

(4) Ifinabondpurportingtosecureafuturedebttheamountofanexistingdebtismentioned,suchexisting<br />

debtshallbedeemedtobesecuredaspartofthemaximumamountintendedtobesecuredbythebond.<br />

(5) Saveasauthorizedbyanyotherenactmentoranorderofthecourt,debtsorobligationstomorethanone<br />

creditorarisingfromdifferentcausesshallnotbesecuredbyonebond.<br />

45 Requirementsincaseofbondsintendedtocoverfutureadvances<br />

Nodeedorinstrumentofhypothecation,whethergeneralorspecial,shallbeofanyforceoreffecttogiveany<br />

preferenceorprioritytothepaymentofanyadvances,debtsordemandsmadeoraccruingafterthe dateofthe<br />

registrationofsuchdeedorinstrumentunlessitisexpressedinsuchdeedorinstrumentthatitismeantorintendedtocoverorsecurefutureadvances,debtsordemandsgenerally,orsomeparticulardescriptionthereoftobe<br />

inthesaiddeedorinstrumentdescribed,andunlessalsosomecertainsumisexpressedinsuchdeedorinstrument<br />

asasumbeyondwhichsuchfutureadvances,debtsordemandsshallnotbedeemedtobecoveredorsecuredby<br />

thehypothecationmadeorcreatedbysuchdeedorinstrument.<br />

46 Cessionofbondtosecurefutureadvances<br />

Acessionofabondpassedtosecurefutureadvancesmayberegisteredandtheregistrationofsuchacession<br />

shallnotaffecttheprovisionsofthebondrelatingtofutureadvancesuptotheamountstatedinthebond.


47 Exclusionofgeneralclauseinmortgagebonds<br />

(1) Theregistrarshallnotattestanymortgagebondwhichpurportstobindmovablepropertyorwhichcontainstheclause,commonlyknownasthegeneralclause,purportingtobindgenerallyalltheimmovableormovablepropertyofthedebtororboth,andshallnotregisteranynotarialbondwhichpurportstobindimmovable<br />

property.<br />

(2) Nomortgagebondshallbepassedbytwoormoremortgagorsunlessitpurportstobindimmovablepropertyofeachmortgagor.<br />

48 Passingofbondsinfavourofagents<br />

(1) Subjecttothissection,nomortgagebondornotarialbondshallbepassedinfavourofanypersonasthe<br />

agentofaprincipal.<br />

(2) Acompany,otherthanaforeigncompanyasdefinedinsection2oftheCompanies<strong>Act</strong>[<strong>Chapter</strong>24:03],<br />

mayapplytoaregistrartorecordinaregisterkeptforsuchpurposethatthecompanyisabond-holdingcompany<br />

andsuchregistershallbeavailabletothepubliconpaymentoftheprescribedfee.<br />

(3) Abond-holdingcompanymayholdaparticipationbondastherepresentativeoftheparticipantstherein.<br />

(4) Abond-holdingcompanyshallkeepatitsregisteredofficearecordinrelationtoeachparticipationbond<br />

heldbyitofthenameofeachpersonentitledtoaparticipationinthebond.<br />

(5) Therealrightsconferredbytheregistrationofaparticipationbondshallbedeemedtobeheldbyeach<br />

participanttotheextentofhisparticipation,whetherthebondwasaparticipationbondatthetimeofitsregistrationornot:<br />

Providedthatthebond-holdingcompanyshallexercisetherightsoftheparticipantundertheparticipation<br />

bondonhisbehalf.<br />

(6) Thissectionshallapplytoanyparticipationbond,whetherregisteredbefore,onorafterthe31stDecember,1971.<br />

(7) Inthissection—<br />

“bond-holdingcompany”meansacompanywhosenameisrecordedintheregisterreferredtoinsubsection<br />

(2);<br />

“participant”,inrelationtoaparticipationbond,meansapersonwhoisspecifiedintherecordkeptbya<br />

bond-holdingcompanyintermsofsubsection(4)asbeingentitledtoaparticipationinaparticipation<br />

bond;<br />

“participation”meansashareoforalltherightssecuredunderaparticipationbond;<br />

“participationbond”meansamortgagebondornotarialbond,whetherdescribedasaparticipationbondor<br />

not,whichisheldbyabond-holdingcompanyasrepresentativeofthepersonsentitledtoparticipations<br />

therein.<br />

49 Requirementsincaseofbondspassedbyorinfavouroftwoormorepersons<br />

(1) Ifabondispassedbytwoormoremortgagors,noreleaseofonemortgagororofhispropertyfromthe<br />

bondmayberegisteredwithoutthewrittenconsentoftheothermortgagorormortgagors.<br />

(2) Nobondmaybepassedinfavouroftwoormorepersonsinwhichitisstipulatedthattheshareofone<br />

holdershallrankpriorinorderofpreferencetotheshareofanother,normayanytransactionberegisteredwhich<br />

wouldhavetheeffectofgivingpreferencetooneshareinabondoveranothershare.<br />

RightsofMortgagees<br />

50 Transferofhypothecatedproperty<br />

(1) Notransferofmortgagedlandshallbeattestedorexecutedbytheregistrar,andnocessionofamortgagedleaseofimmovableproperty,orofanymortgagedrealrightinland,shallberegistereduntilthebondhas<br />

beencancelledortheland,leaseorrighthasbeenreleasedfromtheoperationofthebondwiththeconsentin<br />

writingoftheholderthereof:<br />

Providedthatnosuchcancellationorreleaseshallbenecessaryifthetransferorcessionismade—<br />

(a) inexecutionofthejudgmentofanycourtbythecompetentofficer;or<br />

(b) by—<br />

(i) thetrusteeofaninsolventestate;or<br />

(ii) theassigneeofanestateunderassignmentwherethedeedofassignmenthasbeenregisteredin<br />

termsofsubsection(2)ofsection157oftheInsolvency<strong>Act</strong>[<strong>Chapter</strong>6:04];or<br />

(iii) theliquidatorofacompanywhichisunabletopayitsdebtsandwhichisbeingwoundupbythe<br />

court;<br />

or<br />

(c) inanyothercircumstancesinthis<strong>Act</strong>providedorasorderedbythecourt.<br />

(2) Inthecaseofanytransferorcessionmadeinthecircumstancessetoutintheprovisotosubsection(1),<br />

thebondshallbeproducedtotheregistrarforendorsementofthecircumstancesofthetransferorcessionunless


thenotarypubliccausingtransferorcessiontobemadecertifiesthathehasbeenunabletoobtainpossessionof<br />

thebond.<br />

(3) Aconsenttothereleasefromtheoperationofabondofallthepropertymortgagedthereundershall,exceptwherethedebtsecuredbysuchbondisfurthersecuredbyacollateralbond,bedeemedtobeaconsenttothe<br />

cancellationofthatbond.<br />

51 Substitutionofdebtorinrespectofbond<br />

(1) Iftheowner(inthissectionreferredtoasthetransferor)oflandwhichishypothecatedunderaregistered<br />

mortgagebond,notbeingapersonreferredtoinparagraph(b)oftheprovisotosubsection(1)ofsectionfifty,has<br />

agreedtotransfertoanotherpersonthewholeofthelandandhasnotreservedanyrealrightinsuchland.the<br />

registrarmayregisterthetransferandsubstitutethetransfereeforthetransferorasdebtorinrespectofthebondif<br />

there is produced to him,induplicate,thewrittenconsentoftheholderofthebondandthetransfereetothe<br />

substitutionofthetransfereeforthetransferorasthedebtorinrespectofthebond.<br />

(2) Inregisteringthetransfertheregistrarshall—<br />

(a) makeintheappropriateregister—<br />

(i) anentrysettingforththatthedebtofthetransferorsecuredbythebondiscancelled;and<br />

(ii) anentrysettingforththatthetransfereehasbecomethedebtorinrespectofthebond;<br />

and<br />

(b) annexoneduplicateofthewrittenconsentreferredtoinsubsection(1)tothebondandfiletheother<br />

withtheregistryduplicatethereof;and<br />

(c) endorseuponthebond—<br />

(i) thenameofthetransferee;and<br />

(ii) thedateandnumberofthetransfer;and<br />

(iii) areferencetothesaidwrittenconsent;and<br />

(iv) thatthetransfereehasbeensubstitutedforthetransferorasdebtorinrespectofthebond;<br />

and<br />

(d) makeonthetransferdeedanendorsementofmortgagecontainingthedateandnumberofthebondand<br />

theamountdueintermsthereof.<br />

(3) Asfromthedateofthetransferdeedthetransferorshallbeabsolvedfromanyobligationsecuredbythe<br />

bondandthetransfereeshallbesubstitutedforhimasthedebtorinrespectofsuchbondandshallbeboundby<br />

thetermsthereofinthesamemannerasifhehadhimselfpassedthebondandhadrenouncedthereinthebenefit<br />

oftheexceptionsstatedtherein.<br />

(4) Subsections (1)to (3)shall apply, mutatis mutandis, to a real right in land, other than the ownership<br />

thereof,whichishypothecatedunderaregisteredmortgagebond.<br />

52 NoticebyMasterinconnectionwithinsolventestatesandfurtherprovisionsrelativeto<br />

insolventestates<br />

(1) Ifitappearsfromtheliquidationaccountofanyestatewhichhasbeensequestratedorfromthevouchers<br />

relatingtheretothatafinalpaymenthasbeenmadetoanycreditoronaccountofaregisteredbond,theMaster<br />

shallnotifythepaymentthereoftotheregistrarandshallsubmitsuchbondtotheregistrarforcancellation.The<br />

holderofthebondshall,whenrequestedtodosobytheMaster,deliverthebondtotheMaster.<br />

(2) Immovablepropertywhichhasvestedinatrusteeinaccordancewiththeprovisionsofthelawrelatingto<br />

insolvencyandwhichhasnot,intermsofthatlaw,beenre-vestedintheinsolvent,may,whetherbeforeorafter<br />

rehabilitationoftheinsolvent,betransferredonlybythetrustee,andmaynotaftersuchrehabilitationbetransferred,mortgagedorotherwisedealtwithbytheinsolventuntilithasbeentransferredtohimbythetrustee:<br />

Providedthatifafterrehabilitationthetrusteehasbeendischargedorthereisnotrusteeinexistence,theMastershall,ifsatisfiedthattherehabilitatedinsolventisentitledtotheproperty,givehimtransferthereofinsuch<br />

mannerasmaybeprescribed.<br />

(3) Ifbyvirtueoftheprovisionsofthelawrelatingtoinsolvencyaninsolventhasbeenre-investedwiththe<br />

ownershipofanyproperty,suchpropertymaynotbetransferred,mortgagedorotherwisedealtwithbytheinsolventuntilanendorsement,inthemannerprescribed,thatthepropertyhasbeenrestoredtohim,hasbeenmadeby<br />

theregistraronthetitledeedoftheproperty.<br />

(4) Nothingin thissectioncontainedshallbeconstruedasmodifyinganyprovisionofthelawrelatingto<br />

insolvency.<br />

(5) Theprovisionsofthissectionshallapply,mutatismutandis,inrespectof—<br />

(a) insolventdeceasedestates;and<br />

(b) companieswhichareunabletopaytheirdebtsandareliquidatedorwoundupbyorunderthesupervisionofthecourtunderthelawrelatingtocompanies.<br />

53 Endorsementofbondaftersaleofexecution<br />

Wheneveranymortgagedimmovablepropertyhasbeensoldinexecutionofajudgmentofacompetentcourt<br />

orunderexpressauthoritycontainedinaspecialenactment,tosatisfyanydebtdueinrespectofaregisteredbond


orotherwise,andtheproceedsofthesalehavebeenpaidtothelegalholderofthebond,thedeputysheriffor<br />

messenger concerned or the person acting under the authority of any such special enactment shall notify the<br />

registrarofanysuchsaleandshalltransmitthebondtotheregistrarforcancellationorreleaseintheeventof<br />

therebeingotherpropertiesmortgagedbythebond.Theholderofthebondshall,whenrequestedtodosobythe<br />

deputysherifformessengerorpersonactingundertheauthorityofsuchspecialenactment,deliverthebondtothe<br />

deputysheriff,messengerorperson,asthecasemaybe.<br />

54 Consentofbondholdertoregistrationofmergerofrightsofmortgagor<br />

Iftheholderofamortgagedleaseoflandorofmortgagedrealrightsinlandacquirestheownershipofthat<br />

land,oriftheholderofamortgagedleaseofrealrightsinlandacquiresthoserights,oriftheownerofmortgaged<br />

landwhichisentitledtorightsofservitudeoverotherlandacquirestheownershipofthatotherland,suchacquisitionoftheadditionallandorrightsshallnotberegisteredwithouttheconsentinwritingoftheholderofthebond.<br />

55 Wherenotarialbondtoberegistered<br />

(1) Everynotarialbondexecutedbefore,onorafterthe31stDecember,1971,shallberegisteredinadeeds<br />

registrywithintheperiodofthreemonthsafterthedateofitsexecutionorwithinsuchextendedperiodasthe<br />

courtmayonapplicationallow.<br />

(2) Asignedoriginalforfilingintheregistryastheregistryduplicate,togetherwithtwofurtheroriginalsor<br />

grossesorcopiesofthebondcertifiedbyanotarypublicshallbetenderedforregistration.Theregistrarwho<br />

registerssuchbondshalltransmittotheregistrarinchargeoftheotherdeedsregistryonesuchoriginal,grosseor<br />

copyofthebondforregistrationbyhim.<br />

RIGHTS1NIMMOVABLEPROPERTY<br />

General<br />

56 Restrictiononregistrationofrightsinimmovableproperty<br />

(1) Nodeed,orconditioninadeed,purportingtocreateorembodyinganypersonalrightinrespectofimmovablepropertyshallbecapableofregistration.<br />

(2) Noconditionimposedafterthe2ndJanuary,1960,purportingtorestricttheexerciseofanyrightofownershipinrespectofimmovablepropertyshallbeincludedinanytitledeedofsuchpropertytenderedforregistrationinanydeedsregistryunlesssuchconditioniscapableofbeingenforcedbysomepersonwhoismentionedin<br />

or, if not mentioned therein, is ascertainable from, the said title deed or from other evidence available to the<br />

registrar.<br />

(3) Subjecttosubsection(4),noconditionimposedafterthe1stNovember,1976,whichimposesinrespect<br />

ofimmovableproperty—<br />

(a) restrictionsonthesubdivisionoftheproperty;or<br />

(b) restrictionsonthepurposesforwhichthepropertymaybeused;or<br />

(c) anyrequirementstobecompliedwithortobeobservedinconnectionwiththeerectionofanybuilding<br />

ontheproperty;or<br />

(d) anyrestrictionorrequirementtobeobserved,notreferredtoinparagraph(a),(b)or(c),whichisthe<br />

subjectofcontrolunderanapprovedscheme,operativemasterplanoroperativelocalplanasdefinedin<br />

theRegional,TownandCountryPlanning<strong>Act</strong>[<strong>Chapter</strong>29:12]thatrelatestotheareainwhichthat<br />

propertyissituated;<br />

shallbeincludedinanytitledeedtosuchpropertytenderedforregistrationinanydeedsregistry.<br />

(4) Subsection(3)shallnotprecludetheregistrationofanycondition—<br />

(a) referredtoinparagraph(c)ofsubsection(3)whichisimposedbyapersonotherthantheState,acityor<br />

municipalcouncil,atowncouncil,aruraldistrictcounciloralocalboard;or<br />

(b) whichprovidesforrightsofaccessorsimilarmatters.<br />

(5) Subsection(3)shallnotbeconstruedasprecludingtheimpositionofanyconditionsuchasisreferredto<br />

inthatsubsectioninanyagreementrelatingtotheacquisitionofanyproperty.<br />

Servitudes<br />

57 Creationofservitudes<br />

(1) Saveasisprovidedinanyotherlaw,aservitudeinperpetuityorforalimitedperiodmay,subjecttosubsections(2),(3)and(4),becreated—<br />

(a) byadeedpreparedinaccordancewithsectionfifty-nine;or<br />

(b) inadeedofgrantortransferoflandwhereitencumbers—<br />

(i) thelandtransferred;or<br />

(ii) otherlandofwhichthetransferoristheownerinfavourofthelandtransferred.


(2) Beforeregisteringaservitudewhichisbeingcreatedintermsofparagraph(b)ofsubsection(1),aregistrarshall,wheretheservitudewhichisbeingcreatedencumbersthelandtransferred,requiretheacceptancein<br />

writingoftheownerofthelandinfavourofwhichorthepersoninwhosefavourthatservitudeisbeingcreatedif<br />

thatownerorpersonisnotthetransferor:<br />

Providedthat,wheretheservitudeisbeingcreatedinfavourofthepublicorofallorsomeoftheownersor<br />

occupiersofstandsorlotsinatownship,theregistrarmay,ifinhisopinionitisimpracticableforsuchpersonsto<br />

signifytheiracceptanceoftheservitude,dispensewithsuchacceptance.<br />

(3) Inregisteringanyservitudewhichisbeingcreatedintermsofsubsection(1),aregistrarshall—<br />

(a) wheretheservitudeisbeingcreatedintermsofparagraph(a)ofsubsection(1),endorsethetitledeed<br />

of—<br />

(i) thelandencumberedthereby;and<br />

(ii) anylandinfavourofwhichthatservitudeisbeingcreated;<br />

or<br />

(b) wheretheservitudeisbeingcreatedintermsofparagraph(b)ofsubsection(1) andthetitledeedin<br />

whichtheservitudeisbeingcreatedrelatesto—<br />

(i) thelandinfavourofwhichthatservitudeisbeingcreated,endorsethetitledeedoftheland<br />

encumberedthereby;or<br />

(ii) thelandencumberedthereby,endorsethetitledeedofanylandinfavourofwhichthatservitude<br />

isbeingcreated.<br />

(4) Ifthelandwhichistobeencumberedbyaservitudecreatedintermsofsubsection(1)ismortgagedor<br />

subjecttoanyotherrealrightwithwhichtheservitudemayconflict,theregistrarshallrequirethewrittenconsent<br />

oftheholderoftherightandtheproductionofthebondorotherregistereddeedinwhichtherightisregisteredor<br />

recorded.<br />

58 Requirementsforpreparationandsubmissionofdeedofservitude<br />

(1) Adeedofservitudeshall—<br />

(a) containafulldescriptionofanylandagainstorinfavourofwhichtheservitudeistoberegisteredor<br />

endorsed, including the numbers and dates of the title deeds, and the full namesofthegrantorand,<br />

wherepracticable,thegranteeoftheservitude;and<br />

(b) beexecutedbytheownerofthelandencumberedbytheservitudeandtheownerofthelandinfavourof<br />

whichorthepersoninwhosefavourtheservitudeisbeingcreated:<br />

Providedthat,wheretheservitudeisbeingcreatedinfavourofthepublicorofallorsomeofthe<br />

ownersoroccupiersofstandsorlotsinatownship,theregistrarmay,ifinhisopinionitisimpracticablefor<br />

suchpersonstoexecutethedeed,dispensewithsuchexecutionofthedeed;and<br />

(c) beattestedbyanotarypublic:<br />

Providedthatthisparagraphshallnotapplytoadeedofservitudesuchasisreferredtoinsectionsixty-three<br />

ifthesignatureofeachpersonexecutingthedeediswitnessedbytwocompetentwitnessesorbyacommissioner<br />

ofoathsandthesignature ofeachwitnessorthecommissionerofoaths,asthecasemaybe,hasbeenaffixed<br />

theretointhepresenceofthatperson.<br />

(2) Twosignedoriginalsorasignedoriginalandacopycertifiedbynotarypublicshallbesubmittedtothe<br />

registrarforregistration.<br />

59 Restrictiononregistrationofcertainpersonalservitudes<br />

Nopersonalservitudeofusufruct,usus orhabitatio oranytransferorcessionthereofpurportingtoextend<br />

beyondthelifetimeofthepersoninwhosefavouritiscreatedshallberegistered.<br />

60 Cancellationofregistrationofservitude<br />

(1) Subject to subsections (2) and (3), cancellation of the registration of a servitude in pursuance of an<br />

agreementbetweentheownerofthelandencumberedtherebyandtheholderoftheservitudeshallbeeffectedby<br />

notarialdeed.<br />

(2) Ifaservitudeismortgagedorthedominanttenementismortgaged,theconsentinwritingoftheholderof<br />

thebondtothecancellationoftheregistrationoftheservitudeshallbeproducedtotheregistrar.<br />

(3) Cancellationoftheregistrationofapersonalservitudemay,subjecttotheagreementconstitutingtheservitude,beeffectedbylodgingwiththeregistrarawrittenconsentbytheholderofthatservitudeforthecancellationoftheservitude.<br />

(4) Ifforanyreasonaservitudehaslapsed,theregistrarshall,onwrittenapplicationbytheowneroftheland<br />

encumberedthereby,accompaniedbyprooftohissatisfactionofthelapseoftheservitudeandbyallthedeeds<br />

affectedthereby,noteonsuchdeedsthattheservitudehaslapsed.<br />

61 Transferandmortgageoflandwithpersonalservitudethereon<br />

(1) Iftheowneroflandsubjecttoapersonalservitudeandtheholderofthatservitudehavedisposedofthe<br />

landoranyportionthereoftogetherwiththerightsofservitudetoanotherperson,theymaytogethergivetransfer<br />

thereoftothatperson.


(2) Thedeedoftransferoflandreferredtoinsubsection (1)shalldescribetheownerofthelandandthe<br />

holderoftheservitudeasthetransferors.<br />

(3) Theowneroflandsubjecttoapersonalservitudeandtheholderofthatservitudemay—<br />

(a) togethermortgagethelandtothefullextentoftheirrespectiverightstherein;or<br />

(b) eitherofthemasprincipaldebtormortgagethelandortheservitude,asthecasemaybe,andtheother<br />

oftheminthesamebondmortgagetheservitudeorthelandassurety.<br />

62 Jointtransactionsbyfiduciaryandfideicommissary<br />

(1) Iftheowneroflandsubjecttoafideicommissumandthefideicommissary,ifthelatteriscompetentsoto<br />

do,havedisposedofthelandoranyportionthereoftogetherwiththefideicommissaryrightstoanotherperson,<br />

theymaytogethergivetransferthereoftothatperson.<br />

(2) Thedeedoftransferoflandreferredtoinsubsection (1)shalldescribetheownerofthelandandthe<br />

holderofthefideicommissaryrightsasthetransferors.<br />

(3) Theowneroflandsubjecttoafideicommissumandthefideicommissary,ifthelatteriscompetentsoto<br />

do,maytogethermortgagethelandtothefullextentoftheirrespectiverightstherein.<br />

(1) Noconditionsinatitledeedwhichprohibitstheownership,occupationoruseofanypropertyonthe<br />

groundsofrace,tribeorcolourshallbeofanyforceoreffectandtheRegistrarshallrequireanysuchconditionin<br />

anytitledeedtoanypropertytobeommittedfromanysubsequenttitledeedtothatproperty.<br />

(2) Novoluntaryorinvoluntaryalienationofanypropertyoranydispositionofanypropertywhetherbyway<br />

ofleaseorservitudeorotherwiseoranycontractthereforshallbeinvalidsolelyonthegroundsthatsuchalienationordispositionorcontractthereforwasinconflictwithanyconditionreferredtoinsubsection(1).<br />

64 Saleoflandoninstalments<br />

(1) Wherelandissoldintermsofawrittencontractwherebythepurchasepriceispayableinthreeormore<br />

instalments,theregistrarshall,uponthelodgingwithhimintermsofthissectionofthewrittenconsentofthe<br />

registeredownerandthepurchaser,endorseonthetitledeedofthelandconcernedthatsuchlandissubjecttothe<br />

contract.<br />

(2) Theendorsementintermsofsubsection(1)againstthetitledeedofanylandshallconferonthepurchaser<br />

of the land concerned, subject to this section and to anyprior real rights attaching to the land, the following<br />

rights—<br />

(a) in the event of the insolvency, assignment or liquidation of the seller’s estate or the vesting of the<br />

seller’sestateinatrusteeorassigneeintermsofthelawrelatingtoinsolvencyoraproposedsaleinexecutionoftheland,anduponhimnotifyinghiselectionthereofwithinthreemonthsoftheinsolvency,<br />

assignment,liquidationorattachmentoftheland,asthecasemaybe,tothetrustee,assignee,liquidator<br />

orofficerchargedwiththesaleoftheland,either—<br />

(i) achargeoverthelandinfavourofthepurchaserfortheamountofanyinstalmentsanddeposit<br />

paidbyhimtothesellerandforthevalueofanyimprovementseffecteduponthelandbythe<br />

purchaserandvaluedintermsofsubsection(4)lesstheamount,ifany,referredtoinparagraph<br />

(d)ofsubsection(5);or<br />

(ii) a right to take transfer of the land subject to the payment of the outstanding balance of the<br />

purchasepriceunderthecontractor,ifthelandisencumberedunderapriorrealrightsecuringa<br />

monetaryobligation,tothepaymentoftheoutstandingbalanceunderthepriorrealright,whicheveristhegreater:<br />

Providedthatwherethelandsoldunderthecontractisaportionoflandthewholeofwhichis<br />

subjecttosuchapriorrealright,thepurchasershallbeentitledtotaketransferofthelandupon<br />

paymentofthesumreferredtoinsubsection(3)orthebalanceofthepurchasepriceunderthe<br />

contract,whicheveristhegreater;<br />

or<br />

(b) where the provisions of paragraph(a) do not applyor he has not made an election in terms of that<br />

paragraph, the right enforceable against all persons whatsoever to abide bythe contract and to take<br />

transferofthelanduponfulfilmentoftheconditionsofthecontract.<br />

(3) Inthecaseofasaleofaportionofland,thewholeofwhichissubjecttoapriorrealrightsecuringa<br />

monetaryobligation,theregistrarshallrefusetomakeanendorsementintermsofsubsection(1)unlessthereis<br />

lodgedwithhimawrittenstatementsignedbythepurchaserandtheholderofthepriorrealrightsettingoutthe<br />

amountwhichisdeemedtorepresent,forthepurposesofthissection,theoutstandingbalanceofthemonetary<br />

obligationsecuredbythepriorrealrightinrespectofthelandsold.<br />

(4) Forthepurposesofparagraph(a)ofsubsection(2),thevalueofanyimprovementseffectedupontheland<br />

bythepurchasershallbesuchvalueasmaybeagreedbythepersonsconcernedor,failingagreement,asmaybe<br />

determinedbyavaluatorappointedbytheofficerchargedwiththedutyofsellingthepropertyinexecutionor,in


theeventoftheinsolvency,assignmentorliquidationoftheestateofthesellerorthevestingoftheseller’sestate<br />

inatrusteeorassigneeintermsofthelawrelatingtoinsolvency,bythetrustee,assigneeorliquidatorconcerned.<br />

(5) Aconsentreferredtoinsubsection(1)shallbepreparedbyanotarypublicandshall—<br />

(a) identifytheregisteredownerandthepurchaserasisrequiredintermsofthis<strong>Act</strong>inrespectofdocumentslodgedforregistration;and<br />

(b) describethelandconcernedandspecifythenumberanddateofthetitledeedoftheregisteredowner;<br />

and<br />

(c) statethepurchasepriceandtheamountofthedeposit,ifany,andofeachinstalmentpayableintermsof<br />

thecontractinrespectofcapitalandinterest,ifany;and<br />

(d) statewhatamount,ifany,ofeachinstalmentshall,intheeventofthesaleofthelandpursuanttothe<br />

insolvency,assignmentorliquidationoftheseller’sestateorthevestingoftheseller’sestateinatrustee<br />

orassigneeintermsofthelawrelatingtoinsolvencyorthesaleinexecutionoftheproperty,bedeemed<br />

toberentinrespectoftheoccupationofthepropertybythepurchaser;and<br />

(e) haveannexedtheretothecontractoracopythereofcertifiedbyanotarypublic;and<br />

(f) beaccompaniedbythetitledeedoftheregisteredowner.<br />

(6) Therightsconferreduponapurchaserintermsofthissectionshallrankfromthedateoftheendorsement<br />

referredtoinsubsection(1).<br />

(7) Theregistrarshallcancelanendorsementreferredtoinsubsection(1)uponthelodgingwithhimofthe<br />

writtenconsenttheretooftheregisteredownerandthepurchaserconcerned.<br />

(8) Thissectionshallapplytoacontractreferredtoinsubsection(1)whetheritwasenteredintobefore,on<br />

orafterthel9thJanuary,1973.<br />

Leases<br />

65 Registrationofleasesandsub-leases<br />

(1) Savewhereprovisiontothecontraryismadeinanyenactment,anyleaseorsub-leaseoflandandany<br />

cessionofsuchaleaseorsub-leaseintendedorrequiredtoberegisteredinadeedsregistryshallbeexecutedby<br />

notarialdeedbythelessorandthelesseeorbythelesseeandthesub-lesseeorbythecedentandthecessionary,<br />

asthecasemaybe.<br />

(2) Ifthelandleasedorsub-leasedismortgagedorsubjecttotherightsofanyotherperson,itshallbenecessaryforthepurposesofregistrationoftheleaseorsub-leaseoranycessionthereoftoproducetheconsentofthe<br />

legalholderthereof.<br />

66 Terminationofregisteredlease<br />

Whenaregisteredleaseorsub-leasehasterminated,theregistrarshall,onawrittenapplicationbytheowner<br />

ofthelandaffectedtherebyandtheregisteredholderofthelease,accompaniedbyalldeedsaffectedbysuch<br />

termination,noteonallsuchdeedsthatsuchleaseorsub-lease,asthecasemaybe,hasterminated.<br />

67 Whereleasetoberegistered<br />

Anyleaseofimmovablepropertywhichisregisteredinthenameofthelessorinadeedsregistryshallberegisteredinthatregistry,andanysub-leaseofanyleasesoregisteredshallberegisteredinthatregistry.<br />

68 Cessionsofleasesandsub-leases<br />

Nocessionofaleaseorsub-leaseshallberegisteredinanydeedsregistryunlesstheleaseorsub-leasehas<br />

beenregisteredtherein.<br />

69 Nohypothecationofleasesandsub-leases<br />

Nohypothecationofaleaseorsub-leaseshallberegisteredinadeedsregistryunlesssuchhypothecationis<br />

effectedbymeansof—<br />

(a) amortgagebond,iftheleaseorsub-leaseisimmovableproperty;or<br />

(b) anotarialbond,iftheleaseorsub-leaseisnotimmovableproperty.<br />

70 Bondshypothecatingleasesorsub-leases<br />

(1) Fortheregistrationofabondspeciallyhypothecatingaregisteredleaseorsub-leasethedeedofthelease<br />

shallbeproducedtotheregistrar.<br />

(2) In registering such bond the registrar shall endorse on the deed that the lease or sub-lease has been<br />

hypothecatedbythebond.<br />

(3) Sectionfiftyshallapply,mutatismutandis,inrespectofanyleaseorsub-leasesohypothecated.<br />

PARTVII<br />

GENERAL<br />

71 Cancellationofregistrationonlapseofcertainregisteredrights<br />

(1) Ifitisexpresslyprovidedin—<br />

(a) aregisteredleaseofland;or


(b) aregistereddeedcreatingorevidencingaservitude;<br />

thatitshalllapseuponthehappeningofcertainevents,theregistrarshall,uponwrittenapplicationaccompanied<br />

byanaffidavitbythelessororgrantoroftheregisteredright,asthecasemaybe,thatthoseeventshavehappened,<br />

canceltheregistrationoftheleaseorservitude:<br />

Providedthat—<br />

(i) iftheaddressofthelesseeorgranteeisstatedintheregistereddocument,ortheaddressoranychange<br />

thereofhasbeennotifiedtotheregistrar,noticeshallbegiventosuchlesseeorgranteebytheapplicant<br />

byprepaidregisteredletterthatcancellationoftheregistrationofthedocumentissoughtontheground<br />

ofthehappeningofcertaineventsmentionedthereinandthatunlesswrittenobjectiontothecancellation<br />

specifyingthegroundsofobjectionislodgedwiththeregistrarwithinonemonth,iftheaddressisin<br />

<strong>Zimbabwe</strong>,orwithinthreemonthsorsuchfurtherperiodastheregistrarmayinspecialcircumstances<br />

determine,iftheaddressisoutside<strong>Zimbabwe</strong>,applicationwillbemadetotheregistrarforcancellation<br />

oftheregistrationofthesaiddocument;<br />

(ii) iftheaddressofthelesseeorgranteeisnotstatedinthedocumentorhasnotbeennotifiedtotheregistrar<br />

as aforesaid, the applicant shall publish the notice aforesaid once in the Gazette and twice in a<br />

newspaperpublishedinthedistrictinwhichthelandinquestionissituated(oriftherebenosuchnewspapertheninanynewspapercirculatinginsuchdistrict)andinanewspaper(tobeindicatedbytheregistrar)circulatinginthedistrictofthelessee’sorgrantee’slastknownaddresswhichshallbedisclosed<br />

bytheapplicantinanaffidavit;<br />

(iii) ifanyobjectionislodgedwhich,intheregistrar’sopinion,disclosesreasonablegroundsforrefusing<br />

cancellationoftheregistration,heshallnotcancelituntiltheobjectioniswithdrawnorfallsawayor<br />

cancellationisorderedbythecourt;<br />

(iv) ifanyoftherightstobecancelledaremortgaged,noticeinwritingshallbegivenbytheapplicantby<br />

prepaidregisteredlettertothemortgageeoftheintentiontocancelsuchrights,beforethecancellationis<br />

effected.<br />

(2) Forthepurposesofsubsection(1),thelessororgrantormeansthepersonwho,fromtherecordsinthe<br />

deedsregistry,appearstobetheownerofthelandconcerned.<br />

72 Transferandcessionnottobepassedassecurity<br />

Notransferoflandandnocessionofanyregisteredleaseorsub-leaseorotherrealrightinland,excepta<br />

mortgage,madeassecurityforadebtorotherobligationshallbeattestedbyaregistrarorregisteredinadeeds<br />

registry.<br />

73 Transferofimmovablepropertybyexecutor<br />

Anexecutorwhodesirestoeffectatransferoflandoracessionofrealrightsthereinoracessionofanotarial<br />

bondinpursuanceofasaleorcessionforvaluebysuchexecutorshalllodgewitharegistrar—<br />

(a) anaffidavitstating—<br />

(i) thatnoobjectiontosuchtransferorcessionexists;and<br />

(ii) whetherornottheestateisajointestate;or<br />

(b) anaccounttowhichheisobligedtogiveeffectintermsofsubsection(10)ofsection52oftheAdministrationofEstates<strong>Act</strong>[<strong>Chapter</strong>6:01];<br />

andtheregistrarshallbeentitledtopasstransferorregisterthecessionaccordingly.<br />

74 Transferdutytobepaidbeforetransfer<br />

Ifanylandorrealrightinlandhasbeensettleduponordonatedtoanintendedspouseintermsofanantenuptialcon.tract,orifinconsequenceofadivisionofajointestateintermsofanotarialdeedexecutedunder<br />

the<br />

provisionsofsection3oftheMarriedPersonsProperty<strong>Act</strong>[<strong>Chapter</strong>5:11],onespouseobtainsmorethanahalf<br />

shareinanylandorrealrightinland,notransferorcessionofsuchlandorrealrightinlandbythedonoror<br />

spouseinwhosenamesuchlandorrightisregisteredtoanypersonotherthanthedoneeorthespousewhoobtainssuchshareundersuchdivisionofthejointestate,andnomortgageofsuchlandorrightbythedonororthe<br />

spouse in whose name the land or right is registered, shall be executed,attestedorregisteredbytheregistrar<br />

unlesstheduty,ifany,payableonthedonationordivisionhasbeenpaid.<br />

75 Registrationofchangeofname<br />

(1) Ifthenameofanypersonorpartnershipappearsinanyregistereddeedorotherdocumentandsuchname<br />

hasbeenchanged,suchpersonorpartnershipmayapplyinwritingtotheregistrartoendorseonthesaiddeedor<br />

otherdocumentthatthenameofsuchpersonorpartnershiphasbeenchangedtothenamestatedintheapplication.<br />

(2) Everysuchapplicationshallbeaccompaniedbythedeedorotherdocumentrequiringamendmentandby<br />

theconsentinwritingofeveryotherpersoninterestedinsuchdeedorotherdocumentorintherightscreated,<br />

conveyedorevidencedtherebyandiftheoldnameappearsinanotherdeedorotherdocumentthatdeedordocumentshalllikewisebeforwardedtotheregistrarforendorsement.


(3) Ifthenameofthepersonorpartnershipconcernedhasbeenchangedinaccordancewiththeprovisionsof<br />

anylawandtheregistrarissatisfiedthatnochangeofpersoninlawisimpliedinsuchchangeofname,theregistrarshallendorseonthesaiddeedorotherdocumentthatthenameofthepersonorpartnershiphasbeenchanged<br />

tothenamestatedintheapplicationand,iftheoldnameofsuchpersonorpartnershipappearsinanyotherdeed<br />

ordocumentregisteredinthatregistry,theregistrarshalllikewiseendorsethatdeedorotherdocumentandin<br />

eithercasemakecorrespondingentriesintheappropriateregisters.<br />

(4) Ifthenameofthepersonorpartnershipconcernedhasnotbeenchangedinaccordancewiththeprovisionsofanylaw,ortheregistrarisnotsatisfiedthatnochangeofpersoninlawisimpliedinsuchchangeof<br />

name,theregistrarshall,attheexpenseoftheapplicant,publishanoticeoftheapplicationonceintheGazette<br />

andthreetimesinanewspaperapprovedbyhim.<br />

(5) Ifanyobjectiontotheendorsementbeingmadeislodgedwiththeregistrarnotlaterthanoneweekafter<br />

thelastpublicationintheGazetteornewspaper,whichevermaybethelater,andsuchobjectionisintheopinion<br />

oftheregistrarbonafideandsufficientlymaterial,theregistrarmayrefusetomaketheendorsementexceptupon<br />

theauthorityofanorderofcourt,andthecourtshallhavejurisdictiontomakesuchorderinthematterasitmay<br />

deemjust.<br />

(6) Ifnosuchobjectionislodgedwithintheperiodmentionedinsubsection(5),orifintheopinionofthe<br />

registrarsuchobjectionisnotbonafideorisnotsufficientlymaterial.theregistrarshallmaketheendorsement<br />

andentriesasprovidedinsubsection(3).<br />

(7) Subjecttosectionsforty-twoandseventy-six,nochangeinthenameofanyimmovablepropertyshallbe<br />

recordedinadeedsregistry.<br />

76 Renumberingofproperties<br />

(1) If,afterhehasreceivedareportfromtheSurveyor-Generalandtheregistrarthatthenumberingordescriptionsofregisteredpropertiesinanydistricthavebecomecomplicated,theMinisterissatisfiedthatinthe<br />

publicinterestthepropertiesinthatdistrictshouldberenumbered,hemayauthorizetheamendmentoftherelevantgeneralplansanddiagramsbytheSurveyor-General.<br />

(2) AssoonasadiagramorgeneralplanhasbeenamendedbytheSurveyor-Generalinaccordancewithauthoritygrantedintermsofsubsection<br />

(1),theregistrarshallenterthenewnumberassignedtoeachregistered<br />

propertyinthatdistrictagainsttherelevantfoliointheregisterskeptinthedeedsregistryandshall,bynoticein<br />

the Gazetteandinanewspapercirculatinginthedistrictinwhichtheregisteredpropertiesaresituate,callupon<br />

allaffectedownersofregisteredpropertiesinthedistricttosubmitthetitledeedsunderwhichtheyho1dtheland,<br />

togetherwiththediagramdeedsandallotherdocumentsrelatingthereto,foramendmentwithinthreemonthsof<br />

thedateofpublicationofsuchnotice.Theregistrarshallnote,freeofcharge,uponthetitledeedsandallother<br />

documentssubmittedtohimandupontherelevantregistryduplicates,thenewnumberassignedtotheregistered<br />

propertyandtheSurveyor-Generalshallamendthediagramsthereof,butnoamendmentshallbemadewhich<br />

wouldhavetheeffectofamendinganyrightsofownership.<br />

(3) anyownerfailstosubmithistitledeedandotherdocumentsforamendmentwithintheperiodmentioned<br />

insubsection(2),theregistrarshallimpoundsuchtitledeedandotherdocumentswhentheyarepresentedtohim<br />

foranyactofregistrationandmayretainsuchdeedandotherdocumentsuntiltheamendmentsauthorizedbythis<br />

sectionhavebeenmadeanduntilsuchownerhaspaidsuchfeeasmaybeprescribedinrespectthereof.<br />

77 Deletionofconditionsoftitle<br />

(1) Notwithstandinganythingtothecontraryinthis<strong>Act</strong>,ifaregistrarisoftheopinionthat—<br />

(a) anyconditionsubjecttowhichanapplicationforatownshiphasbeengrantedintermsofPartIIIofthe<br />

Town and Country Planning <strong>Act</strong> [<strong>Chapter</strong>213 of 1974] or the Town Planning <strong>Act</strong> [<strong>Chapter</strong>103 of<br />

1939]isnolongerofanyforceoreffect,hemay,afterconsultationwiththeDirectorofPhysicalPlanning,deletethatconditionintheconditionsofestablishmentofthetownshipconcernedandanystandin<br />

thattownshipwhichisthereaftertransferredshallnotbesubjecttotheconditionsodeleted;or<br />

(b) anyconditionregisteredinthetitledeedtoanyimmovablepropertyshouldnothavebeensoregistered<br />

orisnolongerofanyforceoreffect,heshalldeletethatconditionfromthesaidtitledeedorrequireitto<br />

beomittedfromanysubsequenttitledeedtothatimmovablepropertyoranyportionthereof.<br />

(2) Ifaregistrarisoftheopinionthattherightsofanypersonmaybeaffectedbyanyactiontakenintermsof<br />

subsection(1),heshallpublish,intheGazetteandina`newspapercirculatinginthearea,noticeoftheproposed<br />

deletioncallinguponanypersonaffectedwhohasanyobjectiontotheproposeddeletiontolodgehisobjections<br />

inwritingwiththeregistrarnotlaterthansuchdate,beingnotlessthanonemonthofthedateofthepublicationof<br />

thenoticeintheGazette,asmaybespecifiedinthatnotice.<br />

(3) Wherenoticehasbeengivenintermsofsubsection(2)ofanyproposeddeletion,theregistrarshallconsiderallobjectionslodgedwithhimintermsofthatsubsectionandshall,subjecttosectioneighty-three,make<br />

suchdecisionashedeemsfitandnotifytheobjectorofthedecisionsomade.<br />

78 Attestationofpowersofattorney<br />

Powersofattorneytopassdeedsortodoanyactinconnectionwithadeedsregistryshall—


(a) ifexecutedwithin<strong>Zimbabwe</strong>,beacceptedifwitnessedbytwocompetentwitnessesorbyajusticeofthe<br />

peaceorcommissionerofoathsandthesignatureofeachsuchwitness,thejusticeofthepeaceorcommissionerofoaths,asthecasemaybe,hasbeenaffixedtheretointhepresenceofthepersonexecuting<br />

it;<br />

(b) ifexecutedoutside<strong>Zimbabwe</strong>,beacceptedifauthenticated—<br />

(i) byalegalpractitioner,mayororpersonholdingjudicialoffice;or<br />

(ii) in the case of a country or territory in which <strong>Zimbabwe</strong> has its own diplomatic or consular<br />

representative,bytheheadofa<strong>Zimbabwe</strong>andiplomaticmission,thedeputyoractingheadof<br />

such mission or a counsellor, first, second or third secretary, consul-general, consul or viceconsul.<br />

79 Noticetoregistrarofapplicationtocourt<br />

Beforeanyapplicationismadetothecourtforauthorityoranorderinvolvingtheperformanceofanyactina<br />

deedsregistry,theapplicantshallgivetheregistrarconcernedreasonablenoticebeforethehearingofsuchapplication,andsuchregistrarmaysubmittothecourtsuchreportthereonashemaydeemdesirabletomake.<br />

80 Productionofdocumentsinevidence<br />

(1) Nooriginaldocumentkeptinadeedsregistryshallbeproducedinanylegalproceedingssaveinexceptionalcircumstancesanduponanorderofthecourtbeforewhichsuchproceedingsarebeingbrought.<br />

(2) Wheretheoriginaldocumentisproduceduponanorderofcourtasinsubsection(1)provided,itshallnot<br />

be necessaryin anylegal proceedings for the registrar himself, orforanyofficerunderhim,toproducesuch<br />

originaldocument,butitshallbesufficientifsuchdocumentisproducedbysomepersonauthorizedbyhimtodo<br />

so.<br />

(3) Exceptwheretheoriginaldocumentisproduceduponanorderofcourtasinsubsection(1)provided,a<br />

copyoforextractfromanydocumentkeptinadeedsregistry,certifiedtobeatruecopyunderthehandofthe<br />

registrar,shallinalllegalproceedingsbeadmissibleinevidenceasofequalvaliditywiththeoriginaldocument.<br />

Certifiedcopiesorextractsmaybehandedintocourtbythepartywhodesirestoavailhimselfofthem.<br />

(4) Wheretheoriginaldocumenthasbeendestroyedandsuchoriginaldocumentwas,beforeitsdestruction,<br />

photographedinaccordancewiththeprovisionsofanyregulations,thephotographiccopyofthatdocumentkept<br />

inaccordancewiththoseregulationsshall,forthepurposesofthissection,bedeemedtobetheoriginaldocument.<br />

81 Penaltyforfalsecitementinaffidavit<br />

Everyaffidavitrequiredtobeproducedtotheregistrarundertheprovisionsofparagraph(a)ofsubsection(1)<br />

ofsectionsixshallsetforththatitismadeforthepurposesofthatparagraph;andanypersonwhomakesanysuch<br />

affidavitknowingittobeuntrueinanymaterialparticularshallbeguiltyofanoffenceandliabletoafinenot<br />

exceedinglevelsixortoimprisonmentforaperiodnotexceedingoneyearortobothsuchfineandsuchimprisonment.<br />

82 Substitutedcopyoflostdeedsupersedesoriginalwhichmustbesurrenderedonrecovery<br />

(1) Ifacopyofaregistereddeedorotherdocumenthasbeenissuedinmannerprescribedbyregulationin<br />

substitutionforadeedorotherdocumentwhichhasbeenlostorisbelievedtohavebeendestroyed,theoriginal<br />

deedorotherdocument,ifstillinexistence,shallthereuponbecomevoid.<br />

(2) Ifadeedorotherdocument,whichhasbecomevoidasaforesaid,comesintothepossessionorcustodyof<br />

anypersonwhoknowsthatacopyhasbeenissuedinsubstitutiontherefor,heshallforthwithdeliverortransmit<br />

suchdeedorotherdocumenttotheregistrarconcerned.<br />

83 AppealstoPlanningAppealsBoard<br />

(1) Anypersonwho—<br />

(a) istheownerofimmovablepropertyandisaggrievedbytherefusalofaregistrartoregisteracondition<br />

onthegroundsthatsuchconditionmaynotberegisteredintermsofsubsection(3)ofsectionfifty-six;or<br />

(b) isaggrievedbyanydecisionofaregistrarintermsofsubsection(3)ofsectionseventy-six;<br />

may,withinonemonthofbeingnotifiedoftherefusalordecisionoftheregistrar,asthecasemaybe,orsuch<br />

longerperiodasthePresidentoftheAdministrativeCourtmayinwritingauthorize,appealtotheAdministrative<br />

Courtwhichmayconfirmtherefusalordecisionoftheregistrarorissuesuchotherorderasitdeemsfit.<br />

(2) PartXoftheRegional,TownandCountryPlanning<strong>Act</strong>[<strong>Chapter</strong>29:12]shallapply,mutatismutandis,<br />

inrelationtoanappealintermsofsubsection(1).<br />

84 Exemptionfromlawforactsoromissionsindeedsregistry<br />

NoactoromissionofanyregistrarorofanyofficeremployedinadeedsregistryshallrendertheStateor<br />

suchregistrarorofficerliablefordamagesustainedbyanypersoninconsequenceofsuchactoromission:<br />

Providedthat—


(i) ifsuchactoromissionismalafideorifsuchregistrarorofficerhasnotexercisedreasonablecareand<br />

diligenceincarryingouthisdutiesinconnexionwithsuchactoromission,theStateshallbeliablefor<br />

thedamageaforesaid;<br />

(ii) theregistrarorofficerguiltyofsuchactoromissionshallbeliabletomakegoodanylossordamage<br />

resultingtherefromtotheStateifsuchactoromissionwasmalafide.<br />

85 Feesofofficenotchargeableincertaincases<br />

NofeeofofficeshallbechargedinrespectofthepreparationorissueintermsoftheRegional,Townand<br />

CountryPlanning<strong>Act</strong>[<strong>Chapter</strong>29:12]ofatitledeedtoanylandwhichisacquiredbyalocalauthorityintermsof<br />

that<strong>Act</strong>forpublicpurposesorwhichvestsinalocalauthorityintermsofthat<strong>Act</strong>.<br />

86 Formaldefects<br />

No act in connexion with any registration in a deeds registry shall be invalidated by any formal defect,<br />

whethersuchdefectoccursinanydeedpassedorregistered,orinanydocumentupontheauthorityofwhichany<br />

suchdeedhasbeenpassedorregisteredorwhichisrequiredtobeproducedinconnexionwiththepassingor<br />

registrationofsuchdeed,unlessasubstantialinjusticehasbysuchactbeendonewhichintheopinionofthecourt<br />

cannotberemediedbyanyorderofthecourt.<br />

87 Regulations<br />

(1) TheMinistermaymakeregulationsprescribing—<br />

(a) thefeesofofficetobechargedinrespectofanyact,matterorthingrequiredorpermittedtobedonein<br />

orinrelationtoadeedsregistry,includinganyreportmadetothecourtbytheregistrarinconnexion<br />

withanyapplicationoractiontowhichheisnotaparty;<br />

(b) thestepstobetakenfortheprotectionandpreservationoftherecordsofanydeedsregistry(including<br />

thephotographingofsuchrecordsandtheprotectionandpreservationofthephotographiccopies)and<br />

thedestructionordisposalofanyrecordsotherthancurrentdeeds,diagramsandotherdocuments;<br />

(c) themannerandforminwhichanydeedorotherdocumentrequiredorpermittedtobelodged,registered<br />

orfiledinadeedsregistryshallbeprepared,lodged,executed,registered,filedordelivered;<br />

(d) themannerandforminwhichendorsementsorentriesrequiredbythis<strong>Act</strong>oranyotherenactmenttobe<br />

madeonregistereddeedsorotherdocumentsorintheregistersshallbemadethereonortherein;<br />

(e) theparticulardocumentswhich,whenproducedinadeedsregistry,shallbeattestedorwitnessed,the<br />

mannerinwhichanysuchdocumentshallbeattestedorwitnessedandthenumberofcopiesofadocumentwhichshallbelodgedinadeedsregistrywhensuchdocumentisregistered;<br />

(f) thedivisions,districtsorotherareaswithintheareaservedbyadeedsregistry,whichshallbeadoptedin<br />

numbering,forthepurposesofregistration,thefarmsorotherpiecesoflandsituatetherein;<br />

(g) themethodaccordingtowhichfarmsorotherpiecesoflandinanysuchdivision,districtorotherarea<br />

shallbenumbered;<br />

(h) themannerandforminwhichstandsorlotsorportionsoflandorlotsintownshipsorsimilarareasmay<br />

beregistered;<br />

(i) themannerandforminwhichinformationwhichisrequiredbylawtobefurnishedtoaregistrarshall<br />

berecordedinhisdeedsregistry,themannerandforminwhichinformationpermittedbylawtobefurnishedbyaregistrartothepublicshallbefurnishedandthemannerandforminwhichtheidentityof<br />

personsshallbeestablished;<br />

(j) theconditionsuponwhichconveyancers,legalpractitioners,surveyorsandotherpersonsmayconduct<br />

anysearchinadeedsregistryandtheprecautionswhichshallbetakentoensurepreservationoftherecordsfromdamagebyimproperhandlingorotherwise;<br />

(k) theconditionsunderwhichcopiesofdeedsandotherdocumentsregisteredinadeedsregistrymaybe<br />

issuedforjudicialpurposesorpurposesofinformationorinsubstitutionfordeedsorotherdocuments<br />

whichhavebeenlost,destroyed,defacedordamaged,andtheconditionsunderwhichextractsfromregistersorfromanydocumentsregisteredorfiledinadeedsregistrymaybefurnished;<br />

(l) the manner and form in which consent shall be signified to anycancellation, cession, part payment,<br />

releaseoramendmentoforotherregistrabletransactionaffectinganybondorotherdocumentregistered<br />

inadeedsregistry;<br />

(m) theconditionsunderwhichacopyofapowerofattorneymaybeacceptedbyaregistrarinlieuofthe<br />

original;<br />

(n) theformsofdeedswhichshallbeusedincircumstancesnotprovidedforinthis<strong>Act</strong>;<br />

(o) anymatterwhichunderthis<strong>Act</strong>isrequiredorpermittedtobeprescribed.<br />

(2) Anyregulationsmadeunderparagraph(f)or(g)ofsubsection(1)shallcomeintooperationwithinthe<br />

areaservedbyadeedsregistryuponsuchdatesastheMinistermay,bystatutoryinstrument,fix.<br />

88 Specialjurisdictionofmagistratescourts<br />

NotwithstandinganythingtothecontrarycontainedintheMagistratesCourt<strong>Act</strong>[<strong>Chapter</strong>7:10],anapplicationintermsofsubsection(7)ofsectionsixty-threeforanorderfortheejectmentofanypersonwhooccupiesany


propertyincontraventionoftherestrictiveconditionmaybeheardbyacourtpresidedoverbyaseniormagistrate,<br />

provincialmagistrateorregionalmagistrate,irrespectiveofthevalueoftherightofoccupationoftheproperty<br />

concerned.<br />
