The Lopians later learned that neither Kim nor Young owned an established business to sell, although they owned the property deed. “Plaintiffs’ [The Lopians’] reliance was reasonable in that Defendant Su Min Kim continuously represented to Plaintiffs [the Lopians] that he had a business to sell them, and he had many other buyers waiting to purchase the business for more money than Plaintiffs [the Lopians] were paying,” states the allegations Maag filed with the Riverside County Courthouse. In an interview with the Town Crier last June, Michael Lopian spoke of one instance when he and Kim visited a “potential buyer” interested in the Idyllwild property. Kim spoke to the man in Korean, and explained to Lopian that the man had hoped to purchase the business, but that Kim turned him down. The man broke down crying, according to Lopian. He is now convinced he was witnessing an act, not true disappointment. The total purchase price, as was written on the agreement, was $250,000 to be paid with an $80,000 down payment, then $1,800 per month for the next 10 years, with an interest rate of six and a half percent.
