Aborig<strong>in</strong>al Fisheries<br />
In 1990, <strong>the</strong> Supreme Court of Canada’s Sparrow<br />
decision upheld <strong>the</strong> Aborig<strong>in</strong>al right to fish for<br />
food, social and ceremonial purposes. In response<br />
to this decision, DFO <strong>in</strong>itiated <strong>the</strong> Aborig<strong>in</strong>al<br />
Fisheries Strategy (DFO 2003). This strategy<br />
provided a framework for <strong>the</strong> management of<br />
fisheries for food, social and ceremonial purposes.<br />
In 1999, <strong>the</strong> Supreme Court of Canada’s<br />
Marshall decision affirmed a treaty right to hunt,<br />
fish and ga<strong>the</strong>r <strong>in</strong> pursuit of a “moderate livelihood”<br />
aris<strong>in</strong>g out of Peace and Friendship Treaties<br />
of 1760 and 1761 (R v Marshall 1999). S<strong>in</strong>ce<br />
that time DFO has implemented a number of<br />
programs to facilitate <strong>the</strong> <strong>in</strong>tegration of Aborig<strong>in</strong>al<br />
communities affected by <strong>the</strong> decision <strong>in</strong>to Atlantic<br />
Canadian fisheries. The Marshall Response Initiative<br />
(MRI) was created to provide <strong>the</strong> 34 Mi’kmaq<br />
and Maliseet First Nations with <strong>in</strong>creased access<br />
to <strong>the</strong> commercial fishery through <strong>the</strong> provision<br />
of licenses, vessels and gear. The Aborig<strong>in</strong>al<br />
Aquatic Resource and Oceans Management<br />
(AAROM) program was <strong>in</strong>stituted to facilitate <strong>the</strong><br />
participation of Aborig<strong>in</strong>al groups <strong>in</strong> advisory and<br />
decision-mak<strong>in</strong>g processes for oceans and fisheries<br />
resource management (DFO 2008c). The<br />
Atlantic Integrated Commercial Fisheries Initiative<br />
(AICFI) was developed to build upon <strong>the</strong> accomplishments<br />
of <strong>the</strong> MRI by <strong>in</strong>creas<strong>in</strong>g <strong>the</strong> capacity<br />
of Aborig<strong>in</strong>al commercial fish<strong>in</strong>g enterprises and<br />
support<strong>in</strong>g <strong>the</strong>ir participation <strong>in</strong> <strong>the</strong> co-management<br />
of <strong>the</strong> <strong>in</strong>tegrated commercial fisheries along<br />
with o<strong>the</strong>r commercial harvesters (DFO 2010e).<br />
In <strong>the</strong> decade s<strong>in</strong>ce <strong>the</strong> Marshall decision, Aborig<strong>in</strong>als<br />
throughout <strong>the</strong> Maritimes have participated<br />
<strong>in</strong> tra<strong>in</strong><strong>in</strong>g, established adm<strong>in</strong>istration, governance<br />
and bus<strong>in</strong>ess <strong>in</strong>frastructure, and have substantially<br />
<strong>in</strong>creased <strong>the</strong>ir <strong>in</strong>volvement <strong>in</strong> Atlantic commercial<br />
fisheries and <strong>in</strong> <strong>the</strong> <strong>in</strong>tegrated management<br />
of ocean resources (Atlantic Policy Congress of<br />
First Nations Chiefs 2009).<br />
