This meeting will be held at <strong>BOCES</strong> Administrative Offices located at 900 Watervliet-Shaker Road, Suite 102, Albany, New York and will begin at 6:30 p.m.<br />

Minutes will be posted on the <strong>Capital</strong> <strong>Region</strong> <strong>BOCES</strong> website within 5 days after Board approval.<br />

Privilege of the Floor shall be extended to any person in attendance. Each person wishing to exercise this privilege shall be allowed five (5) minutes in which to<br />

provide vouchers for 35 students to enroll in an online OSHA course.<br />

2. Request permission for the Career and Technical Education Division to apply for a grant<br />

entitled, “Community Improvement: Champions Serving Others” in the amount of up to<br />

$10,000. The purpose of the grant is to complete the rebuilding of the remaining two<br />

structures at Lasell Park, Schoharie, New York.

Recommend adoption of the following resolution which would permit <strong>BOCES</strong> to standardize on<br />

specific equipment, products or services.<br />

WHEREAS, the Albany-Schoharie-Schenectady-Saratoga Board of Cooperative Educational<br />

Services desires to enhance existing or acquire additional equipment, products or services, and<br />

WHEREAS, said equipment, products or services are designed to work in a specific manner and<br />

WHEREAS, staff has been or will be specially trained in the use of said equipment, products or<br />

services, and use of a single manufacturer’s equipment, products or services results in services being<br />

delivered more efficiently and in a more cost effective manner, and<br />

and<br />

WHEREAS, member districts have specifically requested specific equipment, products or services,<br />

NOW, THEREFORE, BE IT RESOLVED, that there is a need to standardize future purchases of<br />

equipment, products or services in order to provide efficiency and economy of operation, and<br />

c. Recommend approval of an agreement between the Albany-Schoharie-Schenectady-Saratoga<br />

<strong>BOCES</strong> and Educational Legacy Planning Group (ELP), 105 Alicia Drive, North Babylon,<br />

New York 11703. ELP will provide district planning and board retreat facilitation for the<br />

Cobleskill-Richmondville School District during the 2012-13 School Year. <strong>BOCES</strong> will pay<br />

approximately $1,750. (2013-21-CA)<br />

d. Recommend approval of an agreement between the Albany-Schoharie-Schenectady-Saratoga<br />

<strong>BOCES</strong> and Manufacturers and Traders Trust Company, M & T Bank, (233 Genesee St.<br />

Corporation, a wholly owned subsidiary), 1310 West Chester Pike, Havertown, Pennsylvania.<br />

M & T Bank will provide installment purchasing financing for LAN Equipment and Software,<br />

based on a Master Lease Agreement, the amount specified in each equipment schedule amortized<br />

as principal and interest. Each individual lease will have its own lease contract. The contract<br />

period is August 20, 2012 through August 19, 2013 with four (4) optional one (1) year<br />

e. Recommend approval of an agreement between the Albany-Schoharie-Schenectady-Saratoga<br />

<strong>BOCES</strong> and Ingersoll Place Assisted Living, 3359 Consaul Road, Niskayuna, New York 12304.<br />

Ingersoll will provide facility use for the students from <strong>Capital</strong> <strong>Region</strong> <strong>BOCES</strong> Health Careers<br />

Program in order for the students to obtain hands on clinical experience in an assisted living<br />

setting The contract period is September 1, 2012 for subsequent one-year terms unless terminated<br />

by either party upon six months written notice. There are no fees involved. (2013-023-CTE)<br />

f. Recommend approval to an amendment to an agreement between the Albany-Schoharie-<br />

Schenectady-Saratoga <strong>BOCES</strong> and CYPRAS, Inc., 4 Commercial Street, 2 nd Floor, Rochester,<br />

New York 14614. CYPRAS will provide student based learning for students of participating school<br />

districts. <strong>BOCES</strong> will pay approximately $21,000 annually, all of which will be reimbursed by<br />

participating school districts using this shared service. The contract period is September 1, 2012<br />

g. Recommend approval of an agreement between the Albany-Schoharie-Schenectady-Saratoga<br />

<strong>BOCES</strong> and Learning A-Z, 1840 E River Road, Suite 320 Tucson Arizona 85718. Learning A-Z<br />

will provide access to online databases and resources. <strong>BOCES</strong> will pay based on member schools<br />

h. Recommend approval of an agreement between the Albany-Schoharie-Schenectady-Saratoga<br />

<strong>BOCES</strong> and LexisNexis, 9443 Springboro Pike, Miamisburg, Ohio 45342. LexisNexis will<br />

provide access to LexisNexis Scholastic as requested by member schools. <strong>BOCES</strong> will pay based<br />

on member schools participation. The contract period is July 1, 2012 through June 30, 2013.<br />

i. Recommend approval of an extension to an agreement between the Albany-Schoharie-<br />

Schenectady-Saratoga <strong>BOCES</strong> and Proquest, L.L.C., 789 E Eisenhower Parkway, Ann Arbor,<br />

Michigan 48106-1346. Proquest will provide access to online databases and resources. <strong>BOCES</strong><br />

will pay based on member schools participation. The contract period is July 1, 2012 through<br />

June 30, 2013. The original contract was approved August 29, 2011. (2012-013e-IS)<br />

j. Recommend approval to an amendment to an agreement between the Albany-Schoharie-<br />

Schenectady-Saratoga <strong>BOCES</strong> and PT Redevelopment, L.L.C. d/b/a Proctors Theatre, 432 State<br />

Street, Schenectady, New York 12305. Proctors will provide theatre based learning for students of<br />

participating school districts. <strong>BOCES</strong> will pay approximately $155,000 annually, all of which will<br />

be reimbursed by participating school districts using this shared service. The contract period is<br />

September 1, 2012 through June 30, 2013. The original contract was approved August 29, 2011.<br />

k. Recommend approval to an amendment to an agreement between the Albany-Schoharie-<br />

Schenectady-Saratoga <strong>BOCES</strong> and Scotia-Glenville Children’s Museum, 303 Mohawk Avenue,<br />

Scotia, New York 12302. The Children’s Museum will provide arts, math, and science based<br />

learning for students of participating school districts. <strong>BOCES</strong> will pay approximately $52,000<br />

annually, all of which will be reimbursed by participating school districts using this shared service.<br />

The contract period is September 1, 2012 through June 30, 2013. The original contract was<br />

l. Recommend approval to an amendment to an agreement between the Albany-Schoharie-<br />

Schenectady-Saratoga <strong>BOCES</strong> and Theatreworks/USA, 151 W. 26th Street, New York, New York<br />

10001. Theatreworks/USA will provide theatre based learning for students of participating school<br />

districts. <strong>BOCES</strong> will pay approximately $24,000 annually, all of which will be reimbursed by<br />

participating school districts using this shared service. The contract period is September 1, 2012<br />

through June 30, 2013. The original contract was approved August 29, 2011 (2012-037a-IS)<br />

m. Recommend approval of an agreement between the Albany-Schoharie-Schenectady-Saratoga<br />

<strong>BOCES</strong> and The Compass Company Consultants, LLC (Compass), 125 State Street, Albany,<br />

New York 12207. Compass will provide liability and casualty insurance review services to the<br />

<strong>BOCES</strong> and districts in conjunction with the Risk Management Service. <strong>BOCES</strong> will pay<br />

approximately $112,000 (based on the number of participating districts). The contract period shall<br />

commence upon signature of both parties to this agreement and run through June 30, 2013. (2013-<br />

n. Recommend approval of an amended agreement between the Albany-Schoharie-Schenectady-<br />

Saratoga <strong>BOCES</strong> and KB Engineering & Consulting PLLC – d/b/a KB Consulting, 89<br />

Kingsbury Road, Burnt Hills, New York 12027. KB Consulting will provide professional<br />

engineering consulting services for component school districts. <strong>BOCES</strong> will pay $20,000. The<br />

contract period is July 1, 2012 through June 30, 2013. (2013-027-MS)<br />

o. Recommend approval of an amended agreement between the Albany-Schoharie-Schenectady-<br />

Saratoga <strong>BOCES</strong> and Microsearch Corporation, 5 Broadway, Saugus, Massachusetts 01906.<br />

Microsearch will update the latest released document search engine portal for the Websearch<br />

Generation 3. This one time upgrade fee will be $5,000. The contract period remains the same,<br />

p. Recommend approval of an agreement between the Albany-Schoharie-Schenectady-Saratoga<br />

<strong>BOCES</strong> and the Town of Colonie Parks and Recreation Department, 71 Schermerhorn Road,<br />

Cohoes, New York 12047. The town will provide space on Tuesday, August 21, 2012 for a 55<br />

member Team Retreat of the Communications Service. <strong>BOCES</strong> will pay $230. (2013-028-MS)<br />

q. Recommend approval of an extension to an agreement between the Albany-Schoharie-<br />

Schenectady-Saratoga <strong>BOCES</strong> and Rubicon International (Rubicon West, Inc.), One World<br />

Trade Center, Suite 1200, 121 SW Salmon Street, Portland, Oregon 97204. Rubicon will<br />

continue to provide Atlas curriculum management software products, licenses, and services to<br />

<strong>BOCES</strong> and its regional school districts. <strong>BOCES</strong> will pay approximately $130,813, based on the<br />

level of school district usage. The contract period is August 18, 2012 through August 17, 2013,<br />

with one-year automatic renewals. The original contract was approved August 18, 2008. (2009-<br />

r. Recommend approval of a renewal lease agreement between the Albany-Schoharie-Schenectady-<br />

Saratoga <strong>BOCES</strong> and Centris Group, LLC, 100 Merrick Road, Suite 418E, Rockville Center,<br />

New York 11570. Centris will provide for software license agreements for the purpose of<br />

assessing and utilizing software. The fee is $18,802. The contract period is July 1, 2012 through<br />

June 30, 2013. (2013-029-SpE)<br />

s. Recommend approval of a renewal lease agreement between the Albany-Schoharie-Schenectady-<br />

Saratoga <strong>BOCES</strong> and The College of St. Rose, 432 Western Avenue, Albany, New York 12203-<br />

1490. The College will continue to lease classroom space to the Special Education Division to<br />

house a FSI Program in order for the students to be integrated into the college academic and<br />

social setting. The annual rent is $12,500. The lease agreement is for the period July 1, 2012<br />

through June 30, 2013 and is contingent upon approval of the State Education Department.<br />

b) Administration Considerations<br />

1. Request Governor Cuomo Veto Bill A.8291-A/S.5771-A<br />

Recommend the Board adopt the following resolution:<br />

WHEREAS, during the final days of the legislative session, a bill (A.8291-A/S.5771-A) passed the<br />

legislature which would grant tenure status seniority rights to non-competitive and labor classes when<br />

there are school layoffs as well as when districts are able to rehire laid-off employees.<br />

And WHEREAS, this bill ties the hands of school districts in making appropriate personnel<br />

decisions that best meet the educational needs of its students.<br />

And WHEREAS, school districts need flexibility to efficiently manage their operations with limited<br />

resources.<br />

And WHEREAS, this legislation undermines the collective bargaining process by uniformly giving<br />

unions a significant benefit without school districts receiving anything in return that could improve<br />

educational programs and services for children.<br />

And WHEREAS, this legislation imposes an onerous mandate on school districts in direct<br />

contravention of efforts by the Mandate Relief Council to reduce state unfunded mandates on school<br />

districts.<br />

THEREFORE, BE IT RESOLVED that the Board of Education calls on Governor Andrew Cuomo<br />

to veto this onerous and inappropriate legislation.<br />

2. Membership - <strong>Capital</strong> District School Boards Association (CAPSBA)<br />

Recommend the <strong>BOCES</strong> renew its membership in the <strong>Capital</strong> District School Boards<br />

Association for the period July 1, 2012 through June 30, 2013. The membership remains unchanged<br />

at $200.<br />
