REQUEST FOR WAIVER/REDUCTION OF FINE<br />

Mr. Lero read the case into the record.<br />

Ms. Elsa Larson stated her name for the record. She stated that most of the issues at<br />

hand were something she could have avoided. The contractor, who originally placed<br />

the doublewide mobile home in place in July, 2005 did not put it together and it got<br />

damaged during the rain storms. She stated the history of her case and her dealings<br />

with repairs to the mobile home as well as with the <strong>County</strong>. She was originally told she<br />

couldn’t get a demolition permit because the trailer was too old and she couldn’t keep it<br />

there. She went back to the <strong>County</strong> in February, 2008 to get a demolition permit and<br />

was asked why she wanted to remove it. She has since been approved for the permit<br />

to place the mobile home there. In the meantime, fines have been assessed and<br />

accruing for non-compliance.<br />

Mr. Lero explained this was a PID that came to him in March, 2007 and heard by the<br />

Board on June 20, 2007. At that time, the Board allowed 60 days to obtain the permit or<br />

face a $100.00 per day fine. The fine amount at this time is 268 days of noncompliance<br />

with a total of $26,800.00 plus interest and filing fees.<br />

Chairman Tucker asked if it was in compliance now.<br />

Mr. Lero stated the Board Order was they obtain a permit which they have done, so the<br />

fine was stopped on May 15, 2008; the day prior to the issuance of the permit.<br />

Chairman Tucker confirmed that all they were dealing with now was the fine.<br />

Mr. Carroll asked if Ms. Larson had documentation that the <strong>County</strong> had sent her to<br />

show that she tried to stay on top of this.<br />

Ms. Larson stated she had a lot of documentation.<br />

CHAIRMAN TUCKER MOVED to review the documentation and move it into evidence;<br />

MR. BLACK SECONDED.<br />

Chairman Tucker called on the motion; the vote was unanimous and the motion carried.<br />

Discussion followed regarding the evidence submitted by Ms. Larson.<br />
