Mr. Lero read the case into the record and asked the Board to hear the case in absentia
and accept evidence.

Chairman Tucker called on the motion; the vote was unanimous and the motion carried.
Mr. Lero said the case came to Staff as a Public Information Department complaint on
March 17, 2008; they were at the site on March 17, 2008 and a short form Notice of
Violation was left at the site. He explained that permit application number 09233 was in
place and explained the violations through photographs. Mr. Lero recommended the
Board find that a violation existed and allow 180 days to come into compliance or face a
$200.00 per day fine.
