NOTICE INVITING TENDER<br />

1. Item rate <strong>tender</strong>s are invited on behalf of the Chairman Executive Council, IHBAS from approved and eligible<br />

Contractors of CPWD and those of appropriate class of contractors enlisted in the MES, Railways and Department<br />

of Telecommunications up to 2.30 P.M. on 17.12.2012 for the following work:<br />

Name of Work: Providing chain link fabric in front of Type-VI quarters at New Residential<br />

colony at IHBAS during 2012-13 under A/R & M/O.<br />

In case only the last date of sale of <strong>tender</strong> is extended, the enlistment of contractor should be valid on the original<br />

date of sale of <strong>tender</strong>s.<br />

In case both the last date of receipt of application and sale of <strong>tender</strong>s are extended, the enlistment of contractor<br />

should be valid on either of the two dates i.e. original date of sale of <strong>tender</strong> or on the extended date of sale of<br />

<strong>tender</strong>s.<br />

1.1 The work is estimated to cost Rs. 12,66,341/- (Rupees Twelve lakhs sixty six thousand three hundred forty<br />

one only).<br />

This estimate however is given merely as a rough guide.<br />

1.1.1 The authority competent to approved NIT for the combined cost and belonging to the major discipline will<br />

consolidate NITs for calling the <strong>tender</strong>s. He will also nominate Division, which will deal with all matters relating to<br />

the invitation of <strong>tender</strong>s.<br />

For composite <strong>tender</strong>, besides indicating the combined estimated cost put to <strong>tender</strong>, should clearly indicate the<br />

estimated cost of each component separately. The eligibility of <strong>tender</strong>er will correspond to the combined<br />

estimated cost of different components put to <strong>tender</strong>.<br />

1.2 The intending <strong>tender</strong>ers should have produce necessary attested copies of registration in the appropriate class &<br />

category, registration in VAT, VAT returns, Permanent Account Number with Income Tax department. The<br />

application for issue of <strong>tender</strong> documents shall be accompanied with cost of <strong>tender</strong> documents in the form of<br />

Cash/Demand Draft/Pay order/ Banker’s cheque of a scheduled bank issued in favour of Director, IHBAS payable<br />

at Delhi and eligibility criteria as per CPWD-6 of NIT. Applications received without cost of <strong>tender</strong> documents and<br />

necessary documents in the prescribed manner are liable to be rejected without any further notice. Earnest<br />

money shall be submitted with <strong>tender</strong> document on date of receipt of <strong>tender</strong> in the form of DD/Pay order/Banker<br />

cheque of a scheduled bank drawn in favour of “The Director, IHBAS” payable at Delhi.<br />

2. Agreement shall be drawn with the successful <strong>tender</strong>er on prescribed Form No. CPWD 7/8 which is available as a<br />

Govt. of India Publication. Tenderer shall quote his rates as per various terms and conditions of the said form<br />

which will form part of the agreement.<br />

3. The time allowed for carrying out the work will be 02 months from the date as defined in schedule “F” or from<br />

the date of handing over the site, whichever is later, in accordance with the phasing, if any, indicated in the<br />

<strong>tender</strong> documents.<br />

4. The site for the work is available.

5. Applications for issue of <strong>tender</strong> forms shall be received by 12-12-2012 (03:00 pm) and <strong>tender</strong> documents shall be<br />

issued by 15-12-2012 (12:00 noon).<br />

Tender documents consisting of plans, specifications, the schedule of quantities of the various classes of work to<br />

be done and the set of terms & conditions of contract to be complied with by the contractor whose <strong>tender</strong> may<br />

be accepted and other necessary documents can be seen in the office of the Executive Engineer (C), Institute of<br />

Human Behaviour and Allied Sciences, Dilshad Garden, Shahdara, Delhi 110095 between hours of 11.00 A.M. &<br />

3:30 P.M. from Monday to Friday and 11.00 am to 1.00 pm on Saturday except on Sundays and Public Holidays<br />

from 07-12-2012 to 17-12-2012. Tender documents, excluding standard form, will be issued from his office,<br />

during the hours specified above, on payment of Rs. 500.00 in Cash/Demand Draft/Payorder/ Banker’s cheque of<br />

a scheduled bank issued in favour of Director, IHBAS payable at Delhi as cost of <strong>tender</strong> document along with<br />

application for issue of <strong>tender</strong> documents:-<br />

Earnest money of Rs. 25,327.00 (Rs. Twenty five thousand three hundred twenty seven only) with <strong>tender</strong><br />

document on date of receipt of <strong>tender</strong> in the shape of Demand Draft/Payorder/ Banker’s cheque of a scheduled<br />

bank issued in favour of Director, IHBAS payable at Delhi. The earnest money shall be placed in the sealed cover<br />

envelop marked ‘Earnest Money’. The <strong>tender</strong> document duly filled shall be placed in the other sealed cover<br />

envelop marked ‘Tender’. Both the envelopes shall then be put in another sealed cover for submission.. The<br />

envelopes marked ‘Earnest Money’ shall be opened first on the due date and envelopes marked ‘Tender’ shall be<br />

opened only if the earnest money is in order, otherwise unopened envelopes marked “Tender” will be treated<br />

as invalid <strong>tender</strong>.<br />

6. Tenders, which should always be placed in sealed envelope, with the name of work and due date written on the<br />

envelopes, will be received by the Executive Engineer (Civil), IHBAS upto 2.30 P.M. on 17-12-2012 and will be<br />

opened by him or his authorized representative in his office on the same day at 03:00 PM<br />

7.1 The contractor whose <strong>tender</strong> is accepted, will be required to furnish performance guarantee of 5% (Five Percent)<br />

of the <strong>tender</strong>ed amount within the period specified in schedule F. This guarantee shall be in the form of Cash (in<br />

cash guarantee amount is less than Rs. 10000.00) or deposit at call receipt of any scheduled bank/Banker’s<br />

cheque of any scheduled bank/Demand draft of any scheduled bank/Payorder of any scheduled bank (in case<br />

guarantee amount is less than Rs. 1,00,000.00) or Government Securities or fixed deposit receipt or guarantee<br />

bonds of any scheduled bank or the State Bank of India in accordance with the prescribed form.<br />

In case the contractor fails to deposit the said performance guarantee within the period as<br />

indicated in Schedule ‘F’, including the extended period if any, the Earnest Money deposited<br />

by the contractor shall be forfeited automatically without any notice to the contractor.<br />

7.2 General instructions to the <strong>tender</strong>ers submitting downloaded <strong>tender</strong><br />

i) The downloaded <strong>tender</strong> document shall be valid for participation in the <strong>tender</strong> process. Tenders<br />

submitted on an incomplete downloaded <strong>tender</strong> document or on a photocopy of the downloaded<br />

<strong>tender</strong> document shall be treated as invalid.<br />

ii) Earnest money and cost of <strong>tender</strong> documents shall be submitted in the form of DD/Pay order/Banker cheque<br />

of a scheduled bank drawn in favour of “The Director, IHBAS” payable at Delhi. Cost of <strong>tender</strong> document is<br />

non refundable in any case.<br />

iii) The <strong>tender</strong>ers using downloaded <strong>tender</strong> document shall submit requisite documentary proof in support of<br />

their eligibility as per the criteria laid down in the Notice Inviting Tender. The documentary proof along with<br />

the earnest money and cost of <strong>tender</strong> document shall be placed in the sealed cover marked ‘Earnest Money’.<br />

The <strong>tender</strong> duly filled in the downloaded <strong>tender</strong> document shall be placed in the envelop marked ‘Tender’.<br />

Both the envelopes shall then be put in another sealed cover for submission of <strong>tender</strong> marked ‘Name of work’<br />

and ‘Date of opening’.

iv) The envelopes marked ‘Earnest Money’ shall be opened first on the due date and if the earnest money & cost<br />

of <strong>tender</strong> document are found in order, the documentary proof submitted by the <strong>tender</strong>ers using<br />

downloaded <strong>tender</strong> document shall be scrutinized with reference to prescribed eligibility criteria to<br />

determine the eligibility of the <strong>tender</strong>ers. In such cases the envelopes marked ‘Tender’ shall be opened only if<br />

the eligibility criteria is fulfilled, otherwise envelopes marked “Tender” shall be treated as invalid <strong>tender</strong> and<br />

not be opened.<br />

v) Tenderers making use of downloaded <strong>tender</strong> document shall seal the <strong>tender</strong>, affix their initials and put<br />

rubber stamp on each page before submission.<br />

New Residential colony at IHBAS during 2012-13 under A/R & M/O.<br />

8. Copies of other drawings and documents pertaining to the works will be open for inspection by the <strong>tender</strong>ers at<br />

the office of the above-mentioned officer.<br />

Tenderers are advised to inspect and examine the site and its surroundings and satisfy themselves before<br />

submitting their <strong>tender</strong>s as to the nature of the ground and sub-soil (so far as is practicable), the form and nature<br />

of the site, the means of access to the site, the accommodation they may require and in general shall themselves<br />

obtain all necessary information as to risks, contingencies and other circumstances which may influence or affect<br />

their <strong>tender</strong>. A <strong>tender</strong>er shall be deemed to have full knowledge of the site whether he inspects it or not and no<br />

extra charges consequent on any misunderstanding or otherwise shall be allowed. The <strong>tender</strong>er shall be<br />

responsible for arranging and maintaining at his own cost all materials, tools & plants, water, electricity access,<br />

facilities for workers and all other services required for executing the work unless otherwise specifically provided<br />

for in the contract documents. Submission of a <strong>tender</strong> by a <strong>tender</strong>er implies that he has read this notice and all<br />

other contract documents and has made himself aware of the scope and specifications of the work to be done<br />

and of conditions and rates at which stores, tools and plants, etc. will be issued to him by the Government and<br />

local conditions and other factors having a bearing on the execution of the work.<br />

9. The competent authority on behalf of the Chairman Executive Council, IHBAS does not bind himself to accept the<br />

lowest or any other <strong>tender</strong> and reserves to himself the authority to reject any or all the <strong>tender</strong>s received without<br />

the assignment of any reason. All <strong>tender</strong>s in which any of the prescribed condition is not fulfilled or any condition<br />

including that of conditional rebate is put forth by the <strong>tender</strong>er shall be summarily rejected.<br />

10. Canvassing whether directly or indirectly, in connection with <strong>tender</strong>s is strictly prohibited and the <strong>tender</strong>s<br />

submitted by the contractors who resort to canvassing will be liable to rejection.<br />

11. The competent authority on behalf of Chairman Executive Council, IHBAS reserves to himself the right of<br />

accepting the whole or any part of the <strong>tender</strong> and the <strong>tender</strong>er shall be bound to perform the same at the rate<br />

quoted.<br />

12. The contractor shall not be permitted to <strong>tender</strong> for works in the IHBAS (responsible for award and execution of<br />

contracts) in which his near relative is posted as Divisional Accountant or as an officer in any capacity between<br />

the grades of Superintending Engineer and Junior Engineer (both inclusive). He shall also intimate the names of<br />

persons who are working with him in any capacity or are subsequently employed by him and who are near<br />

relatives to any officer in the Institute. Any breach of this condition by the contractor would render him liable to<br />

be removed from the approved list of contractors of this Department.<br />

13. No Engineer of gazetted rank or other Gazetted officer employed in Engineering or Administrative duties in an<br />

Engineering Department of IHBAS is allowed to work as contractor for a period of two years after his retirement<br />

from Government service, without the previous permission of IHBAS in writing. This contract is liable to be<br />

cancelled if either the contractor or any of his employees is found any time to be such a person who had not

obtained the permission of IHBAS as aforesaid before submission of the <strong>tender</strong> or engagement in the contractor’s<br />

services.<br />

14. The <strong>tender</strong> for the works shall remain open for acceptance for a period of sixty days from the date of opening of<br />

<strong>tender</strong>s. If any <strong>tender</strong>er withdraws his <strong>tender</strong> before the said period or makes any modifications in the terms and<br />

conditions of the <strong>tender</strong> which are not acceptable to the department, that the Government shall, without<br />

prejudice to any other right or remedy, be at liberty to forfeit 50% of the said earnest money as aforesaid. Further<br />

the <strong>tender</strong>er shall not be allowed to participate in the re-<strong>tender</strong>ing process of the work<br />

15. This Notice Inviting Tender shall form a part of the contract document. The successful <strong>tender</strong>er/contractor, on<br />

acceptance of his <strong>tender</strong> by the Accepting Authority, shall, within 15 days from the stipulated date of start of the<br />

work sign the contract consisting of: -<br />

a) The notice inviting <strong>tender</strong>, all the documents including additional conditions, specifications and drawings, if any,<br />

forming the <strong>tender</strong> as issued at the time of invitation of <strong>tender</strong> and acceptance thereof together with any<br />

correspondence leading thereto.<br />

b) Standard C.P.W.D. Form 7/8<br />

16. In case of any difference / ambiguity between English & Hindi versions, English version shall prevail.<br />

17. The department shall Deduct Income Tax on the value of work done from each bill of the contractor as per<br />

prevailing Govt. instructions / order. In lieu the department shall issue a certificate of deduction of the tax at<br />

source to the contractor in relevant form.<br />

18. The <strong>tender</strong>er must be registered under Delhi Value Added Tax and shall submit an affidavit that up to date<br />

returns have been filed and agency has no due towards sale Tax/ Vat department, he/she shall also submit<br />

copies of all the return filed in the sale tax / vat department<br />

19. The Department shall deduct CESS @1%on the value of work done from each bill of the contractor as per<br />

prevailing Government instruction / order. In lieu, the department shall issue a certificate of deduction at tax at<br />

services to the contractor in relevant form.<br />

20. In the <strong>tender</strong> document, the word ‘CPWD’ shall included “PWD (GNCTD)” whichever exists.<br />

21. For Composite Tenders: -<br />

21.1.1 The <strong>tender</strong>er must associate with himself agencies of the appropriate class eligible to <strong>tender</strong> for the other<br />

components individually.<br />

21.1.2 It will be obligatory on the part of the <strong>tender</strong>er to sign the <strong>tender</strong> documents for all the components (The<br />

schedule of quantities, conditions and special conditions etc.)<br />

21.1.3 After the work is awarded, the contractor will have to enter into separate agreements for each<br />

component with the Officer concerned.<br />

21.1.4 Executive Engineer in charge of minor components shall make interim payments in respect of minor<br />

components of work. Executive Engineer in charge of the major component shall make the payment<br />

against final bill of the composite contract.<br />

21.2 The Executive Engineer Incharge of the major component will call <strong>tender</strong>s for the composite work. The cost of<br />

<strong>tender</strong> document and Earnest Money will be fixed with respect to the combined estimated cost put to <strong>tender</strong> for<br />

the composite <strong>tender</strong>. Security Deposit will be worked out separately for each component corresponding to the

estimated cost of the respective component of works. The Earnest Money will become part of the security<br />

deposit of the major component of work.<br />

21.3 On acceptance of the composite <strong>tender</strong> by the competent authority the letter of award will be issued by the<br />

Executive Engineer Incharge of the major component on behalf of the Chairman Executive Council, IHBAS, making<br />

it clear in the letter of award that the contractor will have to execute separate agreements for different<br />

components of work with the concerned Officers of the respective discipline (Designation to be given).<br />

21.4 The <strong>tender</strong> from consisting of schedule of qty alongwith the conditions can be seen on the website<br />

www.delhigovt.nic.in. However, the information given on the website is illustrative in nature and the<br />

downloaded <strong>tender</strong>s shall be accepted.<br />

T E N D E R<br />

I/We have read and examined the notice inviting <strong>tender</strong>, schedule, A, B, C, D, E & F. Specifications applicable, Drawings &<br />

Designs, General Rules and Directions, Conditions of Contract, clauses of contract, Special conditions, Schedule of Rate &<br />

other documents and Rules referred to in the conditions of contract and all other contents in the <strong>tender</strong> document for<br />

the work.<br />

I/We hereby <strong>tender</strong> for the execution of the work specified for the Chairman Executive Council, IHBAS within the time<br />

specified in Schedule ‘F’, viz., schedule of quantities and in accordance in all respects with the specifications, designs,<br />

drawings and instructions in writing referred to in Rule-I of General Rules and Directions and in Clause 11 of the<br />

Conditions of contract and with such materials as are provided for, by, and in respects in accordance with, such conditions<br />

so far as applicable.<br />

We agree to keep the <strong>tender</strong> open for sixty (60) days from the due date of its opening and not to make any modifications<br />

Chairman Executive Council, IHBAS or his successors in office shall without prejudice to any other right or remedy, be at<br />

liberty to forfeit the said earnest money absolutely. Further if I/We fail to commence work as specified, I/We agree that<br />

Chairman Executive Council, IHBAS or his successors in office shall without prejudice to any other right or remedy<br />

available in law, be at liberty to forfeit the said earnest money & the performance guarantee absolutely, otherwise the<br />

said earnest money shall be retained by him towards security deposit to execute all the works referred to in the <strong>tender</strong><br />

documents upon the terms and conditions contained or referred to therein and to carry out such deviations as may be<br />

ordered, upto maximum of the percentage mentioned in Schedule ‘F’ and those in excess of that limit at the rates to be<br />

determined in accordance with the provision contained in Clause 12.2 and 12.3 of the <strong>tender</strong> form. Further I/We agree<br />

that in case of forfeiture of earnest money or both earnest money & performance guarantee as aforesaid. I/We shall be<br />

debarred for participation in the re-<strong>tender</strong>ing process of the work.<br />

TERMS AND CONDITIONS<br />

Name of Work: Providing chain link fabric in front of Type-VI quarters at New Residential colony at<br />

IHBAS during 2012-13 under A/R & M/O.<br />

Site Conditions: The work shall be carried out at Institute of Human Behaviour and Allied Sciences, G.T. Road, Dilshad<br />

Garden, Delhi.<br />

1.0 GENERAL SPECIFICATION<br />

1.1 The work in general shall be carried out in accordance with the CPWD Specifications 2009 Vol. I to II with up-todate<br />

correction slips.<br />

1.2 The order of preference in case of any discrepancy as indicated in condition no. 8.1 under “Conditions of<br />

Contract” given in the Standard CPWD Contract form may be read as the following:<br />

a) Nomenclature of item as per Schedule of Quantities<br />

b) Particular specifications and special conditions for civil and electrical.<br />

c) General Specification<br />

d) Additional conditions<br />

e) Contract Clauses of Standard CPWD Contract form<br />

f) CPWD Specifications for civil and electrical as applicable.<br />

g) Architectural/structural drawings and specifications mentioned in drawings.<br />

h) Indian Standard Specifications of BIS<br />

i) Manufactures specifications.<br />

j) Sound engineering practice as per directions of the Engineer-in-Charge.<br />

A reference made to any Indian Standard Specifications in these documents, shall imply reference to the latest<br />

version of that standard, including such revisions/ amendments as issued by the Bureau of Indian Standards upto<br />

last date of receipt of <strong>tender</strong>s. The contractor shall keep at his own cost all such publications of relevant Indian<br />

Standards applicable to the work at site.<br />

1.3 The <strong>tender</strong>er shall study carefully, the building drawings, specifications, schedule of quantities and conditions of<br />

the <strong>tender</strong> documents to fully appreciate the scope of work before quoting his rates.<br />

1.4 The disposal of building rubbish shall be disposed off at the authorized dumping ground after obtaining<br />

permission from the department concerned.<br />

1.5 Existing drains, pipes, cables, overhead wires, sewer lines, water lines and other services encountered in the<br />

course of the execution of the work shall be protected against the damage by the contractor at his own expense.<br />

The contractor shall not store materials or otherwise occupy any part of the site in a manner likely to hinder the<br />

operation of such services.<br />

1.6 The contractor shall be responsible for the watch and ward of the material provided by him against pilferage and<br />

breakage during the period of Execution and thereafter till the work is physically handed over to the department.<br />

1.7 For recording measurements and also for preparing abstract the agreement item number both in words as well as<br />

in figures should be given neatly instead of writing description of item in full or abbreviated form, which is not to

be followed in case of extra/substitute items of work those are not covered in the agreement for which full<br />

nomenclature will be produced in the M.B.<br />

The full nomenclature of the item shall be adopted in preparing the abstract of cost of final bill and also in bill of<br />

form.<br />

1.8 Samples of all building materials, fittings and other articles required for execution of the work shall be got<br />

approved from the Engineer-in-Charge . Article manufactured by the Firms of repute and approved by the<br />

Engineer-in-Charge shall only be used. Articles classified as “First Quality” by the manufacturer shall be used<br />

unless otherwise specified. All materials and articles brought by the contractor to the site for use shall conform to<br />

the samples approved by the Engineer-in-Charge which shall be preserved till the completion of the work.<br />

1.9 The contractor shall be required to produce samples of all materials to be arranged and procured by him<br />

sufficiently in advance to obtain approval of the Engineer-in-Charge. Subsequently the materials to be used in<br />

the actual execution of the work shall be strictly of the same quality of samples approved. In case of variation in<br />

the quality, such materials shall be liable to rejection. The contractor at his own cost shall immediately remove<br />

the rejected material from the site of work. If the contractor fails to remove the rejected material from the site<br />

within 48 hours of their rejection, the Engineer-in-Charge is authorized to remove the same at the risk and cost of<br />

the contractor. No claim financially or otherwise shall be entertained on account of any reason whatsoever.<br />

1.10 The water used shall conform to the requirement as laid down in IS: 456-2000.<br />

1.11 The required tests shall be got done from the approved laboratories and the cost of samples, charges of carriage<br />

of samples to laboratories and testing charges for all material to be used at site like cement, bricks, floor tiles,<br />

aggregate etc. shall be borne by the contractors irrespective of the amount involved.<br />

TERMS OF PAYMENT<br />

The department shall not pay advance payment against the supply of materials at site. All the payments shall be made<br />

against the completed works only. However running payments can be made on request on prorata basis against the<br />

completed work of particular block if found in order and to the satisfaction of Engineer in Charge or his authorized<br />

representative. Contractor shall complete the work as per time schedule and he will not link the progress of the work with<br />

the running payments.<br />

SECURITY DEPOSIT:<br />

Security Deposit shall be deducted from each running bill and the final bill to the extent of 5 % of the gross amount<br />

payable subject to maximum limit of 5% of the <strong>tender</strong>ed value of work. The earnest money deposit shall be adjusted<br />

against this security deposit. The security deposit shall be released on the expiry of guarantee and maintenance period<br />

stipulated in the contract.<br />

RATES:<br />

The rates quoted by the <strong>tender</strong>er, shall be firm and inclusive of all taxes (including works contract taxes), duties and levies<br />

and all charges for packing forwarding, insurance, freight and delivery, installation, testing, commissioning etc. at site i/c<br />

watch & ward of the material risk, overhead charges and general liabilities/obligations. Rates shall be firm for the<br />

contractual period of time and for such time for which department shall grant extension of time till completion of work.<br />

The contractor has to carry out routine & preventive maintenance for six months from the date of handing over. Nothing<br />

extra shall be paid for carrying out such work.

Octroi Duty shall not be paid separately but the department on demand can furnish octroi exemption certificate.<br />

However, the department is not liable to reimburse the octroi duty in case the concerned authorities do not honour<br />

exemption certificates.<br />

TAXES AND DUTIES:<br />

The rates quoted by the <strong>tender</strong>er, shall be firm and inclusive of all taxes (including works contract taxes), duties<br />

and levies as per terms & conditions of NIT. Any additional tax or any variation in taxes shall be applicable as<br />

per clauses of 37 & 38 of “General Conditions of contract for CPWD works 2010” which will be a part of<br />

agreement.<br />

ESCALLATION / PRICE VARIATION CLAUSE:<br />

Since the completion period of the work is less than eighteen months the price variation clause shall not be applicable.<br />

However suitable extension of time shall be granted for the unforeseen hindrances at site of work from department side<br />

as per relevant clauses of “General conditions of contract for CPWD works 2010” which will be a part of agreement.<br />

STORAGE AND CUSTODY OF MATERIALS:<br />

The department shall provide no separate storage accommodation. Watch and ward of the stores and their safe custody<br />

shall be the responsibility of the contractor till the final taking over of the completed works by the department.<br />

CARE OF THE BUILDING:<br />

Care shall be taken by the contractor while handling and installing the various equipments and components of<br />

the work to avoid damage to the building. He shall be responsible for repairing all damages and restoring the<br />

same to their original finish at his cost. He shall also remove at his cost all unwanted and waste materials<br />

arising out of the installation from the site of work.<br />

PERFORMANCE GUARANTEE<br />

The successful <strong>tender</strong>er shall submit an irrevocable performance guarantee of 5% of the <strong>tender</strong>ed amount in addition to<br />

other deposits mentioned elsewhere in the contract for his proper performance of the contract agreement within the<br />

period of specified in clause I of schedule F. This guarantee shall be in the form of government securities or fixed deposit<br />

receipts or guarantee bonds of any scheduled bank or the State Bank of India in the specified format. The performance<br />

guarantee shall be initially valid up to the stipulated date of completion plus 60 days beyond. This bank guarantee kept<br />

valid till the recording of completion certificate for the work by the Engineer in charge.<br />

AFTER AWARD OF WORK<br />

The successful <strong>tender</strong>er would be required to submit the following drawings within 10 days of award of work for approval<br />

before commencement of work.<br />

(a) All general arrangement drawings.<br />

(b) Any other drawing / information not specifically mentioned above but deemed to be necessary for the job by the<br />

contractor<br />

SITE CLEARANCE AND CLEAN-UP<br />

The contractor shall from time to time, clear away all debris and excess materials accumulated at the site.

SITE ORDER BOOK<br />

The Junior/Assistant Engineer from the department shall maintain a site order book at the site office. The Engineer in<br />

charge or his authorized representatives, along with contractor’s compliance, shall record all instructions relating to the<br />

job. Contractor is bound to sign the site order book and carry out all such instructions given to him.<br />

VALADITY<br />

Tenders shall be valid for acceptance for a period of 60 days from the date of opening of <strong>tender</strong>.<br />

INDEMNITY:<br />

The successful <strong>tender</strong>er shall at all times indemnify the department, consequent on this works contract. The successful<br />

<strong>tender</strong>er shall be liable, in accordance with the Indian Law and Regulations for any accident occurring due to any cause<br />

and the department shall not be responsible for any accident or damage incurred or claims arising there from during the<br />

period of erection, construction and putting into operation the equipments and ancillary equipment under the<br />

supervision of the successful <strong>tender</strong>er in so far as the latter is responsible. The successful <strong>tender</strong>er shall also provide all<br />

insurance including third party insurance as may be necessary to cover the risk. No extra payment would be made to the<br />

successful <strong>tender</strong>er due to the above.<br />

COOPERATION WITH OTHER AGENCIES<br />

The successful <strong>tender</strong>er shall co-ordinate with other Contractors, Agencies engaged in the construction of building, if any,<br />

and exchange freely all technical information so as to make the execution of this works contract smooth. No<br />

remuneration should be claimed from the department for such technical cooperation. If any unreasonable hindrance is<br />

caused to other Agencies and any completed portion of the work has to be dismantled and re-done for want of<br />

cooperation and cooperation by the successful <strong>tender</strong>er during the course of work, such expenditure incurred will be<br />

recovered from the successful <strong>tender</strong>er if the restoration work to the original condition or specification of the dismantled<br />

portion of the work was not undertaken by the successful <strong>tender</strong>er himself.<br />

No mobilization advance shall be paid for this work.<br />

of Department of Telecommunications, M.E.S. and Railways. The intending <strong>tender</strong>ers should have produce necessary<br />
