Thisestimate however is given merely as a rough guide.1.2 Tenders will be issued to eligible contractors provided they produce definite proof from the appropriate authority,which shall be to the satisfaction of the competent authority, of having satisfactorily completed similar three workof (similar works means “(Providing day to day maintenance services in a Govt. building complex)” each of valuenot less than Rs. 2,60,000/- or two works of value not less than Rs. 3,87,000/- each or one work of value not lessthan Rs. 5,15,000/- in the last five years ending 30.09.20122. Agreement shall be drawn with the successful <strong>tender</strong>er on prescribed Form No. CPWD 8 which is available as aGovt. of India Publication. Tenderer shall quote his rates as per various terms and conditions of the said formwhich will form part of the agreement.3. The time allowed for carrying out the work will be 06 months from the date as defined in schedule “F” or fromthe date of handing over the site, whichever is later, in accordance with the phasing, if any, indicated in the<strong>tender</strong> documents.4. Tenders, which should always be placed in sealed envelope, with the name of work and due date written on theenvelopes, will be received by the Executive Engineer (Civil), IHBAS upto 2.30 P.M. on 04-06-2013 and will beopened by him or his authorized representative in his office on the same day at 03:00 PM7.1 The contractor shall be required to deposit an amount equal to 5% (Five Percent) of the <strong>tender</strong>ed value of thework as Performance Guarantee in the form of an irrevocable bank guarantee bond of any scheduled bank orState Bank of India in accordance with the form prescribed or in cash or in the form of Govt. security, fixeddeposits receipts etc, as in the case of recovery of security deposit within prescribed number of days of the issueof <strong>tender</strong> acceptance. This period can be further extended by Engineer-in-charge upto a maximum period ofprescribed number of days on written request of the contractor.In case the contractor fails to deposit the said performance guarantee within the period asindicated in Schedule ‘F’, including the extended period if any, the Earnest Money depositedby the contractor shall be forfeited automatically without any notice to the contractor.7.2 General instructions to the <strong>tender</strong>ers submitting downloaded <strong>tender</strong>i) The downloaded <strong>tender</strong> shall be accepted and downloadable <strong>tender</strong> document shall be valid forparticipation in the <strong>tender</strong> process. Tenders submitted on an incomplete downloaded <strong>tender</strong>document or on a photocopy of the downloaded <strong>tender</strong> document shall be treated as invalid.ii) Earnest money and cost of <strong>tender</strong> documents shall be submitted in the form of DD/Pay order/Banker chequeof a scheduled bank drawn in favour of “The Director, IHBAS” payable at Delhi. Cost of <strong>tender</strong> document isnon refundable in any case.iii) The <strong>tender</strong>ers using downloaded <strong>tender</strong> document shall submit requisite documentary proof in support oftheir eligibility as per the criteria laid down in the Notice Inviting Tender. The documentary proof along withthe earnest money and cost of <strong>tender</strong> document shall be placed in the sealed cover marked ‘Earnest Money’.The <strong>tender</strong> duly filled in the downloaded <strong>tender</strong> document shall be placed in the envelop marked ‘Tender’.Both the envelopes shall then be put in another sealed cover for submission of <strong>tender</strong> marked ‘Name of work’and ‘Date of opening’.iv)The envelopes marked ‘Earnest Money’ shall be opened first on the due date and if the earnest money & costof <strong>tender</strong> document are found in order, the documentary proof submitted by the <strong>tender</strong>ers usingdownloaded <strong>tender</strong> document shall be scrutinized with reference to prescribed eligibility criteria todetermine the eligibility of the <strong>tender</strong>ers. In such cases the envelopes marked ‘Tender’ shall be opened only ifthe eligibility criteria is fulfilled, otherwise envelopes marked “Tender” shall be treated as invalid <strong>tender</strong> andnot be opened.v) Tenderers making use of downloaded <strong>tender</strong> document shall seal the <strong>tender</strong>, affix their initials and putrubber stamp on each page before submission.The description of the work is as follows: Providing Services for day to day maintenance work for allbuildings, roads, internal & external water supply & sanitary installations within IHBAS Residentialcampus under A/R & M/O during 2013-14.8. Copies of other drawings and documents pertaining to the works will be open for inspection by the <strong>tender</strong>ers atthe office of the above-mentioned officer.Tenderers are advised to inspect and examine the site and its surroundings and satisfy themselves beforesubmitting their <strong>tender</strong>s as to the nature of the ground and sub-soil (so far as is practicable), the form and nature


3of the site, the means of access to the site, the accommodation they may require and in general shall themselvesobtain all necessary information as to risks, contingencies and other circumstances which may influence or affecttheir <strong>tender</strong>. A <strong>tender</strong>er shall be deemed to have full knowledge of the site whether he inspects it or not and noextra charges consequent on any misunderstanding or otherwise shall be allowed. The <strong>tender</strong>er shall beresponsible for arranging and maintaining at his own cost all materials, tools & plants, water, electricity access,facilities for workers and all other services required for executing the work unless otherwise specifically providedfor in the contract documents. Submission of a <strong>tender</strong> by a <strong>tender</strong>er implies that he has read this notice and allother contract documents and has made himself aware of the scope and specifications of the work to be doneand of conditions and rates at which stores, tools and plants, etc. will be issued to him by the Government andlocal conditions and other factors having a bearing on the execution of the work.9. The competent authority on behalf of the Chairman Executive Council, IHBAS does not bind himself to accept thelowest or any other <strong>tender</strong> and reserves to himself the authority to reject any or all the <strong>tender</strong>s received withoutthe assignment of any reason. All <strong>tender</strong>s in which any of the prescribed condition is not fulfilled or any conditionincluding that of conditional rebate is put forth by the <strong>tender</strong>er shall be summarily rejected.10. Canvassing whether directly or indirectly, in connection with <strong>tender</strong>s is strictly prohibited and the <strong>tender</strong>ssubmitted by the contractors who resort to canvassing will be liable to rejection.11. The competent authority on behalf of Chairman Executive Council, IHBAS reserves to himself the right ofaccepting the whole or any part of the <strong>tender</strong> and the <strong>tender</strong>er shall be bound to perform the same at the ratequoted.12. The contractor shall not be permitted to <strong>tender</strong> for works in the IHBAS (responsible for award and execution ofcontracts) in which his near relative is posted as Divisional Accountant or as an officer in any capacity betweenthe grades of Superintending Engineer and Junior Engineer (both inclusive). He shall also intimate the names ofpersons who are working with him in any capacity or are subsequently employed by him and who are nearrelatives to any officer in the Institute. Any breach of this condition by the contractor would render him liable tobe removed from the approved list of contractors of this Department.13. No Engineer of gazetted rank or other Gazetted officer employed in Engineering or Administrative duties in anEngineering Department of IHBAS is allowed to work as contractor for a period of two years after his retirementfrom Government service, without the previous permission of IHBAS in writing. This contract is liable to becancelled if either the contractor or any of his employees is found any time to be such a person who had notobtained the permission of IHBAS as aforesaid before submission of the <strong>tender</strong> or engagement in the contractor’sservices.14. The <strong>tender</strong> for the works shall remain open for acceptance for a period of sixty days from the date of opening of<strong>tender</strong>s. If any <strong>tender</strong>er withdraws his <strong>tender</strong> before the said period or makes any modifications in the terms andconditions of the <strong>tender</strong> which are not acceptable to the department, that the Government shall, withoutprejudice to any other right or remedy, be at liberty to forfeit 50% of the said earnest money as aforesaid. Furtherthe <strong>tender</strong>er shall not be allowed to participate in the re-<strong>tender</strong>ing process of the work15. This Notice Inviting Tender shall form a part of the contract document. 13TERMS AND CONDITIONSName of Work: Providing Services for day to day maintenance work for all buildings, roads, internal & externalwater supply & sanitary installations within IHBAS Residential campus under A/R & M/O during 2013-14.Site Conditions: The work shall be carried out at Institute of Human Behaviour and Allied Sciences, G.T. Road, DilshadGarden, Delhi.1.0 GENERAL SPECIFICATION1.1 The work in general shall be carried out in accordance with the CPWD Specifications 2009 Vol. I to II with up-todatecorrection slips.1.2 The order of preference in case of any discrepancy as indicated in condition no. 8.1 under “Conditions ofContract” given in the Standard CPWD Contract form may be read as the following:a) Nomenclature of item as per Schedule of Quantitiesb) Particular specifications and special conditions for civil and electrical.c) General Specificationd) Additional conditionse) Contract Clauses of Standard CPWD Contract formf) CPWD Specifications for civil and electrical as applicable.g) Architectural/structural drawings and specifications mentioned in drawings.h) Indian Standard Specifications of BISi) Manufactures specifications.j) Sound engineering practice as per directions of the Engineer-in-Charge.A reference made to any Indian Standard Specifications in these documents, shall imply reference to the latestversion of that standard, including such revisions/ amendments as issued by the Bureau of Indian Standards uptolast date of receipt of <strong>tender</strong>s. The contractor shall keep at his own cost all such publications of relevant IndianStandards applicable to the work at site.1.3 The <strong>tender</strong>er shall study carefully, the building drawings, specifications, schedule of quantities and conditions ofthe <strong>tender</strong> documents to fully appreciate the scope of work before quoting his rates.1.4 The disposal of building rubbish shall be disposed off at the authorized dumping ground after obtainingpermission from the department concerned.contractor.The charges of the local body if any shall be borne by the1.5 Existing drains, pipes, cables, overhead wires, sewer lines, water lines and other services encountered in thecourse of the execution of the work shall be protected against the damage by the contractor at his own expense.The contractor shall not store materials or otherwise occupy any part of the site in a manner likely to hinder theoperation of such services.1.6 The contractor shall be responsible for the watch and ward of the material provided by him against pilferage andbreakage during the period of Execution and thereafter till the work is physically handed over to the department.


141.7 For recording measurements and also for preparing abstract the agreement item number both in words as well asin figures should be given neatly instead of writing description of item in full or abbreviated form, which is not tobe followed in case of extra/substitute items of work those are not covered in the agreement for which fullnomenclature will be produced in the M.B.The full nomenclature of the item shall be adopted in preparing the abstract of cost of final bill and also in bill ofform.1.8 Samples of all building materials, fittings and other articles required for execution of the work shall be gotapproved from the Engineer-in-Charge . Article manufactured by the Firms of repute and approved by theEngineer-in-Charge shall only be used. Articles classified as “First Quality” by the manufacturer shall be usedunless otherwise specified. All materials and articles brought by the contractor to the site for use shall conform tothe samples approved by the Engineer-in-Charge which shall be preserved till the completion of the work.1.9 The contractor shall be required to produce samples of all materials to be arranged and procured by himsufficiently in advance to obtain approval of the Engineer-in-Charge. Subsequently the materials to be used inthe actual execution of the work shall be strictly of the same quality of samples approved. In case of variation inthe quality, such materials shall be liable to rejection. The contractor at his own cost shall immediately removethe rejected material from the site of work. If the contractor fails to remove the rejected material from the sitewithin 48 hours of their rejection, the Engineer-in-Charge is authorized to remove the same at the risk and cost ofthe contractor. No claim financially or otherwise shall be entertained on account of any reason whatsoever.1.10 The water used shall conform to the requirement as laid down in IS: 456-2000.General Conditions1. The maintenance shall be carried out strictly as per direction of engineer-in-charge, and or his authorizedrepresentative.2. The intending contractors are advised to visit the site before quoting the <strong>tender</strong>.3. Contractors are required to quote their rates inclusive of all norms, tools and plants necessary for maintenance ofbuildings, water supply and sanitary installations, sewerage system etc.4. All the T&P shall be arranged by the contractor as required for the execution of work except of heavy machinerylike mixtures, vibrators, road rollers etc. Any loss or damages caused to the T&P items due to negligence byhim/his representative/his staff shall have to be good by the firm/contractor, failing which the department shallmake good the loss/damages at the risk and cost of the contractor.5. The normal working hours of work shall be 9-00 AM to 5-00 PM with half an hour lunch-brake from 1.30PM to2.00pm. With a weekly rest day and rest on national holiday. The eight hours working time can be shifted from9:00 AM to 05:00 PM. If required at the time of execution of work as per direction of engineer-in-charge. Duringemergency time can be extended beyond eight hours.6. The contractor or his authorized representative shall maintain the attendance record of the workers and shallensure that requisite workers are available for attending the complaints. Their records shall be made available byJE/AE/EE for verification.7. Necessary materials required for repair maintenance or replacement of defective material shall be provided bythe department. All the dismantled materials shall be returned to department.8. Log books, complaint books and workers diaries shall be provided and be maintained under the contract showingclearing/disposal of complaints, which have to be got verified from JE/AE(C)-in charge on daily basis as perdirections.9. The payments shall be made to the contractor on monthly basis and by cheque.10. Any damages done/ caused to existing machines/buildings due to negligence by him/his representative/staff shallbe made good by the contractor; otherwise department shall make good the damages at the risk and cost of thecontractor.


1511. The contractor shall be responsible for keeping all the installations in good working conditions. The decision ofengineer-in-charge in this regard shall be final.12. All minor materials like bamboo sticks, mustered oil, log book, complaint book, workers diaries etc. shall bearranged by the contractor, which is in the scope of work without any extra payment.13. All complaints shall be attended immediately. If a complaint is not satisfactorily attended within a reasonabletime, without any reasonable cause, the recovery @ Rs. 100/- shall be made for such case. The decision ofengineer-in-charge shall be final and binding in this respect. The consequential damages due to non attending ofcomplaints shall also be recovered from the contractor as decided by engineer-in-charge.14. Contractors shall provide necessary uniforms to all workers, nothing extra shall be paid on this account. Thededuction will be made @ Rs. 40/- per day per persons for not wearing the uniform. The condition of repairing inuniform shall however, not be applicable during first 15 days of the contract starts. All incidental expendituresincurred on upkeep of the uniform viz washing soap, duster shall be met out by the contractor for which nothingextra shall be payable. If the contractor fails to provide required labour strength for attending complaints withoutany valid reason justified in view of the engineer-in-charge, the penalty may be imposed which shall be recoveredfrom the contractor @ Rs. 660/- per skilled worker i.e. for carpenter/plumber/mason/painter/enquiryclerk/supervisor etc., @ Rs. 540/- per unskilled worker and Rs. 600/- per sewer man for each day of default. Theagency or his authorized representative/engineer shall present himself on the site throughout the currency of theagreement failing which the agency may be liable to be analyzed @ 5% of the work done on the day of hisabsence.15. The contractor shall at all times, carry out work in a manner creating minimum interference in the flow to trafficas per direction of Engineer-in-charge.16. The contractor shall have to make arrangement for getting the complaints attended even after 5.00PM and onweekly holidays.17. If any of staff is not considered suitable then he shall have to be replaced immediately. The decision of engineerin-chargeshall be final in this regard.18. The contractor shall take all appropriate measures to ensure safety of his staff and no compensation shall be paidby the department to the firm in case of any accident etc. in that event, the contractor shall be liable for thecompensation.19. Completed complaint books, workers diaries and log books etc. shall be property of submitted to JE(C)/ AE(C)immediately on its completion.20. The Particulars of the staff to be engaged on work from time to time shall be submitted to JE(C)/ AE(C) in themanner desired for reference and record.21. Any defect/ break down in the system shall immediately be brought to the notice of engineer-in-charge so thatservice does not suffer.22. The staff to be engaged at site should have good work experience. Inexperienced staff in the opinion of theengineer-in-charge shall have to be removed immediately.23. The workers should bear good moral character. The contractor shall be responsible for any misconduct of theworker and such workers shall have to be removed from the site immediately. All the workers shall be issuedphoto Identification card giving the designation of the worker and name of the contractor/agency.24. The contractor shall submit his own bill also for payment every month alongwith attendance record.25. The agency shall be responsible for material issued to his labour for bonafide use on the work. any loss or damageto material shall be responsibility of contractor and shall be made good by the agency failing which the lossevaluated shall be recovered from the contractor. The decision of engineer-in-charge shall be final and binding inthis regard. Similar condition shall be apply in respect of dismantled material.26. The skilled staff i.e. carpenter, plumber, mason should be either I.T.I. qualified or should have good workingexperience in the respective trade. All individual trade man be equipped with necessary T&P for maintenance.Enquiry Clerk should be minimum matriculate.27. The agency shall engage minimum, 1 Supervisor, 3 trade man skilled worker (mason, carpenter, plumber),1 painter, 1 semi skilled worker (sewer man) & 5 unskilled worker as required by engineer-in-charge for managingthe day to day maintenance work.


1628. The work force engaged by the agency for the work shall at all time and all purpose by the employees of theagency who shall be solely responsible for payment of wages etc. in time. The contractor shall be responsible fortimely payment of wages to workers engaged by him as minimum wage act.29. The water charge shall be recovered @ 1% (one percent only) on the gross amount of the bill.30. All the labour laws as applicable shall form part of the contract and contractor shall be fully responsible for thebreach of any such law and its consequences. The IHBAS shall own no responsibility for that in all respect asrequired by the relevant statute.31. If the contract is closed before completion of a full month, then payment shall be made on proportionate basisfor the period the contract extends beyond the preceding month.32. No material shall be allowed to be taken away from the site until and unless a valid gate pass is issued by theengineer-in-charge or his authorized representative in that regard.33. The rate quoted by the contactor against any item in the schedule shall be net and final and nothing extra shall bepaid in that regard.34. In case of any default of services by the agency, the Engineer-in-charge may make the alternative arrangement atthe risk and cost of agency at prevailing market rate or the agreement rate whichever is higher. This will be inaddition to the penalty provision provided elsewhere in contract.35. The agency shall not at any stage cause or permit to cause nuisance at premises of Institute or do anything whichmay cause unnecessary disturbance or inconvenience to others working in the premises of the Institute and tothe general public and patients visiting the Institute.36. Since hospital is covered under the essential services, any direction given by the Engineer-in-charge to the agencyin the interest of the hospital shall be binding upon the agency to follow and in case of any deviance from thedirection of Engineer-in-charge reserve the right to take any action as deemed fit in the interest ofhospital/Institute and may even terminate/rescind the contract on serving a summary notice in this regard. Thisclause is not withstanding anything provided anywhere to the contrary.37. The agency shall not leave any building material, debris. Broken pieces of reinforcement, brick bats, malbas etcunattended in open space and shall remove the same immediately from the site as and when directed by theEngineer-in-charge. The clause is the special requirement of the hospital in keeping with the psychiatric patientswho often turn violent and attack others. Any default on the part of the agency for such misshaping shall makethe agency responsible and Engineer-in-charge shall take any action as deemed fit after serving a due notice inthat regard.38. In accordance with the worker welfare cess Act 1996, the labour welfare cess @ 1% of the gross value of workdone shall be deducted from the agency.39. The agency shall deposit T&P such as Phawda-07 nos., Tasla-07 nos., Genti-05 nos., Drill machine (with all drillingbits required)-02nos, Die set complete for all sizes of GI pipes-01nos. before start of work at enquiry office.40. The agency shall also supply other necessary T&P to all the skilled workers as and when required.41. The plumber engaged by agency shall be skilled to repair GI pipeline upto 100mm & all necessary T&P requiredshall be provided by agency.42.
