NOTICE INVITING TENDER
1. Item rate tenders are invited on behalf of the Chairman Executive Council, IHBAS from approved and eligible
Contractors of CPWD and those of appropriate class of contractors enlisted in the MES, Railways and Department
of Telecommunications up to 2.30 P.M. on 20.04.2012 for the following work:
Name of work: A/R & M/O to Residential & Non Residential Building at IHBAS during
2012-13 SH: Aluminium partition for ANS office in old emergency block.
In case only the last date of sale of tender is extended, the enlistment of contractor should be valid on the original
date of sale of tenders.
In case both the last date of receipt of application and sale of tenders are extended, the enlistment of contractor
should be valid on either of the two dates i.e. original date of sale of tender or on the extended date of sale of
tenders.
1.1 The work is estimated to cost Rs. 3,37,944/- (Rupees Three lakh thirty seven thousand nine hundred forty
four only).
This estimate however is given merely as a rough guide.
1.1.1 The authority competent to approved NIT for the combined cost and belonging to the major discipline will
consolidate NITs for calling the tenders. He will also nominate Division, which will deal with all matters relating to
the invitation of tenders.
For composite tender, besides indicating the combined estimated cost put to tender, should clearly indicate the
estimated cost of each component separately. The eligibility of tenderer will correspond to the combined
estimated cost of different components put to tender.
1.2 The intending tenderers should have produce necessary attested copies of registration in the appropriate class &
category, registration in VAT, VAT returns, Permanent Account Number with Income Tax department. The
application for issue of tender documents shall be accompanied with cost of tender documents in the form of
Cash/Demand Draft/Pay order/ Banker’s cheque of a scheduled bank issued in favour of Director, IHBAS payable
at Delhi and eligibility criteria as per CPWD-6 of NIT. Applications received without cost of tender documents and
necessary documents in the prescribed manner are liable to be rejected without any further notice. Earnest
money shall be submitted with tender document on date of receipt of tender in the form of DD/Pay order/Banker
cheque of a scheduled bank drawn in favour of “The Director, IHBAS” payable at Delhi.
2. Agreement shall be drawn with the successful tenderer on prescribed Form No. CPWD 7/8 which is available as a
Govt. of India Publication. Tenderer shall quote his rates as per various terms and conditions of the said form
which will form part of the agreement.
3. The time allowed for carrying out the work will be 02 months from the date as defined in schedule “F” or from
the date of handing over the site, whichever is later, in accordance with the phasing, if any, indicated in the
tender documents.
4. The site for the work is available.

5. Applications for issue of tender forms shall be received by 16-04-2012 (03:00 PM) and tender documents shall be
issued by 18-03-2012 (03:00 PM).
Tender documents consisting of plans, specifications, the schedule of quantities of the various classes of work to
be done and the set of terms & conditions of contract to be complied with by the contractor whose tender may
be accepted and other necessary documents can be seen in the office of the Executive Engineer (C), Institute of
Human Behaviour and Allied Sciences, Dilshad Garden, Shahdara, Delhi 110095 between hours of 11.00 A.M. &
3:30 P.M. from Monday to Friday and 11.00 am to 1.00 pm on Saturday except on Sundays and Public Holidays
from 12-04-2012 to 20-04-2012. Tender documents, excluding standard form, will be issued from his office,
during the hours specified above, on payment of Rs. 500.00 in Cash/Demand Draft/Payorder/ Banker’s cheque of
a scheduled bank issued in favour of Director, IHBAS payable at Delhi as cost of tender document along with
application for issue of tender documents:
Earnest money of Rs. 3,37,944.00 (Rs. Three lakh thirty seven thousand nine hundred forty four only) with tender
document on date of receipt of tender in the shape of Demand Draft/Payorder/ Banker’s cheque of a scheduled
bank issued in favour of Director, IHBAS payable at Delhi. The earnest money shall be placed in the sealed cover
envelop marked ‘Earnest Money’. The tender document duly filled shall be placed in the other sealed cover
envelop marked ‘Tender’. Both the envelopes shall then be put in another sealed cover for submission.. The
envelopes marked ‘Earnest Money’ shall be opened first on the due date and envelopes marked ‘Tender’ shall be
opened only if the earnest money is in order, otherwise unopened envelopes marked “Tender” will be treated
as invalid tender.
6. Tenders, which should always be placed in sealed envelope, with the name of work and due date written on the
envelopes, will be received by the Executive Engineer (Civil), IHBAS upto 2.30 P.M. on 20-04-2012 and will be
opened by him or his authorized representative in his office on the same day at 03:00 PM
7.1 The contractor whose tender is accepted, will be required to furnish performance guarantee of 5% (Five Percent)
of the tendered amount within the period specified in schedule F. This guarantee shall be in the form of Cash (in
cash guarantee amount is less than Rs. 10000.00) or deposit at call receipt of any scheduled bank/Banker’s
cheque of any scheduled bank/Demand draft of any scheduled bank/Payorder of any scheduled bank (in case
guarantee amount is less than Rs. 1,00,000.00) or Government Securities or fixed deposit receipt or guarantee
bonds of any scheduled bank or the State Bank of India in accordance with the prescribed form.
In case the contractor fails to deposit the said performance guarantee within the period as
indicated in Schedule ‘F’, including the extended period if any, the Earnest Money deposited
by the contractor shall be forfeited automatically without any notice to the contractor.
7.2 General instructions to the tenderers submitting downloaded tender
i) The downloaded tender document shall be valid for participation in the tender process. Tenders
submitted on an incomplete downloaded tender document or on a photocopy of the downloaded
tender document shall be treated as invalid.
ii) Earnest money and cost of tender documents shall be submitted in the form of DD/Pay order/Banker cheque
of a scheduled bank drawn in favour of “The Director, IHBAS” payable at Delhi. Cost of tender document is
non refundable in any case.
iii) The tenderers using downloaded tender document shall submit requisite documentary proof in support of
their eligibility as per the criteria laid down in the Notice Inviting Tender. The documentary proof along with
the earnest money and cost of tender document shall be placed in the sealed cover marked ‘Earnest Money’.
The tender duly filled in the downloaded tender document shall be placed in the envelop marked ‘Tender’.
Both the envelopes shall then be put in another sealed cover for submission of tender marked ‘Name of work’
and ‘Date of opening’.

iv) The envelopes marked ‘Earnest Money’ shall be opened first on the due date and if the earnest money & cost
of tender document are found in order, the documentary proof submitted by the tenderers using
downloaded tender document shall be scrutinized with reference to prescribed eligibility criteria to
determine the eligibility of the tenderers. In such cases the envelopes marked ‘Tender’ shall be opened only if
the eligibility criteria is fulfilled, otherwise envelopes marked “Tender” shall be treated as invalid tender and
not be opened.
v) Tenderers making use of downloaded tender document shall seal the tender, affix their initials and put
rubber stamp on each page before submission.

Residential Building at IHBAS during 2012-13 SH: Aluminium partition for ANS office in old
emergency block.
8. Copies of other drawings and documents pertaining to the works will be open for inspection by the tenderers at
the office of the above-mentioned officer.
Tenderers are advised to inspect and examine the site and its surroundings and satisfy themselves before
submitting their tenders as to the nature of the ground and sub-soil (so far as is practicable), the form and nature
of the site, the means of access to the site, the accommodation they may require and in general shall themselves
obtain all necessary information as to risks, contingencies and other circumstances which may influence or affect
their tender. A tenderer shall be deemed to have full knowledge of the site whether he inspects it or not and no
extra charges consequent on any misunderstanding or otherwise shall be allowed. The tenderer shall be
responsible for arranging and maintaining at his own cost all materials, tools & plants, water, electricity access,
facilities for workers and all other services required for executing the work unless otherwise specifically provided
for in the contract documents. Submission of a tender by a tenderer implies that he has read this notice and all
other contract documents and has made himself aware of the scope and specifications of the work to be done
and of conditions and rates at which stores, tools and plants, etc. will be issued to him by the Government and
local conditions and other factors having a bearing on the execution of the work.
9. The competent authority on behalf of the Chairman Executive Council, IHBAS does not bind himself to accept the
lowest or any other tender and reserves to himself the authority to reject any or all the tenders received without
the assignment of any reason. All tenders in which any of the prescribed condition is not fulfilled or any condition
including that of conditional rebate is put forth by the tenderer shall be summarily rejected.
10. Canvassing whether directly or indirectly, in connection with tenders is strictly prohibited and the tenders
submitted by the contractors who resort to canvassing will be liable to rejection.
11. The competent authority on behalf of Chairman Executive Council, IHBAS reserves to himself the right of
accepting the whole or any part of the tender and the tenderer shall be bound to perform the same at the rate
quoted.
12. The contractor shall not be permitted to tender for works in the IHBAS (responsible for award and execution of
contracts) in which his near relative is posted as Divisional Accountant or as an officer in any capacity between
the grades of Superintending Engineer and Junior Engineer (both inclusive). He shall also intimate the names of
persons who are working with him in any capacity or are subsequently employed by him and who are near
relatives to any officer in the Institute. Any breach of this condition by the contractor would render him liable to
be removed from the approved list of contractors of this Department.
13. No Engineer of gazetted rank or other Gazetted officer employed in Engineering or Administrative duties in an
Engineering Department of IHBAS is allowed to work as contractor for a period of two years after his retirement
from Government service, without the previous permission of IHBAS in writing. This contract is liable to be

cancelled if either the contractor or any of his employees is found any time to be such a person who had not
obtained the permission of IHBAS as aforesaid before submission of the tender or engagement in the contractor’s
services.
14. The tender for the works shall remain open for acceptance for a period of sixty days from the date of opening of
tenders. If any tenderer withdraws his tender before the said period or makes any modifications in the terms and
conditions of the tender which are not acceptable to the department, that the Government shall, without
prejudice to any other right or remedy, be at liberty to forfeit 50% of the said earnest money as aforesaid. Further
the tenderer shall not be allowed to participate in the re-tendering process of the work
15. This Notice Inviting Tender shall form a part of the contract document. The successful tenderer/contractor, on
acceptance of his tender by the Accepting Authority, shall, within 15 days from the stipulated date of start of the
work sign the contract consisting of: -
a) The notice inviting tender, all the documents including additional conditions, specifications and drawings, if any,
forming the tender as issued at the time of invitation of tender and acceptance thereof together with any
correspondence leading thereto.
b) Standard C.P.W.D. Form 7/8
16. In case of any difference / ambiguity between English & Hindi versions, English version shall prevail.
17. The department shall Deduct Income Tax on the value of work done from each bill of the contractor as per
prevailing Govt. instructions / order. In lieu the department shall issue a certificate of deduction of the tax at
source to the contractor in relevant form.
18. The tenderer must be registered under Delhi Value Added Tax and shall submit an affidavit that up to date
returns have been filed and agency has no due towards sale Tax/ Vat department, he/she shall also submit
copies of all the return filed in the sale tax / vat department
19. The Department shall deduct CESS @1%on the value of work done from each bill of the contractor as per
prevailing Government instruction / order. In lieu, the department shall issue a certificate of deduction at tax at
services to the contractor in relevant form.
20. In the tender document, the word ‘CPWD’ shall included “PWD (GNCTD)” whichever exists.
21. For Composite Tenders: -
21.1.1 The tenderer must associate with himself agencies of the appropriate class eligible to tender for the other
components individually.
21.1.2 It will be obligatory on the part of the tenderer to sign the tender documents for all the components (The
schedule of quantities, conditions and special conditions etc.)
21.1.3 After the work is awarded, the contractor will have to enter into separate agreements for each
component with the Officer concerned.
21.1.4 Executive Engineer in charge of minor components shall make interim payments in respect of minor
components of work. Executive Engineer in charge of the major component shall make the payment
against final bill of the composite contract.

21.2 The Executive Engineer Incharge of the major component will call tenders for the composite work. The cost of
tender document and Earnest Money will be fixed with respect to the combined estimated cost put to tender for
the composite tender. Security Deposit will be worked out separately for each component corresponding to the
estimated cost of the respective component of works. The Earnest Money will become part of the security
deposit of the major component of work.
21.3 On acceptance of the composite tender by the competent authority the letter of award will be issued by the
Executive Engineer Incharge of the major component on behalf of the Chairman Executive Council, IHBAS, making
it clear in the letter of award that the contractor will have to execute separate agreements for different
components of work with the concerned Officers of the respective discipline (Designation to be given).
21.4 The tender from consisting of schedule of qty alongwith the conditions can be seen on the website
www.delhigovt.nic.in. However, the information given on the website is illustrative in nature and the
downloaded tenders shall be accepted.

T E N D E R
I/We have read and examined the notice inviting tender, schedule, A, B, C, D, E & F. Specifications applicable, Drawings &
Designs, General Rules and Directions, Conditions of Contract, clauses of contract, Special conditions, Schedule of Rate &
other documents and Rules referred to in the conditions of contract and all other contents in the tender document for
the work.
I/We hereby tender for the execution of the work specified for the Chairman Executive Council, IHBAS within the time
specified in Schedule ‘F’, viz., schedule of quantities and in accordance in all respects with the specifications, designs,
drawings and instructions in writing referred to in Rule-I of General Rules and Directions and in Clause 11 of the
Conditions of contract and with such materials as are provided for, by, and in respects in accordance with, such conditions

TERMS AND CONDITIONS
A/R & M/O to Residential & Non Residential Building at IHBAS during 2012-13 SH: Aluminium
partition for ANS office in old emergency block.
Site Conditions:
The work shall be carried out at Institute of Human Behaviour and Allied Sciences, G.T. Road,
Dilshad Garden, Delhi.
1.0 GENERAL SPECIFICATION
1.1 The work in general shall be carried out in accordance with the CPWD Specifications 2009 Vol. I to II with up-todate
correction slips.
1.2 The order of preference in case of any discrepancy as indicated in condition no. 8.1 under “Conditions of
Contract” given in the Standard CPWD Contract form may be read as the following:
a) Nomenclature of item as per Schedule of Quantities
b) Particular specifications and special conditions for civil and electrical.
c) General Specification
d) Additional conditions
e) Contract Clauses of Standard CPWD Contract form
f) CPWD Specifications for civil and electrical as applicable.
g) Architectural/structural drawings and specifications mentioned in drawings.
h) Indian Standard Specifications of BIS
i) Manufactures specifications.
j) Sound engineering practice as per directions of the Engineer-in-Charge.
A reference made to any Indian Standard Specifications in these documents, shall imply reference to the latest
version of that standard, including such revisions/ amendments as issued by the Bureau of Indian Standards upto
last date of receipt of tenders. The contractor shall keep at his own cost all such publications of relevant Indian
Standards applicable to the work at site.
1.3 The tenderer shall study carefully, the building drawings, specifications, schedule of quantities and conditions of
the tender documents to fully appreciate the scope of work before quoting his rates.
1.4 The disposal of building rubbish shall be disposed off at the authorized dumping ground after obtaining
permission from the department concerned. The charges of the local body if any shall be borne by the
contractor.
1.5 Existing drains, pipes, cables, overhead wires, sewer lines, water lines and other services encountered in the
course of the execution of the work shall be protected against the damage by the contractor at his own expense.
The contractor shall not store materials or otherwise occupy any part of the site in a manner likely to hinder the
operation of such services.
1.6 The contractor shall be responsible for the watch and ward of the material provided by him against pilferage and
breakage during the period of Execution and thereafter till the work is physically handed over to the department.
1.7 For recording measurements and also for preparing abstract the agreement item number both in words as well as
in figures should be given neatly instead of writing description of item in full or abbreviated form, which is not to

be followed in case of extra/substitute items of work those are not covered in the agreement for which full
nomenclature will be produced in the M.B.
The full nomenclature of the item shall be adopted in preparing the abstract of cost of final bill and also in bill of
form.
1.8 Samples of all building materials, fittings and other articles required for execution of the work shall be got
approved from the Engineer-in-Charge . Article manufactured by the Firms of repute and approved by the
Engineer-in-Charge shall only be used. Articles classified as “First Quality” by the manufacturer shall be used
unless otherwise specified. All materials and articles brought by the contractor to the site for use shall conform to
the samples approved by the Engineer-in-Charge which shall be preserved till the completion of the work.
1.9 The contractor shall be required to produce samples of all materials to be arranged and procured by him
sufficiently in advance to obtain approval of the Engineer-in-Charge. Subsequently the materials to be used in
the actual execution of the work shall be strictly of the same quality of samples approved. In case of variation in
the quality, such materials shall be liable to rejection. The contractor at his own cost shall immediately remove
the rejected material from the site of work. If the contractor fails to remove the rejected material from the site
within 48 hours of their rejection, the Engineer-in-Charge is authorized to remove the same at the risk and cost of
the contractor. No claim financially or otherwise shall be entertained on account of any reason whatsoever.
1.10 The water used shall conform to the requirement as laid down in IS: 456-2000.
TERMS OF PAYMENT
The department shall not pay advance payment against the supply of materials at site. All the payments shall be made
against the completed works only. However running payments can be made on request on prorata basis against the
completed work of particular block if found in order and to the satisfaction of Engineer in Charge or his authorized
representative. Contractor shall complete the work as per time schedule and he will not link the progress of the work
with the running payments.
SECURITY DEPOSIT:
Security Deposit shall be deducted from each running bill and the final bill to the extent of 5 % of the gross amount
payable subject to maximum limit of 5% of the tendered value of work. The earnest money deposit shall be adjusted
against this security deposit. The security deposit shall be released on the expiry of guarantee and maintenance period
stipulated in the contract.
RATES:
The rates quoted by the tenderer, shall be firm and inclusive of all taxes (including works contract taxes), duties and levies
and all charges for packing forwarding, insurance, freight and delivery, installation, testing, commissioning etc. at site i/c
watch & ward of the material risk, overhead charges and general liabilities/obligations. Rates shall be firm for the
contractual period of time and for such time for which department shall grant extension of time till completion of work.
The contractor has to carry out routine & preventive maintenance for six months from the date of handing over. Nothing
extra shall be paid for carrying out such work.
Octroi Duty shall not be paid separately but the department on demand can furnish octroi exemption certificate.
However, the department is not liable to reimburse the octroi duty in case the concerned authorities do not honour
exemption certificates.

TAXES AND DUTIES:

The rates quoted by the tenderer, shall be firm and inclusive of all taxes (including works contract taxes), duties
and levies as per terms & conditions of NIT. Any additional tax or any variation in taxes shall be applicable as
per clauses of 37 & 38 of “General Conditions of contract for CPWD works 2010” which will be a part of
agreement.
ESCALLATION / PRICE VARIATION CLAUSE:
Since the completion period of the work is less than eighteen months the price variation clause shall not be applicable.
However suitable extension of time shall be granted for the unforeseen hindrances at site of work from department side
as per relevant clauses of “General conditions of contract for CPWD works 2010” which will be a part of agreement.
STORAGE AND CUSTODY OF MATERIALS:
The department shall provide no separate storage accommodation. Watch and ward of the stores and their safe custody
shall be the responsibility of the contractor till the final taking over of the completed works by the department.
CARE OF THE BUILDING:
Care shall be taken by the contractor while handling and installing the various equipments and components of
the work to avoid damage to the building. He shall be responsible for repairing all damages and restoring the
same to their original finish at his cost. He shall also remove at his cost all unwanted and waste materials
arising out of the installation from the site of work.
PERFORMANCE GUARANTEE
The successful tenderer shall submit an irrevocable performance guarantee of 5% of the tendered amount in addition to
other deposits mentioned elsewhere in the contract for his proper performance of the contract agreement within the
period of specified in clause I of schedule F. This guarantee shall be in the form of government securities or fixed deposit
receipts or guarantee bonds of any scheduled bank or the State Bank of India in the specified format. The performance
guarantee shall be initially valid up to the stipulated date of completion plus 60 days beyond. This bank guarantee kept
valid till the recording of completion certificate for the work by the Engineer in charge.
AFTER AWARD OF WORK
The successful tenderer would be required to submit the following drawings within 10 days of award of work for approval
before commencement of work.
(a) All general arrangement drawings.
(b) Any other drawing / information not specifically mentioned above but deemed to be necessary for the job by the
contractor
SITE CLEARANCE AND CLEAN-UP
The contractor shall from time to time, clear away all debris and excess materials accumulated at the site.
SITE ORDER BOOK
The Junior/Assistant Engineer from the department shall maintain a site order book at the site office. The Engineer in
charge or his authorized representatives, along with contractor’s compliance, shall record all instructions relating to the
job. Contractor is bound to sign the site order book and carry out all such instructions given to him.

VALADITY
Tenders shall be valid for acceptance for a period of 60 days from the date of opening of tender.

INDEMNITY:
The successful tenderer shall at all times indemnify the department, consequent on this works contract. The successful
tenderer shall be liable, in accordance with the Indian Law and Regulations for any accident occurring due to any cause
and the department shall not be responsible for any accident or damage incurred or claims arising there from during the
period of erection, construction and putting into operation the equipments and ancillary equipment under the
supervision of the successful tenderer in so far as the latter is responsible. The successful tenderer shall also provide all
insurance including third party insurance as may be necessary to cover the risk. No extra payment would be made to the
successful tenderer due to the above.
COOPERATION WITH OTHER AGENCIES
The successful tenderer shall co-ordinate with other Contractors, Agencies engaged in the construction of building, if any,
and exchange freely all technical information so as to make the execution of this works contract smooth. No
remuneration should be claimed from the department for such technical cooperation. If any unreasonable hindrance is
caused to other Agencies and any completed portion of the work has to be dismantled and re-done for want of
cooperation and cooperation by the successful tenderer during the course of work, such expenditure incurred will be
recovered from the successful tenderer if the restoration work to the original condition or specification of the dismantled
portion of the work was not undertaken by the successful tenderer himself.
MOBILIATION ADVANCE
No mobilization advance shall be paid for this work.

of Department of Telecommunications, M.E.S. and Railways. The intending tenderers should have produce necessary
attested copies of registration in the appropriate class & category, registration in VAT, VAT returns, Permanent Account
