Editorial<br />

For India’s children, the clock is ticking rather<br />

ominously. Schools in city continue to practice<br />

corporal punishment despite laws prohibiting<br />

spanking at educational institutes. In the movie<br />

“Taare Zaamein Par”, an angry father theartens<br />

his son just because the boy was not performing<br />

well in studies. Same way in the movie<br />

“Udaan”, an angry father would beat up his son<br />

just because he aspired to be a writer instead<br />

of pursuing engineering. Such tyrant fathers<br />

may have to be extremely careful in the future<br />

if Maneka Gandhi, the Union Cabinet Minister<br />

for Women and Child Development has her<br />

way. Beating a child, verbally abusing a kid or<br />

inflicting any kind of corporal punishment could<br />

soon attract a stringent jail term of upto five<br />

years. Similarly, college bullies may soon have<br />

to amend their way since cases of ragging<br />

could attract a jail term of upto three years.<br />

The Government of India is in the process of<br />

amending the Juvenile Act of 2000 and these<br />

are some of the suggestions which the draft Bill<br />

plans to incorporate in the Act. The new bill<br />

tries to ensure that rights of children, often<br />

undermind in our society are given their due.<br />

The Bill has already been circulated for interministerial<br />

consultation by<br />

Maneka Gandhi. If<br />

the Bill is ratified by<br />

the parliament, India<br />

will join an elite club<br />

of 40 countries which<br />

adopted a No-<br />

Tolerance Policy on<br />

corporal punishment<br />

by making it a penal<br />

offense.<br />

Selling or Procuring<br />

a child for any<br />

purpose, using a child for vending, peddling,<br />

carrying, supplying intoxication liquor through<br />

children, using a child for terrorist activities are<br />

also among the offences that the government<br />

is looking to bring into new law. Notably, Delhi<br />

Judge Kamini Lau had recently pointed out<br />

absence of a specific law to make selling a<br />

child a penal offence, while noting, “Infants are<br />

sold in bachcha baazar like potatoes, tomatoes<br />

and onions.” The proposed law seeks to make<br />

illegal adoption or transfer of a child an offence<br />

punishable upto Seven years in jail. It also<br />

gives a statutory status to the Central Adoption<br />

Resource Authority (CARA) to regulate<br />

adoptions keeping in view the best interest of<br />

the child. All offences against any disabled<br />

child have been sought to attract twice the<br />

penalty that would otherwise be imposed. The<br />

proposed law also seeks to usher in certain<br />

new principles as far as delinquent juveniles<br />

are concerned. These principles include<br />

principle of presumption of innocence, principle<br />

of dignity and worth, principle of best interest,<br />

principle of family responsibility and safety.<br />

The most significant, however appears to be<br />

the principle of participation, wherein every<br />

child has been given “a right to be heard and<br />

to participate in all processes and decisions<br />

affecting his or her interest and the child’s view<br />

shall be taken into consideration with due<br />

regards to the age and maturity of the child.”<br />

I hope Independence Day will give new<br />

strength and freedom of quality life to our<br />

upcoming generation.<br />
