FOREWORDThe information in this publication is provided as a means of technical assistance to Illinoispublic school districts, regional superintendents, architects and engineers. The <strong>Health</strong>/<strong>Life</strong><strong>Safety</strong> Handbook is a reference manual for understanding various requirements, processes,and forms used in administering the health/life safety code as referenced in 23 IllinoisAdministrative Code, Subtitle A, Part 180, <strong>Health</strong>/<strong>Life</strong> <strong>Safety</strong> Code for Public Schools andshould be used in conjunction with the Administrative Code.This handbook was developed by the Illinois State Board of Education, a committee ofRegional Superintendents, Maria Buzeta from Suburban Cook County ROE #14 and BevLetcher from Boone/Winnebago ROE #4 to create a better understanding of the <strong>Health</strong>/<strong>Life</strong><strong>Safety</strong> for public school districts and regional offices of education. AUTHORITYThis handbook provides guidance to Regional Offices of Education (ROEs) in the oversight ofconstruction, operation and maintenance of schools in their regions. It is also a useful resource fordistrict administrators and architects. Since 1915, Regional Superintendents have been chargedwith the duty:“…to inspect the building plans and specifications…of public school rooms andbuildings…” (ILCS 5/3-14.20)“…to inspect and survey all public schools under his or her supervision…” (ILCS 5/3-14.21)“…to request the Department of Public <strong>Health</strong>, the State Fire Marshal, or the StateSuperintendent of Education to inspect public school buildings and temporary facilitieswhich appear to him to be unsafe, unsanitary, or unfit for occupancy. These officialsshall inspect such buildings or temporary school facilities and if, in their opinion, suchbuildings and temporary facilities are unsafe, unsanitary or unfit for occupancy, shallstate in writing in what particular(s) they are unsafe, unsanitary, or unfit foroccupancy. Upon the receipt of such statement the Regional Superintendent shallcondemn the building or temporary facility and notify the school board thereof inwriting and the reasons for such condemnation”… (ILCS 5/3-14.22)To fulfill these duties, Regional Superintendents are to utilize the “minimum standards” establishedby the State Board of Education pursuant to Section 2-3.12 of the School Code. In 1965, RegionalSuperintendents were charged with the additional duty to review and approve “<strong>Safety</strong> SurveyReports” pursuant to the provisions of Section 2-3.12 of the School Code as amended. They werealso charged with duties concerning the review and approval of amounts of funds to be raisedthrough tax levies or sale of bonds for fire prevention, safety, energy conservation, handicappedaccessibility, school security and specific repair purposes. (ILCS 5/2-3.12 and 5/17-2.11) The rulesestablished relative to these duties are contained in Title 23 Part 180 of the Illinois AdministrativeCode, also referred to as “The <strong>Health</strong>/<strong>Life</strong> <strong>Safety</strong> Code for Public Schools.”ii

School Building Construction/Reconstruction Permit ProcessSchool building construction involves obtaining a building permit, securing a statement of compliance,and issuing an occupancy permit. A building permit is not required for "minor repairs" as explainedbelow.Building Permit ChecklistIf your project has any one (1) of the following, you must complete the Application for a BuildingPermit and submit it to the Regional Office of Education. After examination and approval of theproject, including appropriate drawings, a Building Permit will be issued.£ Repairs to a facility, which, aggregated over the course of a year, cost more than $20,000*£ Change in Use: any change in how an existing facility is operated and utilized which involves:£ structural strength£ ingress or egress£ electrical system(s)£ plumbing system(s)£ fire protection system(s)£ Cutting away of any wall, partition, or portion of the same£ Cutting or removal of a structural beam or load bearing support£ Removal or change in a required means of egress£ Rearrangement of parts affecting:£ exit requirements£ addition to, alteration of, replacement or relocation of any standpipe, drain leader, gas, soil,waste, water supply, sewer drainage, vent or similar piping£ electrical wiring£ mechanical£ other required building system* Minor repairs, which do not require a Building Permit, are defined as: any repairs to a facility, which,aggregated over the course of a year, cost less than $20,000.1- -2

Annual Building InspectionOverviewThe primary purpose of an annual inspection is to ensure that schools are safe, sanitary, and fitfor occupancy. It may also serve to confirm that school boards are making reasonable progresswith previously issued orders to effect compliance.By law, all public schools must be inspected at least once each year by the Regional Office ofEducation. This includes facilities that are leased or rented by the district and used for schoolpurposes. The extent and detail involved in an inspection depends upon the nature of thefacility to be inspected. Factors such as size, complexity, age, previous conditions, etc., shouldbe taken into consideration in planning and conducting inspections.Districts must maintain their school buildings in continuous compliance with minimum standardsand be inspected annually. During the course of the year, a particular facility may be inspectedat the discretion of the Regional Superintendent. Facilities may be inspected more frequently ifthe Regional Superintendent determines that it is necessary to do so.2-2

OVERVIEW OF TEN-YEAR SURVEY PROCESSSection 2-3.12Within 2 years after September 23, 1983, and every 10 years thereafter, or at such other times as theState Board of Education deems necessary or the regional superintendent so orders, each schoolboard subject to provisions of Section 2-3.12 of the School Code, shall conduct a <strong>Safety</strong> SurveyReport of all its school buildings in accordance with the following procedures in this chapter.An architect or engineer licensed in the State of Illinois is required to conduct the surveys under theprovisions of Section 2-3.12 and shall make a report of the findings of the survey titled “<strong>Safety</strong> SurveyReport” to the school board. The school board shall approve the <strong>Safety</strong> Survey Report, including anyrecommendations to effectuate compliance with the code, and submit it to the RegionalSuperintendent. For each year that the school board does not effectuate any or all approvedrecommendations, it shall petition the Regional Superintendent and the State Superintendent ofEducation detailing what work was completed in the previous year and a work plan for completion ofthe remaining work for an extension of time (Page 4-29, form 36-25).Items in the report shall be prioritized. Urgent items shall be considered as those items related to lifesafety problems that present an immediate hazard to the safety of students. Required items shall beconsidered as those items that are necessary for a safe environment but present less of animmediate hazard to the safety of students. Urgent and required items shall reference a specific rulein the code authorized by this Section that is currently being violated or will be violated within the next12 months if the violation is not remedied. The school board of each district so surveyed andreceiving a report of needed recommendations to be made to maintain standards of safety andhealth of the pupils enrolled shall effectuate the correction of urgent items as soon as achievable toensure the safety of the students, but in no case more than one year after the date of the StateSuperintendent of Education’s approval of the recommendation.3-2

SAFETY REFERENCE PLANS & GUIDELINES(To be completed with the 10-Year Survey Report)<strong>Health</strong>/<strong>Life</strong> <strong>Safety</strong> Code for Public SchoolsBased on 23 Illinois Administrative Code 180Section 180.120 <strong>Safety</strong> Reference PlansThe following <strong>Safety</strong> Reference Plan description is a step the Illinois State Board of Education requires inthe Annual Fall Regional Office of Education Inspection. It is important to note that these plans must be“as built” plans. Most districts will have these plans already available within the district, but one set willneed to be kept in the building.<strong>Safety</strong> reference plans shall serve as a means of indicating the safety-related conditions of a facility, asan aid in developing emergency exit plans, and in other circumstances where reference to overall layoutsis necessary.a) Each local school board shall maintain up-to-date safety reference plans for all facilities owned orused by the district for any school purpose. These plans shall reflect all additions, alterations andother changes to these facilities that affect the arrangement, use, rated capacity, student capacity,or other information required to be shown thereon. Each set of safety reference plans shall include1) A site plan meeting the requirements of subsection (e) of this Section;2) Schematic floor plans as described in subsection (f) of this Section;3) An attic plan meeting the requirements of subsection (h) of this Section, if required pursuant tosubsection (g) of this Section; and4) Such additional drawings and or schedules as may be necessary to effectively describe thenature and operational characteristics of the facility in question.b) <strong>Safety</strong> reference plans shall be drawn to scale, using a medium suitable for reproduction andrevision. The kitchen is providedwith 3500 cfm of exhaust over the rangeand ovens and 940-cfm over thedishwasher. The industrial shops haveindividual exhaust connections to the dustproducingequipment as well and theexhaust systems meet all Coderequirements for their particular area. Thefoundry area 05 lacks an exhaust hood overthe two kilns.AIR CONDITIONING:None.WATER HEATER: Domestic hot water is provided by a 920-gallon storage tank heated by a gas-firedwater heater of 199,000 BTU input. Anadditional 8-gallon natural-gas-fired waterheater is located in the kitchen area of the1958 and 1963 addition. An additional8-gallon, electric water heater is located inthe art room. The temperature of water inthe storage tank is 150 F.INCINERATOR:GAS SERVICE:ELECTRICAL SYSTEM:None.Natural gas enters the building on the eastside of the boiler room where it is metered,pressure regulated and provided with anoutside shut-off. The gas piping runs abovethe ceiling of the 1958-63 cafeteria-kitchenaddition. This area is unvented and mustbe brought into line with Rule 185.485casper our recommendations.Electric service is underground, rated208/120 volt, 3 phase, 4 wire. The mainservice has a maximum demand of 8003-16


ampere and is capable of 2000 ampere.The non-metallic sheathed cable used insome of the recent remodeling work is not inconformance with Code requirements.Lighting in all areas is above the minimumstandard as set up by the Code.PLUMBING:There are adequate numbers of plumbingfixtures in this facility. Several fixtures havebeen removed or destroyed and the wastepipes are still open to the atmosphere.Sewage disposal through 2-6’ tiles to themunicipal sanitary sewer system.Main located along the westerly propertyline.VI.PRIVATE PROTECTIONFIRE ALARM SYSTEM: A non-coded, continuous-ringing,supervised fire alarm system with maincontrol panel located in Office 114,consisting of break-glass stations andhorns, presently exists in this building.Certain additions must be made to thissystem in order to meet the requirements ofthe “Building Specifications.”AUTOMATIC SPRINKLERS:AUTOMATIC HEAT DETECTION:There are no sprinklers in this building.There are automatic heat detectors locatedas indicated in the drawings.STANDPIPE HOSE LINES:FIRE EXTINGUISHERS:None.Portable fire extinguishers are located asindicated on the drawings. Guidelines for Paving WorkSince January 1, 1994, the Illinois State Board of Education has been authorized to approve the useof <strong>Health</strong>/<strong>Life</strong> <strong>Safety</strong> Funds for repairing school sidewalks, playgrounds, parking lots, and school busturnarounds if the funds are not needed for fire prevention and safety purposes. (Section 17-2.11 ofthe School Code)1. Repairs should be considered when there is a "substantial, immediate, andotherwise unavoidable threat to the health, safety, or welfare of pupils." Disrepairmeans that the surface of the sidewalks, playgrounds, parking lots, and/or schoolbus turnarounds is so extensively pitted, broken or cracked so as to cause trippingor falling when walking or running, or cause a child to be jolted out of the seat of amoving bus.2. The local school board determines when such conditions exist. An architect orengineer, licensed in the State of Illinois, must certify that the condition exists and therepairs are needed.3. <strong>Health</strong>/<strong>Life</strong> <strong>Safety</strong> Funds can only be used when there are no fire prevention andsafety projects pending. A Certificate of Compliance must be on file for all buildings inthe district before <strong>Health</strong>/<strong>Life</strong> <strong>Safety</strong> Funds can be considered for these purposes. Orif there is an outstanding amendment, both the life safety amendment and pavingrepairs must be completed at the same time (and within one year).4. Temporary Facility ProcessA temporary facility is one which does not comply with all the requirements of 23 Ill. Adm. Code,Part 180. If any facility meets the requirements for permanent occupancy (as determined bycompleting an Application for Occupancy Permit, Form 36-15), it is a permanent facility and willbe inspected annually by the Regional Office of Education. No annual renewal using theTemporary Facility Checklist is necessary.If a facility used by a school district cannot be brought into full compliance, it is considered aTemporary Facility. Condemnation of School Buildings and Temporary FacilitiesA school building must be condemned anytime the regional superintendent feels that thebuilding is in such a state that occupancy by students and personnel will, without question,jeopardize their lives. The regional superintendent must also request the assistance of theIllinois Department of Public <strong>Health</strong> and/or State Fire Marshal to confirm the hazardouscondition of the school building.Section 105 ILCS 5/3-14.22 of the School Code states:Sec. 3-14.22 Condemnation of school buildings. To request theDepartment of Public <strong>Health</strong>, the State Fire Marshal or the State Superintendentof Education to inspect public school buildings and temporary school facilitieswhich appear to him to be unsafe, unsanitary or unfit for occupancy. Theseofficials shall inspect such buildings and temporary school facilities and if, in theiropinion, such buildings or temporary facilities are unsafe, unsanitary or unfit foroccupancy, shall state in writing in what particular they are unsafe, unsanitary orunfit for occupancy. Upon the receipt of such statement the regionalsuperintendent shall condemn the building or temporary facility and notify theschool board thereof in writing and the reasons for such condemnation. He shallalso notify, in writing, the board of school trustees that the school or temporaryfacility so condemned is not kept as required by law.The provisions of this Section shall not preclude inspection of schoolpremises and buildings pursuant to Section 9 of the Fire Investigation Act [425ILCS 25/9], although not requested as herein above provided. (Source P.A.84-25; 87-984, § 1.)Some of the reasons for condemnation of a school building are fire, natural disaster andextremely poor maintenance. To condemn a building does not mean that the building will bedemolished. Regional Superintendent Demolition Inspection Checklistcccccccc1. Site plan:Verify that the application for demolition permit be accompanied by a site plan showing to scale the size andlocation of all existing structures on the site, distances from lot lines, the established street grades and theproposed finished grades; and it shall be drawn in accordance with an accurate boundary line survey. Thesite plan shall show all construction to be demolished and the location and size of all existing structures andconstruction that are to remain on the site or plot. Note accuracy of the site plan.2. Service connections:Verify that before a structure is demolished or removed, the owner or agent shall notify all utilities havingservice connections within the structure such as water, electric, gas, sewer and other connections. A permitto demolish or remove a structure shall not be issued until a release is obtained from the utilities, stating thattheir respective service connections and appurtenant equipment, such as meters and regulators, have beenremoved or sealed and plugged in a safe manner. Check all utilities to insure connections are disconnected.3. Notice to adjoining owners of intent, demolition and excavation:Verify that when a written notice has been given by the applicant to the owners of adjoining each potentiallyaffected lot (not across a street) for notice of building demolition it is at least one week prior to thecommencement of work. Then a permit shall be granted for the removal of a building or structure.4. Other laws:Mention to the demolition contractor that nothing herein contained shall be construed to nullify any rules,regulations or statutes of state or federal agencies governing the protection of the public or workers fromhealth or other hazards. The contractor must follow OSHA, IEPA, IDPH, and other state and federal rules fordemolition. The contractor shall contact each agency.5. Portable fire extinguishers:Verify that all buildings under demolition shall be provided with at least one portable fire extinguisher with aminimum 2-A:20-B:C rating at each exit on all floor levels where combustible materials have accumulated. Aportable fire extinguisher with a minimum 2-A:20-B:C rating shall also be provided in every storage andconstruction shed. Additionally, at least one portable fire extinguisher shall be provided where specialhazards, such as flammable or combustible liquid storage, exist.6. Buildings under demolition:Verify that when the building is being demolished and a standpipe is existing within such a building, suchstandpipe shall be maintained in an operable condition so as to be available for use by the fire department.Such standpipe shall be demolished with the building but shall not be demolished more than one floor belowthe floor being demolished.7. Maintenance:Verify that in case an existing party wall is intended to be used by the person who causes an excavation tobe made, and such party wall is in good condition and sufficient for the use of both the existing and proposedbuilding, such person shall preserve the party wall from injury and shall support the party wall by properfoundations at said person's own expense, so that the wall is and remains as safe and useful as the partywall was before the excavation was commenced. During the demolition, the party wall shall be maintainedweatherproof and structurally safe by adequate bracing until such time as the permanent structural supportshave been provided.8. Adjoining roofs:Verify that where the demolition of an existing building is being conducted at a greater height, the roof, roofoutlets and roof structures of adjoining buildings shall be protected against damage with adequatesafeguards by the person doing the work.6-6


cccccc9. Removal of debris:Verify that all waste materials be removed in a manner which prevents injury or damage to persons,adjoining properties and public rights-of-way.10. Grading of lot:Where a structure has been demolished or removed and a demolition permit has not been approved, thevacant lot shall be filled, graded and maintained in conformity to the established elevation of the street gradeat curb level nearest to the point of demolition or excavation. Provision shall be made to prevent theaccumulation of water or damage to any foundations on the premises or the adjoining property.11. Retaining walls and partition fences:Verify that the adjoining grade is not higher than the legal level, the person causing an excavation to bemade shall erect, where necessary, a retaining wall at his or her own expense and on his or her own land.Such wall shall be built to a height sufficient to retain the adjoining earth, shall be provided with a guardrail orfence not less than 42 inches (1067 mm) in height.12. Removal of waste material:Verify that material shall not be dropped by gravity or thrown outside the exterior walls of a building duringdemolition. Wood or metal chutes shall be provided for the removal of such materials. Where the removal ofany material will cause an excessive amount of dust, such material shall be wet down to prevent the creationof a nuisance.13. Lighting:Verify that all stairways and parts of buildings under demolition shall be adequately lighted while persons areengaged at work.14. Fire department access:Verify that fire department access shall be provided and maintained to all structures undergoing demolition.Fire department access roadways shall be of an approved surface material capable of providing emergencyvehicle access and support at all times, and shall be a minimum of 18 feet (5486 mm) in unobstructed width.The access roadways shall provide a minimum turning radius capable of accommodating the largest fireapparatus of the jurisdiction and a minimum vertical clearance of 13 1/2 feet (4115 mm).Form 36-34 (3/04) (Prescribed by the Regional Superintendent for local board use) 180.2406-7

Code InformationWhen are Part 180, Part 185 and Part 175 of the Il Adm Code used in inspecting a building?Generally, every school board shall secure approval from the regional superintendent for anyconstruction or like activity subject to the requirements of Part 180. (See Section 180.40c).Every facility (other than vehicular unit) and new structures shall conform to the requirementsof Part 180, which references the BOCA National Building Code; the Illinois Accessibility Codeinstead of the accessibility provisions stated in Chapter 11 of BOCA; the Illinois Plumbing Codeinstead of those expressed in the BOCA National Plumbing Code incorporated in Chapter 35;and the Illinois State Fire Marshal's rule titled Boiler and Pressure Vessel <strong>Safety</strong> instead ofthose expressed in Boiler and Pressure Vessel <strong>Safety</strong> Code published by ASME 89 asincorporated by BOCA in Chapter 35. (See Section 180.60).BOCA permits an existing facility to be maintained in compliance with the building code thatpreviously applied to the facility. All equipment, systems, devices and safeguards required bya previous code or statute for the structure or premises when erected or altered shall bemaintained in good working order. The requirements of BOCA Chapter 34 shall not provide thebasis for removal or abrogation of fire protection and safety systems and devices in existingstructures. In summary, the "<strong>Health</strong>/<strong>Life</strong> <strong>Safety</strong> Code for Public Schools," Part 180, stipulates that BuildingOfficials and Code Administrators International (BOCA) permits a facility constructed prior to itseffective date to be maintained in compliance with the building code that previously applied tothe facility.Part 185 is followed for buildings built before July 1, 1965. Part 175 is followed for buildingsbuilt between July 1, 1965, and March 24, 1995. School Code Part 180 is followed forbuildings built after March 24, 1995, and amended on July 6, 1998.However, if the replacement for an existing item can not be made due to various reasons, thenthe replacement is to be done complying with the requirements of BOCA for new building, butshall not make the building more hazardous by doing so.7-3
