4. No censure or other adverse action will be taken against anygrievant or administrator participating in this grievance procedure.5. Only the Federation shall have the right to determine if a grievanceis to proceed to arbitration.6. For arbitration hearings, on a given day not more than three (3)employees other than the grievant and grievant's representativeshall be excused from work without loss <strong>of</strong> pay, benefits, orprivileges. Increments <strong>of</strong> excused time may be used.7. Except as provided in Paragraph 1 <strong>of</strong> this section, the <strong>Board</strong> and13.04 Negotiations Proceduresthe Federation shall equally share in the fees and expenses <strong>of</strong> thearbitrator and any expense incidental to the arbitration proceeding.Each party will be responsible for the fees and expenses <strong>of</strong> itsrepresentative.A. Negotiation PrinciplesThe <strong>Board</strong> <strong>of</strong> <strong>Education</strong> <strong>of</strong> the <strong>New</strong> <strong>Lebanon</strong> Local <strong>School</strong>s hereinafterreferred to as the "<strong>Board</strong>", and the <strong>New</strong> <strong>Lebanon</strong> Federation <strong>of</strong> Teachers,hereinafter referred to as "NLFT", state that the principles stated insucceeding sections <strong>of</strong> this document shall govern the negotiationsprocess between the <strong>Board</strong> and the NLFT.If either the <strong>Board</strong> or NLFT desires to negotiate changes in salaryschedules, fringe benefits, or to other terms and working conditions <strong>of</strong>employment, it shall notify the other party, in writing, no later than three (3)months prior to the expiration date <strong>of</strong> this <strong>Agreement</strong> <strong>of</strong> such desire, andaccording to the terms <strong>of</strong> the negotiating procedure outlined below.Notification in writing from the NLFT shall be submitted to theSuperintendent. Notification in writing from the <strong>Board</strong> shall be addressedto the President <strong>of</strong> the NLFT.B. Choice <strong>of</strong> FormatWithin ten (10) working days after receipt <strong>of</strong> such notice, an initial meetingwill be held between the President <strong>of</strong> the NLFT and the Superintendent todetermine the format for negotiations described as either the "InterestBased Bargaining Approach' or the ''Traditional Collective BargainingApproach."1.
