This plan does not apply to Mt Smart Stadium, the Auckland Botanic Gardens, or<br />

Mutukaroa-Hamlins Hill <strong>Regional</strong> Park. Mt Smart Stadium at Penrose is unlike other regional<br />

parks in that it is used for organised sports and entertainment purposes. The Auckland<br />

Botanic Gardens focus on presenting gardening ideas, taxonomy and plant conservation<br />

programmes. Mutukaroa-Hamlins Hill is jointly owned and managed by the council and<br />

Auckland City Council. These regional parks are covered by separate management plans.<br />

However, it is intended that the high-level principles within this plan will be applied to the<br />

entire regional parks network and will be incorporated into these management plans as they<br />

are reviewed.<br />

It is intended that the general objectives and management policies of this plan will apply to<br />

new acquisitions to the regional park network.<br />

5.3 The The need need for for th the th plan –legislative legislative overview<br />

The council owns and/or manages approximately 40,000 hectares of park land at 26 regional<br />

park locations, 23 of which are covered by this plan. The majority of land the council owns<br />

or manages (about 90 per cent) is administered by the council under the Local Government<br />

Act 2002; however, some (about 10 per cent) is also administered under the Reserves Act<br />

1977.<br />

The Reserves Reserves Act Act 1977 1977 [Section [Section [Section 41] 41] requires the council to prepare reserve management<br />

plans for the parks and reserves they manage. The purposes of these plans are to:<br />

…provide for and ensure the use, enjoyment, maintenance, protection, and<br />

preservation, as the case may require, and, to the extent that the administering<br />

body’s resources permit, the development, as appropriate, of the reserve for the<br />

purpose for which it is classified, and shall incorporate and ensure compliance with<br />

the principles set out in…this Act for a reserve of that classification [Section 41(3)<br />

Reserves Act].<br />

The Local Local Government Government Government Act Act Act 2002 2002 does not require the preparation of a management plan,<br />

however it does allow for one. The council considers it best practice to prepare a plan to<br />

ensure an integrated management approach across the parks network. The process of<br />

preparing the plan requires a consultation and submission process which gives the public<br />

the opportunity to contribute to the formulation of policy and decision-making on matters<br />

that will affect the future of the regional parks. These processes meets the requirements of<br />

Part 6, and more specifically Section 83, of the LGA 2002 (refer to sections 16.2 Review and<br />

variations and 16.6 Consultation and Appendix 2).<br />

The LGA 2002 also provides a framework to establish and maintain processes for Māori to<br />

participate in decision-making. It includes the requirement to take into account the principles<br />

of the Treaty of Waitangi, and the relationship between Māori and land, or a body of water,<br />

where there is a significant decision to be made.<br />

<strong>Regional</strong> Park, requires the council to prepare, adopt and maintain a management plan for<br />

the integrated management of the park. Part of this process requires the council to use the<br />

special consultative procedure set out in section 83 of the LGA 2002, as outlined above.<br />
