full <strong>and</strong> complete final report, concerning such violation or alleged violation (<strong>and</strong> of any requiredinvestigation relating thereto) to the Commissioner.(b)(c)Each member institution shall comply with procedures developed <strong>and</strong> published by the Commissioner, withapproval of the Chief Executive Officers, as such procedures shall be revised from time to time, concerningreporting violations <strong>and</strong> alleged violations of the Rules to the NCAA.The <strong>Conference</strong> office shall not conduct its own investigations but may recommend, among other options,outside resources to work with a member institution in developing necessary information.19.8.2.2 Action by the Commissioner.(a)Upon receipt of the final report required by Bylaw 19.8.2.1(a), the Commissioner shall determine:(i)(ii)(iii)(iv)If the member institution conducted a thorough investigation;If the determination made by the member institution is consistent with the information developedin its review of the allegations;If the information substantiates that a violation of the Rules has occurred; <strong>and</strong>,What, if any, penalties or sanctions should be imposed by the <strong>Conference</strong>, <strong>and</strong> whether anystudent-athlete should be suspended or ruled ineligible.(b)(c)If the Commissioner determines that penalties or sanctions should be imposed or that a student-athleteshould be suspended or ruled ineligible, the Commissioner shall proceed to impose the penalties orsanctions, or issue notice that the student-athlete is suspended or ineligible, as authorized by <strong>and</strong> providedin Article 4 of the <strong>Constitution</strong>.The Commissioner, in his or her discretion, may postpone or decline to take action pending or subsequentto completion of an NCAA investigation <strong>and</strong>/or pending a decision by the NCAA concerning imposition ofpenalties or sanctions or determination of eligibility.19.8.2.3 Reinstatement of Eligibility.(a)(b)A student-athlete, or the member at which a student-athlete is enrolled, may petition the Commissioner toreinstate the student-athlete’s eligibility.The Commissioner may, in his or her discretion, restore a student-athlete’s eligibility if, under all the facts<strong>and</strong> circumstances, the Commissioner concludes that reinstatement is appropriate.19.8.2.4 Appeals.19.8.2.4.1 Unless the Commissioner in his or her discretion stays or delays the effective date, all penalties,sanctions, eligibility determinations, <strong>and</strong> other enforcement or eligibility decisions or actions of theCommissioner shall become effective immediately upon notification to (i) the Athletic Director <strong>and</strong> theChief Executive Officer of the member institution involved, <strong>and</strong> (ii) any student-athlete, coach, or otherathletic department representative or employee affected thereby.19.8.2.4.2 A member institution <strong>and</strong> any student-athlete, coach, or other athletic department representativeor employee affected by a penalty, sanction, adverse eligibility determination, reinstatement determination,or other adverse enforcement or eligibility decision or action (all referred to collectively in the <strong>Constitution</strong><strong>and</strong> <strong>Bylaws</strong> as an “Adverse Action”) has the right to appeal the decision of the Commissioner to theExecutive Committee <strong>and</strong> to further appeal any decision of the Executive Committee to the <strong>Conference</strong>(i.e., to the Chief Executive Officers).19.8.2.4.3 To appeal from an Adverse Action of the Commissioner as provided in Bylaw 19.8.2.4.2, themember institution or individual pursuing the appeal must:33
