The forest is also an importantsource <str<strong>on</strong>g>of</str<strong>on</strong>g> fuelwood, timber and medicines.There have been several shifts in thetraditi<strong>on</strong>al livelihood patterns that replacedbarter system <str<strong>on</strong>g>of</str<strong>on</strong>g> old with commercialactivity, and included also the introducti<strong>on</strong><str<strong>on</strong>g>of</str<strong>on</strong>g> horticulture, plantati<strong>on</strong>, m<strong>on</strong>ocultures andcash crop cultivati<strong>on</strong>. C<str<strong>on</strong>g>of</str<strong>on</strong>g>fee, cashew,pineapple, tobacco are some examples.Large populati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> these tribal people,especially from the VTGs, live in some <str<strong>on</strong>g>of</str<strong>on</strong>g>the most remote and scattered hamlets andvillages with no access to basicinfrastructural facilities like health,educati<strong>on</strong>, roads or transportati<strong>on</strong>. Poverty,malnutriti<strong>on</strong> and ill-health plague them atevery stage in their lives. Today their uniquelanguages, culture, customs and traditi<strong>on</strong>scarefully passed <strong>on</strong> over hundreds <str<strong>on</strong>g>of</str<strong>on</strong>g> yearsis being eroded steadily and is in danger <str<strong>on</strong>g>of</str<strong>on</strong>g>being lost to the future generati<strong>on</strong>s.C<strong>on</strong>stituti<strong>on</strong>al and legalsafeguards for the adivasis inAndhra PradeshThe adivasi communities in the EasternGhats <str<strong>on</strong>g>of</str<strong>on</strong>g> Andhra Pradesh, several <str<strong>on</strong>g>of</str<strong>on</strong>g> whomare VTGs, live in hill-top villages that areremote and difficult to access. Historicallythese communities have been living here forhundreds <str<strong>on</strong>g>of</str<strong>on</strong>g> years, and their existence hasbeen intrinsically linked to the forests,ecology and lands. However, externalinfluences, as far back as the col<strong>on</strong>ial times,have exploited them to access the richnatural resource base in the regi<strong>on</strong>. Thelands and forests <strong>on</strong> which they aredependent have been encroached up<strong>on</strong> byn<strong>on</strong>-tribals and they face a c<strong>on</strong>stant threatfrom development projects that could resultin their displacement (some <str<strong>on</strong>g>of</str<strong>on</strong>g> whichalready have resulted in not <strong>on</strong>e but multipledisplacements). This is inspite <str<strong>on</strong>g>of</str<strong>on</strong>g> the severallegal and C<strong>on</strong>stituti<strong>on</strong>al safeguards thathave been provided to protect their rights.The Fifth Schedule and ScheduledAreasThe Fifth Schedule [under Article 244 (1)(Provisi<strong>on</strong>s as to the Administrati<strong>on</strong> andC<strong>on</strong>trol <str<strong>on</strong>g>of</str<strong>on</strong>g> Scheduled Areas and ScheduledTribes) <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>stituti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> India]essentially provides a historic guarantee tothe tribal people in the country <strong>on</strong> the rightover their lands. The Fifth Schedule dealswith the administrati<strong>on</strong> and c<strong>on</strong>trol <str<strong>on</strong>g>of</str<strong>on</strong>g>specified areas (termed Scheduled Areas)and the tribes living in these areas. ThePresident <str<strong>on</strong>g>of</str<strong>on</strong>g> India, exercising the powersc<strong>on</strong>ferred to him under the Fifth Schedule,in the year 1950 declared specified areas inthe country as Scheduled Areas. Currentlynine states in India—Andhra Pradesh,Chhattisgarh, Gujarat, Himachal Pradesh,Jharkhand, Madhya Pradesh, Maharashtra,Orissa and Rajasthan—have regi<strong>on</strong>sdemarcated as Scheduled Areas.As per the Fifth Schedule the Presidentholds the power to direct that the whole orany specified part <str<strong>on</strong>g>of</str<strong>on</strong>g> a Scheduled Area shallcease to be a Scheduled Area or a part <str<strong>on</strong>g>of</str<strong>on</strong>g>such an area; increase the area <str<strong>on</strong>g>of</str<strong>on</strong>g> aScheduled Area (after c<strong>on</strong>sultati<strong>on</strong> with theGovernor <str<strong>on</strong>g>of</str<strong>on</strong>g> the state); alter the boundariesbut <strong>on</strong>ly by way <str<strong>on</strong>g>of</str<strong>on</strong>g> rectificati<strong>on</strong>, declarethose areas post rectificati<strong>on</strong> as ScheduledAreas, and rescind and make fresh ordersrelevant to Scheduled Areas.Administratively the Fifth Schedule Areasare part <str<strong>on</strong>g>of</str<strong>on</strong>g> the states in which they aresituated. However, the Governor may makeregulati<strong>on</strong>s for the peace and goodgovernance <str<strong>on</strong>g>of</str<strong>on</strong>g> these areas that includeregulati<strong>on</strong>s that (a) prohibit or restrict thetransfer <str<strong>on</strong>g>of</str<strong>on</strong>g> land by or am<strong>on</strong>g members <str<strong>on</strong>g>of</str<strong>on</strong>g> thescheduled tribes (STs) in such area; (b)regulate the allotment <str<strong>on</strong>g>of</str<strong>on</strong>g> land to members <str<strong>on</strong>g>of</str<strong>on</strong>g>11
