Land alienati<strong>on</strong> and violati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the LandTransfer Regulati<strong>on</strong> Act, for purposes <str<strong>on</strong>g>of</str<strong>on</strong>g>private industrial activities is going to havea serious impact <strong>on</strong> the ecological balanceas it would lead to further deforestati<strong>on</strong> bylocal populati<strong>on</strong>s as well as the outsiders. InNALCO area, for instance, it was seen that alarge area <str<strong>on</strong>g>of</str<strong>on</strong>g> land (around 10,000 ha)bey<strong>on</strong>d the requirement <str<strong>on</strong>g>of</str<strong>on</strong>g> mining purposeswas acquired. Today most <str<strong>on</strong>g>of</str<strong>on</strong>g> it remainsunutilised and the communities displacedfrom these lands were forced to migrate oroccupy forest lands. In-migrati<strong>on</strong> as a result<str<strong>on</strong>g>of</str<strong>on</strong>g> mining has led to occupati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a largearea <str<strong>on</strong>g>of</str<strong>on</strong>g> land by outsiders causing pressure<strong>on</strong> the land as well as the forest. Theseimpacts have to be given the seriousnessthey deserve and further land alienati<strong>on</strong>should be stopped for such private andindustrial purposes if the Eastern Ghats haveto be protected.C<strong>on</strong>sultati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> adivasi communitiesthrough the instituti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> Gram Sabhas isbeing completely ignored. The purpose <str<strong>on</strong>g>of</str<strong>on</strong>g>the PESA Act is being negated by thegovernment either by pretentiousc<strong>on</strong>sultati<strong>on</strong>s or by completely bypassingthe c<strong>on</strong>sultative process. Local communitieshave a right to protect the resources <str<strong>on</strong>g>of</str<strong>on</strong>g> theirregi<strong>on</strong> and also to take decisi<strong>on</strong>s over theseresources. Without their participati<strong>on</strong>, itwould be impossible for the state to protectthe natural resources <strong>on</strong> its own. It was inrecogniti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this reality that the CFMprocesses were initiated throughout thecountry. <str<strong>on</strong>g>Government</str<strong>on</strong>g> cannot selectivelychoose to ignore or c<strong>on</strong>sult but have a morec<strong>on</strong>sistent and people-friendly approach todevelopment <str<strong>on</strong>g>of</str<strong>on</strong>g> our ecologically fragileregi<strong>on</strong>s.The manner in which the Envir<strong>on</strong>mentProtecti<strong>on</strong> Act <str<strong>on</strong>g>of</str<strong>on</strong>g> 1986 is being made amockery <str<strong>on</strong>g>of</str<strong>on</strong>g> through engineered publichearings has to be stopped immediately.This Act al<strong>on</strong>g with the PESA andcompliance with the United Nati<strong>on</strong>sDeclarati<strong>on</strong> <strong>on</strong> the Rights <str<strong>on</strong>g>of</str<strong>on</strong>g> IndigenousPeoples and its recogniti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the right t<str<strong>on</strong>g>of</str<strong>on</strong>g>ree, prior and informed c<strong>on</strong>sent have to berespected fully and in the spirit <str<strong>on</strong>g>of</str<strong>on</strong>g> theC<strong>on</strong>stituti<strong>on</strong>.The Forest C<strong>on</strong>servati<strong>on</strong> Act 1980 cannotbe used as a weap<strong>on</strong> against the localcommunities for their usufructory rightswhereas its diluti<strong>on</strong> is justified for purposes<str<strong>on</strong>g>of</str<strong>on</strong>g> industrialisati<strong>on</strong> and commercialisati<strong>on</strong>.It is no l<strong>on</strong>ger small patches <str<strong>on</strong>g>of</str<strong>on</strong>g> isolated ordegraded forests that are being denotifiedfor mining and other n<strong>on</strong>-forestry activities,but the cumulative effect <str<strong>on</strong>g>of</str<strong>on</strong>g> diverting forestlands for multiple commercial activitiestoday is enormous. This cumulative impacthas to be duly assessed. There is more threatto the forest cover today by large-scaleprojects in these regi<strong>on</strong>s than by individualand local communities.The FRA while it has to be effectedimmediately for settling the l<strong>on</strong>g pendingrights <str<strong>on</strong>g>of</str<strong>on</strong>g> the forest dwellers, has to besupported by other ecologically sensitiveways <str<strong>on</strong>g>of</str<strong>on</strong>g> enhancing the land utilisati<strong>on</strong> andlivelihoods <str<strong>on</strong>g>of</str<strong>on</strong>g> these communities. Foodsecurity should be an important comp<strong>on</strong>ent<str<strong>on</strong>g>of</str<strong>on</strong>g> this planning al<strong>on</strong>g with increasing theincomes. Today planning for land utilisati<strong>on</strong>is erratic and ad hoc. It is important forplanning to give priority for local capacitiesand locally manageable systems <str<strong>on</strong>g>of</str<strong>on</strong>g> land useand income generati<strong>on</strong> than exotic andglobal market-oriented land utilisati<strong>on</strong>keeping in mind that adivasi communities’vulnerability to external exploitati<strong>on</strong> stillpersists <strong>on</strong> a huge scale.These legal safeguards are supported by theSamatha Judgment which was fought inthese very lands <str<strong>on</strong>g>of</str<strong>on</strong>g> Ananthagiri. However,the implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the Judgment hasrequired c<strong>on</strong>tinuous people’s vigilance andprotest where the natural resources arec<strong>on</strong>stantly under threat by n<strong>on</strong>-forestry andprivate industrial mining activities. TheSupreme Court, in its lengthy discourse <str<strong>on</strong>g>of</str<strong>on</strong>g>the case and the justificati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> upholdingthe Fifth Schedule <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>stituti<strong>on</strong>,68
