2d) the right to determine, implement and evaluate the qualifications forand the duties and responsibilities of positions; ande) the right to operate the schools in accordance with the Education Actof Ontario and the Laws of Ontario and the right to require all<strong>Secondary</strong> <strong>Occasional</strong> <strong>Teachers</strong> to comply with same.ARTICLE 3 - RECOGNITION:3.1 a) The employer, being the <strong>Algoma</strong> <strong>District</strong> <strong>School</strong> Board (hereinafterreferred to as “the Board”) recognizes the Ontario <strong>Secondary</strong><strong>School</strong> <strong>Teachers</strong>’ Federation (hereinafter referred to as“theUnion”), as the Bargaining Agent authorized tonegotiate on behalfof all <strong>Secondary</strong> <strong>Occasional</strong> <strong>Teachers</strong> employed by the Board in itssecondary panel including persons who are not certifiedto teach but may be used by the Board pursuant to Regulation 298.b) Part-time permanent or part-time probationary teachers who areaccepted by the Board for additional employment as<strong>Occasional</strong><strong>Teachers</strong> shall be covered by this Agreement in respectof the portionrelative to such occasional teaching employment.3.2 All newly hired <strong>Secondary</strong> <strong>Occasional</strong> <strong>Teachers</strong> shall join the Union andremain members in good standing.ARTICLE 4 - DEFINITIONS:4.1 For the purposes of this Agreement, the following definitions shall apply:a) <strong>Secondary</strong> <strong>Occasional</strong> Teacher: A <strong>Secondary</strong> <strong>Occasional</strong> <strong>Teachers</strong>hall mean a “<strong>Secondary</strong> <strong>Occasional</strong> Teacher” as defined in theEducation Act and may include a person employed as a <strong>Secondary</strong><strong>Occasional</strong> Teacher pursuant to Regulation 298.b) Long-term <strong>Secondary</strong> <strong>Occasional</strong> Teacher: A Long-term <strong>Secondary</strong><strong>Occasional</strong> Teacher shall mean a Teacher employed by the Board toteach for a period of ten (10) or more consecutive teaching days as areplacement for the same teacher.
