Pratibha Devisingh PatilPresident <strong>of</strong> The Republic <strong>of</strong> <strong>India</strong>Rashtrapati BhawanNew DelhiSubject: Request to ponder over <strong>Article</strong> <strong>51</strong> <strong>of</strong> <strong>the</strong> <strong>Constitution</strong> <strong>of</strong><strong>India</strong> and to understand its real purpose and implications and act asper <strong>the</strong> provision in <strong>the</strong> <strong>Constitution</strong> and ruling <strong>of</strong> <strong>the</strong> SupremeCourt <strong>of</strong> <strong>India</strong> to ensure a safe future <strong>for</strong> <strong>the</strong> 2 billion children <strong>of</strong> <strong>the</strong>world and generations yet-to-be-born; and to summon a meeting <strong>of</strong>Heads <strong>of</strong> State, Heads <strong>of</strong> Government, Monarchs and Chief Justices<strong>of</strong> all countries <strong>of</strong> <strong>the</strong> world to achieve <strong>the</strong> objectives <strong>of</strong> <strong>the</strong> said<strong>Article</strong>, especially in view <strong>of</strong> <strong>the</strong> present world scenario.24-09-2009Your Excellency,Kindly permit me to thank Your Excellency <strong>for</strong> referring my petitiondated 27-07-2009, regarding my request to Your Excellency to call ameeting <strong>of</strong> world leaders under Your Excellency's leadership, to <strong>the</strong>Prime Minister's Office. Your Excellency's Secretariat sent thispetition to <strong>the</strong> Prime Minister's 0ffice vide communication serialnumber P1-B/7470 dated 10-08-2009.I am also very humbled to learn that <strong>the</strong> petition was considered by<strong>the</strong> Prime Minister's Office and has now been returned to YourExcellency's Secretariat <strong>for</strong> "action as appropriate" vide letter PMO, IDNo. 23/3/2009-PMP-1/87224 dated 11-09-2009. I too have received acopy <strong>of</strong> this letter on 23-09-2009 which is reproduced in <strong>the</strong> right-handcolumn.<strong>Article</strong> <strong>51</strong> <strong>of</strong> <strong>the</strong> <strong>Constitution</strong> <strong>of</strong> <strong>India</strong> states:The State shall endeavour to:(a) promote international peace and security,(b) maintain just and honourable relations between nations,(c) foster respect <strong>for</strong> international law ...; and,(d) encourage settlement <strong>of</strong> international disputes byarbitration.Be<strong>for</strong>e I make my submission with regards to our request, <strong>the</strong>following 5 points which are relevant to consideration <strong>for</strong> action on<strong>Article</strong> <strong>51</strong> <strong>of</strong> <strong>the</strong> <strong>Constitution</strong> <strong>of</strong> <strong>India</strong>, may kindly be noted:(i) ARTICLE <strong>51</strong> IS IN PART IV OF THE CONSTITUTION OF INDIAWHICH CONTAINS DIRECTIVE PRINCIPLES OF STATEPOLICY. FOR THE PURPOSE OF THIS ARTICLE, THEDEFINITION OF 'THE STATE' AS GIVEN IN ARTICLE 36 INPART IV READ WITH ARTICLE 12 IN PART III, STATES THAT" UNLESS THE CONTEXT OTHERWISE REQUIRES, 'THESTATE' INCLUDES THE GOVERNMENT AND PARLIAMENTOF INDIA AND THE GOVERNMENT AND THE LEGISLATUREOF EACH OF THE STATES AND ALL LOCAL OR OTHERAUTHORITIES WITHIN THE TERRITORY OF INDIA ORUNDER THE CONTROL OF THE GOVERNMENT OF INDIA.”(ii) THE WORD 'SHALL' HAS BEEN USED IN ARTICLE <strong>51</strong> OF THECONSTITUTION OF INDIA INSTEAD OF 'SHOULD' OR 'MAY',AND, THEREFORE, BINDS THE STATE TO TAKE ACTION ONTHE SAID ARTICLE.(iii) ARTICLE 31-C, ADDED BY THE CONSTITUTION (25THAMENDMENT) ACT,1971,SEEKS TO UPGRADE THEDIRECTIVE PRINCIPLES. IF THE DIRECTIVE PRINCIPLESAIM AT PROMOTING THE LARGER INTEREST OF THESOCIETY, THE COURTS WILL HAVE TO UPHOLD THE CASEIN FAVOUR OF DIRECTIVE PRINCIPLES IN CASE OFCONFLICT WITH FUNDAMENTAL RIGHTS.(iv) RULING OF THE SUPREME COURT IN THE KESAVANANDABHARATI VS. STATE OF KERALA CASE IN WHICH IT IS RULEDTHAT 'MORAL RIGHTS' EMBODIED IN PART IV ARE ASEQUALLY ESSENTIAL FEATURE OF THE CONSTITUTION ASFUNDAMENTAL RIGHTS AND ARE FUNDAMENTAL IN THEGOVERNANCE OF THE COUNTRY AND ALL THE ORGANS OFTHE STATE ARE BOUND TO ENFORCE THOSE DIRECTIONS.(v) THE DIRECTIVE PRINCIPLES ACT AS A CHECK ON THEGOVERNMENT; THEORIZED AS A YARDSTICK IN THECopies to:1. H.E. Vice-President <strong>of</strong> <strong>India</strong> & Chairman, Rajya Sabha; and allHon'ble Members <strong>of</strong> Rajya Sabha2. Hon'ble Prime Minister & Hon'ble Ministers <strong>of</strong> Government <strong>of</strong> <strong>India</strong>3. Hon'ble Speaker, Lok Sabha & Hon'ble Members <strong>of</strong> Lok Sabha4. H.E. <strong>the</strong> Governors & Hon'ble Chief Ministers all States & Territories5. Hon'ble Leaders <strong>of</strong> all political parties <strong>of</strong> <strong>India</strong>6. Hon'ble MLAs & MLCs <strong>of</strong> all <strong>the</strong> States <strong>of</strong> <strong>India</strong>HANDS OF THE PEOPLE TO MEASURE THE PERFORMANCEOF THE GOVERNMENT. THEREFORE, THE GOVERNMENTSHOULD KEEP THESE PRINCIPLES IN VIEW WHILEFRAMING LAWS AND PLANNING ITS ACTIVITIES ANDACTIONS AS THESE PRINCIPLES ARE FUNDAMENTAL INTHE GOVERNANCE OF THE COUNTRY AND IT SHALL BETHE DUTY OF THE STATE TO APPLY THESE PRINCIPLES INMAKING LAWS.The world's problems need immediate redressal. <strong>India</strong> should take<strong>the</strong> lead as it has done with non-violence! <strong>India</strong> has to play animportant role in uniting <strong>the</strong> world. The above points are explainedbelow:(i) ARTICLE <strong>51</strong> IS IN PART IV OF THE CONSTITUTION OFINDIA WHICH CONTAINS DIRECTIVE PRINCIPLES OFSTATE POLICY.For <strong>the</strong> purpose <strong>of</strong> this <strong>Article</strong>, <strong>the</strong> definition <strong>of</strong> '<strong>the</strong> State' as given in<strong>Article</strong> 36 in PART IV read with <strong>Article</strong> 12 in PART III, states that" unless <strong>the</strong> context o<strong>the</strong>rwise requires, '<strong>the</strong> State' includes <strong>the</strong>Government and Parliament <strong>of</strong> <strong>India</strong> and <strong>the</strong> Government and <strong>the</strong>Legislature <strong>of</strong> each <strong>of</strong> <strong>the</strong> States and all local or o<strong>the</strong>r authoritieswithin <strong>the</strong> territory <strong>of</strong> <strong>India</strong> or under <strong>the</strong> control <strong>of</strong> <strong>the</strong>Government <strong>of</strong> <strong>India</strong>.” There<strong>for</strong>e, it is <strong>the</strong> responsibility <strong>of</strong> <strong>the</strong> '<strong>the</strong>State' – <strong>the</strong> Government <strong>of</strong> <strong>India</strong>, to take action to fulfill <strong>the</strong>responsibility <strong>of</strong> making 'endeavour' <strong>for</strong> international peace andsecurity to ensure a safe and secure future <strong>for</strong> 2 billion children <strong>of</strong> <strong>the</strong>world and generations yet-to-be-born.contd... on page 34VENGEANCE: Vengeance is blameworthy because through vengeance no good result in gained by <strong>the</strong> avenger. 33
