Assessment andTaxation CommitteeTOGETHER, WE WORKTO ASSURE COUNTYGOVERNMENT CAN SERVEITS CITIZENS WELLOngoing discussions surroundingthe explorationand drilling in the Marcellusregions <strong>of</strong> <strong>Pennsylvania</strong>continued to dominate policydiscussions for the CCAP Assessmentand Taxation Committee. Issues rangingfrom bills to restore assessability <strong>of</strong> oiland gas lost as a result <strong>of</strong> a 2002 courtruling, treatment <strong>of</strong> oil and gas sites underClean and Green, impact fees, severancetax and the loss <strong>of</strong> revenues for countieswhere drilling is taking place on state parkand forest land, among other matters werediscussed, and as policy and the politicalwill in Harrisburg shifted, recommendationsfor CCAP’s policy positions weredeveloped and altered. Often workingwith the CCAP Energy Environment andLand Use Committee, and the AgricultureCommittee, areas <strong>of</strong> joint impact wereconsidered from all angles to assure moreeffective positioning by CCAP.The committee lobbied for legislation toconsolidate and coordinate the assessmentlaws <strong>of</strong> our state, and after its successfulpassage, monitored to assure implementation.The committee also closely monitoreddevelopments in the courts and legislativelyfor assessment reform, resultingfrom a Supreme Court’s 2009 Clifton de-14 <strong>Annual</strong> <strong>Report</strong> 2011 <strong>County</strong> <strong>Commissioners</strong> <strong>Association</strong> <strong>of</strong> <strong>Pennsylvania</strong>

The Court stopped short <strong>of</strong>setting standards for assessment equity (tothe dismay <strong>of</strong> Justice Baer in his concurringopinion), but indicated clearly thatthis is a task for the Legislature. Althoughnot ordered, the common presumption isthat if the Legislature does not do so, theCourt is likely to take it upon itself to setstandards in future litigation.The Legislative Budget and Finance Committee(LBFC) released a comprehensivereview <strong>of</strong> assessment law and practices in<strong>Pennsylvania</strong>, pursuant to House Resolution334. The review included comparisonsto other states, with California andMaryland mentioned specifically, and is toinclude recommendations. The committeeprovided extensive information andcommentary and will continue to monitorlegislative developments.Several bills are under considerationwhich would provide for a moratorium oncourt-ordered reassessments until the earlier<strong>of</strong> General Assembly completion <strong>of</strong> astudy <strong>of</strong> the system or June 30, 2011. Billshave seen action in committee but to date,none has made its way to the Governor’sdesk.
