3. Liability of Shipsa) The owner and Master of a ship including an Excepted Ship, ship shallbe jointly and severely liable irrespective of the cause thereof for allloss or damages to piers, jetties, buoys, or other port installations orport facilities, property or machinery whatsoever and for loss of life orpersonal injury to any person lawfully within the limits of the Port inconnection with the navigation by such ship with or without a pilotwithin the limits of the Port or its use of the Port facilities. No shipshall be permitted to leave the Port unless and until security acceptableto the Port Authority has been given for the amount of any loss ordamage so caused.b) The Port Authority shall not be liable, whether resulting from itsnegligence or from any other cause whatsoever, for :i) Any loss, damage or delay to any ship using the Port or portfacilities or to her cargo on board or to any other property ashoreor afloat, fixed or moveable whatsoeverii)Any loss of life or personal injury to the Master or crew usingthe Port as aforesaid.c) Any ship person using any port facility shall indemnity and saveharmless all losses, claims, demands and suits for damages, includingdeath or personal injury and including court costs and attorney’s feeincident to or resulting from their operations in the Port and the use ofPort facilities.d) These conditions shall be constructed to the law of U.A.E, and if sorequired by the Company, the ship and her owners shall submit to thejurisdiction of U.A.E. courts.Version No. 2 / Date : 01.04.2012 Revision No. 7/ 30.01.2013 Page 13 |6 3
