Commenced28 th February 2011.This order authorises a council officer to remove an adultat risk to a specified place if there is a likelihood ofserious harm were they not moved. This type of ordermay be varied or recalled by the Sheriff where this isjustified due to a change in facts or circumstances of thecase. Removal orders are effective up to a maximum ofseven days. As with an assessment order there is noauthorisation to detain the adult at risk and they maytherefore leave the place to which they have beenremoved if they so wish.The sheriff has discretion to appoint a person tosafeguard the interests of the affected adult at risk in anyproceedings relating to a protection order application.The Care Inspectorate is the new unified independentscrutiny and improvement body for care and children’sservices and has a significant part to play in improvingservices for adults and children across Scotland. Theyregulate and inspect care services and carry out socialwork and child protection inspections. They ensure thatpeople receive the highest quality of care and that theirrights are promoted and protected.The Procedures indicate a range of examples when asignificant occurrence form should be completed.Reference should be made to the procedures for fulldetails however, with regard to adult protection,completion of a form should be considered where theincident relates to “New incidents of serious risk involvinglife-threatening ill-treatment or serious neglect”, staffmisconduct or where there is police involvement.Form to be completed and sent to the Executive Director(Social Work) immediately. Form should arrive no laterthan 24 hours after occurrence.Information subject to legal proceedings, the sharing ofwhich may compromise those proceedings. A report tothe Procurator Fiscal or Children’s Reporter by anyagency for the consideration of legal proceedings wouldclass the information concerned as sub judice.75
