POLYPLUMB JOINTING, DISMANTLING AND SYSTEM TESTINGJointingThere are five vital stages tosuccessfully jointing thePolyplumb system.Cutting Polyplumb pipesStep 1a:Firstly check that the pipe is notscored or scratched in any way and ifit is so cut back to a point where thereis no damage present.Always use one of the approved pipecutters (code PB781 or PB778).A slight rotation of the pipe whencutting will help make cutting easier.Never use a hacksaw and always cuton a depth insertion mark. These “K”shaped marks are equally spacedalong the pipe and indicate the depthrequired for full insertion in to aPolyplumb socket fitting.Insertion depth markers onfittingsEach fitting now has an insertiondepth marker on the fitting body toaid with installation. The only way ofbeing certain that a joint has beencompleted successfully is by using theinsertion depth marks on the pipe forcutting and insertion purposes.Cutting copper pipe forinsertion in a PolyplumbfittingStep 1b:Wherever possible, use a rotationalpipe cutter when cutting copper pipe.Ensure that all cut ends have arounded lead in, with burrs removed.Never use a hacksaw. You will need tomark the insertion depth on the pipeas below.Pipe diameter (mm)10 15 22 28Insertion Depth (mm)22 27 30 35Use of pipe stiffenerStep 2:Pipe stiffeners are an integral part ofthe joint when using Polyplumb pipewith either Polyplumb fittings orcompression fittings and need to befully inserted in to the pipe end. Theyare not required when using copperpipe.Visual check of fitting and fittingcomponentsStep 3:Although every single socket isvisually checked during themanufacturing process to ensure thatall components are present and in thecorrect order, a further visual checkmust be carried out as tampering byothers can take place on site or duringdistribution.CAUTION - Do not insert fingers intothe Polyplumb fittings, as the grabring is sharp and designed to grip.NOTE: Components shown indismantling section.Insert pipe fully intofittingStep 4:The pipe should be inserted into thefitting to full socket depth such thatthe insertion depth mark aligns withthe outer end of the cap nut on thefitting.Grab ring checkStep 5:A quick tug on the pipe will confirmthat the pipe is inserted past the grabring and that a grab ring was presentin the fitting. It does not howeverensure that the pipe is fully insertedas this can only be confirmed by usingthe depth insertion mark.IMPORTANT NOTE: Avoidance ofre-jointingOn no account should a pipe beremoved from a jointed Polyplumbfitting by removing the cap-nut andwithdrawing the pipe end completewith all the socket components fromthe fitting to be rejointed withoutremoving and replacing the grab-ringinto the fitting and re-making thejoint in accordance with the normalPolyplumb jointing procedure.If the pipe end complete with all thesocket components is subsequently rejointedinto the body of a fitting,there is a risk that the outer edge ofthe grab-ring could catch on the outerend or the inside surface of the socketof the fitting which forces thegrab-ring into an angled position onthe pipe. Forcing the grab-ring intoan angled position on the pipe in thisway, seriously damages the grab-ringteeth and will reduce the pull-outperformance of the joint whensubjected to pressure, such thatpremature failure will almost certainlyoccur with the potential for seriousinjury.WARNINGAll jointing instructions must befollowed at all times with particularattention being paid to correctinsertion depths. If a pipe is notinserted fully into a fitting throughboth the O ring seal and the grab ringthen the incorrect assembly will comeapart. The pipe will then have anopen end which will result in waterdischarging un-intentionally. As ourproducts can be used on hot waterand heating systems there is thepotential for serious injury should thissituation occur with hot water.06For further information log onto www.totallyplumbing.com


POLYPLUMB JOINTING, DISMANTLING AND SYSTEM TESTINGDismantling a PolyplumbjointPolyplumb fittings must not bedismantled for any reason priorto jointing.Procedure for using thecomponent pack of sparesDismantling the jointStep 1:If it is necessary to remove a jointedpipe from a fitting, the cap-nut shouldbe unscrewed and the pipe with allthe socket components present on thepipe end should be pulled out of thesocket of the fitting. The pipe endcomplete with all the socketcomponents should be cut off anddiscarded. A complete componentpack of socket spares should be fittedto the socket as described below andpipe jointing should be carried out asdescribed left (see fig.1)Replacement componentsStep 2:The component pack (Code: PB95XX)is supplied as a cap-nut with all thesocket components present in thecorrect order and retained by aretaining cap.Preparing componentsStep 3:Checking the fittingStep 5:Carry out a visual check to ensure thatall socket components are present inthe correct order as shown in thediagram and that the rubber ’O’ring islubricated. If in doubt, the ‘O’ringshould be re-lubricated usingPolyplumb silicone lubricant.Fitting the jointStep 6:Carry out pipe jointing as describedon page 10 from step 3 onwards.Reduced componentfittingsChanges have been made to 15mmPolyplumb couplers, elbows and teesand 22mm Polyplumb elbows andtees, which need to be consideredwhen using Polyplumb spares kitswith these fittings, as follows:Original Polyplumb fittingsStep 1:If the bottom white washer is presentin the fitting below the grab-ring,then the spares kit can be used assupplied without making any changes.New Polyplumb fittingsStep 2:System testingPressure testing of systems isrecommended.1st fix installationsPipe and fittings only should betested. The system should becompletely filled using water at notmore than 20°C at a test pressure of18 Bar which should be applied fornot less than 15 minutes and nolonger than 1 hour.Joint security can be checked visuallyand by tugging at joints.2nd fix installationsComplete installations includingappliances should be tested withwater to the maximum test pressureallowed by manufacturers of theappliancesand fittings.Please note, due to health and safetyreasons <strong>Polypipe</strong> do not recommendair testing of pipework installations.Pressure testing in sub-zerotemperaturesSpecial precautions arenecessary if the pressure testingis to take place in sub-zerotemperatures.This applies particularly in under floorcentral heating systems using thescreeded floor system where most ofthe pipe is encased in concrete. Due toCompletely remove the retaining cap,ensuring that the socket componentsremain within the cap-nut.Replacing the componentsStep 4:Without removing any of the socketcomponents from the cap-nut,introduce the cap-nut and socketcomponents to the socket of thefitting and tighten up the cap-nut byhand ensuring that the componentsenter the socket without snagging.If there is no bottom white washerpresent below the grab-ring with oneof the five listed fittings then this isone of the fittings which has beenmodified.Before the spares kit is used, thecarrier moulding should be carefullyremoved from the cap-nut and thebottom white washer should beremoved and discarded withoutchanging the order of any of theother components. POLYFIT JOINTING, DISMANTLING & SYSTEM TESTINGJointingThere are four stages tosuccessfully jointing the Polyfitsystem.1. Cutting Polyfit PipeFirstly check that the pipe is not scoredor scratched in any way and if it is socut back to a point where there is nodamage present.Using a Polyfit pipe cutter cut the pipesquarely using the “K” marks on thepipe as a guide.Cutting of Polyfit pipe2. Inserting pipe fully into fittingPush pipe into the fitting, ensuringit is inserted to the full socket depthdenoted by the next “K” mark onthe pipe.Insertion depth markers on fittingsEach fitting now has an insertion depthmarker on the fitting body to aid withinstallation. The only way of being certainthat a joint has been completedsuccessfully is by using the insertion depthmarks on the pipe for cutting andinsertion purposes.Fitting the joint4. To demount a Polyfitfitting simply depress the colletsquarely towards the fitting and pullthe pipe out of the fitting. Whensystems have been pressurised thecollet is designed to grip into the pipetherefore using a fitting release aid(product code FITAID) will assist indemounting fittings.System testingPressure testing of systems isrecommended.1st fix installationsOnly pipe and fittings should betested. The system should becompletely filled using water at amaximum of 20°C and a test pressureof 18 Bar, which should be applied forat least 15 minutes and no longerthan 1 hour. Joint security can bechecked visually and by tugging atjoints.2nd fix installationsComplete installations, includingappliances, should be tested withwater to the maximum test pressureallowed by the manufacturers. POLYSURE JOINTING AND SYSTEM TESTINGJointingThere are six stages to completinga joint which uses Polysure fittings.Each step is covered in detail here.Unlike the other <strong>Polypipe</strong> systems,Polyplumb and Polyfit, the Polysuresystem requires some specialist pressingtools which can purchased directly from<strong>Polypipe</strong> or via the manufacturersstockists. <strong>Polypipe</strong> recommends usingREMS pressing equipment who havea reputation for manufacturing durableproducts that can stand up to today’ssite conditions. For full details ofproducts, instructions, servicingrequirements and warrantiesplease visit www.rems.de.1. Cutting pipeFirstly check that the pipe is not scoredor scratched in any way and if it is so cutback to a point where there is nodamage present.Pipes should be cut squarely using anapproved <strong>Polypipe</strong> cutter. As there is avisual indicator on each fitting which isused to identify that a pipe has beeninserted into the fitting correctly it isnot essential that pipes are cut on theK marks. It is however essential thatpipes are squarely as this may affectchamfering (see step 2).Cutting of pipe2. Chamfering the pipesAs Polysure fittings use press fittechnology which seals on the pipe boreit is necessary to provide an internallead on the pipe end so the square edgeof the pipe does not damage the ‘O’ring seals. On push fit fittings this leadin is provided by the pipe stiffener.<strong>Polypipe</strong> offer specific pipe chamferingtools for our Polyplumb and Polyfitpipes and these must always be used.The chamfering tools are availablein either individual tools or as a blockof four dependent on the installerspreference however all work in thesame way.The chamfer tool spigot should beinserted down the bore of the pipe untilcontact is made with the blades thenthe chamfer tool should be twistedgently to provide a lead in. Any debrisshould be removed from the pipe endand the chamfer tool. Check that thepipe has been cleanly chamfered aroundthe full diameter of the pipe. If notrepeat step 2, if so proceed to step 3.3. Insert pipe into fittingPolysure pipes have a visual indicator toassist the installer in jointing pipes andfittings together. The chamferedPolyplumb or Polyfit pipe should beinserted into the Polysure fitting andpushed in until pipe can be seenthrough the hole in the stainless steelpressing sleeve. When this has beendone the joint is ready for pressing.Insert pipe in to fitting until pipe is visiblein hole of sleeve4. Preparing the pressing toolsThere are three types of pressing toolrecommended for jointing Polysure fittings.The REMS Eco Press is a manual pressingtool which can be used on 10mm, 15mmand 22mm joints only but provides theinstaller with a light weight, low cost entrypressing tool which can be used in mostsituations. Alternatively the batteryoperated tools (mini or standard version)can be used where a high volume of jointsneeds to be done in a short space of time.The battery operated tools must be usedfor 28mm fittings.The 10mm,15mm and 22mm <strong>Polypipe</strong> THpressing jaws have been designed to fitboth the manual and standard batteryoperated pressing tools. The mini pressingjaws are only compatible with the minipressing gun and can not be used with themanual or standard battery operated guns.All jaws are specifically designed to pressPolysure press fit fittings and should onlybe used for these fittings. Likewise no otherpressing jaw should be used for Polysurefittings.Manual pressing toolcatch on the locking pin on the gun.Slide the jaw into the gun aligning thecentre hole in the jaw with the lockingpin and push the locking pin back intoposition until locked.Once the jaws are locked in therespective machine the pressing toolsare now ready to complete the jointprocess.5. Securing the jointWhether using the manual or batteryoperated press gun the jaws arelocated on to the fitting in exactlythe same manner.Do a final check to ensure that the pipeis still inserted fully into the fitting thenusing the white washer as a locationpoint fix the jaws over the fitting in theun-pressed condition.Manual pressing toolThe levers can now be closed completelyensuring that the two stops on thepress tool are touching. Extensionpieces are included with the Eco Pressif extra leverage is required to completelySecuring the jointclose the tool. Only when the tool hasbeen completely closed with the twostops touching is the joint fully secured.The levers can then be opened and thefitting will be released from the jaws.Battery operated pressing toolThe trigger can now be pressed on thetool to start the pressing process.Keep the trigger depressed until thejaws have closed completely and thepressing machine clicks to denote theend of the process. Note: once theSystem testingPressure testing of systemsis recommended.1st fix installationsPipe and fittings only should be tested.The system should be completely filledusing water at not more than 20°C at atest pressure of 18 Bar which should beapplied for not less than 15 minutes andno longer than 1 hour. Joint security canbe checked visually and by tugging atjoints.2nd fix installationsComplete installations includingappliances should be tested with waterto the maximum test pressure allowedby manufacturers of the appliancesand fittings.Please note, due to health and safetyreasons <strong>Polypipe</strong> do not recommend airtesting of pipework installations.Pressure testing in subzero temperaturesSpecial precautions arenecessary if the pressure testingis to take place in sub-zerotemperatures.This applies particularly in under floorcentral heating systems using thescreeded floor system where most of thepipe is encased in concrete. Due to thecontact between pipe and floor panelon screeded installations, where thescreed does not completely surround thepipe, there may be points where strain iscreated on the pipe in freezing conditionswhich is not normally present.Therefore it is advisable to drain the underfloor central heating system once testingand screeding has been completed.Precautions should also be taken whereinstallations contain large quantities offittings which due to the rigidity of theirconstruction may put undue pressureon the pipe.Chamfering of pipeSecure the jaw in the tool by firstlyremoving the locking pins from the EcoPress, lining up the holes in the EcoPress with those in the jaw and reinsertingthe locking pins.Battery operated pressing toolTo insert a <strong>Polypipe</strong> TH jaw into thebattery operated gun, press the releaseChecking the jointprocess is underway it must be completedbefore the safety catch can be pressedto allow the jaws to be released.6. Checking the jointFinally check that the fitting has beenpressed successfully by ensuring thatthe TH pressing profile has beenindented consistently around the fullcircumference of the fitting. The whitewasher should not be damaged or havemoved in any way, if so discard thefitting and re-press a replacementfitting. Spare pressing sleeves andwashers are available to purchase ifrequired. APPLICATION INFORMATIONThe following information is designed to provide basic guidance forinstallers and specifiers when selecting <strong>Polypipe</strong> products. Theinformation is not exhaustive and guidance may change dependent onsite conditions and applications. This document should be read inconjunction with the <strong>Polypipe</strong> Plumbing & Heating Product Guide. The limitations are indicated against every applicable fitting in the <strong>Trade</strong> <strong>Price</strong> <strong>List</strong> eg“Cold Water Only”.Connections to other materialsConnection to Imperial Copper usingPolyplumbImperial ¾” copper pipe is ofsignificantly different size to its metric22mm counterpart and thereforerequires a different ‘O’ ring to thatsupplied in the 22mm fitting. The 22mm‘O’ ring should be replaced with a ¾”‘O’ ring (PB9034). Standard 15mmfittings can be connected to Imperial½” copper pipe, and 28mm fittings canbe connected to 1” copper pipe.Connection to Irish copper pipeIrish copper pipe to IS238:1980 can beconnected to Polyplumb fittings whichincorporate the ¾” or 1” adaptor set.Using a standard 22mm or 28mmPolyplumb fitting, remove the nut andsocket components and discard. Replacethese parts with the relevant adaptorset, ¾” - PB7034 or 1” - PB701. Theadaptor sets are distinguishable by theblack cap nut.Connections to chrome plated andstainless steel pipeworkPolyplumb and Polyfit fittings shouldnot be connected directly to chromeplated copper pipes or stainless steelpipes. To connect to these pipes werecommend the use of a compressioncoupler. Toconnect to copper pipes we advise theuse of a Polysure press fit x BSP male orfemale adaptor, with the correspondingadaptor being used on the copper sidefrom the Polyplumb or Polyfit range.PTFE tape should be used to seal themating brass components.Connections close to capillary fittingsCapillary fittings should preferably becompleted prior to the use of <strong>Polypipe</strong>fittings. Where this is not possible, careshould be taken to ensure that flux orsolder does not come into contact withplastic pipes or fittings. A damp clothshould be wrapped around the copperpipe close to the nearest plastic pipe orfitting to ensure against damage byconductive heat. Pipework should beflushed to clear flux before active use.Connections to incoming cold watersupplyThere are two options for connectingincoming MDPE mains water servicepipe to Polyplumb and Polyfit pipesystems. Firstly the push fit xcompression adaptors provide a onepiece transition fitting coveringconnections from 20mm, 25mm and32mm MDPE service pipes to 15mm,22mm and 28mm polybutylene pipesand most sizes are available in bothPolyplumb and Polyfit versions.Secondly, as there is a requirement for astopcock on the incoming main there isalso a combined stopcock and adaptorwhich reduces the number of fittingsrequired in a position where there isoften limited space e.g. under a kitchensink. These products allow connectionsfrom 20mm or 25mm MDPE pipe via acompression end to 15mm or 22mmpolybutylene using a push fit connection.Gas, oil, and compressed air<strong>Polypipe</strong> systems are suitable fordomestic plumbing and heating systems.Pipes and fittings must not be used forgas and oil supply pipework orcompressed air pipework. In all theabove instances metal pipework shouldbe installed.Ring main installations(Secondary Hot Water Circulation)A ring main is a water-replenishedcirculating system which is maintainedat a constant high temperature toprovide a constant source of hot water.Ring main systems are used to distributeconstant hot water to wards or roomsthat may be distant from the heatsource or hot water storage vessel.Locations where ring main installationsare used include, but are not limited to,residential care homes, hospitals andhotels. Ring main systems are verydifferent from conventional hot watersupply and central heating systemsfound in domestic properties, for whichour products have been tested to, undereither BS 7291 Class S or WRAS approvalstandards, and for this reasonPolyplumb, Polyfit or Polysure shouldnot be used on any ring maininstallations.Chlorine and other additivesThe polybutylene material used inPolyplumb, Polyfit and Polysure pipesand fittings is WRAS approved. It isresistant to the buildup of scale. Normallevels of chlorine in UK domestic watersupplies will not have an adverse effecton Polyplumb, Polyfit and Polysure.However Polyplumb, Polyfit andPolysure are not suitable for systems inwhich any further additives are everadded, periodically added, or regularlydosed in to or additional to the normalUK mains water supply, for examplechlorine for swimming pools or thoseused for bacteria control or legionellaprevention. Systems must not be flushedthrough with anything other than waterfrom the normal UK mains water supplyor a cleaning product at the correctconcentration that is specificallyrecommended for plastic piping systems.The use of corrosion inhibitor in centralheating systems is acceptable providedthat the inhibitor is specifically designedfor plastic piping systems and guidanceon their suitability should be soughtfrom the inhibitor manufacturer prior toadding to the system.Electrical Safety / EquipotentialBondingWhere <strong>Polypipe</strong> pipes break thecontinuity of existing metal pipe, whichmay be used for earthing, or bondingthis continuity must be re-instated byaffixing permanent earth clips and asection of earth cable between thecopper ends on either side of the plasticsections. Both the IEE and the CharteredInstitute of Plumbing and HeatingEngineers now give guidance on theEarth Bonding requirements of PlasticPipe systems. As plastic pipes do notconduct electricity, installationsgenerally require less equipotentialbonding than metal systems although ifin doubt exact guidance should besought.For further information log onto www.totallyplumbing.comLightPolyplumb & Polyfit pipe and fittingsshould be protected from UV light.Standard decorating paints formadequate protection. Pipe insulationforms adequate protection for externaluse. <strong>Polypipe</strong> products are delivered inlight protective packaging.Compatibility with othersubstancesFor details of compatability withbuilding and cleaning substances, andtreatments (eg filler foam and woodworm treatments) please consult therelevant manufacturers to confirmsuitability with Polybutylene.Polyplumb, Polyfit and Polysure pipesand fittings can be painted usingemulsion or undercoat and gloss.Cellulose based paints, strippers orthinners must not be used.VerminThere is no evidence to suggest thatPolyplumb, Polyfit or Polysure attractvermin. Where vermin are present theycan cause damage to other services,building fabric and pipes and fittings,and therefore a qualified pest controllershould be employed to remove verminfrom the affected area.Connections to otherequipmentBoilers and appliances:All boilers and appliances must havesafety devices such as thermostaticcontrols, cut-outs and pump over-runprotection to make sure that theycannot operate above the Class Sworking temperature and pressurelimits set out in the table of Class Sservice conditions above. Exposure toconditions in excess of those specifiedcould result in failure of the pipes orfittings with the potential for seriousinjury.Gas Boilers:Pipe should only be connected to gasboilers where the pipe connection isoutside the boiler casing and where theboiler incorporates a high limitthermostat and pump over-run facility.The pipe connections should be 350mmfrom the heat source. In all othersituations, a section of metal pipeshould be at least 1m in length. Inaddition for back boilers metal pipework should be used within the fireopening extending out of the chimneybrickwork.Combination Boilers:Where system connections are made toan incoming water supply pipe from awater meter or any other device whichcontains a check valve a suitableexpansion vessel must be fitted toprevent the expansion of heated waterback down the supply pipe. This isespecially important where a watermeter is fitted retrospectively.Solid Fuel & Oil Boilers (Cooking Ranges):Pipes and fittings must not be used forprimary or gravity circuits from solid fuelboilers, cooking ranges or otheruncontrolled heat sources. Pipes andfittings should not be fitted to a sealedsystem oil boiler.Solar Panels / SystemsPipes and fittings must not be used forconnection of solar panels or any part ofsolar distribution that operates abovethe Class S working temperature andpressure limits set out in the table ofClass S service conditions above.


1 GENERAL1.1 In these conditions1.1.1 “the Company” means <strong>Polypipe</strong> Building Products which is a registered tradingdivision of <strong>Polypipe</strong> Limited. Company registration number 1099323, Registered office:Broomhouse Lane, Edlington, Doncaster DN12 1ES, United Kingdom.1.1.2 “Customer” means the person with whom the Company contracts for the supply of Productpursuant to these conditions;1.1.3 “Order” means any order submitted to the Company by a Customer;1.1.4 “Order Confirmation” means any order confirmation submitted to the Customerby the Company;1.1.5 “Product(s)” means the goods and/or services to be supplied by the Company as referred to anddescribed in an Order which is accepted by the Company;1.1.6 “Quotation” means the quotation submitted to the Customer by the Company prior to submissionof an Order which details the prices at which the Customer may make an offer to purchase theProducts;1.1.7 “Writing” includes telex, cable, facsimile transmission, electronic data transfer and comparablemeans of communication.1.2 A contract shall come into force between the Parties each time an Order is accepted by theCompany, whether by issuing an Order Confirmation, by delivery, or otherwise, but not before.Subject to clause 1.3, (i) the terms of each contract shall be as set out in these conditions and theterms of any Order accepted by the Company, and (ii) in the event of any conflict between theseconditions and any such Order, the terms of the Ordershall prevail.1.3 Save to the extent contemplated at clause 2.1, the parties agree that any terms and conditionssubmitted at any time by the Customer which have not been written specifically for the purposes ofthe Product requirement to which a specific Order relates (including, without limitation, any standardterms and conditions of purchase which are printed on any order documentation submitted by theCustomer), shall not apply to any contractual dealings between the parties and shall not be deemedto constitute a counter-offer to purchase Products in accordance with those terms unless a specificintention is expressed for such terms and conditions to apply in respect of a specific Ordernotwithstanding this clause 1.3, and any failure by the Company to challenge or respond to anysuch terms and conditions does not imply and shall not constitute acceptance of those terms andconditions.1.4 Unless otherwise stated therein Quotations shall be valid for a maximum period of 30 days fromissue and may be withdrawn at any time by written or oral notice.1.5 Any statement or representation (other than in the Company’s Quotation or these terms andconditions) by the Company its servants or agents upon which the Customer wishes to rely must beset out in Writing and attached to or endorsed on the Customer’s Order and in any such case theCompany may confirm, reject or clarify the point and submit a new Quotation. Any statement orrepresentation which is not so confirmed in Writing is followed or acted upon entirely at theCustomer’s own risk, and shall not form any part of the contract between the parties, and shall bedeemed not to have influenced the Customer in deciding whether to enter into the contract.1.6 The contract is between the Company and the Customer as principals; neither the benefit nor theburden is assignable by the Customer without the Company’s written consent; the contract may beassigned or subcontracted by the Company.1.7 Unless specifically agreed to the contrary all trade terms shallbe interpreted in accordance with current INCOTERMS.1.8 If, subsequent to any contract of sale which is subject to these conditions,a contractof sale is made with the same Customer without reference to any conditions of sale orpurchase, such contract howsoever made shall be deemed to be subject to these conditions or (ifdifferent) the standard Conditions of Sale of the Company current at the time when such contractof sale is made.2 ELECTRONIC TRADING2.1 If the Company and Customer agree that electronic trading between them shall be a basis for orderprocessing and invoicing then these terms and conditions shall apply subject to any special termsand conditions terms which are specific to electronic trading and which have been agreed by theparties in writing.2.2 Electronic orders shall be valid if all the information agreed between the Customer and theCompany as being required is properly set out in the agreed format and the order is transmitted bythe Customer to the Company by reference to the correct identification code and is received by theCompany when collecting its electronic mail from the relevant system.3 DELIVERY3.1 Unless otherwise agreed in Writing by the Company delivery shall be deemed to take place in thecase of ex-works sales when the Products are made available by the Company for collection by theCustomeror its carrier and in all other cases upon delivery by the Company to the agreed mainland UK deliverypoint airport or port but before the Products are unloaded, which shall be the responsibility of theCustomer.3.2 The Company shall not be obliged to make delivery unless and until the Company has received allnecessary information, drawings, final instructions and approvals from the Customer and theCustomer acknowledges that any delays or alterations by the Customer may result in delayeddelivery for which the Company shall not be responsible.3.3 All dates and periods for delivery are estimated and do not constitute fixed times for delivery by theCompany. Unless such a right or rights are expressly agreed in Writing by the Company, theCustomer shall have no right to damages or to cancel the contract for failure arising from any causeto meet any delivery times given in the contract or subsequently set.3.4 Notwithstanding clause 3.3 the Customer shall be obliged to accept delivery on the date or withinthe period stated in the Quotation or (if none is so stated) no later than one month after the issue ornotice in Writing by the Company requiring the Customer to accept delivery. Failure by theCustomer either to take delivery or to make payment in respect of any one or more installments ofProducts shall entitle the Company to terminate the Contract (such right is without prejudice to anyother rights and remedies available to the Company whether expressly provided for in theseConditions or implied by any rule of law).3.5 Where the Customer requests and the Company agrees to postpone delivery or where delivery isotherwise postponed or delayed without default by the Company, the Customer shall pay uponreceipt of written demand from the Company all costs and expenses including a reasonable chargefor storage and transportation occasioned thereby and the Customer shall pay for the Products inaccordance with these conditions as if the same had been delivered in the ordinary course withoutreference to the postponement or delay. In addition, the Company shall be entitled to claim interestpursuant to Clause 7.3.2 of these Conditions from the date on which payment would have fallendue, had the Products been delivered in the ordinary course but for the postponement or delay.3.6 Unless otherwise expressly agreed in Writing the Company may effect delivery in one or moreinstallments. Where delivery is effected by installments each installment shall be treated as a separatecontract governed by these conditions. No delay in the delivery of any installment of Products or anydefect therein shall entitle the Customer to terminate the remainder of the contract.4 RISK AND TITLE4.1 Risk of damage to or loss of the Products shall pass to the Customer upon delivery and theCustomer is then solely responsible for all loss damage or deterioration to the Products.4.2 Title to the Products shall not pass to the Customer until either:-4.2.1 The Company has received in cash or cleared funds all monies payable (whether or not due) to theCompany under this and any other contracts whenever made between the Company and theCustomer including contracts made after this contract; or4.2.2 When the Company serves on the Customer notice in Writing specifying that title in the Products orany part thereof has passed.4.3 Until title has passed to the Customer the Company may require the Customer to deliver up to theCompany all products in respect of which the Company has title and if the Customer fails to do soforthwith the Company’s officers, employees, representatives or agents shall be entitled to enterupon any premises where such Products are kept for the purposes of recovering the same.4.4 Until title to the Products has passed to the Customer pursuant to these conditions it shall possessthe Products as fiduciary agent and bailee of the Company and shall store the Products separatelyfrom other goods not owned by the Company and shall ensure that they are fully insured on an allrisks basis and clearly identifiable as belonging to the Company and the Company shall be entitledto enter upon any premises where such Products are kept for the purpose of satisfying itself that thiscondition is being complied with by the Customer.4.5 In the event that the Customer has any contract with any other company under the ultimate controlof the parent company that has ultimate control of the Company under which any monies areoutstanding (whether or not due) then the Customer shall not (notwithstanding that title wouldotherwise pass pursuant to Clause 4.2 above) obtain title to the Products or other goods supplied bythe Company under this or any other contracts between them until such other company hasreceived in cash or cleared funds all such monies.5 CANCELLATION AND AMENDMENT5.1 No contract can be amended or cancelled except with the Company’s approval in Writing andshould such approval be given the Customer shall indemnify the Company against any costs, lossesor expenses resulting from any cancellation or amendment.6 PRICES6.1 Unless otherwise agreed in Writing all prices shall be as stated in the valid Quotationor, if no valid Quotation is in place, the Company’s prevailing standard price at the time of receipt of anOrder, and are for delivery ex works and are exclusive of VAT and any other applicable taxes, which arepayable in addition. Unless otherwise stipulated by the Company in Writing prices are payable in Sterlingor if the Sterling currency has ceased to exist when the contract is made, shall be payable in suchcurrency as replaces the Sterling currency.6.2 The Company will use its best endeavors to ensure that all prices on display/provided to Customersare correct and up to date. However, should a Customer place an Order using an incorrect pricethen the Customer agrees that the Company may substitute the incorrect price set out in the Orderfor the correct price (whether the price specified on a valid Quotation or the Company’s prevailingstandard price, as appropriate) and charge accordingly.6.3 The Company shall be entitled at any time by giving notice in Writing, before or after final invoicingto make a reasonable adjustment to the price in the event of any alteration in quantity, design orspecification requested by the Customer.6.4 The Company reserves the right at any time prior to delivery by giving notice in Writing to increasethe price if there is any increase in the cost of materials, labour, transport, or utilities or if the costs ofthe Company are increased by any other factor beyond the reasonable control of the Company.6.5 Charges made on the Company’s invoice for cases will be credited on their return tothe Company’s premises carriage paid and in good reusable condition. Cases shown as returnablebut not charged on the Company’s invoice must be returned to the Company’s premises carriagepaid and in good re-usable condition otherwise an additional charge will be made in respect of theircost.6.6 The Customer shall be liable to the Company for any demurrage costs incurred in the event ofvehicles being unduly delayed at the point of delivery.7 TERMS OF PAYMENT7.1 Unless otherwise agreed by the Company in Writing, the Customer shall make payment by the lastday of the month following the month of invoice and the Company shall be entitled to issue invoicesin the month in which the Products are delivered or would have been delivered, save forpostponement or delay otherwise than due to default on the part of the Company. Time forpayment of the price is of the essence of the contract.7.2 No disputes arising under this contract shall serve to permit payment by the Customer of sums dueto the Company to be delayed nor shall disputes interfere with prompt payment in full. The Buyershall not be entitled to make any deduction from or set off against any sums owing to the Companyby reason of any such dispute or at all.7.3 In the event of default in payment by the Customer the Company shall be entitled, withoutprejudice to any other right or remedy:7.3.1 to suspend without notice all further deliveries on this or any other contract between the Companyand the Customer;7.3.2 to charge interest on a daily basis (after as well as before judgement) on any amount outstanding atthe rate of 4% above the Base Rate of Lloyds Bank plc from time to time: and/or7.3.3 to serve notice on the Customer requiring immediate payment for all goods supplied by thecompany under this and all other contracts between them whether or not payment is otherwise dueor invoiced.8 SPECIFICATIONS8.1 Subject to Clause 8.2 the Products shall in all material respects be of such specification agreedbetween the Company and the Customer under the contract, or (if not so agreed) shall be generallyin all materials respects in accordance with any published specification issued by the Company.8.2 The Company reserves the right to make changes in dimensions or other specifications of theProducts as are required to conform to applicable standards or laws or are otherwise withinreasonable limits having regard to the nature of the Products. Dimensions specified by the Companyare to be treated as approximate only unless it is specifically agreed in Writing that exactmeasurements are required.8.3 The Customer acknowledges that it has not specified any particular use for the Products and that itis entirely its own responsibility to satisfy itself that the Product is suitable for the use which itintends.9 LOSS SHORTAGES AND DAMAGE APPARENT ON DELIVERY INSPECTIONS9.1 The Customer shall have no claim for loss, shortages or damage on delivery which are or would beapparent on inspection unless the Customer:9.1.1 unpacks and inspects the Products as soon as reasonablypracticable following receipt:9.1.2 notifies the Company of any loss, shortages or damage (otherwise than by a qualified signature onthe delivery note) within ten working days of receipt: and9.1.3 demonstrates to the satisfaction of the Company that such loss, shortages or damage occurred priorto delivery.9.2 The Customer shall have no rights in respect of loss, shortages or damage unless the Company isgiven a reasonable opportunity to inspect the Products and investigate any complaint before any useof or alteration to or interference with the Products.9.3 On a valid complaint made in accordance with this Clause the Customer shall be entitled (in the caseof notified shortages) to receive within a reasonable time a delivery of Products equivalent to theshortfall and (in the case of defects) to repairs to or replacements for the affected Products or at theCompany’s option a credit for the price thereof but the Company shall have no further liabilitywhatsoever. If a complaint of loss, shortages or damage on delivery is not made to the Company inaccordance with this Clause 9 within 5 working days of the date of delivery, then the Products shallbe deemed to be delivered complete and undamaged in accordance with the contract and theCustomer shall be bound to pay for the same accordingly.9.4 Loss, shortages or damage in a delivery or any installment delivery shall not be a ground fortermination of the contract or the remainder of the contract (as the case may be).10 WARRANTY10.1 The Company warrants that Products which do not comply with either Clause 8.1 or Sections 13 to15 of the Sale of Goods Act 1979 (as amended) are shown to have been defective at delivery as aresult of faulty design workmanship or materials (other than free-issue materials), shall either berepaired or replaced or that, at the Company’s option, a credit or refund for the price thereof shallbe given provided always that:10.1.1 the Company receives written notice of the defect within 12 months of delivery;10.1.2 no alteration to or interference with the Products takes place before the Company is given access tothe Products to inspect and test the same;10.1.3 the defect does not consist of a loss shortage or damage to which Clause 9 is expressed to apply;10.1.4 the defect does not arise by reason of a design specification or instruction given by the Customer;10.1.5 the Customer has not defaulted in its obligation to make payment of the contract price for theProducts;10.1.6 the defect shall not be attributable to incorrect storage or use of the Products by the Customer.10.2 The benefit of Clause 10.1 shall only extend to Products or parts not manufactured by the Companyto the extent that the Company has equivalent recourse against the manufacturer or supplierthereof.10.3 The Customer shall indemnify the Company in respect of loss or damage arising from any use madeof Products after the Customer became or ought reasonably to have been aware of a defect.10.4 In the event of a valid claim being made in accordance with Clause 10.1:10.4.1 the Customer shall be bound to accept repaired or replacement Products or at the Company’soption credit or repayment and shall not be entitled to terminate the contract;10.4.2 if the Company does not repair or replace Products within 60 days or such longer time as may bereasonable then the Customer’s sole remedy shall be an entitlement to full credit or repayment inrespect of the defective Products; and the Company shall be under no further liability in respect ofany loss or damage arising from the defect or from any delay before repair replacement credit orrefund is effected.11 LIABILITY11.1 The Company does not exclude liability arising under Section 12 of the Sale of Goods Act 1979(good title) (as amended) or for death or personal injury caused by its negligence as defined in theUnfair Contract Terms Act 1977, fraudulent misrepresentation or any other type of liability whichcannot by law be excluded or limited11.2 Save as provided under Clauses 9, 10 and 11.1 the Company shall have no liability to the Customerin connection with or arising from any defect or failure in the Products or otherwise due to thequality, condition, suitability, durability, safety or any other aspect or feature of the Products. TheCompany’s liability, whether in respect of one claim or in the aggregate, shall not exceed thecontract price payable under this contract for the supply of Products to be provided under it. Theprice of the Products is predicated on the basis of the limitations and exclusions set out in theseconditions. The Customer acknowledges that without those exclusions and limitations, the price ofthe Products would be higher and that the limitation of the Company’s liability is thereforereasonable in all the circumstances. The Customer agrees that it is its own responsibility to insureadequately to cover any loss or damage in excess of the aforesaid limit of the Company’s liability.Subject to reaching agreement on terms, the Company and the Customer may determine anincreased level of liability which is to be accepted in Writing by the Company to cover, in particularspecific types of loss or damage which both parties reasonably foresee and anticipate.11.3 In Clause 11.2 the term “liability” means any form of liability whatsoever including but not limited toliability in misrepresentation and under contract, common law, equity and any statutory provisionwhether or not based on negligence or breach of any express or implied duty to act with care orskill.11.4 Notwithstanding any other provisions of these conditions the Customer shall have no claim againstthe Company in respect of any loss other than strictly direct losses (meaning for these purposes theincreased costs of purchasing products from a third party or the cost of remedial repair work) andspecifically consequential, financial economic loss whether direct or indirect including but not limitedto any incidental costs of dismantling fitting or other ancillary work required in connection with theprovision of a repair or replacement, any loss or production profits contracts loss of use oranticipated savings and any claims made against the Customer by any third party are excluded evenif reasonably foreseeable.11.5 To the extent that any liability of the Company is expressed to be limited or excluded by theseconditions the Customer shall indemnify the Company in respect thereof.12 CONFIDENTIAL INFORMATION ETC12.1 All drawings, documents, records, computer software and other information supplied by theCompany are supplied on the express understanding that all intellectual property rights therein isreserved to the Company and that the Customer will not without written consent of the Companyeither give away, loan, exhibit, or sell the same or extracts therefrom or copies thereof or use thesame in any way except in connection with the Products in respect of which they are issued.13 PATENT INDEMNITIES13.1 If the Customer is subject to a claim or threatened with any action alleging that the Products in theform supplied infringe any patent, copyright, design right or other intellectual property right thenprovided that the Customer promptly informs and fully co-operates with the Company and ifrequested allows the Company the conduct and defence thereof on the Customer’s behalf, theCompany will indemnify the Customer against any award or damages for infringement made in anysuch action by a court or other competent body against the Customer. Further, if the Products areinfringing the Customer agrees that the company shall have the option at its own expense either tomodify the Products so that they do not infringe: to replace the Products with a non infringingsubstitute: to procure for the Customer the right for the Customer to continue its use of theProducts: or to repurchase the Products from the Customer at the price paid by the Customer lessan allowance for the use made thereof.13.2 The Company shall have no liability in respect of claims for infringement or alleged infringement ofthird parties patent or other intellectual property rights arising from the manufacture or supply of theProducts to the Customer’s instructions or in accordance with designs plans or specifications givenby the Customer and the Customer shall indemnify the Company against all losses damagesexpenses costs or other liability arising from such claims.14 CUSTOMER’S DRAWINGS14.1 The Customer shall be solely responsible for ensuring that all drawings information advice andrecommendations specified or given to the Company by the Customer or its agents, servantsconsultants or advisers are accurate correct and suitable Examination or consideration by theCompany of such drawings information advice or recommendations shall not result in any liability onthe part of the Company.15 COMPANY LITERATURE15.1 The information contained in the advertising, sales, technical, and other literature issued by theCompany may be relied upon to be accurate in the exact circumstances in which it is expressedotherwise any illustrations performance details examples of installations and methods of assemblyand all other information and data in such literature are based on experience and upon trials undertest conditions and are provided for general guidance only. No such information or data shall formpart of the contract unless it is specifically referred to in the Quotation.16 TERMINATION16.1 Without prejudice to any other rights or remedies of the Company it shall be entitled in any of thefollowing circumstances to terminate (in whole or in part) this and any other contract whenevermade between the Company and the Customer and/or to suspend deliveries and/or to receive upondemand payment of all monies payable under any such contracts whether or not otherwise due:16.1.1 the Customer made or proposes any voluntary arrangement with its creditors or becomes subject toan administration order or becomes bankrupt or goes into liquidation;16.1.2 an encumbrancer takes possession or a receiver is appointed of any of the propertyor assets of the Customer;16.1.3 the Customer becomes unable to satisfy its debts as they fall due or cease, or threatens to cease tocarry on business;16.1.4 the Company reasonably believes that any of the events mentioned above or any equivalent orsimilar event under any relevant laws to which the Customer or any connected person is subject hasor may occur;16.1.5 the Customer or any connected person commits any breach of this or any either contract whenevermade between the Customer and the Company.17 FORCE MAJEURE17.1 The Company shall be excused performance of its obligations whilst and if affected by act of Godgovernmental restriction condition or control, any act done or not done pursuant to a trade disputewhether such dispute involves its employees or not, default by suppliers of the Company, shortageof materials or by any other act matter or thing beyond its reasonable control including failure by theother party to carry out anything required for performance of the contract.17.2 In the event that the Company does not perform its obligations by reason of any ofthe causes referred to in Clause 17.1 within six months after the time for performance then theCompany or the Customer may by written notice terminate the contract without liability save thatthe Customer shall pay for any Products delivered or completed at the time of termination.18 TOOLS18.1 Any tools (such as jigs, dies, etc) which the Company may construct or acquire specifically inconnection with the Products shall, notwithstanding any charges the Company may make for them,be and remain the Company’s sole and unencumbered property and in the Company’s possessionand control without restriction.19 FREE-ISSUE MATERIALS19.1 Free-issue material shall be insured by and remain at the risk of the Customer at all times and theCompany shall be indemnified by the Customer against any loss, damage, injury or expensewhatsoever arising directly or indirectly therefrom and the company shall not be liable for loss of ordamage to any such materials during fabrication by the Company or sub-contractor employed byCompany or whilst on the premises of the Company or of any such subcontractor or in transit to orfrom the premises of the Company or of any such sub-contractor provided that the Company mayat its sole discretion make a contribution towards the replacement costs of such materials.19.2 An allowance for material lost as process scrap is (where applicable) included in the contract priceand no such losses shall be the subject of any claim by the Customer or contribution by theCompany.19.3 Where materials are supplied by or on behalf of the Company the Customer shall be responsible toensure that the material is of satisfactory quality and is fit for its purpose and shall indemnify beCompany against any loss damage, injury or expenses whatsoever arising directly or indirectly fromany fault in or incorrect specification of the said materials.20 CONSUMER PROTECTION ACT 198720.1 Where the Customer purchases the Products for use or incorporation with any other products to beassembled, produced, processed packed or supplied by the Customer or for resale or supply ancillaryto any such other products or other products supplied by the Customer then:20.1.1 the Customer shall forthwith on demand produce for inspection by the Company copies of allwritten instructions information and warnings to be supplied by the Customer in relation theretoprovided nevertheless that such inspection or right to inspect shall not give rise to any responsibilityor liability on the part of the Company; and20.1.2 the Customer shall indemnify the Company against any losses, costs and damages that theCompany may suffer or incur in the event any claim is made against the Company in relationthereto if the Products did not comprise the detective element thereof or were rendered defective byreason of actions or omissions of the Customer (including without limitation the supply of defectivefree-issue materials) or were rendered defective by reason of instructions or warnings given oromitted by the Customer or other reseller.20.2 For the purpose of Clause 20.1 the term “defective” shall be interpreted in accordance with thedefinition contained in Part 1 of the Consumer Protection Act 1987.21 HEALTH & SAFETY21.1 The Customer agrees to pay due regard to any information supplied by the Company relating to theuse for which the Products are designed or have been tested or concerning conditions necessary toensure that they will be safe and without risk to health at all times when they are being set, used,cleaned, serviced or maintained by any person and the Customer undertakes to take such steps asmay be specified by such information or otherwise necessary to ensure that as far as is reasonablypracticable the Products will be safe and without risk to health at all times as mentioned above.22 LAW AND JURISDICTION ETC22.1 The Contract shall be governed and interpreted exclusively according to the Laws of England.The parties hereby agree to submit to the exclusive jurisdiction of the English courts provided thatthe Company may at its option take proceedings in the courts of the state in which the Customer isdomiciled including action to obtain any remedy (including injunctive relief). In the case of any orderfor the export of Products, the Schedule to the Uniform Law on International Sales Act 1967 shallnot in any circumstances apply to the Contract and neither shall the limits imposed by the UnfairContract Terms Act 1977 on the extent to which liability can be excluded or limited.22.2 No waiver of or delay or failure by the Company to exercise any rights or remedies shall prejudice orpreclude any future or further exercise thereof.22.3 If any provision of these conditions shall be held invalid or unenforcable in whole or in part then theunaffected provisions shall remain in full force and effect. Headings appear for convenience only andshall not affect the Construction of these conditions.22.4 If the Contract provides for the supply of services and no general conditions of the Companyrelating specifically to the supply of services are made applicable to such services then theseconditions shall mutatis mutandis apply to such services as they would apply to Products and in suchevent Clause 10.1 will be deemed to include a reference to Sections 3 to 5 of the Supply of Goodsand Services Act 1982 (as amended), either in addition to or in place of the reference to Sections 13to 15 of the Sale of Goods Act 1979 (as amended) as may be appropriate. For the avoidance ofdoubt the following provisions apply where the Company supplies services to the Customer inaccordance with clause 22.4:-22.4.1 the Company’s obligation to provide the services is in any event conditional upon payment of theagreed price for the services. Any default or delay in payment according to the terms agreedbetween the Company and the Customer shall entitle the Company at its option to decline toperform or decline to continue to perform its obligations hereunder but without thereby incurringany liability to the Customer.22.4.2 Save to the extent that by reason of negligence on the part of the Company in the performance ofthe services which results in death or personal injury (which the Company does not limit or exclude),the Company’s liability under the contract shall be limited to the amount of charges paid to theCompany in return for the services and in particular the Company accepts responsibility only fordirect and unavoidable loss or damage arising from any negligence in the provision of services and inparticular all other types of loss whether economic, financial, indirect or consequential and whetherreasonably foreseeable or not are excluded to the fullest extent permitted by law.22.4.3 The Customer shall lend all such reasonable assistance to the Company in the performance of theservices as the Company shall reasonably require.22.4.4 The Customer shall indemnify and keep the Company, its employees, agents and contractorsindemnified at all times from and against any loss or damage and injury caused to persons orproperty in the course of the provision of the services where such loss or damage arises by reason ofthe Customer’s negligence or negligence of persons under the control of the Customer.22.4.5 The Customer acknowledges and agrees that if due to the act or omission of the Customer, theCompany is not able, having attended at the Customer’s premises to perform the services, theCompany shall be entitled to claim reasonable additional costs and expenses from the Customeroccasioned by any resulting delay in the provisions of the services.22.5 In cases for the sale or supply of Products overseas, the following additional provisions shall applyunless otherwise stipulated in writing by the Company:22.5.1 the Customer shall be solely responsible for obtaining all necessary import authorisations, thepayment of any applicable import taxes, duties or imposts and the Company shall be under noobligation to give the Customer the notice specified in Section 32(3) of the Sale of Goods Act 1979(or any re-enactment thereof);22.5.2 Quotations issued in a currency other than Sterling may at the Company’s option, unless otherwiseagreed in writing, be subject to amendment in the event of fluctuations in the applicable exchangerate prior to the date of invoice;22.5.3 payment in respect of Products for export is due on the date specified by the Company at the datewhen the Contract is made, in the currency stated in the invoice and in accordance with the methodof payment stipulated by the Company. All costs incurred by the Company in connection with thedesignated particular method of payment shall be met by the customer.23 DISTANCE SELLING REGULATIONSIf you are a consumer within the meaning of the Distance Selling Regulations 2000and you have bought the products detailed overleaf over telephone, internet or via mail order thenwithin seven days of receipt of you products you have the right to cancel your order and return theProducts for a full refund.June 2009POLYPIPE CONDITIONS OF SALEFor further information log onto www.totallyplumbing.com 35
