more than ten percent (10%) of the total number of potentialdwelling units in the sub-division plan or the "sub-divisionapproval not required" plan, (3) in the opinion of thePlanning Board, the development sequence established by theschedule is not arbitrary or unreasonable, and (4) in theopinion of the Planning Board, the development schedule willnot place an unreasonable burden on the Town.A single real estate module is a parcel of land which hasbeen divided into three or more lots since June 1, 1979,where under Chapter 183, Section 6A of the General <strong>Laws</strong> aplan is required to be recorded in the Registry of Deedsbecause new boundaries are being created.G. Permitted Use All Districts:The purpose of this regulation to promote the safe,effective and efficient use of small wind energy systemsinstalled to reduce the on-site consumption of utilitysupplied electricity.A. Permitted uses: Small wind energy systems shall be apermitted use in all zoning classifications wherestructures of any sort are allowed; subject to certainrequirements as set forth below.1. Tower Height: In district R-11, R-30, CentralBusiness, General Business the tower height shallbe limited to 80 feet. For district R-66,Industrial there is no limitation on tower height,except imposed by FAA regulations.2. Set-Back: No part of the Wind system structureexcept guy wire anchors, may extend closer that 1½ times the length of the tower including theturbine to the property boundaries.3. Noise: Small wind turbines shall not exceed 60DBA, as measured at the closest property boundaryin perpetuity. The applicant must provide theBuilding Inspector with onsite test resultsperformed by a certified or licensed professionalof the decibel levels at the closest propertyboundary, prior to final approval by the BuildingInspector.4. Approved wind turbine: Small wind turbines musthave been approved under the Emerging Technologiesprogram of the California Energy Commission or anyother small wind certification program recognizedby the American Wind Energy Association.5. Compliance with MA State Building Code: Buildingpermits for small wind energy systems shall be16
