Al-Arian, the son of Palestinian refugees, has been in theUnited States since 1975 and was a tenured professor at the University ofSouth Florida who criticized the Israeli occupation of Palestine and openlypromoted the rights of Palestinians. In 2001, the government beganwiretapping a co-defendant, Hatem Fariz, although Al-Arian had beenwiretapped for eight years before that. In 2003, Al-Arian, Fariz, and twoother co-defendants were indicted and charged with having providedmaterial support to Palestinian Islamic Jihad (PIJ). Even though he neverwaived his speedy trial right, he was held in solitary confinement duringhis first forty-one months of detention in humiliating and inhumaneconditions, which became so bad that Al-Arian, a diabetic, eventually wenton a hunger strike to protest his treatment. It almost killed him.While the government presented eighty witnesses, including twentyonefrom Israel, Dr. Al-Arian rested his case without calling a singlewitness, basing his defense on the First Amendment.
