B. Jurisdictional Analysis1. New York, New Yorka. Legal or regulatory licensing standardNew York City has some of the most strict and thorough statutes and rules governing theoperation of for-hire vehicles. Under the City Charter, the New York City Taxi and LimousineCommission (“TLC”) is given broad authority over for-hire vehicles, including establishingstandards and criteria for the licensing of vehicles, drivers and chauffeurs, owners, and operatorsengaged in such services. 32New York City local laws extensively regulate for-hire vehicle service. Under thelegislative findings to the laws, the legislature found that “. . . the business of transportingpassengers for hire by motor vehicle in the City of New York is affected with a public interest, isa vital and integral part of the transportation system of the City and must therefore be supervised,regulated and controlled by the City.” 33 Under the local laws of New York City, for-hire vehicledrivers must be, among many other things, “of good moral character . . .” 34b. <strong>Background</strong> check processFor-hire vehicle drivers must apply for a new license by completing an application thatthey can complete in person or online. 35 In addition to standard questions asking for applicantinformation, such as address, date of birth, and contact information, the application also asks forinformation about whether the applicant has been convicted of a crime (misdemeanor or felony).Under the TLC rules, for-hire vehicle driver applicants must be fingerprinted for the purpose ofobtaining criminal history records from the New York State Division of Criminal Justice32 City Charter § 2300, et seq.33 NYC Ad.
