provisions of Title 13, California Code of Regulations (the latter regulations being those that areequally applied to private vehicle drivers in the state, generally). 66TCPs must also enroll in California’s Employer Pull-Notice (“EPN”) program,administered by the California Department of Motor Vehicles, which provides employers andregulatory agencies a means of promoting driver safety through the ongoing review of driverrecords. Through EPN, employers of drivers are notified of any of the following on the drivingrecord of any employee driver: convictions, failures to appear, accidents, driver licensesuspensions or revocations, and any other actions taken against the driving privilege. Anemployer enrolled in the EPN program is assigned a requester code which is added to anemployee’s driver license (“DL”) record. When an employee’s DL record is updated to recordan action/activity, a check is made electronically to determine if a pull notice is on file. If theaction/activity is one that is specified to be reported under the EPN program, a driver record isgenerated and mailed to that employer.TCP drivers are not required to undergo a fingerprinting check in California and neitherare TNCs; only local taxicab drivers are required to have their fingerprints “run” as part of thebackground check process.c. <strong>Background</strong> check process (SFMTA)In order to become a taxicab driver, one must apply for an SFMTA permit, or “A-card.” Theapplication fee is $255.50. 67 In addition to standard requirements such as providing proof ofresidency, holding a California driver’s license and undergoing a driver training course, in orderto obtain an A-card a driver must also submit to a Live Scan fingerprint and background checkfrom a Live Scan location designated by the SFMTA.
