No driver’s license shall be issued to any applicant who has been convicted of a felony orbeen an inmate of a reform school or penitentiary as a result of a conviction for a felony withinfive (5) years prior to the application for such license except that if the applicant has received apardon or been placed on probation, the director of excise and licenses may, at the director’sdiscretion, issue the license if all other provisions of this section are fully complied with. Thedirector of excise and licenses may refuse to issue a license to any applicant whose police recordshows convictions for drunkenness, repeated moving violations, or for any other good and justcause, which, in the opinion of the director, would be inimical to the public health, safety, ormorals.b. <strong>Background</strong> check processColorado law prohibits employers from requiring applicants to disclose informationcontained in sealed conviction records. 98 According to the Colorado Civil Rights Commission,inquiries about convictions are limited to those that are job-related. 99 It would not bediscriminatory to inquire about actual convictions which are substantially related to anapplicant's ability to perform a specific job, if this question is addressed to every applicant. 100In Denver, the specific process for conducting criminal background checks on FHVdriver-applicants begins with the applicant submitting the Applicant Criminal History Form 101with the rest of the application materials. Denver does not require an FBI fingerprint check.Instead, a Colorado Bureau of Investigations (“CBI”) Name <strong>Check</strong> 102 is run using the applicant’sname and date of birth; this name check is a service provided by the CBI as a division of theColorado Department of Public Safety, through a centralized database of criminal history records98 Colo.
