LUCIP-SWMU 101<strong>KSC</strong>-TA-11462LAND USE CONTROL IMPLEMENTATION PLANNATIONAL AERONAUTICS AND SPACE ADMINISTRATIONKENNEDY SPACE CENTERBREVARD COUNTY, FLORIDAFACILITY: <strong>Processing</strong> <strong>Control</strong> <strong>Center</strong> <strong>Area</strong>Solid Waste Management Unit 101CONTAMINANTS: Vinyl Chloride in Groundw<strong>at</strong>erCONTROL: Prohibit Groundw<strong>at</strong>er UsePURPOSE OF LAND USE CONTROLIMPLEMENTATION PLANThis Land Use <strong>Control</strong> Implement<strong>at</strong>ion Plan(LUCIP) has been prepared to inform currentand potential future users of the <strong>Processing</strong><strong>Control</strong> <strong>Center</strong> <strong>Area</strong> (PCCA) of institutionalcontrols th<strong>at</strong> have been implemented <strong>at</strong> thesite 1 . Although there are no currentunacceptable risks to human health or theenvironment associ<strong>at</strong>ed with the PCCA, aninstitutional land use control (LUC) isnecessary to prohibit groundw<strong>at</strong>er use <strong>at</strong> thesite. <strong>Control</strong>s will include periodic inspection,condition certific<strong>at</strong>ion, and agencynotific<strong>at</strong>ion.WHY LAND USE CONTROLS ARENEEDEDA human health risk assessment wascompleted as part of a Resource Conserv<strong>at</strong>ionand Recovery Act (RCRA) FacilityInvestig<strong>at</strong>ion (RFI). One chemical of concern(vinyl chloride) exceeded the FloridaDepartment of <strong>Environmental</strong> Protection(FDEP) cleanup target level and wasidentified as a potential human health riskduring the RFI.SITE DESCRIPTIONThe PCCA site contains eight structures: two1-million gallon w<strong>at</strong>er storage tanks (K6-0946and K6-0995); a 250,000-gallon elev<strong>at</strong>edw<strong>at</strong>er storage tank (K6-0994); two storagebuildings (K6-0996 and K6-1046); amaintenance shop (K6-0996A); the PCCFacility (K6-1094), and an undesign<strong>at</strong>edstorage shed. Formerly a cooling tower w<strong>at</strong>ertre<strong>at</strong>ment facility (K6-0945); the VehicleAssembly Building (VAB) Support Facility(K6-1045), and five trailers (K6-1043Athrough K6-1043D and K6-1044) wereloc<strong>at</strong>ed <strong>at</strong> the Site. The facility is used as anIntermedi<strong>at</strong>e Level Maintenance Facility forLaunch <strong>Processing</strong> Systems (LPS),Engineering Development Labor<strong>at</strong>ories formodific<strong>at</strong>ions and testing of consoles, andShuttle <strong>Processing</strong> D<strong>at</strong>a Management Systemssupport associ<strong>at</strong>ed with the Space Shuttle<strong>Program</strong>. Inform<strong>at</strong>ion found in the <strong>KSC</strong>archives indic<strong>at</strong>es th<strong>at</strong> the facility wasdesigned to support orbiter testing, launchteam training, and LPS maintenance.1 This LUCIP summarizes institutional controls regarding the NASA PCCA. LUCIP-SWMU 101<strong>KSC</strong>-TA-11462SITE LOCATIONThe PCCA is loc<strong>at</strong>ed in the Vehicle AssemblyBuilding (VAB) <strong>Area</strong> of <strong>KSC</strong>, southwest ofthe Crawlerway on the intersection of UtilityRoad and VAB Road. The facility is borderedby the Orbiter <strong>Processing</strong> Facility (K6-0894)to the north, Utility Road to the east, VABRoad to the south, and railroad tracks to thewest (Figure 1). The groundw<strong>at</strong>er use controlarea covered by the LUCIP is shown onFigure 2. Coordin<strong>at</strong>es of the corners of theLUC are provided on Figure 2 in the US St<strong>at</strong>ePlane Coordin<strong>at</strong>e System NAD 1983, meters,Florida East.SITE CONTAMINATION ANDCONTROLThe concentr<strong>at</strong>ion of vinyl chloride present ingroundw<strong>at</strong>er is above the FDEP’sGroundw<strong>at</strong>er Cleanup Target Level (GCTL)but is less than the FDEP N<strong>at</strong>ural Attenu<strong>at</strong>ionDefault Concentr<strong>at</strong>ion. Since groundw<strong>at</strong>erexceeds the FDEP GCTL, LUCs prohibitingthe use of groundw<strong>at</strong>er are required until thecleanup level is achieved. The current andprojected land use of the PCCA does notinclude the use of site groundw<strong>at</strong>er; therefore,there is no current or projected exposure risk.DECISION DOCUMENTA St<strong>at</strong>ement of Basis (SB) establishesinstitutional controls as a component of theremedy for the site. The SB for the site, <strong>KSC</strong>document number <strong>KSC</strong>-TA-11461, isavailable for review by contacting the <strong>KSC</strong><strong>Environmental</strong> Assurance Branch <strong>at</strong> telephonenumber (321) 867-8402.IMPLEMENTATIONInstitutional controls will be implemented bythe <strong>KSC</strong> <strong>Environmental</strong> Assurance Branch inaccordance with their RCRA permit and aLand Use <strong>Control</strong> Assurance Plan included inthe Memorandum of Agreement (MOA) 2between NASA and the FDEP, effectiveFebruary 23, 2001. Upon approval of thisLUCIP, it will be incorpor<strong>at</strong>ed into the permitby reference. Property transfer (if conductedin the future) will be conducted in accordancewith Section X of the MOA.<strong>KSC</strong>’s <strong>Environmental</strong> Assurance Branch willprovide <strong>KSC</strong>’s Master Planning Office withsurvey coordin<strong>at</strong>es of the LUCs. Restrictionswill specify limit<strong>at</strong>ions on development andreuse for the area for as long as LUCs arenecessary to protect human health and theenvironment.MONITORINGQuarterly inspections to monitor th<strong>at</strong> theinstitutional controls specified herein are inplace and oper<strong>at</strong>ing will be conducted by<strong>KSC</strong>’s <strong>Environmental</strong> Assurance Branch. Theinspections will verify th<strong>at</strong> no groundw<strong>at</strong>eruse is occurring <strong>at</strong> the site.2 By separ<strong>at</strong>e MOA effective February 23, 2001, with the FDEP and <strong>KSC</strong>, on behalf of NASA, agreed to implement <strong>Center</strong>-wide, certainperiodic site inspections, condition certific<strong>at</strong>ion, and agency notific<strong>at</strong>ion procedures designed to ensure the maintenance by <strong>Center</strong>personnel of any site-specific LUCs deemed necessary for future protection of human health and the environment. A fundamental premiseunderlying execution of th<strong>at</strong> agreement was th<strong>at</strong> through the <strong>Center</strong>'s substantial good faith compliance with the procedures called forherein, reasonable assurances would be provided to the FDEP as to the permanency of those remedies which included the use of specificLUCs.Although the terms and conditions of the MOA are not specifically incorpor<strong>at</strong>ed or made enforceable herein by reference, it is understoodand agreed by NASA <strong>KSC</strong> and FDEP th<strong>at</strong> the contempl<strong>at</strong>ed permanence of the remedy reflected herein shall be dependent upon the <strong>Center</strong>'ssubstantial good faith compliance with the specific LUC maintenance commitments reflected herein. Should such compliance not occur orshould the MOA be termin<strong>at</strong>ed, it is understood th<strong>at</strong> the protectiveness of the remedy concurred in may be reconsidered and th<strong>at</strong> additionalmeasures may need to be taken to adequ<strong>at</strong>ely ensure necessary future protection of human health and the environment.PCCA LUCIP Rev. 0 2 3/31/11


LUCIP-SWMU 101<strong>KSC</strong>-TA-11462REPORTING<strong>KSC</strong>’s <strong>Environmental</strong> Assurance Branch willsubmit annual reports to FDEP certifyingretention of the implemented LUCs.ENFORCEMENT<strong>KSC</strong>’s <strong>Environmental</strong> Assurance Branch willbe responsible for stopping any activities th<strong>at</strong>are not compliant with this LUCIP.MAINTENANCEThe LUCIP shall remain in place until theconcerns managed by the LUCIP aremitig<strong>at</strong>ed, or until there is a discovery, basedupon analytical evidence, th<strong>at</strong> scenariosmanaged by the LUCIP are no longer aconcern.
