07030/2010/576173/SER/C2 47In general, asking for the provision of financial guarantees is a goodpractice. Financial guarantees are asked to be provided by operators inadvance to starting the operation, to ensure that the obligations arisingunder the permit are fulfilled (e.g. after-care treatment, the defined closureprocedures). From a wider perspective, requesting financial guaranteessupports the polluter pays principle.Such guarantees are, for instance, required by the Landfill Directive (Article8). However, it is uncertain to which extent Member States request financialguarantees also for other waste management operations, including smallertreatment facilities.Best practice examples on the setting of conditions to be included in thepermit are described in more detail in the accompanying practical manual,in particular:Application for apermitSetting of conditions(based on MemberStates' practice):- Standardisedconditions- Technicalstandards- General rulesThe example from Belgium (Flanders) about a fixed set of conditions isapplicable to all waste operators; In order to avoid a case-by-casedecision approach, the set of fixed conditions is directly applicable tocompanies. The conditions include general provisions applicable to allwaste treatment facilities. In addition, a set of further provisions isdetermined for (1) waste storage and treatment facilities, (2) the typeof waste, and (3) the type of waste treatment facilities (incinerators, landfills).See chapter 2.2.1 of the practical manual---------------------------Further readingBest practiceexample in practicalmanual:chapter 2.2.1European Commission<strong>Guidance</strong> (Final version)Services to support Member States' enforcement actions and inspections concerning the application of EU waste legislation
