Ms. No. 1137, Revenue Department, dated the 14 th July, 1963)In his reference first read above, the Collector, Nellore, while referring tothe authority competent to order resumption of the lands assigned under the D.C.Rules, has proposed that the Collectors may be authorized to order resumptionof the lands assigned under the general assignment policy in case of breach ofthe condition of grant specified in para 1 (5) of G.O. Ms. No. 1142, Revenue,dated 18-6-84, that the Board of Revenue may be authorised to entertainappeals against the order of the Collector, and that the orders of the Board ofRevenue be made final. The Board of Revenue has recommended theproposals of the Collector, Nellore.2. The Government have carefully examined the proposals and considerthat the authority vested with the power to grant lands, may also be the authorityfor the enforcement of the conditions of the grant. The Government, therefore,direct that the Tahsildars and Deputy Tahsildars in independent charge who arethe assigning authorities, should be the authorities competent to orderresumption in case of a breach of the conditions. In regard to appeals andrevisions the provisions, in the B.S.O. 15 relating to the orders of assignment,shall apply also to the orders relating to resumption.3.
