(C) These monies are not refundable and shall be used to provide health benefits forthe Actor.(D) The Producer further agrees to be bound by the Agreement and Declaration ofTrust establishing the aforesaid Health Trust Fund, including all its rules andregulation and any and all amendments and modifications thereto which may beadopted by its Trustees during the term of this Agreement.31. HOUSING AND LOCAL TRANSPORTATION.(A) Housing Requirements. It shall be the Producer’s obligation and responsibility tolocate and reserve suitable Equity approved air-conditioned living accommodationssituated within a 25-mile radius of the theatre for all <strong>Actors</strong> employed whose placeof residence as listed with Equity is more than 50 miles from the theatre location.[See also Rule 55(C), SALARIES.](1) <strong>Actors</strong> earning more than three times the minimum salary per week shall beresponsible for the cost of their housing unless otherwise negotiated with theProducer. <strong>Actors</strong> earning less than twice the minimum salary per week mayelect to receive the full Per Diem as listed in Rule 55(C) and becomeresponsible for the total cost of their housing or they may elect to accept theProducer provided housing and allow the Producer to take the per diem housingdeduction as listed in Rule 55(C). <strong>Actors</strong> earning between twice and three timesthe minimum salary per week shall have single occupancy housing provided atno cost to the Actor. Per diem shall not be required unless otherwise negotiatedwith the Producer. The Producer may, at his option, include double occupancyaccommodations on the housing list offered to <strong>Actors</strong>. In no case shall anyActor pay more than 50% of the cost of a shared room.
