(2) Footage from commercials may be used for any or all of the above uponpayment of the applicable AFTRA/SAG fee for such use.(3) <strong>Actors</strong>’ Equity shall not apply any additional fees for the above usesprovided the Producer fully complies with all of the terms and conditions setforth herein.(4) The above permitted uses shall not include the sale of videos or DVDs orother endorsement of any commercial products.(G) This Rule shall apply in all instances irrespective of the use made of suchRecording, the method employed in obtaining same, or the length or character ofthe "part" of said production so reproduced.(H) Nothing contained herein shall negate or minimize the Actor’s right tonegotiated payments for any Recording. If the minimum payments herein requiredfor any Recording should be less than the minimum rate required by AFTRA or SAGfor such work, the Actor shall receive not less than the AFTRA or SAG minimum.Overtime, residuals or any other additional payments which may become due theActor are not included in the minimums specified herein.(I) The Actor shall not knowingly participate in any Recording except under thecircumstances set forth above or unless Equity otherwise consents thereto inwriting.(J) Closed Circuit Television. It is not intended that this Rule apply to Closed Circuit,Pay Television, or the making of Cassettes or other Audio-Visual recording forpublic sale or distribution, and the Producer agrees that there will be no ClosedCircuit, Pay Television or the making of cassettes or other types of Audio-VisualRecording of the production without prior negotiations and agreement with Equity asto the payments and working conditions for said Recordings.(K) Web Sites and Other Platforms. Up to a total of 15 minutes of edited rehearsaland/or performance footage per production (which may depict an entire scene ormusical number), as well as unlimited Additional Footage, may be used as follows:(1) On web sites of the Producer (including pages on non-embeddable thirdpartyhosting sites, e.g., Facebook); not-for-profit arts and tourism-relatedagencies of the city, county, state and intra- and inter-state region in which theProducer is located; local Rotary, Chamber of Commerce and local not-for-profit“booster” organizations; media web sites; arts calendar web sites (such asPlaybill.com); third party promotional and ticketing services (e.g.,Theatremania.com, Ticketmaster, WebTix.com) and not-for-profit arts serviceand arts promotion organizations (e.g., <strong>Actors</strong>’ Equity Association, TheatreCommunications Group, Americans for the Arts);(2) On web sites of sponsors and/or supporters of the Producer, provided:(a) The Actor’s likeness is used solely to acknowledge the sponsorship orsupport and is not in any way used directly or indirectly to endorse thesponsor or a specific product of the sponsor;(b) At the time of contracting, the Producer solicits from the Actor anycurrent or potential professional conflicts that may limit the use of theActor’s image on the sponsor’s or supporter’s web site, and the Producer,43
