costume fittings/changes and warm-ups. There may be no Recording ofnudity.(c) There is no time limit on the Recording or use of Additional Footage.(4) Provisions Applicable to both Performance and Rehearsal.(a) No more than 15 minutes of edited performance and/or rehearsalfootage per production Recorded by the Producer or a third party directlyengaged by the Producer shall be used. The edited footage/material maydepict an entire scene or musical number.(b) A news organization or media company may only Record up to 30minutes of rehearsal and up to 30 minutes of performance per production.No more than three minutes of edited performance or rehearsal footage thatis Recorded by news organizations or media companies may be broadcast.Such broadcast may not depict an entire scene or musical number.(c) A Stage Manager signed to an Equity contract is required at everyRecording session.(d) Recording may take place for the purpose of promotion and publicitywithout additional compensation during a scheduled rehearsal, dressrehearsal or performance. It is understood and agreed, however, thatenhanced lighting and multiple takes may occur during such rehearsal,dress rehearsal or performance provided that in the event an excessivenumber of takes transform the rehearsal into a “session,” then theapplicable AFTRA/SAG session fee shall be due every Actor at the call.Further, in the event that particular <strong>Actors</strong> are requested to come in early orstay later for retakes or special shots, such <strong>Actors</strong> shall likewise be paid theapplicable AFTRA/SAG session fee(s) that may be due.(e) Recording may take place after the first public performance of theproduction specifically called for such purpose provided such rehearsal isshot as a run-through and counted against rehearsal hours and paid at theovertime rate. A limited number of retakes is allowed.(f) For any violation hereof other than violations of unauthorizedsubsequent use of Recorded material, the Producer shall pay one week’scontractual salary or Production Minimum, whichever is greater, to eachActor whose rights have been breached hereunder. Such payments shallnot preclude any right in law or equity, civil or criminal, that arises under abreach of this Rule, which the Actor or Equity has against the Producer orany third party.(C) Non-Broadcast. Subject to the conditions listed herein, a Recording may bemade for non-broadcast promotion, publicity, marketing, in public relations, fundraising,audience development, education, and/or civic, state, and nationalpromotion. <strong>Actors</strong> employed in a production under the terms of this Agreement mayparticipate in the Recording of material for use by the Producer for theaforementioned purposes under the following terms and conditions:(1) All Recording of performance and rehearsal must occur in accordance withParagraph (B) above;39
