HOSPITALIZATION AND MEDICAL COVERAGE. A schedule of SWC benefits canbe obtained at the Equity office.34. LAWS GOVERNING.This Agreement shall be subject to, be construed by, and all the rights of the partiesthereto shall be determined by the laws of the state of New York, except as otherwisemay be provided. For the purpose of Unemployment Insurance and Workers’Compensation, the laws of the Producer’s domicile state shall apply between theProducer and the Actor.Any rule illegal in any state or any city shall not be binding therein. Any illegality in anyrule or agreement shall not affect any other rule or agreement.35. LAYOFF WEEKS.For Unit Tours, the Producer agrees that if consecutive employment is not providedwithin the playing schedule of the tour, if declared at the time of contract signing, theProducer may schedule up to four weeks of layoff. Once the tour has begun, oneadditional layoff week will be permitted only to accommodate the loss of a booking dueto the cancellation by the Presenter. Such layoff will require the payment of theapplicable health rate for the week.Layoff weeks may be used in any combination. In the event there is a layoff, the <strong>Actors</strong>hall be returned to his place of residence no later than 24 hours after his lastperformance or shall be provided with transportation monies equivalent to theProducer's actual cost for such transportation. The Actor shall be required to appear atthe next theatre location no earlier than the day before the opening in the new locationas specified on the playing schedule. Transportation necessitated by any layoff shall beat the Producer's expense. Provided that the Producer transports the Actor as statedabove, the Producer shall not be required to pay salary, per diem, or benefits during thelayoff, and the Actor shall not accrue sick leave or paid vacation during the layoff.On the day of reopening following any layoff, the Producer may call a run-through ordress rehearsal. This rehearsal shall be without additional compensation, but shall becharged against the regular weekly rehearsal allowance. The Producer shall give noless than two weeks notice of any change in schedule with respect to layoffs. Shouldless than two weeks notice be given, the Actor shall receive one week's minimum salaryfor each failure to give proper notice. [See Rule 55, SALARIES.]36. MEDIA: RECORDING & BROADCAST.(A) Except as provided below, there shall be no televising, broadcasting, visualand/or sound recording, motion picture filming, videotaping, other mechanical,electronic, or evolving digital means or other substantially similar current andevolving methods of recording (hereinafter "Recording") in whole or in part, of anyproduction, including rehearsals, in which <strong>Actors</strong> are employed under the terms ofthis Agreement without the express permission of Equity and under terms andconditions established by it.(1) This Rule shall also apply to any Recording made within a period of 16weeks following the final performance of the production.37
